A copy of Department of Pension & Pensioners’ Welfare (DOP&PW’s) O.M. No. 12/9/2020-P&PW(C)-6450 dated 17th July, 2020 along with proforma for sanction of provisional pension and provisional gratuity is enclosed herewith for compliance and guidance. These instructions shall apply mutatis mutandis on the Railways also. Rule 64 and Rule 72(5) of the Central Civil Services (Pension) Rules, 1972 correspond to Rule 91 and Rule 16(5) of the Railway Services (Pension) Rules, 1993 respectively. Also, Form 5 and Form 3 of the Central Civil Services (Pension) Rules, 1972, referred to in the aforesaid O.M. dated 17th July, 2020, correspond to Form 8 and Form 6 of the Railway Services (Pension) Rules, 1993, respectively.
Para 3(f) of the proforma for sanction of provisional pension and provisional gratuity will also include the provision of Rule 16(8) of the Railway Services (Pension) Rules, 1993 in cases of railway servant who have been allotted railway quarters and are in occupation of that at the time of retirement.

Subject:- Implementation of Hon’ble Supreme Court Order Dt. 27/09/2018 in Contempt petition (C) No. 1860/2017 and 924/2018 and MA No. 1067/2018 in civil appeal No. 2147/2011 with contempt petition (C) No. 04/2018 in SLP (C) No. 19790/2010, for grant of Special Pension under Regulation 95 of Navy (Pension) Regulations, 1964.
In above mentioned subject, it is intimated that Special pension to Ex-Naval personnel are being notified by generating manual PPOs (Computerised). Hard copies of such PPOs are being sent to the NAVPEN. Descriptive Roll, Ink-singed PPO and other necessary documents are further submitted to respective CPPC/DPDO/Treasury Offices by the NAVPEN Office, Mumbai.
2. In pursuance of the decision to impose various restrictions in view of threat posed by the spread of COVID-19, NAVPEN has been requested to transmit scanned copies of necessary documents alongwith digitally signed pdf of PPO to the Pension Disbursing Agencies through their official email-ID as per Circular No. 632 dated 30.03.2020.
3. In view of above, all PDAs are hereby requested to accept the digitally signed pdf of PPOs (only for Special Naval Pension cases) for immediate implementation of Apex Court order. Digitally signed pdf of PPOs and other necessary documents will be submitted by NAVPEN to PDAs through their official email-ID: [email protected]. All instructions contained in circular No.633 dated 30.03.2020 apply mutatis mutandis in Special Naval Pension cases.

Subject:- Simplification of pension payment procedure – Submission of certificates by retiring Armed Forces Personnel/Defence Civilian alongwith pension papers.
Reference is invited to this office Circular No. 633 dated 30.03.2020 under which this office has issued instructions to credit the pensionary awards notified in favour of the pensioner into his/her bank account without the physical presence of that individual, as and when due, on the basis of documents mentioned in the ibid circular in soft copy (scanned copies in PDF) on dedicated mail IDs of the respective PDAs. Pension disbursing authorities were requested to ensure that the pensionary benefits as given in the PPO are not to held up for want of documents. Where required, PDAs may make the effort to contact the pensioner through his email or mobile number notified in the PPO. It was also mentioned in the circular that this measure will be applicable till further orders.
2. Complaints from various sources have been received in this office that the PDAs are not accepting scanned copies of the documents mentioned in circular No. 633 stating that these instructions were applicable only during the Lockdown period.
3. In this context, PDAs are requested to refer this office Circular No. 546 dated 10.09.2015 in implementation of GoI, MoD letter No. 3(01)/2015-D(Pen/Pol) dated 25.08.2015, wherein it was provided that the pensioner would no longer be required to visit the pension disbursing agency to activate the first payment of pension except case where documents provided by the Service HQrs in the case of ICOs (through PSA)/Record Office in the case of PBORs are incomplete. Further, it is once again advised as earlier that this measure has been necessitated to avoid inconvenience to defence pensioners and will be applicable till further orders to change the procedure.
4. All other instructions will remain unchanged.

In terms of Regulation 37 of Bank Employees’ Pension Regulations, 1995 Dearness Relief is payable to pensioners at rates specified in Appendix II to the Regulations.
Pending amendments to Pension Regulations, Banks may pay on ad hoc basis, the Dearness Relief payable to pensioners for the period August 2020 to January 2021 as per Annexure.

The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Base 1960=100) for the quarter ended June 2020 are as follows:-

The average CPI of the above is 7540 and accordingly the number of DA slabs are 775 (7540 – 4440= 3100/4= 775 Slabs) The last quarterly Payment of DA was at 761 Slabs. Hence there is an increase in DA slabs of 14 i.e. 775 Slabs for payment of DA for the quarter August, September & October 2020
In terms of clause 7 of the 10th Bipartite Settlement dated 25.05.2015 and clause 3 of the Joint Note dated 25.05.2015, the rate of Dearness Allowance payable to workmen and officer employees for the months of August, September & October 2020 shall be 77.50 % of ‘pay’. While arriving at dearness allowance payable, decimals from third place may please be ignored.

In pursuance of the decision to impose various restrictions in view of threat posed by the spread of COVID-19, Record Offices were advised to submit the pension claim through e-mail on the scanned copy (in pdf) of duly completed LPC-cum-Data Sheet along with requisite documents in respect of JCOs/ORs for timely notification of PPOs as a temporary measure. In the mean time, this office has also been working on a project of e-submission of pension claims through CGDA WAN.
2. Now, an integrated system for online submission of all the regular cases (original as well as corrigendum) through UTILITY software has been developed. This would be available for all Record Offices except the six Record Offices viz. AMC Lucknow, Signals Jabalpur, EME Secunderabad, JAT Record Bareily & RRC Fategharh (working on SUVINAY) and RRRC Delhi Cantt.
3. To facilitate the online submission of service/family pension claims, it has been decided to host a system on CGDA WAN through which the pension claim will be submitted by Record Offices to this Office in place of submission of hard copy of pension claims. This system has been designed in such a way that earlier data punched for service pension on Data-Expert software will be imported and displayed to the Record Office user for further uploading scan image of documents in pdf format. In this system, Admin login allotted to Record Office, officer/representative will equally work as Admin administrator for this project. This system will require three users i.e RO- uploader, RO-initiator and RO-approver.
4. The User Manual for Regular Pension Claim submission of JCO/ORs is enclosed along with this circular for guidance of the Record Offices/PAO(ORs) Offices.
5. All the pension claims of JCO/ORs on or after 01.08.2020 will be submitted to this office through this system. The claims submitted earlier will be dealt with as per the practice in vogue. The Record Offices where CGDA WAN connectivity is not available may submit the claims on e-mail of this office.

Subject: Reimbursement of medical claims to pensioners residing in non-CGHS areas-reg.
This refers to medical claims being received from pensioners residing in non-CGHS areas. In this respect, Ministry of Health and Family Welfare’s (MoH&FW) OM No. S. 14025/23/2013- MS.EHSS dated 29.09.2016 may be referred (copy enclosed). As per this OM, the pensioners residing in non-CGHS have following options to avail medical facilities:
(a) They can avail Fixed Medical Allowance (FMA) @ Rs. 500/- per month or as revised from time to time. At present, vide OM 4/34/2017/P&PW(D) dated 19.07.2017, FMA is @ Rs. 1000/- per month.
(b) They can also avail benefits of CGHS (OPD & IPD) by registering themselves in the nearest CGHS city after making the required subscription.
(c) They also have the option to avail FMA for OPD treatment, and CGHS for IPD treatment after making the required subscriptions as per CGHS guidelines.
2. In addition, in accordance to MoH&FW’s OM No. S.11011/11/2016 CGHS (P)/EHS dated 09.01.2017 (copy enclosed), pensioners have option to avail CGHS facilities by making contribution on an annual basis (1 year/ 12 months) or by making contribution for 10 (ten) years (120 months) for getting a pensioner CGHS card with life-time validity.
3. The undersigned is directed to request all the Pr. CCA/CCAS and others concerned offices that the pensioners of this Department residing in non-CGHS areas may be intimated/sensitized (more than once) by an appropriate means about the above options for medical facilities available to them as per MoH&FW OM dated 29.09.2016 and OM No. S.11011/11/2016 CGHS (P)/EHS dated 09.01.2017. They may be advised that for availing reimbursement of their medical bills, they have to mandatorily register themselves with the nearest CGHS facility as per one of the options above. They may also be advised that if they fail to register themselves w.e.f. applicable date with the nearest CGHS facility for availing OPD/IPD treatment, their further medical bills may not be reimbursed by this Department.
4. Compliance report in respect of the above may be furnished to this office for appraisal of Secretary, DoT.
5. This issues with the approval of competent authority.

Subject : Revision of Pension w.e.f. 1.1.2016 of Pre-2006 pensioners who retired from the 5th CPC scale of Rs. 6500-10500 or equivalent pay scale in the earlier pay Commission periods.
Madam/Sir,
I am directed to refer to this Department’s letter No.4-1(2)/2019- Pension dated 31.01.2019 forwarding there with DoP&PW’s OM No.-38/33/2012-P&PW(A) dated 04.01.2019 on the above subject. Reference is also invited to letter of even number dated 09.07.2019 forwarding there with DoP&PW’s OM No.38/33/2012-P&PW(A) dated 09.07.2019 on the above cited subject.
In this regard, representations have been received from various quarters for non-implementation of above-said order with the request to take immediate action for clearing pending cases of pre-2006 pensioners.
In view of above, it is requested to instruct the concerned officials to take immediate necessary action to settle the pending cases. Efforts may also be taken to ensure to identify those cases which fall under the preview of DoP&PW instructions.
