CIRCULAR

Comrade,

A meeting of Postal J.C.A consisting of NFPE, FNPO, AIPEU GDS and NUGDS was held at NFPE office, North Avenue, New Delhi on 15-11-2018. All General Secretaries of NFPE, FNPO and GDS Unions participated in the meetings.

The meeting was presided over by Com. T.N Rahate, Secretary General FNPO.

A threadbare discussion took place on the prevalent situation in Deptt of Post. Deptt is moving ahead on the path of corporatization which will lead to privatization of services in future . IPPB is the burning example of this. After MNOP, PNOP has been brought and separate Parcel Directorate has been Setup. The Minister communication is announcing to setup a separate company for PLI & RPLI.

There is acute shortage of staff in each cadre . Cadre Restructuring for left out categories is not being finalized. The result of regular membership verification conducted in 2015 has not been declared yet. The entire process of GDS membership verification was cancelled arbitrarily.

High Court & Supreme Court decisions in respect of MACP, RTP and others matters are not being implemented.

Positive recommendations of Sri Kamlesh Chandra Committee are not being implemented.

Every day new services are being introduced without developing proper infrastructure and without providing adequate manpower and training to the staff. Dept Council meetings and periodical meetings are also not being held since long. More and more victimization of trade union leaders has become the order of the day.

So therefore taking a serious note of all the above mentioned facts, PJCA has decided unanimously to conduct 2 days strike on 8 & 9 January – 2019 for which vigorous campaign will be launched . All leaders of NFPE & FNPO will carry on the campaign programme which will be declared shortly.

The Charter of demands for which 2 days strike will be conducted is mentioned as under.

CHARTER OF DEMANDS

1. Implement all positive recommendation of Sri Kamlesh Chandra Committee report and grant Civil servant Status to GDS.

2. Fill up all Vacant Posts is all cadres of Deptt of Post i.e P.A/S.A, Postmen, Mail Guard , MTS, GDS, Postal Acctts, P.A Admn Offices, P.A SBCO & Civil Wing etc and separate identity of all cadres within a time frame.

3. Settle all the problems arisen out of implementation of C.S.I & R.I.C.T.

4. Withdraw NPS and Guarantee minimum pension 50% of last pay drawn.

5. Membership verification of G.D.S and declaration of result of regular employees membership verification conducted in 2015.

6. Implementation of orders of payment of revised wages and arrears to the casual , Part time, Contingent employees & daily rated mazdoors as per 6th 7th CPC and Regularize Services of casual Labourers.

7. Implement Cadre Restructuring for left out categories i.e RMS, MMS, Postman/MTS, PACO, PASBCO, Postal Acctts, Postmaster Cadre and Civil Wing etc.

8. Stop Privatization, Corporatization and out sourcing in Postal Services.

9. Very Good Bench Mark should be implemented after issue of orders i.e from 25.7.2016 .

10. Implement 5 days week in Postal and RMS

11. Consider the suggestions by RMS JCA regarding PNOP & CSI.

12. Enhancement of higher payscales to those categories whose minimum qualification has been enhanced e.g Postmen, Mail guard.

13. Grant of pension to the promoted GDS based on Supreme Court Judgement in SLP No (C) 13042/2014

14. Withdraw orders of enhancement of cash conyance limit without security.

15. Implement all High Court and Supreme Court decision in C/W MACP, RTP and others.

16. Cash less facility treatment under CGHS and allotment of adequate fund under head MR & T. A

17. Retention of Civil wing is the Deptt of Post.

18. Holding of Deptt Council Meetings and periodical meetings at all level.

19. Stop Trade Union victimization and in the name of unscientific

20. Provide 40 percent SCF quota promotion in AAO cadre and amend RR incorporating the modifications demanded by AIPAEA.

21. Status of audit to SBCO.

Sub: Extension of CGHS facility to retired BSNL employees.

Please refer to your letter No. NU/CHQ/36/BDPA dated 30.07.2018 on the subject mentioned above. Orders regarding reimbursement of onetime payment of subscription for availing CGHS facility by retired employees was issued on 29.7.2016 with the approval of the Management Committee. The matter was examined and it is observed that orders are made effective only from the prospective dates unless otherwise specified and cannot be made effective retrospectively on a later date.

This issues with the approval of the Competent Authority.

Dear Comrades,

A meeting of Postal J.C.A consisting of NFPE, FNPO, AIPEU GDS & NUGDS was held at NFPE office, North Avenue, New Delhi on 15-11-2018.

All General Secretaries of NFPE, FNPO and two GDS Unions (AIPEU-GDS & NUGDS) participated in the meeting.

An elaborate and effective discussion taken place on all issues of GDS and departmental employees transparently between the Federations and two GDS Unions.

It is decided that the AIPEU-GDS will participate in two days strike on 8th & 9th January 2019 along with all Departmental employees’ Unions of NFPE & FNPO including the demands of GDS in the charter.

All the CHQ Office bearers, Circle Secretaries, Branch/Divisional Secretaries & members of AIPEU-GDS are requested to start campaign to mobilize the cadre to make the two days strike a grand success.

Sub :- GST Tax Deducted at Source-Reverse Flow of GSTR-7 filed data-instructions thereof.

GSTR-7 Return for the month of October, 2018 has now been filed by all the Principal Officers of Indian Railways by using the JSON file provided by CRIS in the IPAS. It has come to notice that many records were rejected, as the GSTIN of the vendor has been wrongly captured while passing the vendor bill in the Internal-Check module of IPAS. Due to this invalid GSTIN of vendor, GSTR-7 data could not be uploaded in the GSTN-TDS portal. Therefore there is an urgent need to launch a drive to validate the vendor master by populating valid GSTIN of the vendor, so that such mistakes do not recur in future. This exercise may be got completed within a week say by 21stNovember, 2018. It is requested that all PHODs be instructed to coordinate with PFAs for immediate correction of this data. Non uploading of data has financial implication due to penal provision in GST Rules.

2. In order to complete the task relating to TDS for the month of October, 2018, following, details may be provided by all the Principal Officer responsible for filing of GST-TDS return to Mr.Ajay Srivastava, PPE/CRIS at [email protected] , by 15th November, 2018 :-

a) JSON/Excel file containing GSTIN wise TDS details (IGST, CGST, SGST) he downloaded from GSTN Portal;

b) Details of Tax deposited with CO-6 number and date to be provided;

c) Contact Name, Designation and Mobile Number of the authorized person of the GST-TDS portal

3. GSTIN wise Tax details received by CRIS will be ported into IPAS to enable:-

a) Generation of TDS (as deposited) statement through IPAS/IREPS;

b) Reconciliation of TDS between “to be deposited” and “as Deposited”;

c) MIS details for raising Debits against associate Railways/Units by Principal Railways;

d) Filtering left. out GSTINs for which TDS was deducted but could not be deposited due to invalid OSTIN. TDS for such GSTINs will be included in next month’s GST Return for TDS (GSTR-7), after these are corrected by the concerned accounting units.

Sub:- Process to accept/reject GST TDS-Credit.

GSTN portal has come up with a functionality to accept or reject GST-TDS summary, as deducted by Railway’s PSU customer, In this regard, Railway Board’s GST Consultants have prepared a process flow which is attached for information and necessary action. CRIS will place a MIS report which will contain Principal Railway wise, Customer GSTIN wise summary data in the GST manual utility, which may be relied upon to accept the GST-TDS that is residing in Principal Railway’s GSTIN. In case the difference between the CRIS report and the figure that is getting reflected in the Railway’s GSTIN is substantial, then the data needs to be rejected and necessary, follow-up action needs to be taken for recovery of the TDS amount from the Railway Customer.

Sub :- Spot Check of Pension Payments by Pension Disbursing Banks.

Expenditure on Pension accounts has increased substantially due to revision of pension as per 7th CPC. It is therefore necessary that the pension payments made by the banks are monitored closely and the pension debits are checked concurrently to ensure that there are no excess payments and the debits are in respect of bonafide Railway pensioners only.

Besides internal checks and spot checks of pension payments, a physical verification drive of pensioners may also be launched during November, 2018 like previous years to carry out inspections and verifications of the ‘Life Certificate” by pensioners to the banks. A team of staff from Personnel and Accounts department may be deputed for this purpose to visit the banks in their proximity. A suggestive checklist for verification to be carried out is enclosed. A brief report of the outcome of the above verification may be submitted to Board by 15th December, 2018.

In wake of recent frauds detected on one of the Railways relating to salary payment and other allowances, there is an urgent need to validate the employee master data that generates pay roll and other establishment claims. The validation is necessary to establish that employees included in the master table are bonafide employees, appointed by competent authorities, following legislated recruitment procedures. This validation can only be done by comparing pay roll details with the service records, starting with recruitment and appointment letters.

It is, therefore, urged that all CPOs be directed to take a onetime exercise to validate employee master data on IPAS with employees’ service records. Further, the data on appointment lettefs issued by RRCs and RRBs may also be linked with new entrants’ details to prepare memorandum of differences by the Drawing officer. This will enable sanitization of the base line. This shall also need to be done by all PFAs/CSCs who are having Personnel functions of their department. The PFAs would then conduct an independent internal check to validate Payroll database on IPAS to ensure proper Maker-Checker protocols.

The validation of the pay rolls may be completed by 15.10.2018.

1. Operation of CT Scan/MRI/Diagnostic Machines on PPP Mode in railway hospitals,
2. Setting up of Railway Medical Colleges.
3. Implementation of Cashless Treatment Scheme in emergency (CTSE) for RELHS beneficiaries.
4, Health Camps being organized at workplaces to assess fitness to operational staff.
5. Installation of Wi-Fi and CCTV in railway hospitals.
6. Exchange of patients between railway and PSUs hospitals
7. Preparedness of railway hospitals for participation in Aayushman Bharat Scheme.
8. Utilization of costly machines installed in railway hospitals.
9. Creation of dummy bills for assessing cost of services being provided to railway medical beneficiaries.

It is desired that adequate arrangement at the zonal level may please be got ensured for up-linking during Video Conference and Pr.CMD/CMOs of the Zones/PUs be instructed to ensure their presence during the Video Conference at the Zonal/Ms Headquarters with all details on above mentioned issues so that proper briefing could be done.

Government Brought Most Public Authorities Under RTI Act

The Union Minister of State (Independent Charge) Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh stated here today that in the last four and half years, the government led by Prime Minister Shri Narendra Modi has brought most of the public authorities under the purview of the RTI act, which is in keeping with the commitment to ensure maximum transparency in the working of these institutions. The Department of Personnel and Training(DOP&T), which is the nodal department for the Right to Information and Central Information Commission, has so far successfully covered nearly 2000 public authorities under the RTI Act, he said.

Dr Jitendra Singh made these observations when the Chief Information Commissioner (CIC), Shri R.K. Mathur called on him today.

Lauding the achievements of the last over four years, Dr Jitendra Singh said, when the government came in, there were very few public authorities under the purview of RTI Act, but a fast – track process was initiated to make the RTI more effective and more inclusive.

In addition, Dr Jitendra Singh noted that the filing of RTI has been made much more convenient and easy with the use of latest technology. There is now a portal and an App, as a result of which, any citizen can file an RTI from his mobile phone, at any time of the day or night, and from anywhere.

The disposal time of the RTI application received in the Central Information Commission has been drastically reduced, said, Dr Jitendra Singh, and added that the pendency has also considerably reduced in comparison to what it was before 2014.

In the DOP&T, Dr Jitendra Singh said, we have tried to sincerely live up to Prime Minister Shri Narendra Modi’s commitment of maximum governance with minimum government, maximum transparency and maximum citizen-participation. He said, there has also been a successful effort to compile inputs from the various RTIs received, in order to prepare research manuals for planning future strategies and improve upon the existing methodologies.
