“(ix) The increment of a Government servant which falls due in a quarter may be sanctioned on the first day of that quarter even though he retires from services or expires prior to the actual date of accrual of increment”.

ORDER:

In the Government Order third read above, amendment to Fundamental Rule 101 for granting special adoption leave for a period of 180 days to a woman government servant who adopts a child below the age of one year, have been issued.

2. In the Government Order forth read above, orders have been issued enhancing the child adoption leave from 180 days to 270 days.

3. Accordingly, the following notification will be published in the Tamil Nadu Government Gazette:-

NOTIFICATION.

In exercise of the powers conferred by the proviso to Article 309 read with Article 313 of the Constitution of India and of all other powers hereunto enabling, the Governor of Tamil Nadu hereby makes the following amendment to the Fundamental Rules and the Instructions thereunder.

2. The amendment hereby made shall be deemed to have come into force on the 5th January 2018.

AMENDMENT. 

In the said Fundamental Rules, in rule 101, under the heading Instructions under Rule 101 (ab) — Special adoption leave”, in instruction 1, for the expression “180 days”, the expression “270 days” shall be substituted.

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 read with Article 313 of the Constitution of India and of all other powers hereunto enabling, the Governor of Tamil Nadu hereby makes the following amendment to the Fundamental Rules.

2. The amendment hereby made shall be deemed to have come into force on the 24th February 2017.

AMENDMENT

In the said Fundamental Rules, in Annexure VII referred to in ruling (3) under rule 85, under the heading “II.Special Casual Leave”, in rule 7, in sub-rule(a), in clause(ii),for Note 2, the following Note shall be substituted, namely:-

“2.The following diseases shall be treated as infectious diseases for the purpose of grant of special casual leave and special casual leave shall be sanctioned on production of certificate issued by the concerned authority, i.e. Municipality Health Officer or Corporation Health Officer or District Health Officer (DDHS), as the case may be, for the period noted against each disease:-

In the said Fundamental Rules, in rule 101, under the heading “Instruction under Rule 101(a) – Maternity Leave”, in Instruction 1, after the proviso, the following proviso shall be added, namely:-

“provided further that, in the case of a woman government servant with two surviving children born as twins in the first delivery, maternity leave shall be granted for one more delivery”.

Sub : Sharing of order dated 11.10.2018 of Hon’ble CAT/PB/Delhi in O.A.No 2230/2014 filed by Shri Partha Protim Mukhopadhyay & Ors Vs UOI & Ors.

A number of court cases have been filed by the employees (in the pre-revised scales of Rs. 6500-10500/7450-11500) of various Zonal Railways seeking re-fixation of their pay in the upgraded pay scales (in pre-revised scale of Rs. 7450-11500/7500-12000). In one such case, the issue has been adjudicated by Hon’ble CAT/PB/Delhi in O.A.No.2230/2014 filed by Shri Partha Protim Mukhopadhyay & Ors Vs UOI & Ors.Union of India & Ors and Hon’ble CAT/PB/Delhi has been pleased to pass the following orders:-

“5. The recommendations of the 6th CPC became enforceable w.e,f: 01.01.2006. The formula evolved by the 6th CPC is that the pay scale of an employee shall be .revised by multiplying the basic pay of the employee as on 01.01.2006 with the factor 1.86. This is fact, is the ratio laid down by the Hon’ble Supreme Court in a batch of civil appeals. The plea of the applicant is that they have been wrongly placed in the pay scale of Rs. 7450-11500 instead of Rs. 7500-12000.

6. The grievance is referable to the fixation of pay scales on the basis of 5th CPC recommendations. That in turn, became enforceable in the year 1996. The mistake, if at all, as regards fixation of pay scales has crept in the year 1996. There is nothing on record to disclose that the applicant has ever raised this contention either after the recommendations of the 5th CPC were implemented or before the Anomalies Committee constituted soon after the report of the eh CPC.

7. At this length of time, the grievance even if genuine, cannot be redressed. The OA is accordingly dismissed.”.

2. The Railways may bring the above position to the notice of Railway Advocate contesting such other cases and take necessary action to file a copy of above judgement of the Principal Bench before the respective Hon’ble Tribunals/ Hon’ble Courts and also to utilize the same during arguments.

Sub: Reiteration of GP 4800/5400 (level-8/level-9) as apex promotional grade in stenographers cadre in Field offices (including Zonal Railways) as per extant provisions.

Proposals are being received from Railways/ Production Units for upgradation of Stenographers cadre by granting GP 6600/- in PB-3 (6th CPC scales) to senior PSs-I in the Railway/ Unit.

2. In above context, it is hereby clarified that in terms of the extant rules/position such a grade in GP Rs.6600/- is not available/ sanctioned in the category of Stenographers on zonal Railways (Field Offices). Further, based on the recommendations of Pay Commissions and decisions of the Government/Railway Board, there is no provision for a grade in pay structure highher than GP Rs.4800/5400 Level 8 / Level 9 in field offices includin zonal Railways. Any local Office Order wherever issued by any Railway contrary to this established position is irregular and is to be withdrawn immediately under intimation to this office.

Attention is invited to instructions contained in Board’s letter of even number dated 12.05.2017 regarding modification in the AVC for promotion to the post of Goods Guards in Grade Pay Rs.2800 (Level-5).

In para 2(i) of the aforesaid letter showing the feeder categories eligible to appear in General Selection against 60% quota for filling up the vacancies of Goods Guard in Grade Pay Rs.2800, the categories of Shunting Master-II and Shunting Jamadar, both in GP Rs.2400 (Level-4) may also be included.

This supersedes the earlier instructions contained in letter of even number dated 27.07.2018, wherein shunting Master & Shunting Jamadar were inadvertently mentioned as eligible category for promotion to Goods Guard.

This also disposes off Northern Railway’s letter No.752-E/42/E1B/Pt.I dated 31.08.2018.

On receiving feedback from different Gp controllers, the suggestions were forwarded to Wage Package Team, Ishapore for incorporation in the Wage Package. The updated format of wage package has been accepted by OFB and some further modifications for incorporation of Aadhaar No, Bank Account No, Date of Retirement (copy enclosed) has now been sought in the Wage Package by OFB.

It is therefore, requested to kindly look into it and offer your valuable suggestions/proposals in consultation with Br. Accounts Offices under your jurisdiction for onward submission to OFB.

OFFICE MEMORANDUM

Sub : Promotion of Government servants found fit by review DPC after retirement —procedure and guidelines to be followed

The undersigned is directed to invite reference to this Department’s OM of even number dated 25.1.2016 which deals with the grant of notional promotion to a Government servant exonerated in a disciplinary proceedings after retirement. However, the cases of Government servants who are found fit by review DPC after their retirement on account of revision of seniority list of the feeder cadre, upgradation of below benchmark APARs etc. are not covered under the said OM. These cases have now been examined and it has been decided to lay down procedure as narrated in subsequent paragraphs for dealing with such cases.

2. A Government servant who is not recommended in the panel by the original / supplementary DPC but later on is recommended in the panel by a review DPC but has since retired may be given the benefit of notional promotion w.e.f. the date of promotion of his immediate junior in the reviewed panel and fixation of notional pay subject to the fulfillment of the following conditions:

(i) That the officer who is immediate junior to the retired Government servant assumed charge of the higher post on or before the date of superannuation of the retired Government servant.

(ii) That the said retired Government servant was clear from vigilance angle on the date of promotion of his immediate junior.

(iii) A retired Government servant who is considered for notional promotion from the date of promotion of his immediate junior on the recommendation of a review DPC would also be entitled to fixation of pension on the basis of such notional pay.

(iv) The notional promotion, notional pay fixation and revision of pension shall be further subject to extant rules on promotion, pay fixation and CCS (Pension) Rules, 1972. Actual increase in pension shall be given only from the date of approval of reviewed panel by the competent authority. No arrears shall be paid.

3. The provisions contained in this Office Memorandum shall become operational from the date of issue of this Office Memorandum. Past cases settled in accordance with the earlier provision shall not be reopened.

4. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

Kind attention is invited to GS/NFIR’s letter of even number dated 03rd October, 2018 to CRB (copy enclosed).

The subject was also discussed with the Member (Staff) by NFIR on 25th October, 2018 and explained the need for issuing instructions to GMs to appoint the wards of safety category staff who have already been selected prior to 27/10/2017. The MS has assured to take appropriate initiative and reach CRB for decision.

NFIR, therefore, requests the CRB to kindly see that orders are issued by Railway Board for appointing those selected wards of safety category staff early. As already requested by the Federation, CRB and Railway Board may kindly take conscious decision with regard to continuance of LARSGESS keeping in mind the reality that the Indian Railways is unique, complex and un-comparable with any other system and at times, decisions are required to be taken by Railways in larger public interest and equally safety of staff belonging to critical safety categories.
