CIRCULAR

Subject : Obtaining of Life Certificate by Banks from the doorstep of the pensioners

The undersigned is directed to say that instructions have been issued from time to time. for submission of Life Certificate by pensioners, in the month of November every year Attention is also drawn to the following circulars, meant to facilitate submission of Life Certificate by Pensioners and ensure Ease of Living for them:

i. CPAO/Tech/Grievances/2010-11/531, dated 30.06.2011, issued by Central Pension Accounting Office. New Delhi, which provides for exemption from personal appearance by Pensioners submitting Life Certificate. if the prescribed form in Annexure-XVII of Para 15.2(i) of Scheme Booklet, is signed by certain specified authorities.

ii. CPAO/Tech/Life Certificate/2014-15/31-32, dated 30.01.2015, issued by Central Pension Accounting Office, New Delhi, which highlights the Digital Life Certificate mode of submission as part of Prime Minister’s “Digital India” scheme.

iii. RBI/2014-15/587, dated 07.05.2015, issued by the Reserve Bank of India, prescribing mandatory issue of acknowledgement to Pensioners on submission of Life Certificates and promoting the use of Digital Life Certificates among Pensioners, which would eliminate the need for their physical presence at branches.

iv. RBI/2017-18/89, dated 09.11.2017, issued by Reserve Bank of India, directing Banks for enabling Ease of submitting Life Certificate, whereby a Pensioner can submit Life Certificate in any branch of the pension paying Bank and the same is uploaded promptly in CBS by the receiving branch itself. It also directs all Banks to ensure Door-step submission of Life Certificate facility, along with Banking facility to all senior citizens of more than 70 years of age and differently abled or infirm persons, including pick up of cash and delivery of cash against withdrawal.

v. OM No. 1/20/2016-P&PW(E), dated 14.11.2017, issued by Department of Pension & Pensioners’ Welfare, which re-iterates RBI’s concern w.r.t. old/infirm pensioners, for whom Banks should make concrete efforts to provide the facility of obtaining Life Certificate from their premises/residence and exempt personal appearance.

vi. OM No. 1/20/2018-P&PW (E), dated 18.07.2019, issued by Department of Pension & Pensioners’ Welfare, which prescribes that pensioners aged 80 years and above may be allowed to give their Life Certificate w.e.f. 1st October every year, which would be valid till 30th November of the subsequent year, in order to provide Senior pensioners with an exclusive window at Banks, for the activity and avoid the general rush.

(2) In spite of detailed instructions, as brought out above, it has been observed that a large number of pensioners (around 8-10 percent) are unable to submit their Life Certificate by the stipulated date, i.e. 30th November every year on account of various reasons. The pension disbursing authorities/banks are constrained to discontinue disbursement of their monthly pension, in such cases, due to non-submission of the Life Certificate. Such pensioners face a lot of difficulty in re-commencement of their pension.

(3) In order to promote Ease of Living for Pensioners and minimize the cases of non submission of Life Certificate by the pensioners and ensure uninterrupted disburse. Pension to them, in addition to the instructions contained in Para 1 above, the following Instructions are hereby issued for strict compliance –

i. All Pension disbursing banks shall send SMSs/E-mails to the pensioners on 24th October, 1st November, 15th November and 25th November, every year reminding them to submit their Annual Life Certificate by the stipulated date, i.e. 30th November.

ii. All Pension disbursing banks shall make an exception list. as on 1st December every year, of those pensioners who fail to submit their Life Certificate by 30th November and send SMS/E-mail to the pensioners included in the aforesaid exception list advising them to submit the Life Certificate at the earliest to avoid discontinuation of their pension. The Bank shall also ask such pensioners, through SMS/E-mail. as to whether they are interested in submission of Life Certificate through a doorstep visit by the bank. Wherever a call centre /App based facility is available, Banks should also encourage taking request for doorstep visits through such modes. The banks shall not charge any Pensioner more than Rs. 60/- for such a doorstep visit. In line with the Reserve Bank of India circular, RBI/2014-15/587, dated 07.05.2015, all banks shall encourage promoting Life Certificate through Digital means.

iii. As regards pensioners who have failed to submit their Life certificate in the year 2019, the banks will prepare an exception list of such pensioners immediately and follow the steps mentioned in sub-para 3(ii) above.

iv. The CPPCs of Pension Disbursing Banks (in case of more than 1 CPPC in any Bank, then one nominated official on behalf of the bank as a whole) shall report to the Department of Pension & Pensioners’ Welfare in the months of January, February and March respectively the total number of Central Govt Pensioners who have given the Life Certificate, the total number of Pensioners who have not given their Life Certificate. along with a break-up of the certificates submitted physically and through digital means, on the following email address: [email protected]

(4) CPPCs/Branches of your bank may be advised to Strictly comply with the above instructions. The banks are also requested to give wide publicity by putting up these instructions in their websites and also on the notice boards of the branches of the bank etc.

Subject : Furnishing of Annual Immovable Property Return (IPR) for the year 2019 (position as on 01.01.2020) – IDAS Officers.

In accordance with the Rule 18(1)(ii) of the CCS (Conduct) Rules, 1964 and MHA OM No. 25/10/55-Estt (A) dated 12/01/1956, every Government Servant holding a Group ‘A’ post is required to submit the IPR in the prescribed format giving full particulars regarding the immovable property inherited by him or owned or acquired by him or held by him on lease or mortgage either in his own name of in the name of any member of his family or in the name of any other person by 31st January of the next year. Further, as per DoP&T OM No. 11013/3/2011-Estt.A dated 23.09.2013, Annual Property Returns submitted by Group ‘A’ Services of Central Government are required to be placed in domain by 3181 March of that year, by respective Cadre Controlling Authorities.

2. Further, failure on the part of a Government servant to comply with the requirement of the aforesaid rule can form good and sufficient reasons for initiating disciplinary proceedings against him/her in terms of DOP&T OM No.11013/12/93-Estt.(A) dated 24.01.1994.

3. Therefore, it is, enjoined upon all the PCsDA and CsDA & equivalent to ensure that all the Immovable Property Returns (IPR) for the year 2019 (as on 01.01.2020) are submitted by all the IDAS officers (including themselves) under their administrative jurisdiction (including those on deputation) positively by 31/01/2020, so that the same could be placed in public domain.

4. Further, it is added that in case no immovable property is owned then “NIL” is required to be written against the relevant column of the proforma and the statements such as No Change” or “Same as last year” etc will not be accepted. It is mandatory to mention the date of filing of IPR.

5. The contents of the circular may be brought to the notice of all IDAS officers and IPRs concerned may be forwarded to this HQrs office latest by 20/02/2020.

Subject : Submission of Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) by the Officers of Central Secretariat Stenographers’ Services (CSSS) & Central Secretariat Clerical Service (CSCS) — regarding.

In terms of Rule 18 of CCS (Conduct) Rules, 1964 and instructions issued by this Department vide OM No,11013/7/2014-Estt.A-III dated 05.01.2016, the Immovable Property Return(IPR) is required to be furnished by all the Government Servants belonging to Group-A, B and C. Accordingly, IPR should be submitted by all the CSCS/ CSSS Officials/ Officers latest by 31.01.2020. CSSS Officers in the grade of Principal Private Secretary (PPS) and above should submit their IPR through Web Based Cadre Management System hosted at cscms.nic.in, A copy of the print out of IPR submitted online should also be signed and submitted to CS.II(A) Section, which is the custodian of Immovable Property Return (IPR) of these Officers. Stenographer Grade-13′, Personal Assistants and Private Secretaries of CSSS & Junior Secretariat Assistants and Senior Secretariat Assistants of CSCS will also submit their IPR to their respective Admin./ Vigilance Division.

2. Ministries/ Departments are therefore, requested that the contents of this O.M. may be widely circulated to the notice of all CSCS/ CSSS Officials/ Officers working under their respective control. They should also ensure that the IPR for the year 2019 (as on 31.12.2019) is submitted within the stipulated time by all the CSCS/ CSSS Officials/ Officers. All the officials/officers are informed that non-submission of IPR within the stipulated date, would invite the denial of Vigilance Clearance for Empanelment, Deputation., assignment to training programme (except mandatory training), applying to sensitive posts etc. as the IPR status needs to be checked for the said purpose(s).

3. It is, therefore, requested that all the CSCS/ CSSS Officers may be directed to file their Immovable Property Return (IPR) for the year 2019 (as on 31.12.2.019) well in time, latest by 31.01.2020. IPRs received beyond the stipulated date, shall not be regarded as conforming to the extant guidelines. Filing of IPR has already been started from 01.01.2020 and the “Immovable Property Returns” window has been operative at cscms.nic.in.

The undersigned is directed to refer to this Department’s OM of even number dated 08.11.2019 and subsequent reminder dated 03.12.2019 on the subject mentioned above and to say that only 18 cadre units of CSSS as shown in Annexure have provided the inputs in respect of those officers who are covered under the extant provisions of FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972.

2. It may be appreciated that this all important exercise is to be carried out on top priority and on a regular & continuous basis. It is unfortunate that the inputs are not being received promptly from a large number of cadre units. delaying the process.

3. All the remaining cadre units are, therefore, once again requested to furnish the information as per the proforma attached immediately and the same may be furnished to this Division by 21.01.2020 positively. In connection with arrangements for the Republic Day/ At Home Function/Beating Retreat Ceremony, 2020, it has been decided that the Government offices located in the buildings indicated in Annexure-A would be closed from 1300 hours on 25.01,2020 to 1300 hours on 26.01.2020. These buildings would also be closed at 1830 hours on 22.01.2020 and will reopen at 1300 hours on 23.01.2020 for the full dress rehearsal.

2. The buildings indicated in Annexure-B would be closed on 26.01.2020 till 1930 hours for At Home Function’. The buildings indicated in Annexure-C would be closed at 1200 noon on 29.01.2020 till 1930 hours on 29.01.2020. The buildings indicated in Annexure-D would be closed on 28.01.2020 from 1600 hours till 1930 hours for the full dress rehearsal for Beating Retreat Ceremony.

MEMORANDUM

In terms of the first proviso to Rule-6 of WBS(ROPA) Rules,2019 under Notification No. 5562-F dt. 25.09.2019, a Govt. employee on deputation or on foreign service has no scope to exercise option to come under the revised pay structure until he is repatriated to his parent cadre and on repatriation he is eligible to exercise such option within three months of his/her return/ repatriation to the parent cadre. However, the Officers/Staffs on deputation who are drawing pay in their respective cadre post i.e. who have opted to draw pay in the pay structure of their parent department with or without deputation allowance may be allowed to exercise such option online through their respective HRMS ID provided the amount of deputation allowance, if any as on 31.12.2019, shall remain the same.

The Government employees who are on deputation in a board, corporation, municipal body, zilla parishad, development authority, trust, society, undertaking, commission or parastatal etc. under the administrative control of West Bengal Government may be categorized in 2 categories as below:

1) The employees who are on deputation and draw their pay through HRMS of IFMS. For example, Officers posted in Municipalities/Municipal Corporations.

2) The employees who are on deputation and do not draw their pay through HRMS of IFMS but the Parastatals where they are posted have a HOO Code and HOO login Id in HRMS. For example Officers posted in Zilla Parishads.

Now in view of the above the Governor is pleased to decide that for the employees falling under category 1, submission of option by such employees and the process of pay fixation for ROPA 2019 through HRMS of IFMS is mandatory. And the employees falling under category 2 above, submission of option and the process of pay fixation for ROPA 2019 through HRMS is optional.

NOTIFICATION

Finance Department Vide Notification No. 536-F (Pen) dated 01.10.2019 issued the guidelines for Revision of Pension / Family Pension/ Gratuity and Commutation of Post 01.01.2016 Pensioners w.e.f. 01.01.2020. Thereafter vide Notification No. 660-F(Pen) dated 16.12.2019, revised format (Annexure I, II & III) for application, sanction of Pension /Family Pension were introduced and vide clarification regarding further commutation were issued vide Memorandum No. 680-F (Pen) dated 23.12.2019.

But certain points have been raised from different corners while fixation of revised Basic Pension/Family Pension, disbursement of Gratuity/ Commutation of Pension etc of post 01.01.2016 Pensioner/Family Pensioner.

After careful consideration of the matter the undersigned in directed by order of the Governor to provide the following clarification :-

1 Who shall draw and disburse the Revised Gratuity/ Additional Commuted Value of Pension of the State Government employees who retired on or after 01.01.2016 and in whose case PPO has already been issued by AG (A&E) W.B. 1. As already detailed in Point No.D of Memorandum No.536-F(Pen) dated-01.10.2019, DDO of the Pension Sanctioning Authority (PSA) shall continue to draw the balance amount of Revised Retiring/Death Gratuity/Commuted Value of Pension on the basis of emolument fixed notionally.

2. PSA shall endorse the copies of Annexure-II/III (as the case may be) as notified vide Order No. 660-F (Pen) dated-16.12.2019 to the DDO and the Pay & Accounts Officer/Treasury with whom DDO is attached for drawal of a bill for the balance amount of Gratuity, Additional Commuted Value of Pension.

3. Pension Disbursing Treasury /Public Sector Bank (in KMC area) shall disburse only the Revised Basic Pension/Family Pension following the directions contained in Notification No.536-F(Pen) Dated-01.10.2019, 660-F(Pen) dated-16.12.2019, 680-F(Pen) dated-23.12.2019, 681-F(Pen) dated-23.12.2019. In no case the Revised Retiring Gratuity /Death Gratuity/ Additional Commuted Value of Pension that arises due to ROPA, 2019 shall be drawn by Pension Disbursing Treasury /Public Sector Bank

2 How the Revised Basic Pension/Family Pension w.e.f. 01.01.2020 as per ROPA 2019 will be calculated for the entitled categories of employees who were in receipt of Non-Practising Allowance (NPA) on the date of retirement/ death.

 

The last Notional Basic Pay on the date of retirement/ death in Point No.9 of Annexure-Il or in Point No.10 of Annexure-Ill (as the case may be) shall be calculated taking together the amount of NPA also vide Notification No.5562-F dated-25.09.2019. On the basis of such last Notional Basic Pay, the Revised Pension / Family Pension etc shall be calculated as per Notification No. 536 F(Pen) dated 01.10.2019.
3 What will be the date of restoration of commutation/ additional commutation due to implementation of ROPA, 2019 1. Those employees who will commute additionally on the Basic Pension revised notionally as per ROP A 2019, the additional commuted portion of pension shall be restored after 15 (fifteen) years from 01.01.2020 or thereafter from the first day of the month on which the additional commutation will be disbursed by the DDO of PSA.

2. The portion of pension already commuted during or after retirement as per Basic Pension under ROP A, 2009 shall however be restored as usual i.e. after 15 (fifteen) years from the date of retirement as per order No.4159-F dated-26.04.1990.

3. Commuted portion of the pension of those pensioner who will retire on or after 01.01.2020 after coming into revised pay structure as per ROPA 2019 shall however be restored as usual i.e. after 15 years from the date of retirement as per order No.4159-F dated-26.04.1990.

4 What shall be the basis of calculation and period of restoration for those Pensioners who retired between 01.01.2016 to 31.12.2019 and wants to commute for the first time after fixation of Revised Basic Pension fixed notionally with actual effect from . 01.01.2020? 1. Such Pensioner shall be eligible to apply for commutation as per existing rule. Commutation value expressed as number of years purchase for the age as on next birthday on or after 01.01.2020 shall be taken into account.

2. Commuted portion of Pension shall be restored after 15 years from the date of retirement

5 Whether the Pensioner shall require to apply before the Pension Disbursing Authority for restoration of commuted portion of pension (both original and additional) after completion of period of restoration as stated in SL No.3 above. No. Pension Disbursing Authority shall restore the commuted portion of pension (both original and additional) on his / her own after the period of restoration is over i.e. from the first date of next month without seeking any application for restoration of commuted portion of pension from the pensioner.

This order shall take effect from 01.01.2020. Necessary amendment in relevant rules shall be made in due courses.

The undersigned is directed to say that the Schedule V of the W.B.S. (R.O.P.A.) Rules, 2019 published vide Notification No.5562-F, dated 25.09.2019 has been designed, as in the previous R.O.P.A. Rules, for initial pay fixation (called I.P.F. Statement) of a Government employee on 01.01.2016 or on the date of option to come under the revised pay structure. Further course of action as regards allowing subsequent annual increment(s) in the revised pay structure and fixation of pay on promotion that would take place after the date of option are usually made by issuing separate order(s).

Now, consequent upon the decision taken by Government to make initial pay fixation in the revised pay structure on the date of option of the Government employee, subsequent annual increment(s) and fixation of pay on promotion, if any, after the date of option through H.R.M.S. at a time in a single endeavour, the undersigned is directed by order of the Governor to revise the said Schedule V in the manner as annexed herewith so that all such courses of action can be accomplished through H.R.M.S. in a single endeavour.
