I am directed to say that Central Board of Direct Taxes, Department of Revenue, Ministry of Finance has issued a press release dated 13.05.2020 (Copy enclosed) as “In order to provide more funds at the disposal of the taxpayers for dealing with the economic situation arising out of COVID-19 pandemic, the rates of Tax Deduction at Source(TDS) for the following non-salaried specified payments made to residents has been reduced by 25% for the period from 14th May, 2020 to 31st March, 2021”.

Accordingly revised rates of TDS in respect of POSB schemes are as under:-

Sub : Rotational Transfer Policy (RTP) applicable to CSSS officers – Modification thereof – regarding

The undersigned is directed to refer to this Department OM No. 25/28/2014-CS-II (A) dated 22.07.2015 vide which the Rotational Transfer Policy applicable to CSSS officers was circulated.

2. The competent authority has now approved the following modifications/additions in the aforementioned Rotational Transfer Policy dated 22.07.2015 as given below:

(i) Para No. 11 (officers returning from deputation/long leave/long term training etc.) of the existing RTP guidelines is modified and replaced as under:

An officer returning from deputation, long leave long term training will be posted to any Ministry/Department based on the Administrative exigencies, with the approval of the Competent Authority. In such cases this posting will be treated as a fresh tenure. In case it is decided that an officer is to be posted back to the same Ministry/Department he last served, then his tenure will be limited to the balance period of the tenure prescribed for the grade subject to the availability of the vacancy and subject to the condition that at least one year balance tenure is left.

(ii) Para No. 13 (Preference for posting) Two new sub-paras are added after para 13(f) as below:-

(g) The transferring out of Officers working in Establishment Office, DoP&T will be done only with the concurrence of Establishment Officer (ED). The DoP&T Administration will consult the ED and maintain a list of such officers, ready to be sent to CS Division as and when RTP exercise is taken up

(h) Any officer who is not clear from vigilance angle and who may/may not be due for transfer under RTP may be transferred out in case a report is received from the concerned Ministry/Department. Such an Officer will be posted to a non-sensitive post in any Ministry/Department without seeking his option for posting irrespective of the tenure of his posting in that Ministry/ Department. No preference will be sought from such officer.

Sub: Cashless Investigation for Diagnostic Tests from Private Centres/ Labs recognized by Railways.

In order to improve the Health Care System and to align with CGHS system, Board (FC & CRB) have approved the following:

1. Cashless investigation of Railway Medical Beneficiary (serving or retired employees and their medical beneficiaries) for Diagnostic Tests as per prescribed CGHS tests and CGHS rates from Private Centres/Labs recognized by Railways.

2. Cashless investigation for Diagnostic Tests from Private Centres/ Labs Recognized by Railways may be allowed with following documents and no further additional referral is needed:

2.1. Original or sci f attested copy of prescription of Railway Doctor.
2.2. Copy of UMID Card/RELHS Card/Medical Card of the patient and main card holder.

3. The Private Centres/Labs will produce the bills to the authority as being done in referral cases and the amount will be paid as per CGHS rates.

4. To remove any ambiguity, Zonal Railways may prepare a procedure order for smooth implementation and clearance of the bills. The same will be prepared by PCMD & PFA and approved by General Manager.

5. Other extant instructions/guidelines issued from Board on the subject shall remain unchanged or as modified from time to time.

This issues with the concurrence of Associate Finance of Railway Board.

Entry Pay benefit on upgradation under ACP Scheme – BPMS Letter

Subject: Entry Pay benefit on upgradation under ACP Scheme.

Respected Sir,

With due regards, it is submitted that Assured Career Progression Scheme was introduced vide DoP&T O.M. No. 35034/1/97-Estt.(D) dated 09.08.1999 for Central Govt Employees whereby the benefit of two assured financial upgradations was granted to the employees.

Pay fixation method on upgradation under ACP Scheme as described under rule 9 of Annexure-1 of above letter is as under-

“9. On upgradation under the ACP Scheme, pay of an employee shall be fixed under the provisions of FR 22(1)a(1) subject to a minimum financial benefit of Rs 100/- as per the DoP&T O.M. No. 1/6/97- Pay I dated 05th July 1999.”

The above paragraph clearly establishes that Pay fixation in both cases viz Promotion and financial upgradation under ACP Scheme, is to be done by applying same methodology/ rule.

Further, Rule 8 of CCS (RP) Rules, 2008 stipulates that section II of Part A of the First Schedule of these Rules indicates the entry level pay in the pay band at which the pay of direct recruits to a particular post carrying a specific grade pay will be fixed on or after 01.01.2006.

But the above fixational benefit was not extended to promoted employees on the same post whereas there was a provision of Direct Recruitment in relevant rules. This discrimination agitated the promoted employees and the matter was referred to higher authorities/ forums.

Hence, vide letter No. 8-23/2017-E.IIIA dated 28th Sep, 2018 of Department of Expenditure, Min of Finance, the benefit of Entry Pay was extended in 6th CPC scales to the under mentioned extent

With respect to those posts where entry pay for direct recruits appointed on or after 01.01.2006, as per Section II of Part A of the First Schedule of CCS(RP) Rules, 2008, becomes applicable by virtue of the provision of the element of direct recruitment in the relevant recruitment rules, the pay of Central government employees who were appointed to such posts prior to 01.01.2006 turns out to be lower than the entry pay w.e.f 01.01.2006. Likewise, the pay of Central Government employees who were appointed to such posts by way of promotion on or after 01.01.2006 and whose pay, as fixed under Rule 13 of CCS(RP) Rules, 2008, happens to be lower than the said entry pay, shall also not be less than such entry pay from date of their promotion taking place on or after 01.01.2006.

[In the nutshell, Entry Pay benefit on promotion will be available for those post wherein the provision of DR exists]

After issuance of above order, the matter with respect to Industrial Employees of Ordnance Factories for extension of benefit of Entry Pay was raised and CGDA allowed the benefit in favour of them on the basis of DR clause in the relevant recruitment rules.

Thus, Employees got the benefit of Entry Pay on Promotion but in case of upgradation under ACP till 31.08.2008, parity was not maintained. Though Promotion and upgradation under ACP, both have same methodology of Pay Fixation, upgradation under ACP still lacks equal treatment. Industrial Employees who have got upgradation under ACP from 01.01.2006 to 31.08.2008 have been waiting for their turn of getting the above benefit.

The above matter was raised in 26th Ordinary meeting of OFB JCM –III Level Council (11th Term) held on 22.02.2020 and minutes was circulated vide letter No. 20/15/26(11)/IR dt 19.05.2020. In turn, OFB replied that there is no such Govt. instruction.

Therefore, you are requested to examine the matter and issue necessary instructions in this regard with consultation of DoP&T and Min of Fianance.

UPSC Civil Services (Preliminary) and IFS Examination 2020 – Candidates allowed to change Centers

UPSC CIVIL SERVICES (PRELIMINARY) EXAMINATION, 2020 AND INDIAN FOREST SERVICE EXAMINATION, 2020

NOTICE FOR THE CANDIDATES TO SUBMIT CHOICE OF CENTRE

The Union Public Service Commission will be conducting the Civil Services (Preliminary) Examination, 2020 [including the Indian Forest Service (Preliminary) Examination, 2020] on 04.10.2020 (Sunday) all over India as per the Revised Programme of Examinations/RTs published on 05.06.2020.

Keeping in view the large number of candidates of the Civil Services (Preliminary) Examination, 2020 [including the Indian Forest Service (Preliminary) Examination, 2020] and requests received from the candidates for changing their Centers, the Commission has decided to give an opportunity to them to submit their revised choice of Centre. Besides above, the option to change the Centers for the Civil Services (Main) Examination, 2020 and the Indian Forest Service (Main) Examination, 2020 is also being made available to the candidates. The requests of the candidates for change in their Centers will be considered against the additional/enhanced capacity intimated by the Centers for accommodating the additional candidates.

The window of submitting the revised choice of Centers by the candidates will be operational in two phases i.e. 7th-13th July, 2020 (06.00 PM) and 20th-24th July, 2020 (06.00 PM) on the Commission’s website https://upsconline.nic.in. The candidates are advised to visit the website and submit their choices of Centers of the above Examination, if required.

The candidates may please note that their requests for change in the Centers will be considered based on the principle of “first-apply-first allot” basis [which is followed in all the Examinations of the Commission and was mentioned in the Examination Notices of the Civil Services (Preliminary) Examination, 2020 and Indian Forest Service Examination, 2020] and once the capacity of a

particular Centre is attained, the same will be frozen. The candidates, who cannot get a Centre of their choice due to ceiling, will be required to choose a Centre from the remaining ones.

All the conditions and eligibility mentioned in the EXAMINATION NOTICE NO. 05/2020-CSP DATE: 12/02/2020 of the Civil Services (Preliminary) Examination, 2020 and the EXAMINATION NOTICE NO. 06/2020-IFoS DATE 12/02/2020 of the Indian Forest Service Examination, 2020 will remain unchanged.

In addition to the above, the Commission will also make a Withdrawal Window available to the candidates on the Commission’s website https://upsconline.nic.in during the period from 1st-8th August, 2020. All the terms and conditions of the withdrawal of application will be the same as have been mentioned in the EXAMINATION NOTICE NO. 05/2020-CSP DATE: 12/02/2020 of the Civil Services (Preliminary) Examination and the EXAMINATION NOTICE NO. 06/2020-IFoS DATE 12/02/2020 of the Indian Forest Service Examination, 2020. Candidates must note that once the application has been withdrawn by the candidate, it cannot be revived in future under any circumstances.

Subject : Revision of flat rate of licence fee for General Pool Residential Accommodation (GPRA) throughout the country.

In terms of the provisions of the Rule 74 of the “Central Government General Pool Residential Accommodation Rules. 2017”, the Government has decided to revise the flat rates of licence fee recoverable for the residential accommodation available in General Pool and also in Departmental Pools of Ministries/Departments of the Government of India throughout the Country (except in respect of substandard/unclassified accommodation of Ministry of Defence, accommodation for service personnel of the Ministry of Defence and accommodation under the control of Ministry of Railways), as shown in the Annexure.

2. The revised rates of licence fee would be effective from 1st July, 2020. All Ministries/Departments are requested to take action to recover the revised licence fee in accordance with these orders in respect of accommodation under their control all over the country.

3. This issues with the concurrence of Integrated Finance Wing of the Ministry of Housing and Urban Affairs vide their note dated 15-6-2020.

REVISION OF RATES FOR RT PCR TEST FOR COVID 19

1. Please ref the fwg :-

2. In view of the current Corona virus Disease(COVID-19) Pandemic, all out efforts are made by the Government to contain its impact by instituting measures at community as well as at individual level.

3. The matter has been reviewed and it is now decided in supersession of the earlier orders that the CGHS rate for RT-PCR test for COVID-19 shall be as per the rate prescribed by I.C.M.R, or the rate prescribed for the State by the concerned State Government or actual, whichever may be lower.

4. The Private hospitals /Laboratories empanelled under ECHS and approved for undertaking the test shall perform the investigation after the same has been advised as per the prevalent ICMR protocols by any Specialists of Government Hospital/centre /Private empanelled hospitals / Medical Officer of ECHS/Service hospitals.

5. In this regard ECHS beneficiaries are advised to download ‘Aarogya Setu’ App on their mobile Phones and self-assess themselves by uploading their health status on the mobile application. If the ECHS beneficiary is unwell or shows any symptoms of COVID-19 i.e., Fever, Cough or, Breathlessness, etc, – he/she may contact any service/government Hospital/Medical Officer of ECHS PC/Private empanelled hospital and advised RT-PCR test for COVID-19 as per the prevalent ICMR protocols, the same may be undertaken from any Government/approved centre empanelled under ECHS.

6. ECHS empanelled centers shall perform the test on cashless basis in respect of ECHS beneficiaries and submit the bills to ECHS through UTI-ITSL. The reimbursement for the cost of expenditure on the test at approved rate shall be reimbursed by concerned RC.

7. The other terms and conditions given in letter mentioned at para 1 above remain unchanged.

DECISION OF THE NATIONAL SECRETARIAT MEETING HELD ON 28.06.2020

The National Secretariat Meeting of Confederation of Central Government Employees & Workers was held on 28.06.2020 through Video Conference. Com. Ravindran B. Nair presided. About 21 office bearers attended. Senior leaders Com. K. K. N. Kutty and M. Krishnan were present.

Before Commencement of the meeting, one minutes silence was observed paying homage to the Jawans who were martyred on the India-China border and also to the departed leaders.

Com. R. N. Parashar, Secretary General, presented a brief report on the agenda items and also about the activities taken place during the period after the Nagpur national Conference. Thereafter the agenda items were taken for discussion. Detailed discussion took place on all agenda items. Many other issues faced by the Central Government Employees, especially COVID-19 related issues, were also discussed.

The following decisions are taken.

1. Review of the 26th National Conference held at Nagpur

The Conference was well organised and the arrangements made were excellent. About 36 affiliates and 13 state level COCs attended. 213 delegates and 13 visitors attended (Male – 238, Female-18). The Conference was jointly inaugurated by Com. Tapan Sen (General Secretary, CITU) and Com. Amarjeet Kaur (General Secretary, AITUC). The National Secretariat congratulated the COC, Vidarbha Region, Nagpur under the leadership of Com. Nilesh D. Nasare, for making best arrangements for the successful conducting of the meeting.

2. Setting up of a committee for finalisation of Accounts for the period from 2016 to 2019.

Secretary General reported that the Accounts for the period from 2016 April to 2019 March could not be presented in the national Conference, as the then Financial Secretary, Com. Vrigu Bhattacharjee, had not attended the Conference. Com. Vrigu Bhattacharjee has emailed the Receipt and Expenditute statements for the period from 2016 to 2019 to the then President. Com. K. K. N. Kutty on 7th February 2020. As it was not signed by the Financial Secretary nor it was audited, the Conference decided to appoint a committee of incoming office bearers and outgoing President and Secretary General. The Conference further decided that after finalisation of the accounts, it should be audited by the internal auditor of Confederation and presented before the National Council for adoption. Com. R. N. Parashar, Secretary General, reported that he had written to Com. Vrigu Bhattacharjee, Ex-Financial Secretary to hand over the accounts alongwith all connected documents to him. But no reply was received. He has also contacted Com Vrigu Bhattacharjee over phone and requested to hand over the accounts. But, Com. Vrigu Bhattachajee was reluctant to hand over the accounts to the newly elected Secretary General. The issue was discussed at length in the National Secretariat and following decisions are taken.

(a) Secretary General, Confederation, shall write another letter to Com. Vrigu Bhattacharjee, Ex-Financial Secretary, to handover the accounts from the period from April 2016 to January 2020 along with all connected records, citing the decision of the national Secretariat held on 28.06.2020.

(b) If Com. Vrigu Bhatacharjee, Ex-Financial Secretary, still refuse to handover the Accounts to the Secretary General, then the Secretary General Shall circulate the skeleton of Accounts sent by Com. Vrigu Bhattacharjee to Ex-President on 07.02.2020, which is not signed by the Financial Secretary nor it is audited, to all National Executive Committee members to verify whether there is any discrepancies in the accounts. After getting reply from national Executive Committee members, the accounts will be finalised by a Committee of following office bearers, for presentation in the next National Executive Committee meeting to be convened by Video Conference.

The National Secretariat decided that after completing the above formalities, the Accounts should be presented before the National Executive Committee meeting by not later than 15.08.2020.

3. Financial review and strengthening of funds position

After detailed discussion it is decided that the Secretary General and Financial Secretary shall issue notice to all affiliates and COCs directing them to remit up to date quota and to clear all arrears of quota and dues within one month. The Financial position will be further reviewed in the next national Executive meeting to be held before 15.08.2020.

5. Charter of demands of Confederation.

Both the above agenda items were discussed together. It is decided that protest programmes should be organised, exclusively on Central Govt. Employees demands, by Confederation. In the revised Charter of demands adopted by the Nagpur National Conference, the following demands are to be added.

(a) Withdraw the orders, freezing the DA and impounding of arrears of Central Govt. Employees & Pensioners till June 30th 2021.
(b) Stop the unjustified increasing of prices of Petrol and diesel. Reduce the price by reducing the excise duty by Central Government.
(c) Settle all COVID-19 related issues pertaining to the Central Govt. Employees (detailed note will be attached). Treat the period of absence during lockdown as duty. Grant wages to casual, part-time, contingent and contract workers including daily-rated mazdoors, during the lock-down period. (It is reported that in Tamilandu Postal Circle no wages are paid during lockdown period to Casual/Contract workers inspite of Finance Ministry & DOP orders.)

Secretary General and President is authorised to re-draft the Charter of demands and Circulate among all National Secretariat member for approval before publishing in website. The date of the protest programme is to be decided by President and Secretary General, preferably in the 3rd or 4th Week of July 2020. Next phase of programme will be decided by the National Executive Committee meeting to be held before 15.08.2020.

6. Organizational Review

The National Secretariat felt that the disruptive activities initiated by the Ex-Financial Secretary has not affected the overall functioning of Confederation. Efforts are to be made to sort out the issues and to bring back the misguided comrades and to further strengthen the functioning of all affiliated organisations and COCs. It is decided that indiscipline and anti-organisational activities from any corner should not be compromised or tolerated.

7. Date of next National Executive Committee meeting

The meeting authorised President and Secretary General to fix and notify the date of next National Executive meeting by not later than 15.08.2020.

8. Central Trade Unions Programme on 03.07.2020

The meeting decided to organise the protest programme against the anti-people and anti-worker policies of the Central Government at all important Centres on 03.07.2020. The Central TUs has included the DA freeze and impounding of arrears as one of the main demands. All affiliates and COCs are requested to ensure participation of Central Govt. Employees in the joint protest programmes of Central Trade Unions.

9. It is decided to prepare a detailed note on the present situation and the issues faced by the Central Govt. Employees for wide circulation among Central Govt. Employees through Websites and Social media. Com. K. K. N. Kutty, Vice President will prepare the draft.
