Sub:- Observance of three phase countrywide agitational programme by GDS JCA

Sir,

As you are aware non-implementation of positive and basic recommendations of Kamlesh Chandra committee on G.D.S Employees viz., implementation with effect from 01st of January 2016, gratuity Revision, SDBS/pension, 30 days paid leave, Enhancement of composite allowance, financial up gradation on completion of 12, 24 and 36 years of service etc. has generated resentment and discontentment among the G.D.S employees. It is pertinent to mention here that although discussions were held at Directorate, I am sorry to state that no progress is observed so far on any of the issues. Under the circumstances we are compelled to observe three phase fast Programme of agitation.

The above three GDS Unions, JCA decided the following countrywide agitational programme to settle the charter of demands.

Agitational programmes:

  1. 25-09-2018 : One day country wide hunger fast infront of Divisional Offices
  2. 04-10-2018 : One day country wide hunger fast in front of Circle Offices.
  3. 10-10-2018 : One day massive hunger fast in New Delhi.

CHARTER OF DEMANDS

1) GDS committee report as a whole be implemented with effect from 01st of January 2016.

2) Change the formula already adopted for calculation of arrears.

3) Change of upper limit of gratuity from Rs 1,50,000/- to Rs 5,00,000/-

(a) GIS limit should be enhanced to Rs.5,00,000 with the subscription of Rs.500/-

4) 10% of the TRCA of the GDS should be recovered towards SDBS contribution and the Government to contribute equal share.

(a) And also EPF Scheme to be introduced to GDS as recommended by the GDS Committee. This was also recommended by the previous GDS Committees.

5) GDS should be granted 30days paid leave in a year and the leave should be allowed to be carry forward subjected to the maximum of 180 days and provide encashment of the leave.

6) Grant Children Education allowance Rs.6000/- per child per Annum.

7) Enhance composite allowance to the BPMs from Rs500/- to Rs 1600/- Also grant composite allowance to ABPMs & GDS working in classified cities and the GDS working in Departmental Offices etc., wherever applicable.

8) GDS employees should be granted financial up gradation on completion of 12, 24 and 36 years of service in the form of grant of additional increments.

(a) Point to point fixation to be ordered instead of bunching of TRCA scales.

9) Limited transfer facility to GDS on request should be relaxed. There shall not be any drop in wage scale on account of a request transfer. The transfer of GDS will be approved by Divisional head if the transfer is within the Division, by regional PMG if it is within the region by HOC if the transfer is within the Circle.

10) Voluntary discharge schemes for the GDSs: 3 types of voluntary discharge schemes as recommended by GDS committee for the GDSs’ who are willing to quit the post before the discharge at the age of 65 years should be implemented.

11) All discharge benefits (retirement benefits) should be implemented retrospectively, w.e.f 01 January 2016.

12) Put off duty may be averted by transferring the GDS to another place.

13) Incentive system should be abolished for India post payment bank (IPPB) work. Enhance the working hours of branch post office and GDS officials concerned after introducing the IPPB.

14) GDSs’ should be allowed to get discharge from the service on the last day of the month in which He/She attains the 65 years of the age.

15) All single handed branch post offices should be provided with one more hand to upgrade to double handed office.

16) Employees’ state Insurance ( ESI) facility to be extended to Grameen Dak Sevaks wherever E.S.I dispensaries and hospitals are available the country.

The programme will be a peaceful one.

Ref: 1. Ministry of Personnel, Public Grievances and Pensions (DoP&T)’s Notification No. GSR.767(E) dated 11.08.18 (Annexure A).

2. MoH&FW’s OM NO. A.12034/4/2018-CHS.V dated 13.8.18 (Annexure B).

In supersession of orders contained in Board’s Letters of even number dated 31.05.16 (RBE No. 57/2016) and 26.12.2017 (RBE No. 205/2017) and in accordance with the orders contained in the DoP&T’s Notification No. GSR.767(E) dated 11.08.18 amending Clause (bb) under FR 56 of the Fundamental Rules, 1922, the provisions in respect of age of superannuation of doctors of the Indian Railways Medical Service and Dental Doctors under the Ministry of Railways are modified as stated in the Notification.

2. The age of superannuation of Doctors belonging to IRMS and Dental Doctors under the Ministry of Railways shall be sixty-two (62) years unless they exercise the option of posting to a Clinical post depending upon their expertise and experience, as decided by the Competent Authority in the Ministry of Railways from time to time, in case they desire to continue in their service upto the age of sixty-five (65) years.

3. The serving doctors belonging to IRMS and Dental Doctors under the Ministry of Railways who have already attained the age of 62 years or will be attaining the age of 62 years within 6 months from the date of issue of these orders may exercise their option as per the enclosed format within a period of 30 days from the date of issue of these orders. All other doctors would, in future, be required to submit their option not less than 06 months before their attaining the age of 62 years. The Railway doctors should furnish their option through the Personnel Branches of their respective Railway administrations.

4. The serving doctors who fail to exercise the option within the period specified above shall stand superannuated from service on attaining the age of 62 years or on expiry of the period of 30 days from the the date of issue of these orders, whichever is later.

5. Posting orders involving inter-Railway transfers and for those working in Boards office will be issued by the Railway Board. Orders of CMSs and CMDs in Zonal Railways who cross 62 years of age and opt to serve in a Clinical post and who are posted on the same Railway itself would be issued by the Zonal Railway administration themselves.

6. Copies of options exercised by the Railway doctors should be forwarded to the Board’s office (Secretary’s Confdl. Cell) for record and necessary action.

7. A list of administrative posts identified by the Ministry of Railways and designations of IRMS officers after 62 years is annexed (Annexure C).

8. These instructions are available online at www.indianrailways.gov.in.

9. These instructions may be brought to the notice of all doctors belonging to IRMS and Dental Doctors under the Ministry of Railways.

10. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

1. All officers and staff posted to non CGHS stations have to surrender their CGHS Card at the earliest for onward submission to Additional Director CGHS and discontinuance of CGHS Subscription.

2. In this regard it is also pertinent to mention that employees posted at non CGHS station are governed by CS (MA) for availing medical facilities and should submit medical reimbursement claim accordingly.

In this regard, it is to inform to all the candidates that they may pay online application fee through login ID until the fee is paid successfully. The fee earlier deducted on account of online application will be refunded by the bank concerned.

If the candidates do not pay application fee through their login ID, the admit card will not be issued to the candidates for the applied post and KVS will not be responsible for not issuing the admit card.

Please refer to Board’s letter of even no. dated 31.07.2017 forwarding therewith a copy of Ministry of Personnel, Public Grievances and pensions, Department of Personnel & Training’s (MoPPG&P/DoP&T) OM No.13/02/2017-Estt.(Pay)I dated 27.07.2017 regarding guidelines on availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in context of CCS(RP) Rules,2016 for adoption of the same in Railways with respect to RS(RP) Rules,2016.

2. Now Ministry of Personnel, Public Grievances and Pensions, Department of personnel & Training vide their OM No.13/02/2017-Estt.(Pay-I) dated 28.08.2018 has clarified various aspects of their earlier OM. The clarifications issued by DoP&T shall be applicable mutatis mutandis in Railways with respect to RS(RP) Rules,2016.

3. The ‘one month’ period mentioned in the aforesaid OM of DoP&T dated 28.08.2018 under clarification to point of doubt as Sl.No.2 shall be one month from the date of issue of these instructions.

Dear Sir,

Sub: Incidents of violent attacks on Railway employees in the course of performing their duties-reg.

Of late, it is noticed that the Railway employees are becoming targets of physical attacks by the unruly people/antisocial elements. In this connection, NFIR cites the case of recent physical attack on Travelling Ticket Examiner of S.C. Railway (Secunderabad Division) by a group of people who are habituated of travelling unauthorizedly and threatening on duty staff. It has further been reported that three persons have attacked the Gate Keeper (Track Maintainer) at Level Crossing Gate on Northern Railway and chopped off his left arm on 17th September, 2018. Similar attacks on staff were also reported from different places and no adequate action has been taken by the concerned Law & Order Authorities to deter the miscreants.

The Railway Staff who perform duties in the field and at remote places are developing constant fear of criminal attacks on them by the miscreants. In order to maintain the morale of staff, it would be necessary to urge upon the concerned high level authorities who are accountable for maintaining Law & Order situation to take effective measures. So far as Level Crossing Gates are concerned, provision of CCTV cameras may be considered seriously to facilitate detecting the culprits for further action.

NFIR, therefore, requests the Railway Board to kindly see that concrete steps are taken to protect the Railway Staff working in the field and in the remote sections of the Railway system. Federation may please be kept advised of action being taken by the Railway Board early.

Pension – Dearness Allowance to the Pensioners and Family Pensioners -Revised Rate admissible from 1st July 2018 – Orders – Issued.

2. From the Government of India, Ministry of Personnel, Public Grievances and Pensions, Department of Pension and Pensioners Welfare, New Delhi Office Memorandum No.42/06/2018-P&PW (G) dated 18-09-2018.

3. G.O.Ms.No.313, Finance (Allowances) Department, dated 18-04-2018.

ORDER:

In the Government Order first read above, orders were issued sanctioning the revised rates of Dearness Allowance to the State Government Pensioners / Family Pensioners as detailed below:-

2. Government of India, in its Office Memorandum second read above has enhanced the Dearness Allowance payable to its Pensioners / Family Pensioners from the existing rate of 7% to 9% with effect from 1st July 2018.

3. In the Government order third read above, orders were issued revising the Dearness Allowance payable to State Government employees and teachers from the existing rate of 7% to 9% with effect from 1st July 2018, following the Government of India’s decision on enhancing the Dearness Allowance to its employees.

4. Following the orders issued by the Government of India, the Government sanction the revised rate of Dearness Allowance to the State Government Pensioners / Family Pensioners as indicated below:

5. The additional installment of Dearness Allowance payable under these orders shall be paid in cash with effect from 1-7-2018.

6. The arrears of Dearness Allowance for the months of July and August, 2018 shall be drawn and paid by existing cashless mode of Electronic Clearance System (ECS). While working out the revised Dearness Allowance, fraction of a rupee shall be rounded off to next higher rupee if such fraction is 50 paise and above and shall be ignored if it is less than 50 paise.

7. It will be the responsibility of the Pension Disbursing Authority including Public Sector Banks to calculate the quantum of Dearness Allowance payable in each individual case.

8. Pending formal authorisation by the Principal Accountant General, the revised Dearness Allowance shall be paid straightaway by the Pension Pay Officer, Chennai-35, Treasury Officers and Public Sector Banks concerned.

9. This order will apply to the following categories of pensioners:-

(i) Government Pensioners, Teacher Pensioners of aided and local body educational institutions and other pensioners of local bodies.

(ii) The State Government employees who had drawn lumpsum payment on absorption in Public Sector Undertaking / Autonomous Body / Local Body / Co-operative institution and have become entitled to restoration of commuted portion of pension as well as revision of the restored
amount.

(iii) Present and future family pensioners; In the case of divisible family pensioners, Dearness Allowance shall be divided proportionately.

(iv) Former Travancore-Cochin State pensioners drawing their pension on 1st November, 1956 in the Treasuries situated in the areas transferred to Tamil Nadu State on that date, i.e. Kanniyakumari District and Shencottah Taluk of Tirunelveli District.

(v) Pensioners who are in receipt of special pensions under Extra-ordinary Pension Rules, Tamil Nadu and Compassionate Allowance.

10. The expenditure on Dearness Allowance payable to the Pensioners and Family Pensioners shall be debited to the respective following Heads of Account:

“2071. Pension and Other Retirement Benefits – 01. Civil – 101. Superannuation and Retirement Allowances – State’s Expenditure – AC. Dearness Allowance to Pensioners – 03. Dearness Allowance (D.P.C. 2071 01 101 AC 0306)”

“2071. Pension and Other Retirement Benefits – 01. Civil – 105. Family Pensions – State’s Expenditure – AC. Dearness Allowance to Family Pensioners of Tamil Nadu Government – 03. Dearness Allowance (D.P.C. 2071 01 105 AC 0308) “.

11. The orders regarding sanction of Dearness Allowance to the widows and children of the deceased Contributory Provident Fund / Non Pensionable Establishment beneficiaries of State Government and the former District Boards who are drawing ex-gratia will be issued separately.

12. The increased expenditure due to the sanction of Dearness Allowance in this order is allocable among the successor States as per the provisions laid down under the State Reorganization Act, 1956.
