Sub :- Waiver of recovery of wrongful/excess payments made to retired Government servants – regarding

The undersigned is directed to say that Hon’ble Supreme Court in the case of State of Punjab and Others Vs. Rafiq Masih (White Washer), etc. in C.A. No. 11527 of 2014 summarised a few situations wherein recoveries by the employers would be impermissible in law. One of these situations relates to recovery from retired employees or employees who are due to retire within one year of the order of recovery.

2. Based on the above judgment, Department of Personnel & Training has issued instructions vide their OM No. 18/03/2015-Esst. (Pay-l) dated 02.03.2016 that the issue of wrongful/excess payment made to Government servants may be dealt with in accordance with the decision of the Hon’ble Supreme Court in the above mentioned case. The instructions further provide that wherever the waiver of recovery in the situations mentioned in that OM is considered, the same may be allowed with the express approval of Department of Expenditure in terms of DoPT’s OM No. 18/26/2014-Estt (Pay-l) dated 06.02.2014.

3. In order to examine the matter in its entirety, all Ministries/ Departments and Pension Disbursing Banks are requested to provide the following information regarding excess payment of pension and other retirement benefits to the retired Government employees:

1. No. of retired employees from whom recovery of excess payment of pension and other retirement benefits has been made or is sought to be made by the Ministry/Department as well as its attached offices and subordinate offices.

2. No. of pensioners from whom recovery of excess payment of pension and other retirement benefits has been made or is sought to be made by the Pension Disbursing Bank.

3. Period of excess payment in each case and the date on which excess payment was noticed.

4. Amount of excess payment in each case.

5. Whether any court/CAT order has been received for waiver of recovery of excess payment in the light of the judgement of Hon’ble Supreme Court in Rafiq Masih’s case. If so, the details of such cases received in last three years (year-wise) and action taken on the order of court/CAT may be indicated

6. Whether any representation has been received for waiver of excess payment. If so the details of such representations received in last three years (year-wise) and action taken on the representations may be indicated.

4. All the Ministries/Departments are, therefore, requested to furnish the information sought in para 3 above to this Department by 15.09.2020 positively.

Please take cognizance of this office circular cited under reference. Grievances are being received from PDAs regarding applicability of ibid circular to similar rank NCC Whole Time Officers (Male) pensioners who were from Navy and Air force.

2. Matter has been reviewed in view of GOI, Ministry of Defence vide letter 8/23/2018-D(GS-VI) dt.19.09.2019 and it is clarified that circular No.C-203 dt.25.09.2019 is also applicable to equivalent rank of Air Force and Navy NCC Officers.

3. The equivalent rank of Army NCC officers, Air Force and Navy NCC Officers with their Guaranteed Pension & family pension wef 0.01.2006 is tabulated below:

Subject : Facility for Central Government Civil pensioners to store Electronic PPO in Digi Locker – regd.

1. It has come to the notice of this Department, that several Pensioners, over a period of time, misplace the original copies of their Pension Payment Order (PPO) which, needless to say, is a very important original document. In the absence of their PPO, these pensioners have to face innumerable hardship at various stages of their retired life. For newly retiring officials, in view of the widespread Covid-19 pandemic, it is a dilemma to physically receive hard copies of the PPO.

2. Accordingly, the Department of Pension & Pensioners’ Welfare (DoPPW) has decided to integrate the electronic Pension Payment Order (e-PPO) generated through Public Financial Management System (PFMS) application of CGA(Controller General of Accounts) with Digi Locker, in order to enhance Ease of Living of Central Government Civil Pensioners. This system will enable any Pensioner to obtain an instant copy/print-out of the latest copy of his PPO from his Digi Locker account. This initiative will create a permanent record of his PPO in his Digi Locker and at the same time eliminate delays in reaching the PPO to new pensioners, as well as the necessity of handing over a physical copy.

3. This facility has been created within ‘Bhavishya’ software, which is a single window platform for Pensioners, right from the start of their Pension processing, till the end of the process. “Bhavishya” shall now provide an option to the retiring employees, to link their Digi-locker account with their “Bhavishya” account and obtain their e-PPO in a seamless manner.

4. The following steps are required to store e-PPO in Digi Locker:

  • Bhavishya” provides option to retiring employees for linking their Digi-locker account with “Bhavishya” to get e-PPO.
  • Above option is available to the retiree at the time of filling of retirement forms, as well as after submission of the forms
  • Retiree will sign into their Digi-locker account from Bhavishya and authorize Bhavishya to. PUSH the e-PPO to Digi Locker.
  • As soon as e-PPO is issued, it is automatically PUSHED into corresponding Digi locker account and the retiree is informed about the same through SMS and Email by Bhavishya.
  • To view/download the e-PPO, retiree has to log into the Digi Locker account and simply click on the link.

5. The Administrative Divisions of all Ministries/Department and attached/subordinate offices are requested to bring these instructions to the notice of all concerned for compliance.

6. This issues with the approval of the Secretary (Pension & Pensioners’ Welfare).

Subject :- Pay revision of Board level and below Board level Executives and Non-Unionised Supervisors of Central Public Sector Enterprises(CPSEs) w.e.f. 01.01.2017- Review of the Profitability- regarding.

The undersigned is directed to refer DPE’s OM No W-02/0028/2017- DPE(WC)- GL-XIII/17 dated 03.08.2017 on the subject cited above. Para 3(iv) of the said OM, inter-alia, stipulates that “Subsequent to implementation of pay revision, the profitability of a CPSE would be reviewed after every 3 years and (b) If the profitability of a CPSE falls in such a way that the earlier pay revision now entails impact of more than 20% of average PBT of last 3 years, then PRP/ allowances will have to be reduced to bring down impact.”

2. Further, as per para 18 of the said DPE OM dated 03.08.2017 “Presidential directives would be issued by the administrative Ministry concerned based on the result of review which is to be done after every 3 years”

3. Accordingly, all administrative Ministries/ Department are requested to take necessary action to review the profitability of CPSEs under their administrative control in the light of provisions stipulated in the above mentioned DPE’s OM dated 03.08.2017.

Sub:- Implementation of Tele Consultation in CGHS Delhi.

With the objective of facilitating CGHS beneficiaries Tele Consultation services have been started in CGHS Delhi w.e.f. 25th August, 2020.The timings for Tele­ Consultation are from 9 am to 12 noon daily. To begin with Tele Consultation facility will be available for following facilities :

1. Medicine
2. Orthopaedics
3. Eye
4. ENT

The facility may be considered for other specialities subsequently. The beneficiaries can avail the facility by logging into eSanjeevani application of Ministry of Health and Family Welfare through their mobile number.

The flowchart and description on steps to be followed for availing the facility on eSanjeevani Application are attached as annexure.

A. Registration:

iii. Fills Patient Registration Form
iv. Select Specialty OPD
v. User uploads scanned copy of his/her CGHS card under documents(Mandatory).
vi. eSanjeevaniOPD assigns a Patient ID

B. Token:

i. User requests a token for consultation
ii. Uploads health records, if any
iii. User receives Patient ID & Token through SMS

C. Login:

i. Closer to the turn eSanjeevani OPD sends an SMS notification asking user to login
ii. User logs in using Patient ID
iii. Patient enters the clinic and is placed at the end of the existing queue. If there is no queue you will be placed at serial no. 1

D. Wait:

i. eSanjeevaniOPD assigns a doctor to the patient (time interval depends on the length of the queue)
ii. As the doctor is assigned to the patient “CALL NOW” button gets activated
iii. User is required to click “CALL NOW” button within 120 seconds*
iv. Upon clicking “CALL NOW” within 10 seconds the doctor shows up in video

E. Consultation:

i. Patient consults the doctor
ii. During the consultation doctor has an access to the patient’s
health records (if uploaded at v)

F. ePrescription:

i. During the consultation, doctor prepares an electronic prescription (ePrescription)
ii. At the end of the consultation doctor sends the ePrescription and closes the call
iii. e Prescription shows up on patient’s end.
iv. Patient logs out after saving/printing the received ePrescription
v. After the call eSanjeevaniOPD sends SMS notification to the patient with a link to download ePrescription

NFIR has raised the issue that due to total Lock down on account of Covid-19 pandemic, the staff promotions have been delayed on Zonal Railways etc., although vacancies existed and Staff entitled for promotion against vacancies. It has been stated that some employees entitled for promotion to higher pay levels have retired on Superannuation in March and April, 2020, which has deprived them of status, financial and retiral benefits.

The Federation has requested that keeping in view that the legitimate promotions to staff should not be denied or delayed even in extraordinary situations arisen as a result of Covid-19, all such staff may be granted promotion with retrospective effect.

The matter has been considered by the Board, while it may not be a practical solution to offer promotion with retrospective effect, Zonal Railways have been requested that the selection Process may be expedited to the extent feasible, taking any special measures during the lockdown etc.

Subject : Grants-in-aid for the year 2020-2021 to the Central Government Employees Residents Welfare Associations- Submission of Accounts for the year 2019-2020 – regarding.

Sir/Madam,

The Department of Personnel & Training has been sanctioning Grants-in-aid to the eligible recognized Residents Welfare Associations formed by the Central Government employees in residential colonies to enable them to meet a part of their expenditure on the welfare activities, programmes during the financial year. The recognized Central Government employees Residents Welfare Associations eligible to receive grants-in-aid may send a request to this effect to this Department in the prescribed Performa. (copy enclosed)

2. The recognized Central Government Employees Residents Welfare Associations are requested to send their request keeping in view the following guidelines:-

a. Central Government employees and employees of Lok Sabha, Rajya Sabha, Supreme Court, High Court, UPSC, Statutory and Autonomous bodies and Delhi Administration shall qualify for regular membership of an Association in respect of the grants-in-aid from the Department of Personnel & Training subject to fulfillment of conditions as laid in para (b) to (h) of clause 11 (2) of the G.M. No. 5/8/2013-Welfare dated 3rd June, 2014.

b. Grants-in-aid admissible will be subject to an upper ceiling of Rs.10,000/- during a financial year.

c. Consolidated accounts for the previous financial year may be provided in Annexure `A’ signed by the President, Secretary, Treasurer and Internal Auditor.

d. A complete list of the members showing their names, residential address, official designation and address as on 31.03.2020 may be submitted as in Annexure

e. All the vouchers relating to each head of expenditure as appearing in Annexure ‘A’ should be maintained by the Association, so as to verify the expenditure as and when needed.

f. The Stock Register maintained by the Association as audited and certified by the Internal Auditor after physical verification should be maintained by the Association. The Department of Personnel & Training may verify the Stock Register as and when required. Similarly, the inventory of articles should also be maintained.

g. A copy of the minutes of the General Body meeting wherein the accounts of the Association and other activities thereof for the previous year have been approved may be submitted (Annexure ‘K’).

h. Utilization Certificate in respect of the grants-in-aid provided by this Department and information regarding assets acquired wholly or substantially funded from the grant may also be furnished as per proforma in Annexure ‘F’ and G’ respectively. The Association who have not received grants-in-aid for the year 2018-19 and 2019-20 may submit Utilization Certificate for the previous year. However, the newly formed Associations need to submit Utilization Certificate indicating ‘Nil’ along with the Accounts for the year 2019-20.

i. A report on the activities of the Association with reference to the Annual Action Plan as provided in Clause 7 of the Rules and Regulations framed under the Model Constitution may also be provided (Annexure `J’).

j. A certificate regarding expenditure on Swachh Bharat Mission may also be provided (Annexure `L’).

3. It may be noted that even if the Association is not keen to obtain further grants-in-aid from the Government, it shall have to render full and satisfactory accounts of the grants taken in the past. In case any Association fails to get grants-in-aid for any reason for two consecutive years, such Association will stand derecognized.

4. CGERW As are requested to send their request complete in all respect, in the prescribed proformae, to DoPT by 15.10.2020 for further necessary action in the matter.

Note: Incomplete Accounts for the year 2019-20, for receiving the grants-in-aid for the year 2020-21, will not be entertained by this Department.
