Ref :- This office circular no.C‐182 dated 19.02.2018.

This office important circular no. C‐182 dated 19.02.2018 may be treated as withdrawn. Further, pension papers shall be forwarded to this office not later than six months before the date of retirement of Government Servants in consonance with Rule 61 of CCS (Pension) Rules 1972.

2. In view of the above, you are also requested to issue suitable instructions (along with copy of this circular) to all the Head of Offices under your administrative control to ensure that pension papers on the subject matter henceforth are floated in accordance with instructions given in above Para.

2. Term of engagement mentioned in Appendix “X” of Circular No. 555 dated 04.02.2016 for Honorary Flying Officer (HFO) of Air Force may be read as 21 to 33 years w.e.f. 30.5.1998 till date.

Subject : Closure of Office/Buildings surroundings R.P. Bhawan in connection with AT HOME FUNCTION on the occasion of Independence Day Celebrations 2019 -regarding.

The Anti-Sabotage Checks are required to be done in the buildings (as per list enclosed), before AT HOME FUNCTION at Rashtrapati Bhavan on 15.08.2019 evening. These buildings will have to be vacated by 0900 hours on 15.08.2019, so that rooms are sealed after regular Anti-Sabotage checks are completed. It has therefore been decided that the Government Offices located in the buildings in the Annexure to this OM would be closed by 0900 hours on 15.08.2019 (Thursday).

G.S.R .551(E).— the following Order made by the President is published for general information:-

THE CONSTITUTION (APPLICATION TO JAMMU AND KASHMIR) ORDER, 2019

C.O. 272

In exercise of the powers conferred by clause (1) of article 370 of the Constitution, the President, with the concurrence of the Government of State of Jammu and Kashmir, is pleased to make the following Order:—

1. (1) This Order may be called the Constitution (Application to Jammu and Kashmir) Order, 2019.

(2) It shall come into force at once, and shall thereupon supersede the Constitution (Application to Jammu and Kashmir) Order, 1954 as amended from time to time.

2. All the provisions of the Constitution, as amended from time to time, shall apply in relation to the State of Jammu and Kashmir and the exceptions and modifications subject to which they shall so apply shall be as follows:—

To article 367, there shall be added the following clause, namely:—

“(4) For the purposes of this Constitution as it applies in relation to the State of Jammu and Kashmir—

(a) references to this Constitution or to the provisions thereof shall be construed as references to the Constitution or the provisions thereof as applied in relation to the said State;

(b) references to the person for the time being recognized by the President on the recommendation of the Legislative Assembly of the State as the Sadar-i-Riyasat of Jammu and Kashmir, acting on the advice of the Council of Ministers of the State for the time being in office, shall be construed as references to the Governor of Jammu and Kashmir;

(c) references to the Government of the said State shall be construed as including references to the Governor of Jammu and Kashmir acting on the advice of his Council of Ministers; and

(d) in proviso to clause (3) of article 370 of this Constitution, the expression “Constituent Assembly of the State referred to in clause (2)” shall read “Legislative Assembly of the State”.”

I am directed to forward a copy of D.O. No.1/12/2019-P&PW(G) dated 28.06.2019, received from Secretary, Department of Pension & Pensioners’ Welfare (DoP&PW) on the subject mentioned above for information and necessary action. As detailed in the DoP&PW’’s reference, it has been decided to conduct nation-wide Pension Adalats by the Ministry/Department/Organisation/Field Formation on 23rd August, 2019, for which wide publicity should be given to Pension Adalat of Organisation and cases brought out by individuals should be taken up in the Adalat. The main objective of these Adalats is to provide prompt quick redressal of Pensioners’ grievances, within the framework of extant policy guidelines.

2. All the field formations under CBIC are therefore requested to furnish the status of the cases on the Pension Adalats, in the prescribed proforma (copy enclosed), directly to the DGHRD (HRM), on or before 05.09.2019 under intimation to this office, for compilation and sending a consolidated statement to the Board.

Anomaly in Pay due to belated submission of option certificates

In the context of grievances being sent by Officers regarding pay fixation on promotions effected during 5th CPC and for switching over to revised pay structure of 6th CPC and 7th CPC, it is intimated that extant Govt orders do not provide for carrying out pay revision in cases of belated submission of option certificate(s) exercised after the prescribed time limit.

This Office can take action for revision of pay in the said cases only on receipt of necessary orders from MoD

(i) for accepting options exercised belatedly, OR

(ii) for extending the time limit for exercise of option (from a prospective date) to enable the affected Officers to exercise fresh options.

Will the Minister of PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-

(a) whether Government has implemented any policy for removal of non-performing civil servants;

(b) if so, the details thereof and if not, the reasons therefor;

(c) whether any non-performing civil servant has been removed during the last three years; and

(d) if so, the details thereof, State-wise and year-wise?

(a) to (d): Yes Sir. The provisions of Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rules, 1972 and Rule 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 lay down the policy of periodic review and premature retirement of Government servants, which is a continuous process. As per these, the Government has the absolute right to retire Government officials prematurely on the ground of lack of integrity or ineffectiveness, in public interest.

For the period July 2014-May 2019, a total of 36,756 Group-A and 82,654 Group-B officers have been reviewed under FR 56(j)/similar provisions, out of which FR 56(j)/ similar provisions have been invoked /recommended against 125 Group-A and 187 Group B officers

ABSTRACT

Advance – Festival Advance to pensioners – Enhancement of the quantum of advance – Orders – Issued.

Read the following:-

1. G.O.(Ms.).No.285, Finance (Pension) Department, Dated 18.02.1971.
2. G.O.(Ms.).No.836, Finance (Pension) Department, Dated 31.07.1976.
3. G.O.(Ms.).No.1091, Finance (Pension) Department, Dated 04.10.1989.
4. G.O.(Ms.).No.782, Finance (Pension) Department, Dated 12.10.1992.
5. G.O.(Ms.).No.460, Finance (Pension) Department, Dated 24.09.2007.
6. G.O.(Ms.).No.75, Finance (Pension) Department, Dated 14.03.2013.

ORDER :

In the Government Order sixth read above, it has been ordered that all the Tamil Nadu Government Pensioners (both State Civil and Teacher Pensioners) shall be granted Festival Advance of Rs.2,000 (Rupees two thousand only).

2. During the Budget session for the year 2019-2020, the Hon’ble Deputy Chief Minister made the following announcement:-

தற்போதுள்ள நடைமுறைகளுக்கு உட்பட்டு ஒய்வூதியதாரர்களுக்கு வழங்கப்படும் பண்டிகைக் கால முன்பணம் 2,000 ரூபாயிலிருந்து உயர்த்தி வழங்கப்படும்

3. The Government after careful consideration and accordingly direct that the Festival Advance payable to all the Tamil Nadu Government Pensioners (both State Civil and Teacher Pensioners) shall be enhanced from Rs.2,000 to Rs.4,000 (Rupees four thousand only).

4. These orders shall take immediate effect and apply to festivals to be celebrated after the date of issue of this order.

5. All other conditions laid down in the Government Order first read above as amended in the Government Order second read above shall remain unchanged.
