Attention is invited to RBE No.102/2005 vide which the 20% DR quota that was introduced for, inter-alia OS-II, was decided to be operated instead as an LDCE quota open to all Graduate serving employees with prescribed residency period. The written exam (Railway wise) was to be conducted by RRB Vide RBE No.147/2006, the conduct of the exam was shifted from RRBs to respective Zonal Railways themselves. Vide RBE No. 110/2016, conduct of Senior Clerk LDCE (13.33% quota) was also handed over from RRBs to Zonal Railways.

The conducting of the OS-II and Senior Clerk LDCEs has however been centralized in each Railway so far, meaning thereby that vacancies of all Departments and all Divisions are clubbed together for a common exam and panel.

Railways have however, been raising this issue of centralized LDCE for these categories periodically, pointing out that with MACP in place, volunteers for OS-II and Senior Clerk LDCE are scarce due to the risk of inter-divisional transfer in a centralized panel scenario, which results in a number of vacancies remaining unfilled.

The matter has accordingly been reviewed in consultation with the Zonal Railways and it has been decided that the LDCE for both the OS-II and Senior Clerks may be decentralized, by holding the exam at the Divisional level by clubbing the vacancies of all the departments. This decentralization will be in respect of Divisionally controlled cadres/ seniority units for these posts.

Reference MoD ID Nos. 16(18)/2017/D(Works-II) dated 04.07.2017 and 19.12.2017 regarding Bio-metric Attendance System for punctuality in Defence Establishment.

2. Ministry has observed that till date Aadhar Enabled Bio-metric Attendance System is not implemented in E-in-C’s Branch. Further, it is also observed that subordinate offices are not maintaining proper leave record of Officers. The Ministry has taken a very serious view in this regard as non-maintenance of leave record will result in various administrative issues and loss to government exchequer.

3. In view of above, it is once again directed that Aadhar Enabled Bio-metric Attendance System shall be implemented in E-in-C’s Branch and all, the offices of Military Engineer Services. Non-implementation shall be viewed seriously and appropriate action as per relevant service rules/conduct rules shall be taken against the erring officials. As informed by E-in-C’s Branch, the case for exemption of Service Personnel is still under consideration in this Ministry, therefore, presently Service Personnel are not covered under ibid instructions.

4. This issues with the approval of Competent Authority.

1. There are three prayers in this writ petition – one is for a direction to the Respondents to grant the Petitioner the benefit of the first Assured Career Progression (‘ACP’) Scheme with effect from October, 1999, when the Petitioner had actually completed 12 years of service instead of 30th December, 2000. The second is that the benefit of the MACP should be granted with effect from October, 2007 (instead of 1st September, 2008), when the Petitioner completed 20 years of service. The third prayer is that the benefit of the MACP should be given by placing the Petitioner in the scale of Sub Inspector (‘SI’) i.e. Rs.5500-9000 (pre-revised).

2. As far as the first prayer is concerned, the same has already been granted by the Respondents to the Petitioner. As far as the second prayer is concerned, the issue is covered in favour of the Petitioner by the judgment dated 8th December, 2017 of the Supreme Court in Union of India v. Balbir Singh Turn (2018) 11 SCC 99. The Supreme Court has in the above judgment clarified that the benefit of the MACP which was on the basis of the recommendations of the Sixth Central Pay Commission to be extended with effect from 1st January, 2006 and not from 1st September, 2008, as was directed by the Respondents.

As regards the fixing of the correct pay scale of the Petitioner, it is seen that in BSF/General Duty, there is no post of ASI/General Duty in the pay scale of Rs.4000-100-6000 (pre-revised) which had been converted into Pay Band-I i.e. 5200-20200 in the grade pay of Rs.2800 having pay band of 8560 with the total pay (basic pay) of Rs.11360. Thus, in the case of the Petitioner, the second financial upgradation was required to be given in the pay scale of Rs.5500-9000 (pre-revised). Since this was not granted to other similarly placed as the Petitioner, writ petitions were filed in this Court. A series of judgments have been passed by this Court in those writ petitions, as a result of which the Respondents extended the benefit of financial upgradation in the pay scale of Rs.5500-9000 to all personnel who had completed 24 years of regular service during the period 9th August, 1999 to 31st August, 2008.

The counter affidavit of the Respondents does not dispute the applicability of the judgment of the Supreme Court in Union of India v Balbir Singh Turn (supra) or the applicability of the other orders of this Court, including the order dated 18th December, 2015 in W.P.(C) No.11725 (Digamber Singh ASI v UOI) concerning the appropriate pay scale for the purposes of grant of the MACP benefits.

5. Consequently, this Court directs as under:

(i) The Petitioner would be given the benefit of the MACP with effect from October, 2007 instead of 1st September, 2008; and

(ii) The above benefit will be given by placing the Petitioner in the pay scale of Sub Inspector i.e. 5500-9000 (pre-revised).

(iii) The appropriate orders will be issued and the arrears will be paid to the Petitioner within a period of 12 weeks from today, failing which the Respondents will be liable to pay simple interest @ 6% per annum on the arrears for the period of delay.

6. The petition is disposed of in above terms. No costs.

Madam/Sir,

I am to refer to MHRD’s circular No. F.1-5/2018-NAT dated 06.05.2019 on the subject cited above and to forward the circular along with revised NAT Guidelines and timelines for National Award to teachers.

Your attention is invited to the fact how we complete the selection process of teachers for the National Awards. It has been observed last year that many proposals forwarded by the Regional Selection Committees were not up to the mark and worth consideration. Kendriya Vidyalaya Sangathan is blessed with a lot of outstanding teachers who are contributing immensely to the institutions society and ultimately to the nation. Many teachers are having remarkable achievement in the filed of education. Many teachers who are worth of consideration for awards but do not take part in this process due to their busy schedule or some other reasons. These teachers need to be encouraged to apply for this Award through online process. Mere completion of formality to forward some names of teachers to KVS (HQ) under this process will not serve our purpose. Achievements, efforts & records of the individuals whose names are being selected by the Regional Selection Committees must be quite visible and from their proposals In nutshell this is to say that proposals should be self explanatory in itself.

All Deputy Commissioners are requested to take personal interest to identify, motivate and forward worthwhile proposals so that KVS nominations may be adjudged amongst the best proposals by the National Level Independent July The conferment of National Award to a genuine teacher inspires other teachers to endeavor for higher achievement.

Kindly give this circular wide publicity so that the same can be known by every teacher. Timelines prescribed for each stage of this process may be strictly adhered to

Indian Navy’s Service Selection Board Inaugurated At Kolkata

Admiral Sunil Lanba, the Chief of Naval Staff inaugurated Indian Navy’s first full-fledged Service Selection Board (SSB) today at Diamond Harbour, near Kolkata. The Flag Officer Commanding-in-Chief, Eastern Naval Command, Vice Admiral Karambir Singh, was also present at the venue.

SSB (Kolkata) is located approximately 55 km away from central Kolkata, on land that was previously occupied by a Naval Coastal Battery. This is the fifth Service Selection Board of the Indian Navy and caters for selection of both Permanent and Short Service Commission officers. The other Boards are located in Bhopal, Bengaluru, Visakhapatnam and Coimbatore. Spread over an area of 27 acres on the banks of the river Hooghly, SSB (Kolkata) has the capacity to screen approximately 5000 officer-candidates annually. The Board can accommodate approximately 160 candidates at a time and has separate facilities and accommodation for men and women candidates. Facilities available at the Board are GTO ground, Testing Hall, Conference Room, accommodation for staff and a Medical Inspection Room. These are not only custom-built to meet the stringent testing requirements, but also to cater for the comfort and convenience of candidates.

The SSB at Diamond Harbour, Kolkata will boost the induction of officers, both men and women, into the Indian Navy. Its location will reduce the travel time and effort for candidates from Northern and North Eastern parts of the country.

The above referred OM dated 28-9-2018 issued by Department of Expenditure, Ministry of Finance was circulated by OFB (Per/Policy Section) vide Circular No.01/6th CPC/Per/Policy dated 09-10-2018 and the operative portion (i.e Para 08) of the said OM is furnished here-under:-

“Accordingly, the President is pleased to decide that in respect of those posts where entry pay for direct recruits appointed on or after 1.1.2006, as per Section II of Part A of the First Schedule of CCS(RP) Rules, 2008, becomes applicable by virtue of the provision of the element of direct recruitment in the relevant recruitment rules, the pay of Central government employees who were appointed to such posts prior to 1.1.2006 and whose pay, as fixed in the revised pay structure under Rule 7 thereof as on 1.1.2006 turns out to be lower than the prescribed entry pay for direct recruits of that post, shall not be less than such entry pay w.e.f. 1.1.2006. Likewise, the pay of Central Government employees who were appointed to such posts by way of promotion on or after 1.1.2006 and whose pay, as fixed under Rule 13 of CCS(RP) Rules, 2008, happens to be lower than the said entry pay, shall also not be less than such entry pay from the date of their promotion taking place on or after 1.1.2006”

Further Column No.11 (the method of recruitment) of the existing Recruitment Rules i.e SRO 185 of 1994 for the grades of Highly Skilled II & Highly Skilled I says:-

“By Promotion after adjustment of surplus and transfer failing which by direct recruitment”

Since the provision of direct recruitment is prescribed only under ‘failing which’ clause of SRO and no direct recruitment in the said grades has actually been made so far, PCA(Fys) was requested to offer comments /views on the admissibility of the benefit of entry pay for the IEs. In turn, PCA(Fys) referred the matter to CGDA, Delhi for clarification/guidelines. Now, CGDA vide letter No.AT/II/2702/Clar-III dated 26-4-2019 (Copy Enclosed) has clarified that the benefit of entry pay to direct recruits can also be extended to the IEs promoted to HS Gr.-II &HS Gr.-I on or after 01.01.2006.

In view of the above, all the Ordnance factories are requested to implement the MoF/DoE OM No.8-23/2017-E-IIIA dated 28-9-2018 w.e.f 01.01.2006 for eligible Industrial Employees

Subject :– Instructions regarding Rotational transfer.

Sir/Madam,

I am directed to refer to transfer policy guidelines for regulating transfer of Group ‘C’, Group ‘B’ (non-gazetted) and Assistant Superintendent of Posts issued vide Directorate’s communication no. 141-141/2013-SPN-II dated 17.01.2019. As per para 5 (i) if ibid communication, Post tenure of an employee shall be 3 years and station tenure shall be 6 years. However, an employee may be transferred before completion of post/station tenure on administrative grounds for reasons to be recorded in writing by an authority who is superior to the authority competent to order such transfer. The Authority Competent to approve the rotational transfer in normal course will initiate the proposal with proper justification for approval of the Superior Authority.

2. Various references have been received from service Unions/Associations requesting to exempt RMS officials from the provision of 6 years of Station tenure. The matter has been examined and found that most of the posts in RMS held by Group ‘C’ officials are non sensitive posts. Therefore, it has been decided to exempt Group ‘C’ RMS officials from the provision of 6 years of station tenure. However, the provision of post tenure of 3 years will continue to be in force.
