WHEREAS the President is of the opinion that it is in the public interest to do so;
Now, THEREFORE, in exercise of the powers conferred by clause (i) of rule 56 of the Fundamental Rules, the President hereby retires Sh. Ram Kumar Bhargava (145 FF), Assistant Commissioner of Income Tax with immediate effect from the afternoon of 11 June 2019 on completing 50 years of age and shall be paid a sum equivalent to the amount of his pay and allowances for a period of three months calculated at the same rate at which he was supposed to be drawing them immediately before his retirement.

I am working as Senior Secretarial Assistant at NIMHANS and belongs to SC category. i joined this Institute on 04.07.2008. The next promotional hierarchy is Manager cadre and 04 post were vacant. In the month of December, 2018, departmental examination was conducted with a condition that 03 years of completion as SSA and my name was removed from the LDCE circular, stating that cut-off period to take exam is 30th June 2019 (Considering future 06 months time for completion of 03 years) . Since, my date of joining is after 30th June 2019, they denied granting me examination. Examination was conducted to my batch colleagues and they were granted Manager Promotion, but the effect date was not on their completion of 03 years but from the date of DPC i.e., 19.12.2018.
After examining from the department it was found that as per roster one post should be given to SC category. Now, my query is whether category post can be filled by UR as it is showing backlog or the post should be kept vacant and to be filled by the eligible SC employee.
