NOTIFICATION

New Delhi, dated the 30th March, 2015

G.S.R…………….. (E) – In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India, in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Pension) Rules, 1972, namely:-

1. (1) These rules may be called the Central Civil Services (Pension) Amendment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Civil Services (Pension) Rules, 1972, in Form 5, under the heading “Check List of Documents to be submitted along with Form 5”, after serial number 8 and the entry relating thereto, the following serial number and entry shall be inserted, namely:-

“9. Form for submitting details under ‘Anubhav’ (optional)”

Subject: Revision of Special Allowance and Cash Handling Allowance as a result of enhancement of Dearness Allowance w.e.f. 1.1.2014

References are being received from various Ministries with regard to the amount of Special Allowance and Cash Handling Allowance admissible consequent upon enhancement of Dearness Allowance payable to Central Government employees @ 100% w.e.f. 1 st January, 2014 announced vide Ministry of Finance, Department of Expenditure O.M. No.1/1/2014-E-II (B) dated 27th March, 2014.

2. This Departments O.M. 4/6/2008-Est(Pay II) dated 1.10.2008 provides that the rates of Special Allowance and Cash Handling Allowance will be increased by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.

3. All Ministries/Departments are therefore, again advised to take necessary action accordingly.

Facilities to Employees of Border Roads Organisation

The workforce of Border Roads Organisation (BRO) comprises both of Army and civilian personnel. The Army personnel are governed by their own terms and conditions of service, while the civilian personnel are governed by Central Civil Service Rules and their pay and allowances are regulated pursuant to these rules at par with other Central Government employees.

However, keeping in view the service conditions of BRO, the civilian personnel have been extended some additional facilities such as Mess, Ration, CSD Canteen, Uniform, 60 days Earned Leave in a calendar year, etc., which otherwise are not entitled to other civilian employees of Central Government.

Certain facilities / allowances like retirement age of 60 years, Non-Functional Upgradation, Headquarter Allowance, Special Duty Allowance etc., are applicable for entitled Civilian personnel only and not for Army personnel.

The terms and conditions of the army and civilian personnel in BRO are governed by two different sets of Rules / Regulations; therefore, complete parity among them is not feasible.

This information was given by Defence Minister Shri Manohar Parrikar in a written reply to Shri Om Birla in Lok Sabha today.

Subject : Declaration of Assets and Liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013 – Clarification regarding formats to be used for filing returns under the Act.

The undersigned is directed to refer to this Department’s DO letter of even No. dated 29th December, 2014 and the O.M. of even No. dated 13th January, 2015 regarding furnishing of information relating to assets and liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013, forwarding therewith copies of the Central Government’s notifications dated 26th December, 2014 containing :-

(a) Amendment to the Lokpal & Lokayuktas (Removal of Difficulties) Order, 2014, for the purpose of extending the time limit for carrying out necessary changes in the relevant rules relating to different services from “three hundred and sixty days” to “eighteen months” , from the date on which the Act came into force, i.e., 16th January, 2014; and

(b) The Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Amendment Rules, 2014, extending the time limit for filing of revised returns (pl see proviso under sub- rule 2 of rule 3 of the principal rules) by all public servants from 31st December 2014 to 30th April, 2015.

2. In this regard, it is clarified that:-

(i) The first return (as on 1st August, 2014) under the Lokpal Act should be filed on or before the 30th April, 2015;

(ii) The next annual return under the the Lokpal and Lokayuktas Act, 2013 for the year ending 31st March, 2015 should be filed on or before 31 st July, 2015; and

(iii) The annual return for subsequent years as on 31st March every year should be filed on or before 31 st July of that year.

3. The following Assets & Liabilities Return forms (both in English and Hindi) are enclosed herewith as indicated below:

A. Declaration to be filed with Return of Assets and Liabilities on First Appointment or as on the 31st March, 20…….. (Under Sec 44 of the Lokpal and Lokayuktas Act, 2013.) [Appendix-I of the notification dated 14.07.2014].

B. (a) FORM No. I – Details of Public Servant, his/ her spouse and dependent children[Appendix-II of the notification dated 14.07.2014].

(b) Modified FORM No. II – Statement of movable property on first appointment or as on the 31st March, 20…[Appendix-II of the notification dated 14.07.2014 as modified vide notification dated 26.12.2014].

(c) FORM NO. III – Statement of immovable property on first appointment or as on the 31st March, 20…. (e.g. Lands, House, Shops, Other Buildings, etc.) [Held by Public Servant, his/her spouse and dependent children] [Appendix-II of the notification dated 14.07.2014].

(d) Modified FORM No. IV – Statement of Debts and Other Liabilities on first appointment or as on 31st March, 20…. [Appendix-II of the notification dated 14.07.2014 as modified vide notification dated 26.12.2014].

4. It is requested to ensure that all officers and staff in your Ministry/ Department/ organizations file the said declarations/returns within the prescribed time-limits, in the aforementioned forms.

Subject: “Anubhav” – showcasing outstanding work done during service – submission of details by the retiring employees regarding .

The undersigned is directed to refer to the interactive session chaired by Secretary (P) on 18.3.2015 with the officers of CSS and CSSS retiring in the month of March and April, 2015 on the subject mentioned above.

2. As Ministries/ Departments are aware, Department of Pension & Pensioners’ Welfare has launched an online platform viz. “Anubhav” for the retiring Central Government employees to showcase commendable work done by them during their service. It is envisaged that this would provide satisfaction to the retiring employee and also act as a motivator for serving employees. This would also be a wonderful opportunity to garner the resource of retiring employees for voluntary contribution to nation building post retirement.

3. The link to the “Anubhav” is at http://pensionersportal.gov.in/anubhav/CSS/CSSS Officers retiring within six months are requested to submit the write up not more than 5000 words along with appropriate attachments where need be in the online portal. For detailed instructions they may refer to the circulars issued by Department of Pension & Pensioners welfare in this regard.

4. All Ministries/Departments may request CSS/CSSS Officers retiring within six months to submit a write up providing details of their work that has contributed to the efficiency, economy and effectiveness in government functioning or / and any innovation which led to improved work culture or any other contribution considered significant by the retiring employee.

5. Ministry/ Department wise list of employees of CSS and CSSS retiring within the next six months as per web based cadre management system is attached. Mistakes if any in the list may also be brought to the notice of this Department.

Subject: Declaration of Holiday on 14th April, 2015- Birthday of Dr. B.R. Ambedkar.

It has been decided to declare Tuesday, the 14th April 2015, as a Closed Holiday on account of the birthday of Dr. B.R. Ambedkar, for all Central Government Offices including Industrial Establishments throughout India.

2. The above holiday is also being notified in exercise of the powers conferred by Section 25 of the Negotiable Instruments Act, 1881 (26 of 1881).

3. All Ministries/Departments of Government of India may bring the above decision to the notice of all concerned.

Fine for harassment of women at workplace

The Supreme Court of India laid down formal guidelines for dealing with sexual harassment at the workplace in the case of Vishakha Vs. State of Rajasthan. The guidelines clearly state that all workplaces should constitute a Complaint Committee to deal with complaints of sexual harassment. Taking forward the Supreme Court guidelines, “Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013” was enacted which came into force with effect from 9th December 2013.

The Act casts a responsibility on every employer to create an environment which is free from sexual harassment. Employers are required to organize workshops and awareness programmes at regular intervals for sensitizing the employees about the provision of this legislation and display notices regarding the constitution of Internal Committee, penal consequences of sexual harassment etc. An employer will be liable to a fine of Rs 50,000/- in case of violation of his duties under the Act and in case of subsequent violations, the amount of fine will be double together with penalty in the form of cancelation of his licence, withdrawal or non-renewal of the registration required for carrying out his activity.

The Ministry of Women and Child Development had issued advisories to States/UTs to ensure effective implementation of the Act. The Ministries/Departments in Government of India have also been advised to ensure the compliance of the Act.

Reimbursement of expenditure on account of acquiring driving license for Motor cars to Dispatch Rider / MTS

Subject: Reimbursement of expenditure on account of acquiring driving license for Motor cars to Dispatch Rider / MTS.

The undersigned is directed to say that a revised Model Recruitment Rules (RRs) for the post of staff car driver has been issued vide this Department OM No. AB-14017/10/2014-Estt (RR) dated 4.7.2014. Accordingly Ministries / Departments have been advised to review the existing rules to bring them in conformity with the model RRs. It may be observed from column 10 of the model RRs that the method of recruitment prescribed for filling up the post of staff car driver (ordinary grade) is “Deputation/absorption failing which by direct recruitment”. With regard to Deputation / Absorption following criteria has been prescribed:-

“From amongst the regular Dispatch Rider (Group C) and Group C employees in Pay Band I Rs. 5200-20200 Grade pay Rs. 1800 in the same Ministry / Department who possess valid Driving License for Motor Cars on the basis of a Driving Test to assess the competence to drive Motor Cars failing which from officials holding the post of Dispatch Rider on regular basis or regular Group C employees in Pay Band 1 Rs. 5200-20200 Grade Pay Rs. 1800 in other Ministries / Department of the Central Government who fulfil the necessary qualifications as mentioned in column 7.”

2. To encourage filling up of the post of Staff Car Driver through the method of Deputation/Absorption of Despatch Rider and Group ‘C’ employees in Pay Band I with Grade Pay of Rs.1800/-, it has been decided to reimburse the expenditure incurred on account of acquiring Driving Licence for Motor Cars to Despatch Riders (DR)/MTS subject to the condition that reimbursement is allowed to only such DRs/MTS who otherwise fulfil the criteria laid down in the RRs for appointment as Staff Car Drivers.

3. This issues with the concurrence of Department of Expenditure vide their OM FTS No. 16056/E.Coord-2015 dated 13th February, 2015.

Digitisation of Government Functioning

National Informatics Centre (NIC) has developed work flow based application software for visitor management at any office known as eVisitor. It is a web based solution hosted at the NIC data centre and can be accessed / adopted by any Government office just by providing necessary master data for on-boarding.

Government has taken initiative to digitize Government files and documents for its easy accessibility. NIC is providing technical support and consultancy on digitization of files and documents to the various Ministries / departments. Government has conceived Mission Mode Project (MMPs) under National e-Governance Plan (NeGP) to improve service delivery system in the Central /State Government Ministries / Departments. The responsibility of provisioning of funds and digitization of file and documents rests with the concerned Ministry/Department/Organization.

NIC has also developed and implemented eOffice application. The eOffice application aims to support governance by ushering in more effective and transparent inter and intra-government processes. eOffice is Mission Mode Project under the National E-Governance Plan.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri Ramesh Chander Kaushik in the Lok Sabha today.
