LIC Class 1 Officer Wage Revision Gazette Notification 2021 – G.S.R. 268(E) – Dated 15.04.2021

NOTIFICATION
New Delhi, the 15th April, 2021

G.S.R. 268(E).—In exercise of the powers conferred by section 48 of the Life Insurance Corporation Act, 1956 (31 of 1956), the Central Government hereby makes the following rules further to amend the Life Insurance Corporation of India Class I Officers‘ (Revision of Terms and Conditions of Service) Rules, 1985, namely:─

1. (1) These rules may be called the Life Insurance Corporation of India Class I Officers‘ (Revision of Terms and Conditions of Service) Amendment Rules, 2021.

(2) They shall be deemed to have come into force on the 1st day of August, 2017.

(3) These rules shall be applicable to those Class I Officers who were in the whole-time salaried service in the permanent establishment of the Corporation on or after the 1st August, 2017:

Provided that where any Class I Officer gives a notice in writing to the Corporation, within a period as specified by the Corporation, expressing his option to be governed by the provisions of these rules with effect from a date which is not earlier than 1st August, 2017 and not later than the date of publication of this notification in the Official Gazette, then the Corporation may, by order, permit such Officer to be governed by these rules with effect from the said date and no arrears for the period prior to the date so opted shall be payable to such officer:

Provided further that an officer whose resignation had been accepted or whose services had been terminated under rule 39 of Life Insurance Corporation of India (Staff) Rules, 1960 during the period from 1st August, 2017 to the date of publication of this notification in the Official Gazette, shall not be eligible for the arrears on account of revision under these rules.

2. In the Life Insurance Corporation of India, Class I Officers (Revision of Terms and Conditions of Service) Rules, 1985 (hereinafter referred to as the principal rules), for rule 4, the following rule shall be substituted, namely:—

“4. Scales of pay and seniority of Class I Officers.—(1) The scale of pay of the Class I Officers shall be as specified in the table below:—

(2) A separate seniority list shall be maintained in respect of Officers appointed to posts specified in entries (i) and (ii) respectively under various serial numbers in the table in sub -rule (1).”

3. In rule 4A of the principal rules,—

(i) in clause (b), after the words ―maximum of five such additions‖, the words ―and after two years from availing the fifth such addition, he may be granted one further addition to the basic pay equal to the last increment drawn by him in the scale of pay‖ shall be inserted;

(ii) in clause (c), after the words ―maximum of two such additions‖, the words ―and after two years from availing the second such addition, he may be granted one further addition to the basic pay equal to the last increment drawn by him in the scale of pay‖ shall be inserted.

4. In rule 5 of the principal rules,─

(a) for sub-rule (1), the following sub-rule shall be substituted, namely:—

“(1) The scale of dearness allowance applicable to Class I Officers shall be determined as under:—

(a) Index: All India Average Consumer Price Index Number for Industrial Workers.

(b) Base: Index No. 6352 in the series 1960 = 100.

(c) Rate: For every four points in the quarterly average of the All India Consumer Price Index above 6352 points, a Class I Officer shall be paid dearness allowance at the rate of 0.08 % of Pay.

Explanation.- For the purposes of this clause, “Pay” means the basic pay including additions to the basic pay after reaching maximum of the scale as provided under rule 4A of these rules.”;

(b) in sub-rule (2), for the figures and words “4708 points in the sequence of 4708-4712-4716-4720”, the figures and words “6352 points in the sequence of 6352-6356-6360-6364” shall be substituted.

5. In rule 6 of the principal rules, for sub-rule (1), the following sub-rule shall be substituted, namely:—

“(1) The House Rent Allowance applicable to Class I Officers, except those who have been allotted residential accommodation by the Corporation, shall be as specified in the table below:—

Notes: For the purposes of this sub-rule,─

(i) the population figures shall be as per the latest Census report;

(ii) cities shall include their urban agglomerations; and

(iii) “Pay” means basic pay, additions to basic pay under rule 4A and Fixed Personal Allowance under rule 9A.”

6. For rule 7 of the principal rules, the following rule shall be substituted, namely:—

7. City Compensatory Allowance.—The City Compensatory Allowance payable to Class I Officers shall be as specified in the table below:—

7. For rule 7A of the principal rules, the following rule shall be substituted, namely:—

“7A. Hill Allowance.—The scales of Hill Allowance payable to Class I Officers shall be as specified in the table below:—

8. In rule 7B of the principal rules, for the letters and figures “Rs. 500”, the letters and figures “Rs. 710” shall be substituted.

9. In rule 7C of the principal rules, for the letters and figures ―Rs. 1130‖, the letters and figures “Rs. 1,595” shall be substituted.

10. After rule 7F of the principal rules, the following rule shall be inserted, namely:—

“7G. Special Allowance.—(1) The amount of Special Allowance payable to Class I Officers shall be as specified in the table below:—

(2) The allowance under this rule shall be reckoned for the purpose of calculation of dearness allowance but shall not be reckoned for the purposes of Provident Fund, gratuity, House Rent Allowance, pension, encashment of privilege leave and fixation of pay upon promotion.

11. In rule 9B of the principal rules, for the letters and figures ―Rs. 1330‖, the letters and figures “Rs. 1,960” shall be substituted.

12. In rule 9D of the principal rules, for the letters and figures ―Rs 185/-‖, the letters and figures “Rs. 265” shall be substituted.

EXPLANATORY MEMORANDUM

It is certified that no employee of the Life Insurance Corporation of India is likely to be affected adversely by the notification being given retrospective effect.

OFFICE MEMORANDUM

Subject:- Date of next increment under Rule 10 of Central Civil Services (Revised Pay) Rules, 2016 – Clarifications – regarding.

The undersigned is directed to invite attention to this Department’s O.M. of even No. dated 28th November, 2019 on the subject noted above. In the said O.M. dated 28.11.2019, in para ‘7’, the employees who have been regularly promoted or granted financial up-gradation on or after 01.01.2016 and desire to exercise/re-exercise option for pay fixation under FR 22(1)(a)(I) were given an opportunity to exercise or re-exercise of their option for pay fixation within one month of the date of issue of the said O.M. dated 28.11.2019. However, a large number of references have been received in this Department seeking condonation of delay and allowing another opportunity to exercise/re-exercise the option for pay fixation as allowed under O.M, dated 28.11.2019 as the employees have faced time constraint, etc. in exercising their option for pay fixation thereunder.

2. The issue has been examined in this Department and the Competent Authority in partial modification of the conditions enumerated in para ‘7’ of the said O.M. has approved for allowing another opportunity to Government employees to exercise/re-exercise option for pay fixation as allowed under O.M. dated 28.11.2019 within three months from the date of issue of this Office Memorandum. No further request for extension of date or relaxation of condition in exercising of option will be entertained under any circumstances.

3. All other conditions of O.M. dated 28.11.2019 remain unchanged.

4. In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller and Auditor General of India’ .

G.S.R. 267(E).—In exercise of the powers conferred by clause (cc) of sub-section (2) of section 48 of the Life Insurance Corporation Act, 1956 (31 of 1956), the Central Government hereby makes the following rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Life Insurance Corporation of India Class I Officers (Special Allowance for Passing Examinations of Insurance Institute of India) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to whole-time, salaried and confirmed Officers of the Corporation.

3. Special Allowance.—Subject to the conditions specified in rule 4, an officer who passes such examination of the Insurance Institute of India as is set out in column (1) of the Table below, shall be paid Special Allowance as specified against the corresponding entry in column (2) of the said Table:

4. Conditions.-

1. An officer who has passed one or more examinations of Insurance Institute of India prior to promotion as Class I Officer shall be eligible for the allowance for the examination passed while in Class I reduced by the allowance as per above table for the examination passed prior to promotion as Class I officer.

2. An officer who has passed all examinations of Insurance Institute of India prior to promotion as Class I officer shall not be eligible for the said allowance on promotion to Class I.

Provided that such Officer whose pay is fixed at the minimum of the scale on promotion to Class I shall be eligible for half of the allowance specified under rule 3.

Sub: Performance Appraisal Report (PAR) for the year 2020-21 in respect of IDAS officers

As per DoPT OM No. 21011/01/2009-Estt.(A)-Part dated 11/03/2021, the PARs for the year 2020-21 are to be recorded and completed by the timelines prescribed in DoPT OM No. 21011/01/2005-Estt (A)(Pt.II) dated 23/07/2009. Copies of the both OMs are enclosed for ready reference for all concerned. As the due date for generation of PARs is 31/03/2021, the PAR Managers are requested to generate the PARs immediately, if not generated earlier.

2. Strict Adherence of timelines: Timelines for self-appraisal, reporting, reviewing and acceptance are sacrosanct. They cannot be violated by any authority at any stage. The timeframe prescribed by DoPT instructions have been given legal sanctity by several court judgments. Particularly in case of reporting and reviewing, if the same is not done in prescribed timeframe, courts have clearly ruled that APAR would be considered as ‘NRC’ for that year. Therefore, sanctity of timelines is of paramount importance.

3. Force-forwarding of PAR: It has been decided by the competent authority that the PARs, where self-appraisal or assessment i.e. reporting, review or acceptance is not completed by due dates, may be force-forward to the next level by the PAR Manager immediately after due dates. If a PAR is force-forwarded from both the reporting and reviewing authorities, it may be closed at that stage only and need not be sent to the accepting authority.

4. Streamlining of 4-tier PARs: PARs of some officers posted in Ordnance Factory setup are assessed in 4-tier channel as these are reported/ reviewed by two officers/ authorities. At present, there are no separate forms for these PARs and the reporting/ reviewing part is completed manually which may cause delays in the processing. Also, the timelines prescribed by DoPT do not have a provision for 2 reporting/ 2 review. To maintain punctuality in processing of such PARs, the competent authority has defined the timelines as under:

To overcome the delays in manual processing of these PARs, new forms containing separate parts for 2nd reporting/ 2nd review are being incorporated on SPARROW. As incorporation of the forms is still under process, it is requested that the PARs may be generated in existing formats.

5. Online processing of PARs: All the PARs are to be generated online, except for the cases where the officer has been specifically exempted from recording the PAR online. All PARs which are generated online are to be processed online as well except for the parts where the assessing authority is a political authority or is not available on SPARROW. If the PAR manager is unable to locate any officer/authority on SPARROW, the respective assessment stage may be kept as manual and the same should be brought to the notice of this HQrs through email on [email protected] immediately without fail. If a part of a PAR is written manually, the PAR Manager should carefully check the manual part before uploading on SPARROW, especially the integrity column, if applicable.

6. Generation of PARs for the officers posted on deputation: As the PARs of the officers posted on deputation to various Ministries/ Departments (other than those posted in Ministry of Defence, UPSC and OFB) are generated centrally by this office, the officers were requested to provide requisite details for generation of their PARs vide this office email dated 26/03/2021. However, the same is still awaited from some officers. It is again requested to provide details for generation of PAR in the attached format immediately through e-mail on [email protected]. The officers posted on deputation in MoD, UPSC and OFB are also requested to provide their details to the PAR Managers of MoD, UPSC and PCA (Fys) Kolkata respectively.

7. A strict compliance of the above may please be ensured.

2. All the officers & staff of the age of 45 years and above may be advised accordingly to get themselves vaccinated to effectively contain the spread of COVID-19. They may also be advised to strictly follow the guidelines issued from time to time on preventive measures to contain the spread of COVID-19 and to follow covid-appropriate behavior, even after vaccination, by frequent washing of hands/ sanitization, wearing a mask/ face cover and observing social distancing etc.

3. The official meetings/ conferences, whenever required to be convened, may be conducted through Video Conferencing.

Sub: Reiteration of guidelines issued in view of COVID-19 – regarding

In view of the Corona Virus Disease(COV1D-19) , all out efforts are made by the Government to contain its impact by instituting measures at community as well as at individual level.

2. In this regard the undersigned is directed to draw attention to the various Office Memoranda and circulars issued in this regard and to state that in view of the resurgence of COVID-19 cases it has been decided to reiterate the guidelines issued from time to time to the Additional Directors and Staff and for extending healthcare services to the beneficiaries for urgent and strict compliance and for necessary action.

3. Copies of the relevant orders are enclosed.

Sub: Modifications in the rates of Risk Allowance in consonance with the DOP&T’s orders dated 03.11.2020 under 7th CPC.

Ref: Board’s letter No. E(P&A)I-2017/SP-1/AD-1 dated 01.03.2018 (RBE No.32/2018)

Attention is invited to Railway Board’s letter under reference vide which the rate of Risk Allowance was revised from ₹ 60 per month to ₹ 135 per month w.e.f. 01.07.2017 in terms of Ministry of Finance (Department of Expenditure)’s resolution No. 11-1/2016-IC dated 06.07.2017 conveying Government’s decision on 7th CPC’s recommendations. It was also mentioned in para 4 of the said letter that any modification/changes would be issued, if any instructions which are at variance from these, are received from the nodal Ministry/Department i.e. DOP&T.

2. DOP&T’s orders have been received in terms of their OM No. A-27018/01/2017-Estt.(AL) dated 03.11.2020. In accordance with the provisions thereof, the matter has been considered by the Board and the following has been decided:-

i. The revised rate of Risk. Allowance under the 7th CPC will be admissible w.e.f. 03.11.2020.

ii. Risk Allowance will be payable @ ₹ 90/- per month w.e.f. 03.11.2020 onwards.

iii . Payment of Risk Allowance for the period from 01.07.2017 to 02.11.2020 would be at the 6th CPC rate i.e. @ ₹ 60/- per month.

iv All the Railways/PUs should recover the difference of Risk Allowance @Rs.75 pm (Rs.135-Rs.60) i.e., excess of Risk allowance paid per month from 1.7.2017 to 2.11.2020 and @ Rs.45 pm (Rs.135-Rs.90) i.e., excess of Risk allowance paid per month from 3.11.2020 to the date of recovery.

3. The categories/staff engaged in the jobs who are eligible for grant of Risk Allowance is annexed with this letter.

4. The categories who are in receipt of HPCA/PCA are not eligible for grant of Risk Allowance.

5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Ref : Board’s letter of even number No. dated 12.05.2020 & 07.08.2020.

Reference Board’s letter of even No. dated 07.08.2020, vide which Railways were advised that the unimplemented periodical transfer orders of the staff working on sensitive posts be reviewed and pended till 31.03.2021 due to the extra ordinary situation created by the pandemic COVID-19.

2. In view of the ongoing pandemic situation, on request from both the Federations i.e. AIRF & NFIR, the matter has been further reviewed by the Board, and it has been decided by the Competent Authority that the periodical transfer orders of the staff working on sensitive posts be pended till 30th June, 2021.

The details of batch of the officers belonging to the Indian Administrative Service who have been posted at the Centre in various grades of PB-3 and PB-4 was last circulated in this Department OM of even No. dated 13-11-2020.
