OFFICE MEMORANDUM
Subject :- Admissibility of Nursing Allowance during absence of more than 30 days.
References have been received in this Department seeking clarification regarding admissibility of Nursing Allowance to Nursing personnel working in various hospitals and institutions during absence of full calendar month(s) due to leave, training, tour etc.
2. The matter has been considered in this Department. It has been decided that Nursing Allowance will be admissible to Nursing personnel during absence of more than 30 days due to leave, training, tour etc., however, duration of such leave will be restricted to maximum 60 days. Beyond 60 days leave/ absence, the Nursing Allowance will not be admissible.

BSNL 3 day Relay Hunger Strike from 24th July 2017
The 3 day Relay Hunger Strike starts tomorrow – organise it effectively with massive participation.
The All Unions and Associations of BSNL (AUAB) has called on the BSNL employees to organise a powerful 3 day Relay Hunger Strike, starting from tomorrow. The circle and district secretaries of BSNLEU are requested to organise the Relay Hunger Strike effectively, with massive participation of the employee, by making necessary coordination with the other constituents of the AUAB. Report and photos of the programme may be sent to the CHQ on [email protected]. Demands of the programme are as follows:-
The Department of Telecommunications will move a Cabinet Note, seeking approval for the settlement of wage revision of BSNL employees.
Steps will be taken for the revision of pension of the BSNL retirees.
Pension contribution will be collected from BSNL, by the DoT, only as per the Government of India Rule.
BSNL will be allotted 4G spectrum, as per the terms and conditions submitted to the government, by the BSNL Management.
DEDUCTIONS U/S 16 OF THE ACT FROM THE INCOME FROM SALARIES
Entertainment Allowance [Section 16(ii)]:
A deduction is also allowed under section 16(ii) in respect of any allowance in the nature of an entertainment allowance specifically granted by an employer to the assessee, who is in receipt of a salary from the Government, a sum equal to one-fifth of his salary(exclusive of any allowance, benefit or other perquisite) or five thousand rupees whichever is less. No deduction on account of entertainment allowance is available to nongovernment employees.
Tax on Employment [Section 16(iii)]:
The tax on employment (Professional Tax) within the meaning of article 276(2) of the Constitution of India, leviable by or under any law, shall also be allowed as a deduction in computing the income under the head “Salaries”.
It may be clarified that “Standard Deduction” from gross salary income, which was being allowed up to financial year 2004-05 is not allowable from financial year 2005-06 onwards.

Strike by Bank Employees

(a) whether the Government has taken note of the frequent strikes being called for by the bank employees to consider their demands and if so, the details thereof;
(b) whether this has become a farce by bank employees going on strike every now and then, if so, the details thereof and the reasons therefor; and
(c) whether the Government has taken any decision to ward off any future strikes by banks that hinders the daily routine of the customers across the country, if so, the details thereof and if not, the reasons therefor and the stand of the Government in this regard?

(a) to (c): Intimations of calls for strike given by unions/associations of employees of various Public Sector Banks in support of their demands are received from time to time. As per inputs of the Indian Banks’ Association (which, inter alia, carries on negotiations with labour unions on behalf of bank managements on their specific mandate),demands raised by workmen unions or officers’ associations are discussed between the managements of banks and the unions/associations in appropriate forums, with a view to settle the issues raised amicably through mutual discussions/negotiations. Further, all efforts are made to avert strike whenever a strike call is given, which may include conciliation proceedings before the Chief Labour Commissioner.
Upon receipt of the intimations, Government issues an advisory to banks regarding maintenance of banking operations during the strike through appropriate steps for avoiding inconvenience to the general public, including adequate loading of cash in ATMs, ensuring operation of clearing houses, internet banking and core banking solution, etc.

Sub: Amendment in the Rajasthan Travelling Allowance Rules, 1971
In exercise of the powers conferred under Rule 42 of the Rajasthan Service Rules, the Governor is hereby pleased to make the following amendment in the Rajasthan Travelling Allowance Rules, 1971, namely :-
In the said rule, in Appendix-III – MILEAGE ALLOWANCE FOR TRAVEL BY AIR of Rule 8(1), below existing Item No. 3 of Exception, the following new Item No. 4 shall be inserted, namely :-
“4. The Additional Director General of Police, Intelligence, Rajasthan, Jaipur is authorised to grant permission to travel by Air to the Security Personnel of Chief Minister’s Security Cell who travel in advance in cases of Chief Minister’s tour outside the State, whenever the exigencies of work so require, even though he is not entitled to travel by Air under these rules.”

With reference to the above mentioned matter, the undersigned is to draw attention to the Office Memorandum of even Number dated 14.12.2017 vide which empanelment of Mata Chanan Devi Hospital, Janakpuri, New Delhi under CGHS Delhi was suspended. In this regard the representation of the said hospital for revoking of the suspension on the basis of corrective steps taken by the hospital has been examined and it is now been decided to revoke the suspension of the empanelment of Mata Chanan Devi Hospital, Janakpuri, New Delhi under CGHS, w.e.f. date of issue of this order on the same terms and conditions as indicated in Office Memorandum No S-11045/36/2012-CGHS (HEC) vide which it was initially empanelled.

Pension Benefits to Bank Employees

FINANCE be pleased to state:-
(a) the total number of Bank officers/ employees that were denied pension benefits as per 2010 bipartite settlement between IBA and UFBU;
(b) the total number of court cases that are pending all over the county in this regard;
(c) whether it is legal and constitutional to deny pension to eligible resigned bank officers/employees and if so, the details thereof;
(d) whether his Ministry is aware of this anomaly prevailing in the system; and
(e) if so, the steps being taken to resolve the pension issue, if not, the steps are likely to be taken by the Government to resolve the pension issue?
ANSWER The Minister of State in the Ministry of Finance
(a): Pension of nationalised banks is based on a bipartite negotiation process at the industry level between the Indian Banks’ Association (IBA)(which negotiates on behalf of bank managements on their specific mandate) and unions/associations of bank employees. IBA has informed that as per the agreed terms and conditions of the settlement dated 27.4.2010 between IBA (on behalf of member banks) and Workmen Unions (Bipartite Settlement) / Officer Associations (Joint Note), the officers/employees who fulfilled eligibility criteria and opted for pension option are not denied pension benefits.
(b): As per inputs received from banks, 178 court cases are pending in this regard.
(c) to (e): IBA has informed that as per the terms and conditions of the settlement arrived at between IBA and United Forum of Bank Unions (UFBU), the officers/employees who had resigned from service were not eligible for pension option, although they were entitled to Contributory Provident Fund and the same was paid to them. Some of these ex-employees of different public sector banks approached different high courts praying that they be made eligible for pension option. Hon’ble Karnataka High Court, vide judgement dated 31.8.2017, dismissed the writ petitions filed by these ex-employees with the observation that the court does not find merit in the same.
