With reference to GM/SR’s letter at (3) above and Board’s letter at (1) above, Board (FC & CRB) have approved the following:

1. Enhancing the honorarium paid to Railway Servants appointed to act as Arbitrator from Rs 500/- per day to Rs 1000/- per day and from Rs 250/- per half day to Rs 500/- per half day subject to a maximum of Rs 20,000/- per case.

2. Other extant instructions/guidelines issued from Board on the subject remains unchanged or as modified from time to time.

This issues with the concurrence of Associate Finance of Transformation Cell of Railway Board.

The Ministry of Labour and Employment proposes to amend the Employees’ Provident Funds & Miscellaneous Provisions (EPF and MP) Act, 1952. 2. CBDT Notification – Amend the Income-tax Rules, 1962(PAN, Aadhar) in IT rules 114

New Delhi, the 30th August, 2019

G.S.R. 614(E).– In exercise of the powers conferred by section 139A read with section 295 of the Income-tax Act, 1961 (43 of 1961), the Central Board of Direct Taxes hereby makes the following rules further to amend the Income-tax Rules, 1962, namely:-

1. Short title and commencement.– (1) These rules may be called the Income-tax (Fifth Amendment) Rules, 2019.
(2) They shall come into force from the 1st day of September, 2019.

2. In the Income-tax Rules, 1962, in rule 114, –

(i) after sub-rule (1), the following sub-rules shall be inserted, namely: –

“(1A) Any person, who has not been allotted a permanent account number but possesses the Aadhaar number and has furnished or intimated or quoted his Aadhaar number in lieu of the permanent account number in accordance with sub-section (5E) of section 139A, shall be deemed to have applied for allotment of permanent account number and he shall not be required to apply or submit any documents under this rule.

(1B) Any person, who has not been allotted a permanent account number but possesses the Aadhaar number may apply for allotment of the permanent account number under sub-section (1) or sub¬section (1A) or sub-section (3) of section 139A to the authorities mentioned in sub-rule (2) by intimating his Aadhaar number and he shall not be required to apply or submit any documents under this rule.

(1C) The Principal Director General of Income-tax (Systems) or Director General of Income-tax (Systems) shall on receipt of information under sub-rule (1A) or sub-rule (1B), as the case may be, authenticate the Aadhaar number for that purpose.”;

(ii) after sub-rule (6), the following sub-rule shall be inserted, namely: –
“(7) The Principal Director General of Income-tax (Systems) or Director General of Income-tax (Systems) shall lay down the formats and standards along with procedure for,-

(a) furnishing or intimation or quoting of Aadhaar number under sub-rule (1A); or
(b) intimation of Aadhaar number under sub-rule (1B); or
(c) authentication of Aadhaar number under sub-rule (1C); or
(d) obtaining demographic information of an individual from the Unique Identification Authority of India,

for ensuring secure capture and transmission of data and shall also be responsible for evolving and implementing appropriate security, archival and retrieval policies in relation to furnishing or intimation or quoting or authentication of Aadhaar number or obtaining of demographic information of an individual from the Unique Identification Authority of India, for allotment of permanent account number and issue thereof.”.

Fraud case in passing of Bills – Railway Board

Ref:- Board’s letter No. even dated 26.04.2019 RBA No. 33/2019 .

In continuation to Board’s letter under reference, an extract of the detailed report on Fraud case in Lumbding Division, NFR is enclosed for information and necessary action. Board (FC) has desired that all the Zonal Railways and Production Units may review the existing system in place in the context of modus-operandi of the fraud committed in NF Railway immediately, so that the loopholes (if any) in the existing system are plugged. Following action may be taken by all the Railways in this regard:

a) Systemic review of Vendor/Party Master by all the PFAs. This activity should be targeted for completion in a time period of three months, by 19th November, 2019, by weeding out fake entities and expired contracts;

b) It may be got confirmed from the staff that all prescribed protocol or Rules are being strictly followed as envisaged in Codes and Manuals;

c) Strict compliance to be ensured in rotating staff from Sensitive Seats to Non-Sensitive seats

d) Test Check Mechanism at various levels (from Junior Scale to Higher Administrative Grade ) to be strictly followed.

Action taken report on the above may be submitted to Board’s office. This may be treated as most urgent.

Denial of LC Gate Allowance to the Gate Keepers/Gatemen of Operating in Railways

Dear Sir,

Sub: Denial of LC Gate Allowance to the Gate Keepers/Gatemen of Operating in Railways – reg.

Ref: NFIR’s letter No.I/5(g)/Pt.VI dated 04/06/2018 & 17/08/2018 to the Railway Board.

NFIR once again invites the kind attention of Railway Board to the Federation’s letters dated 04/06/2018 & 17/08/2018, urging upon the Railway Board to grant LC Gate Allowance to the Operating Department Gate Keeper/Gatemen on par with those Gate Keepers of Civil Engineering Department. It is however sad, to mention that neither orders issued to GMs for payment of LC Gate Allowance to the Operating Department Gate Keeper/Gatemen nor reply sent to the Federation on the subject matter.

It needs to be appreciated that pursuant to the acceptance of 7th CPC recommendation, the Railway Board issued orders vide RBE No.87/2017 dated 10/08/2017 and RBE No.110/2017 dated 30/08/2017, granting LC Gate Allowance to the Civil Engineering Department Gate Keepers. These instructions should have been applied to the Operating Department Gate Keepers also automatically. Discriminating Operating Department Gate Keepers in respect of LC Gate Allowance is totally unjustified as the Gate Keepers of Operating Department have been performing similar nature of duties, being performed by Civil Engineering Gate Keepers.

The Operating Department Gate Keepers are extremely disappointed over non-payment of LC Gate Allowance to them, while similarly placed Gate Keeper of Civil Engineering Department are paid the same w.e.f. 1st July 2017.

The Railway Board has constituted EDs Committee to consider the categories which are to be recommended for payment of risk and hardship allowance. NFIR had already given detailed proposal to the EDs Committee, justify for bringing various categories of staff under the ambit of risk and hardship matrix for payment of risk and hardship allowance. However the case for payment of LC Gate Allowance of Operating Department need not be linked to the EDs Committee as this case is different to that of risk and hardship allowance, therefore this crucial point be considered for allowing payment of LC gate allowance to the operating department gate keepers at par with Civil Engineering Department.

NFIR therefore once again urges upon the Railway Board to kindly expedite action for granting LC Gate Allowance to the Gate Keepers of Operating Department w.e.f. 1st July 2017. Federation may kindly be replied of action being taken on the subject early.

Dear Comrades,

Observance of countrywide “Warning Week” from 16-19 September, 2019

As all of you are aware that, burning issue of Corporatization and Privatization was discussed in the meeting of the Standing Committee of AIRF held on 1st September, 2019 at New Delhi.

After long drawn deliberations it was decided to lodge strong protest against such move of the Ministry of Railways (Government of India). Accordingly, it is decided to observe “Warning Week” from 16th to 19th September, 2019, calumniating on 19th September, the “Sahidi Diwas”.

All of your are requested to take appropriate action by directing Branch and Divisional Units to observe the “Warning Week” by holding massive dharna, demonstration and rallies, right from the Branch to Headquarters level.

The programme should be given wide publicity through print and electronic media and the report of the observance be sent to AIRF Office.

This may please be treated as “Most Urgent”.

Sub : Guidelines for providing various facilities including allowing scribes to person with disabilities at the time of departmental examination.

Reference Board’s letter of even number dated 01.09.2014 on the above subject which provides that the various facilities including scribes to persons with disabilities as laid down in Railway Boards letters No. E(NG)II/2006/RC-2/13 dated 17.09.2007, 18.02.2011, 27.04.2017, 25.09.2013 and 19.12.2013, for direct recruitment, may be made applicable for departmental examinations also, wherever circumstances so warrant.

A doubt has been raised by one Zonal Railway as to whether the facility of scribe for departmental examination is restricted to persons recruited against 3% PwD quota or it can also be extended to persons who have been certified disabled by a Railway Doctor due to disability during service. If yes, whether the facility is available for promotion from Group ‘C’ to Group ‘B’ also, in addition to promotions within Group ‘C’.

The matter has been examined in consultation with the Management Services Dte., and it is clarified that the instructions contained in Board’s letter of even number dated 01.09.2014 ibid is also applicable to persons who have attained the disability while in service, for appearing in all departmental examinations both within Group ‘C’ and from Group ‘C’ to Gazetted categories.

Sub : Opening of a CGHS Wellness Centres (Allopathic) at Dibrugarh.

This is for information to all eligible Central Govt. Employees, Pensioners & other stake holders that Central Govt. Health Scheme (CGHS) Wellness Centres (erstwhile Postal Dispensary) now merged with CGHS vide Govt. of India, Ministry of Health & Family Welfare letter No.S.11011/01/2015-CGHS-III-EHS dated 21.12.2018 will be functioning at Dibrugarh from 19th August 2019 near Santi Gas Agency, Chowkidingee , Dibrugarh-786001 to provide comprehensive medical facilities.

The scheme will cover the Dibrugarh city and all eligible Central Govt. Employees and their dependent family members, Central Govt. Pensioners and their dependents and others eligible beneficiaries as per CGHS guideline residing in Dibrugarh city. The coverage shall be limited to the areas within 5 km (approx.) radius of the CGHS Wellness Centre (Ministry’s letter No.C/14012 /02/2018/CGHS-IIl/DIR dated 06.04.2018 may please be seen for clarification , in this regard). Pensioner beneficiary can enroll irrespective of their place of residence, if desire.

The beneficiaries will be able to avail the CGHS facilities through the Wellness Centre during office hours i.e. from 7.30 am to 2.00 pm in all working days except on Sundays & Holidays.

Annual Health Check-up at Hospitals empanelled under CGHS in respect of CGHS Pensioner beneficiaries (Primary card holders) aged 75 years and above- regarding

With reference to the above mentioned subject, the undersigned is directed to state that the matter relating to Annual Health Check-up at private hospitals empanelled under CGHS in respect of elderly CGHS beneficiaries was under consideration at this Ministry and it has now bean decided that hereinafter, CGHS Pensioner beneficiaries {Primary Card holders) aged 75 years and above shall be permitted to undergo ‘Annual Health Check-up’ at CGHS ernpanelled hospitals.

Permission in respect of CGHS Pensioner beneficiaries (Primary Card holders) aged 75 years and above shall be granted by CMO in charge of CGHS Wellness Centre.

The private hospitals empanelled under CGHS shall perform the Annual Health Check-up at CGHS rates and extend cashless facility for the same in respect of CGHS Pensioner beneficiaries (Primary Card holders) aged 75 years and above.
