SUBJECT: Permission of Partial withdrawals towards treatment of specified illnesses.

In continuation of the circular no. PFRDA/2018/47/Reg-Exit/4 dated 24.05.2018, issued on the applicability & handling of partial withdrawals, Authority is issuing this circular referring the terms of sub-regulation 8(1)(A)(d)(xv) of PFRDA (Exits and withdrawals under NPS) Regulations, 2015 and amendments thereunder, prescribes that-

(a). In view of the decision of Government of India, which has declared COVID-19 as a pandemic, It has been decided to declare “COVID-19” as a critical illness which is life threatening in nature.

Hence, in view of the above, the partial withdrawals shall be permitted to fulfil financial needs of the subscribers, if required to him/her against the request placed for partial withdrawals towards treatment of illness of subscriber, his legally wedded spouse, children, including a legally adopted child or dependent parents as mentioned in regulation 8(1)(A)(d) of the said regulations.

(b). The other terms and conditions as prescribed under regulation 8 of the PFRDA(Exits and withdrawals under NPS) Regulations, 2015 and amendments thereto shall continue to be applicable regarding defining of limits and frequencies.

(c). Documentation

The Nodal Office/PoPs/Aggregators would ensure that the subscriber has provided the following document before authorising partial withdrawals.-

(1). Medical Certificate
(2). Formal request for partial withdrawal.

This has reference to Circulars issued by PFRDA on the captioned subject, nos. PFRDA/2020/9/SUP-CRA/2 dated 13.04.2020, PFRDA/2020/11/SUP-CRA/4 dated 20.04.2020, PFRDA/2020/29/SUP-CRA/12 dated 30.06.2020, PFRDA/2020/43/SUP-CRA/16 dated 01.10.2020 and PFRDA/2021/1/SUP-CRA/1 dated 31.12.2020 whereby the timelines of OPGM without photo and signature was extended upto 31st March 2021.

2. Based on requests received from several POPs, which are still in the process of developing system level features complying with the above circulars , it has been decided by PFRDA to further extend the time lines for opening new accounts by POPs without photo and signature till 30th April 2021. It may be noted that no further extension would be granted by the Authority in this regard.

3. This Circular issued under Sec 14 of Pension Fund Regulatory and Development Authority Act 2013 is placed in the CRA section of intermediaries and also under the Circular sub section of Regulatory framework section of PFRDA website.

Sub: CCS (RP) Rules, 2016 – Opportunity for revision of option to come over to revised pay structure, Clarification sought on DoE OM dated 12.12.2018 – regarding.

Kindly refer your office letter AC II/ Pen/VJA/Corr/Vol.11/2018 dated 04.05.2020 seeking clarifications on Department of Expenditure OM 4-13/17-IC/E-II A dated 12.12.2018, providing an opportunity to government servants for revision of option to come over to the revised pay structure as notified in CCS (RP) rules 2016.

2. DoE OM dated 04.05.2020, permitted another opportunity to Central Government employees who have already exercised their option to come over to the revised pay structure as notified by CCS (RP) 2016 to revise their initial option in terms of Rule 5 & 6 thereof. The provisos of Rule 5 of RP rules 2016 are self-explanatory: Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure and for those Government Servants who has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation as the case may be, with explanation 1 under Rule 5 as the option to retain the existing pay structure under the provisos to this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.

3. On the foregoing facts it is hereby clarified that DoEOM 12.12.2018 permits employees who have already exercised option to come over to the revised pay structure or to retain the old pay structure from 01.01.2016 till the date of issue of OM, to revise their initial option in terms of Rule 5 & 6 thereof.

4. Hence it is requested to settle the grievances of officials/ officers on the subject matter at your end on the basis of above clarification.

Subject : Streamlining of pension payment procedure – first identification of pensioner for release of pensionary awards reg.

Sir,

The undersigned is directed to refer to provisions contained in Regulations 76(a)(ii) and 76(b)(iii) of Pension Regulations for the Army Part-II(2008) and similar provisions available for Navy & Air Force in their respective Pension Regulations which prescribe that upon receipt of Pension Payment Order etc, the Pension Disbursing Agency (PDA) will make payment of the pensionary benefits only after due identification of the pensioner. The modes of identification of pensioner have been prescribed in Regulation 78 and 80 of PRA Part-II(2008). Government has also authorized PDAs to accept e-life certificates issued by Jeevan Pramaan using biometric verification vide this Ministry’s letter No 3(01)/2015-D(Pen/Pol) dated 25.8.2015. Kind attention is drawn to provisions of Para 3 of ibid letter dated 25.8.2015 which prescribes that physical presence is not required to receive first payment of pensionary benefits and that the undertaking for refund/to make good of excess payment and re-employment status after discharge/ retirement by retiree, are to be submitted along with pension claim.

2. In order to remove this discrepancy in the rule position regarding requirement of first identification for commencement of pension, it has been decided that life certification of retiring pensioner either physically or otherwise (through biometric or life certificate) is not required for release of Gratuity, Commuted Value of Pension, Ex-gratia payments, monthly pension etc. where the payment is to be disbursed through SPARSH application. However, existing rules relating to annual identification of pensioner after completing twelve months from date of first disbursement of pensionary benefits may continue to be followed as hithertofore.

3. The above said dispensation is not applicable for-

i. Payment of pensionary benefits to the family pensioners in cases of death of the Service personnel in service or after retirement. In such cases payment of pension as well as lump sum payments, if any, will be paid only after identification of family pensioner.

ii. Payment of pension/family pension other than through SPARSH application.

4. The Head of Office/Service HQrs/ Record Offices will be responsible for ensuring that action for cancellation of PPO is taken immediately in case where death of individual occurs before discharge/ retirement from service. This is necessary to avoid any overpayment or payment of gratuity to parties other than the nominee. In case any excess payment occurs in such cases, the same shall be adjusted against payment due to subsequent family pensioner(s), as per the existing orders on the subject.

5. This order will be applicable from date of issue of this letter. The relevant provisions of Pension Regulations for the Army, Navy & Air Force will be amended in due course.

6. This issues with the concurrence of Ministry of Defence (Finance/ Pension) vide ID No. 10 (07)/2014/FIN/PEN dated 26.2.2021.

This office has issued letter regarding Extension of Revalidation of BSNL MRS Card for BSNL Retired employees till 31.03.2021 vide this office letter dated 28.09.2020. Requests have been received from Union / Association to further extend the revalidation of BSNL MRS Card for BSNL Retired employees on Pan India basis, in view of current COVID-19 situation.

In this regard, it has been decided with the approval of competent authority to extend the validity of BSNL MRS Card of BSNL Retired employees up to 30.09.2021 or till further order. All Circles are requested to take necessary action and extend the validity up to 30.09.2021 or till further order.

These instructions shall apply mutatis mutandis on the Railways also. The Central Civil Services (Pension) Rules, 1972 correspond to the Railway Services (Pension) Rules, 1993. In continuation to this ,Department’s O.M of even number dated 17.02.2020. providing one time option to Government servants for coverage under Central Civil ,Services (Pension) Rules, 1972 in place of National Pension System who were declared successful for recruitment in the results declared on or before 31.12.2003 against vacancies occurring before 01.01.2004 and are covered under the National Pension System on joining service on or after 01.012004.

2. The said Office Memorandum provides for cut off dates for various activities involved in the process of exercising of option, deciding representations by appointing authorities and closure of NPS accounts of the concerned Government servants.

3. In view of the country-wide lockdown in the country due to outbreak of Covid – 19 pandemic and references received from some Ministries / Departments for extension of time schedule prescribed in the said OM, in partial modification of this Department’s OM of even number dated 17.02.2020, it has been decided to extend the above cut-off dates as under:

This is regarding use of RPLI-2 form for collection of PLI/RPLI premium in Branch Post Offices. As RICT devices are now being used at Branch Offices, collection of premia through device as well as through manual receipt results in duplicity of work.

2. Therefore, manual receipt of RPLI is not required in Branch Post Offices, wherein premium are being collected in RICT device and receipt is being generated for the same through device.

3. However, offices where RICT device is not functional due to any reasons (network, device or technical issue), the prescribed receipt may be used.

You are aware that consequent to revision of pay scales under the 11th Bipartite Settlements, the need has arisen to provide for revised guidelines on the formula for fitment in pay scales on promotion from substaff to clerical cadre and clerical to Scale I officer cadre.

After the 10th BP Settlement, IBA gave these guidelines vide IBA Circular No. 1194 and 1195 dated 7th August, 2015.

Similar guidelines need to be issued by IBA now after 11th BP Settlement. We request IBA to process the same and issue the Guidelines at the earliest which will be effective for all promotions w.e.f 01-11-2017.
