(a)whether Government is aware that the major national trade unions of the country have announced general strike on January 8, 2020, if so, the main demands of the trade unions;

(b)what are the major issues that have led to the announcement of such a strike and what are Government’s comments on those issues;

(c)whether Government is planning to call meeting of the trade unions to address these issues; and

(d)in what way Government is planning to prevent the move for a general strike by trade unions?

STATEMENT REFERRED TO IN REPLY TO PART (a) TO (d) of RAJYA SABHA STARRED QUESTION NO. 93 DUE FOR REPLY ON 27/11/2019 BY SHRI ELAMARAM KAREEM, M.P. REGARDING GENERAL STRIKE ON 8TH JANUARY, 2020.

(a) to (d): Government has, till date, not received any notice for a nationwide strike on 8th January, 2020. However, it is learnt through various media reports that some Central Trade Unions (CTUs) have given a call for a nationwide general strike on 8th January, 2020.

As and when, a strike notice is received by the Government, the Central Industrial Relations Machinery (CIRM) under the Office of Chief Labour Commissioner (Central) initiates the conciliation proceedings with the objective of resolving the issues involved in strike.

(a) whether there is any proposal before the Government to decrease the retirement age of Central Government employees from 60 years to 58 years or under article 56(J) of compulsory retirement on attaining the age of 50 years;

(b) if so, the details thereof; and

(c) if not, the reasons therefor?

(a) : No Sir. Presently, there is no proposal to reduce age of retirement on superannuation from 60 years to 58 years.

There are provisions under Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rules, 1972 and Rule 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958, according to which the Government has the absolute right to retire Government officials prematurely, on the ground of lack of integrity or ineffectiveness, in public interest, by giving notice of not less than three months in writing or three month’s pay and allowances in lieu of such notice:

(i) If he is, in Group ‘A’ or Group ‘B’ service or post in a substantive, quasi-permanent or temporary capacity and had entered Government service before attaining the age of 35 years, after he has attained the age of 50 years;

(ii) In any other case after he has attained the age of 55 years.

(b) & (c): Does not arise.

(a) whether a provision of reservation in the Government jobs for the Scheduled Castes, Scheduled Tribes and Other Castes existed in Jammu and Kashmir (J&K) before the revocation of Article 370 and 35A;
(b) if so, the details thereof;
(c) whether revocation of Article 370 and 35A in the State has ensured reservation to the communities belonging to the reserved category;
(d) if so, the details thereof; and
(e) the number of people from the communities belonging to the reserved category to be benefited from this in the time to come?

ANSWER

(a) to (e): Yes, sir. Before the revocation of Article 370 and 35A, ‘The Jammu and Kashmir Reservation Act, 2004’ was in force to provide reservation in jobs to the Scheduled Castes, Scheduled Tribes and Other Socially and Educationally Backward Classes in the erstwhile state of Jammu & Kashmir. After revocation of Article 370, ‘The Jammu and Kashmir Reservation Act, 2004’ is applicable to the Union Territory of Jammu and Kashmir and Union Territory of Laddakh with certain amendments, as mentioned in ‘The Jammu and Kashmir Reorganisation Act, 2019’. The number of people from the communities belonging to the reserved category to be benefited will be in proportion to the percentage of reservation for the respective categories.

(a) & (b): According to Ministry of Health & Family Welfare, to fulfil medical related necessities of Government servant, Central Government Health Scheme (CGHS) was started in 1954 for providing comprehensive medical care facilities to serving/retired Central Government employees and their families. CGHS facilities are admissible to all the Central Government Servants who are paid their salary/pension from the civil estimates of the Central Government and having their place of residence in an area covered by a CGHS Wellness Centre. CGHS was started in Delhi in 1954 and has now been extended to 70 other cities across the country. Wherever CGHS is not available, Central Government serving employees are governed by Central Service (Medical Attendance) Rules, 1944.

Further, to enhance the educational level, a Government employee is permitted to avail Study Leave upto 24 months in his entire service and 36 months for Central Health Scheme officers. Similar facility is also available under AIS (Study Leave) Regulations, 1960 for AIS officers.

(c): Does not arise.

(a) & (b): Total number of Central Government employees as on 01.03.2014, 01.03.2015, 01.03.2016 and 01.03.2018 is at Annexure-I,II,III & IV. The salary expenditure of Central Government employees during the five i.e. 2013-14 to 2017-18, is at Annexure-V.

(c): Number of sanctioned posts in Central Government as on 01.03.2014 and 01.03.2018 was 36,45,584 and 38,02,779 respectively, showing an increase in sanctioned strength by 1,57,195.

Retention of Lien of Post

Consolidated guidelines on “Technical Resignation and Lien” have been issued by Department of Personnel & Training.

(i) Lien is retained by a permanent Government employee (GE) for a period of 2 years. It is extendable upto 3 years in exceptional cases. However, while considering termination of lien of a GE it is to be ensured that he is not left without a lien on a permanent post.

(ii) Ministries/Departments are required to take timely action to extend or terminate lien on completion of the prescribed period of 2/3 years, after providing adequate opportunity to the GE.

This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Lok Sabha today.

Dear Secretary

Rule 16(2) of AIS (Conduct) Rules, 1968 provides that every member of the Service shall submit an annual return in such form as may be prescribed by the Government in this regard, giving full particulars regarding the immovable property inherited by him or owned or acquired by him or held by him on lease or mortgage, either in his own name or in the name of any member of his family or in the name of any other person. In terms of the instructions vide OM No.8/9/60-AIS(III) dated 16.02.1960 and OM No.11017/74/93-AIS(III) dated 04.01.1994 issued under this Rule, every member of the service is required to submit annual immovable property return by 31st January of the next year. Failure on the part of the members of the Service to comply with the requirements of the aforesaid provisions constitutes good and sufficient reason for institution of disciplinary proceedings, among other things vide this Department’s OM No.104/33/2005-AVD-I dated 29.10.2007 and 07.09.2011, against them.

2. In order to further facilitate the filing of IPR’s, this Department has vide- DO No.6(1)/2014-EO (PR) dated 22.12.2016 introduced online filing of IPR in respect of IAS officers w.e.f. 1st January, 2017 through the Module designed for the purpose. Through this Module, the officers can submit the IPR either electronically or upload scanned copy of the manually filled in IPR. This online Module closes automatically after the prescribed timeline of 31st January, 2020 in respect of the calendar year 2019.

3. I would, therefore, request you to kindly issue necessary instructions to all IAS officers working in your Ministry / Department and its various organizations, to ensure that they submit their IPRs online in the IPR Module for the year ending on 31st December, 2019, as per the prescribed timeline.

(d) Does not arise.
