Sub : Revision of Regulation relating to rate of Family Pension (Normal rate & Enhanced rate) of Pension Regulation for the Army, Part-I (2008) in the line of amendment done in Sub Rule (3) of Rule 54 of CCS Pension Rule, 1972 by DoP&PW-reg.

Sir,

The undersigned is directed to refer to the provision of Note 3 (i) & (ii) below Army Instruction 51/80 and Regulation 64 (b) in Pension Regulation for Army, Part-I (2008) under which the minimum of 7 years of continuous qualifying service is required for grant of enhanced rate of Family Pension for the Armed Forces personnel.

2. Consequent upon issue of Gazette Notification No. 550 dated 19.09.2019 of the Ministry of Personnel, Public Grievances & Pensions, Department of Pension and Pensioners’ Welfare (DoP&PW), the condition of minimum requirement of 7 years of continuous service for grant of enhanced rate of Ordinary Family Pension in the sub rule (3)(a) & (b) of Rule 54 of CCS Pension Rule, 1972 has been deleted w.e.f 1st October, 2019 and now Government servants who died in service/invalided out even with less than 7 years of qualifying service shall be eligible for enhanced rate of Family Pension. This notification also has a provision where a Government servant who died within ten years before the 1st day of October 2019 without completing continuous service of seven years, his family shall be eligible for family pension at enhanced rates in accordance with sub rule (3) with effect from the 1st day of October 2019, subject to fulfillment of other conditions for grant of family pension.

3. Now, the President is pleased to decide that the same provision shall be extended to Armed Forces Personnel also. Accordingly, the clause “after having rendered not less than 7 years continuous qualifying service” of Regulation 64{b) of Pension Regulations for the Army, Part-I (2008) stands deleted w.e.f. 01.10.2019.

4. It has also been decided that where an Armed Forces Personnel died within ten years before the 1st October, 2019 without completing continuous service of seven years, his family shall be eligible for ordinary family pension at enhanced rate as per Regulations 64(b) of Pension Regulations for the Army Part-I(2008) with effect from the 1st October 2019 subject to fulfillment of other conditions for grant of Ordinary Family Pension.

5. Further, the provision of Army Instruction No. 51/1980 would stand modified upto this extent w.e.f. 01.10.2019. The regulation and their instructions for grant of Ordinary Family Pension in Navy and Air Force shall also be amended accordingly.

6. This issues with the concurrence of the Finance Division of this Ministry vide their ID No. 10(02)/2020/FIN/PEN dated 23.09.2020.

ORDER:

In the Government Order first read above, orders were issued fixing the rate of interest on the accumulation at the credit of the subscribers of Contributory Pension Scheme at 7.1% (Seven point one percent) for the period from 1st April, 2020 to 30th June, 2020.

2. In the Government Order second read above, the rate of interest for accumulation at the credit of subscribers to the General Provident Fund (Tamil Nadu) were fixed at the rate of 7.1% (Seven point one percent) for the period from 1st July, 2020 to 30th September, 2020.

3. The Government now direct that the rate of interest on the accumulations at the credit of the subscribers to the Contributory Pension Scheme (Tamil Nadu) shall be fixed at 7.1% (Seven point one percent) for the period from 1st July, 2020 to 30th September, 2020.

Sub : Inter-Railway Request Transfer – Hardships being faced by the staff – Reg.

As the Railways are aware, transfers on request of officials working on the Zonal Railways cannot be claimed as a matter of right. However, enabling provisions under Ministry of Railways’ decision below Rule 226 of IREC Vol.I allows Transfer of Railway Servant in Group ‘C’ on request on the grounds of hardship from one Railway to another. Detailed instruction/ guidelines governing such transfers have been laid down by the Board from time to time.

2. Despite several executive orders issued by the Board from time to time to minimize the hardship of the officials, repeated complaints are being received from staff and the Federations that the transfer requests are not being processed properly. It has been observed that after issue of the NOC by the accepting Railway, the staff concerned are not relieved on time, at times taking more than one year, and by the time the staff are relieved on the basis of the NOC, the vacancies get filled up, and the Railway which had issued the NOC refuses to accept the transferred staff, putting such staff to considerable hardship as he is left with nowhere to go, having been relieved by the parent Railway.

3 The matter has been considered by the Board. To obviate such issues, it has been decided by the Board that NOC issued by the receiving Railway should be valid for a period of six months, and if transfer of the employees concerned are not effected within this period, the NOC in such cases should be mandatorily revalidated. The employees should be relieved on transfer only after re-confirming the validity of the NOC.

Requirement of Minimum Qualifying Service Scrapped for Enhanced Family Pension w.e.f. 01 October 2019

As per existing provision, there is a requirement of continuous qualifying service of 7 years for grant of Ordinary Family Pension at enhanced rate to NoK of Defence Forces personnel.

Ordinary Family Pension at enhanced rate is calculated @ 50% of last Emoluments and Ordinary Family pension is calculated @ 30% of last Emoluments. Ordinary Family Pension at enhanced rate is payable for 10 years without any upper age limit from the date following the date of death of the personnel in service. Where service personnel dies after release/retirement/discharge/invalidment with a pension, Ordinary Family Pension at enhanced rate is granted for a period of 7 years from the date of death or up to attaining the age of 67 years, whichever is earlier.

The requirement of continuous qualifying service of 7 years is done away with w.e.f 1.10.2019 vide Govt. letter dated 05.10.2020

Further, Defence Forces personnel who died within ten years before the 1st day of October 2019 without completing continuous service of 7 years, his family shall also be eligible for family pension at enhanced rate w.e.f 1.10.2019.


मौजूदा प्रावधान के अनुसार रक्षा बलों के कर्मियों के निकट सम्बन्धियों को बढ़ी हुई दर पर साधारण पारिवारिक पेंशन देने के लिए 7 साल की निरंतर सेवा की अनिवार्यता समाप्त कर दी है।

बढ़ी हुई दर पर पारिवारिक पेंशन की गणना अंतिम परिलब्धियों के 50% पर की जाती है जबकि साधारण परिवार की पेंशन की गणना अंतिम वेतन के 30% पर की जाती है। सेवा में कर्मियों की मृत्यु की तारीख के बाद किसी भी ऊपरी आयु सीमा के बिना 10 साल के लिए बढ़ी हुई दर पर साधारण पारिवारिक पेंशन देय है। रक्षा कर्मियों की सेवा समाप्ति / सेवानिवृत्ति / निर्वहन / अमान्य होने के समय पेंशन की उपलब्धता रहेगी तो बढ़ी हुई दर पर साधारण पारिवारिक पेंशन, मृत्यु की तारीख से 7 वर्ष की अवधि के लिए या 67 वर्ष की आयु प्राप्त करने तक प्रदान की जाती है, जो भी पहले हो।

दिनांक 05.10.2020 को जारी परिपत्र में 7 वर्षों की निरंतर योग्यता सेवा की अनिवार्यता को ख़त्म कर दिया गया है।

इसके अलावा, रक्षा बल के वो कर्मी जिनकी मृत्यु 7 साल की निरंतर सेवा पूरी किए बिना पहली अक्टूबर 2019 से पहले दस साल के भीतर हुई है, उनका परिवार भी बढ़ी हुई दर पहली अक्टूबर 2019 से बढ़ी हुई पारिवारिक पेंशन के लिए पात्र होगा।

Sub : Rotation of officials working in Sensitive Posts

Ref: No. 2017/V-1/ALSL/1/1 Dt.10.12.19 :

Vide above reference, uniform guiding factors for designating posts as sensitive, as per nature of duties rather than nomenclature of posts have been issued. Keeping in view of above guidelines, with the approval of General Manager, list of sensitive posts have been identified and submitted by Zonal Railways/PUs/other units to this office.

a) Perusal of lists submitted by various units, culminates to identification of nomenclature of sensitive posts as indicated in Annexure 8.1 of IRVM 2018, is considered to be applicable for all Zonal Railways/PUs/other units. For non-gazetted category, existing instructions issued vide RBV . No.2008/V-1/CVC/1/4 dt.11.08.08 would be relevant.

b) In regard to other posts not mentioned in Annexure 8.1, which are specific to ZR/PUs, sensitive posts as approved by concerned General Manager and submitted to Board vigilance would be deemed as “sensitive” in nature.

(c) In addition to above, General Managers on their own may also treat any other post not mentioned in the list as “Sensitive” and inform Board Vigilance, as and when need arises in future.

As part of Preventive Vigilance strategy, it is advised that officials manning sensitive posts should be rotated as per the extant policy to avoid developing vested interests. SOGMs may report on the compliance of rotation policy please.

Sub : Scheme for compassionate appointment – Relative Merit Points and Procedure for selection.

Madam / Sir,

I am directed to refer to Department of Posts letter No.37-36/2004-SPB-1/C dated 20.1.2010 on the above subject providing for Relative Merit Points and procedure for compassionate appointments in the Department of Posts. The matter has been reviewed keeping in view the instructions issued by Department of Personnel and Training, the changes in various factors for calculating Relative Merit Points and the changes in financial status of the family of the deceased employees consequent upon increase in the terminal benefits.

2. The Relative Merit Points (RMP) for assigning weightage to various attributes of the applicants for compassionate appointment have been reviewed. The revised RMP is based on 100 points of 10 variables with provision of additional 15 maximum bonus points for the applicant if she is the widow of the deceased employee/wife of an employee who has retired on medical grounds. The revised RMP to be applied are as laid down in Annexure 1.

3. Periodicity of CRC meeting: In respect of all applications for compassionate appointments received from January to December of a calendar year, the CRC meeting will be held by all circles once in a year, between January to March of the next calendar year.

4. Cut-Off Date: Date of death or date of retirement on medical grounds will be considered as cut off date for the purpose of assessing the indigent condition of the applicant under RMPS for compassionate appointment.

5. Circle specific vacancy: The vacancies to be utilised by a Circle for compassionate appointment in a year should not be more than 5% of the vacancies in Direct Recruitment Quota in Group C Posts in a year.

6. Place of Posting: As far as administratively feasible, applicant appointed on compassionate grounds will be posted at a place as per preference indicated or near his /her home town or in same division in which the applicant is residing, subject to availability of vacancies.

8. Date of effect of these guidelines: These revised guidelines will come into effect from 1st October 2020. Cases recommended by previous CRC to be considered by subsequent CRC will be considered based on these revised point system. All cases closed so far will not be reopened.

9, Instructions issued by DoPT from time to time related to compassionate appointment will continue to be guiding factor while deciding the cases.

Sub : – Extension of period for submission of Life Certificate from October 2020 till December 2020.

Your kind attention towards the guidelines mentioned in the Para 15.1 of the “Scheme for Payment of Pension to Central Government Civil Pensioners by Authorized Banks”, wherein it is mentioned that the Life Certificate is to be submitted by the pensioners once a year in the month of November.

2. The pensioners above the age of 80 years have been allowed to submit the life certificate from 1st October onwards every year instead of November vide Department of Pension and Pensioners” Welfare OM No. 1/2012018-P&PW(E) dated 18.07.2019 (copy enclosed).

3. In view of the current COVID-I9 pandemic and keeping in view of the vulnerability of elderly population to the Corona virus, and the OM No,18/1/2020-P&PW (C)-6681 dated-11.09.2020 (copy enclosed) issued by Deptt. of Pensions & Pensioners Welfare, the provision laid down in the para 15.1 of the “Scheme for Payment of Pension to Central Government Civil Pensioners by Authorized Banks”, for submission of life certificate has been relaxed.

4. Now the pensioners may submit their Life Certificate from 01st November, 2020 till 31st December. 2020 and the pensioners in the age group of 80 years and above may submit their Life Certificate from October 2020 to 31st December, 2020. During this extended period the pension will be continued to be paid by, the Pension Disbursing Authority (PDA) uninterrupted.

5. All the Heads of CPPCs are requested to accept the requisite certificates from pensioner’s from November, 2020 to 31st December. 2020 and for pensioners of 80 years and above from October 2020 to 31st December, 2020 and ensure that the pension will continue to be paid by the Pension Disbursing Authority (PDA) during this extended period.

(a)the status of the unemployment allowance given to workers who are members of the Employees State Insurance Corporation (ESIC), State-wise; and

(b)the number of people benefited from the said scheme?

ANSWER

(a) & (b): The Employees’ State Insurance Corporation (ESIC) provides unemployment allowance under the Rajiv Gandhi Shramik Kalyan Yojana (RGSKY) and relief in the contingency of unemployment under Atal Beemit Vyakti Kalyan Yojana (ABVKY). The brief details of both the schemes are as follows:

(i) The Rajiv Gandhi Shramik Kalyan Yojana, has been introduced w.e.f. 01.04.2005 to provide unemployment allowance to the insured person, who has been rendered unemployed on account of closure of factory/ establishment, retrenchment or permanent invalidity not less than 40% arising out of non-employment injury.

Under the RGSKY, unemployment allowance is provided for two years. For first year the unemployment allowance is provided @ 50% of average daily wages and for the second year it is provided @ 25% of average daily wages.

The state-wise details of number of beneficiaries under the RGSKY scheme and the amount paid to them during the year 2019-20 is attached at Annexure-I.

(ii) The Atal Beemit Vyakti Kalyan Yojana was implemented as a Pan India pilot project for two years period i.e. from 01.07.2018 to 30.06.2020. Under the scheme, relief in the form of cash compensation for a maximum period of 90 days is given to insured person in case he/ she gets unemployed. The scheme has been extended for one more year i.e. w.e.f. 01.07.2020 to 30.06.2021.

In order to provide benefit to insured person who become unemployed due to Covid-19 pandemic, the eligibility conditions under Atal Beemit Vyakti Kalyan Yojana have been relaxed and quantum of relief has been increased from 25% of average daily earning to 50% of average daily earning for the period 24.03.2020 to 31.12.2020.
