It has come to the notice of the Government that few Public Sector Banks are not issuing Form 16 TDS Certificate for the financial year 2018-2019 to its PSB Pensioners / Family Pensioners citing that original papers of Pensioners / Family Pensioners who had drawn pension/family pension under Public Sector Bank Scheme and subsequently have been transferred to the concerned Pension Pay Officer, Chennai/ Treasury Officers/Sub-Treasures Officers as per the orders issued in the reference cited.

2. In this connection, I am directed to invite your attention to the provisions of Section 203 of the Income Tax Act, 1961 read with the Rule 31 of the Income-tax Rules, 1962 which stipulates furnishing of certificate of tax deduction at source (TDS) by the deductor to the deductee specifying therein the prescribed particulars such as amount of TDS, valid permanent account number (PAN) of the deductee, tax deduction and collection account number (TAN) of the deductor, etc. The time limit for issuance of Form 16 is 31st May of the financial year immediately following the financial year in which income was paid and tax deducted.

3. I am therefore request you to issue necessary Form 16 TDS Certificate for the financial year 2018-2019 immediately to your PSB Pensioners / Family Pensioners for the period upto which pension/family pension was paid and tax deducted so as to file their income tax returns in time.

Subject : Merger of Group ‘B’ and ‘C’ staff cadres (Executive, Ministerial and non-Technical) of all Directorates under CBIC into one Common Cadre and Common RRs – Delegation of work/function of the CCA to the Directorates under the CCA of DGPM – regarding.

A meeting was conveyed on 22.05.2019 by the Member, CBIC to resolve the pending issue related to the delegation of power between DGPM and DRI. The issue has arisen out of DGPM order F.No. 1040/21/2018 dated 30.07.2018 distributing certain functions to various Directorates under Cadre Control of DGPM. DRI vide letter F.No. C-38015/04/2015-Confl. Dated 06.08.2018 had raised certain objections regarding delegation of such powers and had pointed out that the Appointing Authority alone can exercise powers like taking disciplinary action, accepting YRS/technical resignation and taking up of litigation matters. The following decisions were taken in the meeting:

(i) DGPM will act as Cadre Controlling Authority and power of appointment etc. be given to the respective Directorates. DGPM being the Cadre Controlling Authority, the combined vacancy for various grades will be intimated by DGPM and on receipt of Dossiers; they will allocate those dossiers to various Directorates. Further process of appointment etc. may be taken care of by the respective Directorates. Head of the Directorate or an appropriate officer of Directorate may be declared as Head of Department. Directorates being appointing authority/disciplinary authority shall also decide issues such as YRS/Technical Resignat ions, initiation of disciplinary powers, etc. The list of functions to be performed by DGPM as CCA and the delegated functions of Directorates under CCA of DGPM, once the Heads of Directorates or an appropriate officer of Directorate is declared Head of Department/Disciplinary Authority are given in Annexure-I.

(ii) Looking into the sensitivity of the nature of work performed by DGRT/DGGI/DG Vig, it will be desirable that DGPM consults the heads of these organizations or an officer authorized by Heads of these organizations, before positing any officer to these three organizations.

(iii) All out efforts should be made to ensure that new RRs for the Directorates are issued as soon as possible. For this a meeting should be held with JS (Admn) and DG HRM. Further, without disturbing the existing position of officers in DGPM seniority l ist, the Directorates can attempt to fill up the vacancies as per the RRs in force where there is no contradiction.

(iv) Regarding posting of officers on loan basis, it has been decided that till restructuring comes into picture, the loan officers, as a matter of fact, sanctioned on loan to different Directorates in a station, that sanction has been given to the local CCA and that local CCA should be responsible to fetch the requirement of local Directorates. With regard to calling of applications by different Directorates for posting on loan basis, it was decided that it should be stopped forthwith and those who have already been accommodated under this arrangement, after completion of their tenure, they will not be given any further extension.

(v) As regards the transfer/posting of officers within the Directorate, it has been decided that once an officer has been posted to an organization , the head of that organization has to decide for his posting/transfer within the organization.

Subject : Implementation of recommendations of GDS Committee on Social Security Benefits for Gramin Dak Sevaks (GDS) .

The undersigned is directed to refer to this Directorate O.M of even number dated 27.06.2018, wherein approval of Competent Authority on the above noted subject was conveyed.

2. The Competent Authority has now approved the following modification in payment of Severance Amount and GDS Gratuity with effect from 01.01.2016 instead of 01.07.2018 as mentioned below:

3. All other existing eligibility conditions for the aforesaid schemes have undergone no change and wiII be applicable to all GDSs .

4. This issues in consultation with Ministry of Finance, Department of Expenditure vide their ID Note No. 3(1)/E-V/2018 dated 05.04.2018 and AS &FA Diary No 37/2019-FA-CS Dated 01.07.2019.

Subject : – Clarification on Department of Posts Postman and Mail Guard (Group ‘C’) Recruitment Rules, 2018.

Madam / Sir,

I am directed to refer to Department of Posts Postman and Mail Guard (Group ‘C’) Recruitment Rules (RRs), 2018 notified on 20.09.2018 which superseded Department of Posts (Postman and Mail Guard) Recruitment Rules, 2010. In this regard, a few Circles have sought clarification on certain points, which are clarified as under:-

S.No Circle/ Issue Clarification
1 Andhra Pradesh, Haryana, Karnataka: Whether the educational and other qualifications (Knowledge of computer Language and possessing valid driving license of two-wheeler) required for direct recruits detailed in column 7 of RRs of Postman/Mail Guard is applicable for GDS candidates (direct recruitment).

Andhra Pradesh: Whether the candidates having two wheeler license only should be allowed for examination/ selection OR can license be obtained afterwards.

Provisions of Column 7 of Postman/ Mail Guard RRs have been relaxed for existing GDS (who have been engaged prior to notification of new RRs) as per letter no. 03-02/2019-SPN-I dated 26.03.2019. Following relaxations have been provided to the GDS candidates:

a) GDS with 10th standard pass shall be allowed to appear in the competitive examination, if otherwise found fit;

b) GDS without license to drive two wheeler or light motor vehicle shall also be allowed to appear in the competitive examination. However, a candidate not having valid driving license at the time of appointment shall not earn periodical increment in pay till production of such license or for a period of five years from the date of appointment whichever is earlier and after production of such license or expiry of such five years period, pay shall be restored prospectively to the level pay would have reached had the periodical increment in pay was not withheld and no arrears of pay shall be paid for the intervening period

2 Andhra Pradesh: Procedure to be followed for testing the knowledge of computer. Syllabus and pattern of LDCE examination has been revised as per Directorate’s letter no. 17-08/2018- SPB-I dated 10.05.2019.
3 Andhra Pradesh: Keeping m view, work involved and time sensitivity for conducting separate examinations for filling the vacancies of Postman / Mailguard among both MTS and GDS, whether a common examination may be conducted for filling the postman / mailguard vacancies by both MTS and GDS. A common examination may be held across the Circle for filling up of vacancies of Postman/ Mailguard from both MTS and GDS.

Seeking Option from Candidate

a. At the time of inviting application for appearing in examination, candidates may be asked to exercise order of preference for Recruiting Units (All Divisions).

b. The candidates belonging to postal divisions shall indicate order of preference for postal divisions excluding parent division (s) followed by RMS divisions.

c. The candidates belonging to RMS divisions shall indicate order of preference for RMS divisions excluding parent division (s) followed by postal divisions.

d. It should be clarified that candidates should exercise preference for all Recruiting Units for consideration. In case preference is exercised for a limited number of units and could not be allocated to one of those units as per merit vis a vis vacancy in the category he/ she belongs to, he/ she will not be considered for other recruiting units not preferred even though a candidate lower m rank to him/ her is considered who has opted for that unit.

e. Order of preference once exercised shall not be changed.

Preparation of Merit List and allocation of Division

a. At first, two merit lists for each division/recruiting unit shall be prepared for Qualified candidates

(i) One of MTS candidates, and
(ii) One of GDS candidates.

b. Qualified candidates shall be allocated to their respective parent recruiting unit in the order of merit vis a vis category in which selected vis a vis availability of vacancy in the respective category (for the purpose of vertical I horizontal reservation).

c. After allocation of candidates to their respective Parent Unit (Postal Divisions I RMS Divisions), four separate merit lists for the entire Circle shall be prepared for all such candidates who could not be adjusted/ allocated against their Parent Unit (s), viz.

(i) MTS of all Postal divisions
(ii) MTS of all RMS divisions
(iii) GDS of all Postal divisions
(iv) GDS of all RMS divisions

d. A reserve category candidate selected against an unreserved vacancy on •own merit shall have choice to migrate to reserve category if by doing so he/she can be allocated to a Unit, which is higher in the order of preference exercised by him/her. Therefore, an undertaking to this effect shall be included m the application for appearing m examination.

Publication of Results

The Circle shall publish separate results for both Postman and Mailguard.

a) Postman: Division wise lists of candidates in order of merit who have been allocated to parent unit followed by list of surplus qualified candidates, who were not allocated to Parent Unit/ Division and allocated to other Recruiting Units/Divisions based on merit, shall be published for each division.

b) Mailguard: Division wise lists of candidates in order of merit who have been allocated to parent unit followed by list of surplus qualified candidates, who were not allocated to Parent Unit I Division and allocated to other Recruiting Units/Divisions based on merit, shall be published for each division.

4 Andhra Pradesh and Karnataka: The revised syllabi and pattern for LDCE for the cadre of Postman I Mailguard as per the educational qualification I.e. 12th standard, prescribed m the Revised Recruitment Rules of Postman I Mail Guard, 2018. Syllabus and pattern of LDCE examination has been revised as per Directorate’s letter no. 17-08/2018- SPB-I dated 10.05.2019.
5 Andhra Pradesh: Whether the DR vacancies of the year 2017-18 can be offered to GDS surplus qualified candidates as per the provisions of New RRs under Rules 10(iii)(b) & (c) OR these vacancies can be included in the vacancy position of 2018 to fill up as per new Recruitment Rules.

North East: Whether vacancy of Postman to be calculated from 01.04.2018 to date of publication of above said Gazette as per old RRs or as per new RRs.

Telangana : Whether the DR vacancies of the year 2017-18 can be offered to GDS surplus qualified candidates as per the prov1s10ns of New RRs under Rules 10(iii)(b) & (c) OR these vacancies can be filled up by issuing open notification as per old Recruitment Rules.

O.M No. AB.14017/13/2013-Estt.(RR)(1349) of Department of Personnel & Training (DOPT) states as under:-

“The legal position is that the posts are to be filled up as per – the eligibility conditions prescribed in the Recruitment Rules in force at the time of occurrence of vacancies unless the Recruitment Rules are amended retrospectively. The practice has however been to give effect to the Recruitment Rules prospectively.”

Further, clarification has already been issued vide letter number 37-10/2002-SPB-I dt. 14.11.2002 which states as follows-

“According to cannons of la w, the recruitment rules in force at the time of occurrence of vacancies whatsoever be the date of notification, should be followed. ”

Accordingly , vacancies upto the vacancy year 2017 (April 2017 . March 2018) are required to be filled up as per the Postman and Mailguard, Recruitment Rules, 2010, and vacancies occurring in 2018 vacancy year (April – December 2018) and thereafter are required to be filled up as per Recruitment Rules of 2018 notified on 20.09.2018.

6 Haryana: As per old RRs of Postman/Mail Guard, 2010 service conditions for GDS is five years of regular service m the grade as on 1st April of the year. But in new RRs of PMJM:G, 2018, nothing has been mentioned about the service condition for GDS to apply for the post of PMJM:G. Point No. (iii) under column 10 of the Schedule of Department of Posts (Postman and Mailguard) Recruitment Rules, 2018 may be referred to in this regard. Only those GDS who have worked regularly for five years in that capacity as on the 1st day of January of the year to which the vacancy (ies) belongs are eligible.
7 Rajasthan Circle: In the RRs of Postman and Mail Guard, it is mentioned that age and educational qualifications prescribed for direct recruits will not apply in the case of promotees. However, there is no mention about the other qualifications in the column no. 8 of RRs as mentioned in column no. 7. Observations of the Circle have been noted. Amendment of Department of Posts Postman and Mail Guard (Group ‘C’) Recruitment Rules (RRs), 2018 to this extent is under consideration.

Till further revision of RRs, other qualifications may not be made applicable for considering promotion.

8 Karnataka Circle: To provide SOP for departmental examination. SOP for Departmental Examinations is under process.

2. The above clarifications may be brought to the notice of all concerned and action taken to conduct DPC/Examination for promotion/appointment to the cadre of Postman/ Mail Guard at the earliest.

(a)whether the Government proposes to revise the pension laws implemented in the year 1995;

(b)whether the Government is accepting the recommendations made in the report submitted by Bhagat Singh Koshyari Committee in this regard and if so, the details thereof;

(c)whether the Government has taken or proposes to take any steps to provide atleast 7500/- rupees basic pension and dearness allowance thereon to the EPS pensioners of the year 1995 besides providing free of cost health facilities to the pensioners and their families;

(d)whether the Government has also received representatives from the EPS pensioners of the year 1995 regarding their collective demand;

(e)if so, the details thereof; and

(f)the action taken or to be taken by the Government in this regard?

(a): Amendment of the Employees’ Pension Scheme is a continuous process and is done as and when necessitated in consultation with stakeholders.

(b): Due to financial constraints in increase in Government share under Employees’ Pension Scheme (EPS), 1995 and to maintain sustainability of the Employees’ Pension Fund, the recommendations of the Koshiyari Committee have not been accepted. However, the Government has started providing a minimum pension of Rs. 1000/- per month to the pensioners under EPS, 1995 from 01.09.2014.

(c): A pilot scheme to extend medical benefits to Employees’ Pension Scheme (EPS) 1995 pensioners drawing minimum pension upto Rs. 1000/- per month under EPS, 1995 and residing in Delhi has been drafted. The Scheme would be optional to those pensioners who give their willingness for deduction of Rs.100/- per month from and out of their pension disbursed on monthly basis.

(d) to (f): Representations are received from individual EPS, 1995 pensioners as well as pensioners associations raising various demands like:

(i) To increase the minimum pension to Rs. 2000/ Rs. 3000/Rs. 7500 per month.
(ii) To link the monthly pension with cost of living index.
(iii) Restoration of commuted value of pension.
(iv) Re-introduction of the provision of commutation of pension.
(v) Restoration of the provision of Return of Capital.
(vi) Reduction in the period for calculation of monthly average pensionable salary from 60 months to 12 months.
(vii) Payment of pension on Higher Wages to employees of exempted establishments.

Various representations received were placed before the High Empowered Monitoring Committee constituted by the Government of India for complete evaluation and review of EPS 1995. The committee has submitted its report on 21.12.2018 to the Government.

(c) whether the Government proposes to set up Jawahar Navodaya Vidyalayas in the rural areas of the country on priority basis; and

(a) to (d): Jawahar Navodaya Vidyalayas (JNVs) are set up with the object of providing good quality modern education to the talented children predominantly from rural areas. At least 75% seats of the districts are filled by the candidate selected from rural areas. Navodaya Vidyalaya Scheme envisages opening of one JNV in each district of the country.

All the districts of the country (as on 31.5.2014) including all the districts of Madhya Pradesh have been covered under the Navodaya Vidyalaya scheme (except districts in the state of Tamil Nadu which has not yet accepted the scheme).

Consequent upon carving out of new districts (created upto 31.3.2018), there are 45 districts which are yet to be covered under the Navodaya Vidyalaya Scheme. The details of these districts are annexed.

Opening of new Jawahar Navodaya Vidyalayas (JNVs) is a continuous process which depends on the willingness of the concerned State Government to make available requisite suitable land free of cost for construction of the permanent building and making available required temporary building, free of rent, to run the Vidyalaya till the permanent building is constructed. However, actual sanction and opening of new JNV depends on availability of funds and approval by the Competent Authority. As such it is not possible to identify the areas where JNVs are likely to be set up in next three years.

Sub : Extension of validity period of empanelment of already empanelled Health Care Organizations under CGHS.

With reference to above mentioned subject attention is drawn to office order dated 27.03.2019 whereby empanelment of all existing empanelled health care organizations under CGHS was extended till 30.06.2019.

In this regards it has been now decided to extend empanelment of all Health Care Organizations already empanelled under CGHS for a further period of three months w.e.f. 01.07.2019 till 30.09.2019 or till next empanelment whichever is earlier on same terms conditions and rates on which they are presently empanelled. However, all hospitals and diagnostic centres shall charge NABL rates only for those investigations conducted by them which are NABL accredited. For all other investigations they shall claim Non-NABL rates.

This issues with approval of AS & DG (CGHS).

Subject: Revision of interest rates for Small Savings Schemes.

The undersigned is directed to refer to this Department’s OM of even number dated 16th February, 2016, vide which the various decisions taken by the Government regarding interest fixation for small savings schemes were communicated to all concerned.

2. On the basis of the decision of the Government, interest rates for small savings schemes are to be notified on quarterly basis. Accordingly, the rates of interest on various small savings schemes for the second quarter of financial year 2019-20 starting 1st July, 2019, and ending on 30th September, 2019, on the basis of the interest compounding / payment built-in in the schemes, shall be as under:

Sub: Post-operative Follow-up treatment from Hospitals empanelled under CGHS in respect of critically ill CGHS beneficiaries – regarding

With reference to the above mentioned subject the undersigned is directed to state that in view of the difficulties being faced by critically ill CGHS beneficiaries in getting post-operative follow-up treatment at CGHS empanelled hospitals, the matter was reviewed and it has now been decided that critically ill CGHS beneficiaries shall be permitted for follow up treatment in CGHS empanelled hospitals as per the details given under:

i. Permission for post-operative follow-up treatment in respect of the following post —operative conditions requiring frequent Consultations from Specialists at private hospitals empanelled under CGHS, need not be re validated from time to time and follow-up treatment may be under taken at CGHS rates without time limit.

ii. The consultation /investigations are permitted under these follow-up cases. The conditions covered are:

a. Post Cardiac Surgery Cases including Coronary Angioplasty

b. Post Organ Transplant Cases (Liver, Kidney, Heart, etc.,)

c. Post Neuro Surgery Cases/Post Brain Stroke cases requiring regular follow-up treatment

d. End Stage Renal Disease/follow up cases of Liver Failure

e. Cancer treatment

f. Auto-immune disorders like Rheumatoid Arthritis requiring regular follow-up

g. Neurological disorders like Dementia, Alzheimer’s disease, Parkinsonism , etc.,

Medicines prescribed are to be procured from CGHS Wellness Centre.

iii. The beneficiaries shall have to submit a self-attested photo copy of the permission letter to the hospital to enable the hospitals to provide credit facility in respect of pensioners and other categories of CGHS beneficiaries entitled for credit facility. Serving employees (and their dependents) who may not be entitled for cashless facilities shall enclose a self-attested photo copy of permission letter to claim reimbursement from the concerned Ministry /Department.

iv. Permission in respect of Pensioner CGHS beneficiaries, Ex-MPs (and other categories of CGHS beneficiaries, whose medical expenditure is borne by CGHS) etc., shall be granted by CGHS. Permission in respect of Hon’ble Members of Parliament shall be granted by Rajya Sabha Secretariat/Lok Sabha Secretariat as the case may and by concerned Ministry /Department in respect of serving beneficiaries and by concerned Autonomous Body / Statutory Body in respect of serving /pensioner beneficiaries.

v. However, if any non-listed investigations / procedures are advised permission from competent Authority shall be required, except in emergency.

2. These orders are in supersession of the earlier guidelines on the subject.
