Kendriya Vidyalaya Sangathan vide office-order of even number dated 30.03.2017, conveyed approval of Government of India, for establishing 50 new Kendriya Vidyalayas under Civil Sector with the stipulation that the sponsoring authority concerned is required to transfer the identified and demarcated land and also to give possession of the same to KVS prior to opening of the new Kendriya Vidyalaya. Kandriya Vidyalaya Tivri. District Jodhpur, Rajasthan is one of the 50 new Kendriya Vidyalayas sanctioned.

Since the land in the matter of this Kendriya Vidyalaya has been transferred in favour of Kendriya Vidyalaya concerned, sanction of the Commissioner, KVS is hereby conveyed to start a new Kendriya Vidyalaya under Civil Sector with immediate effect, at the following location:-

Subject: Submission of documents / information by identified Pensioner Associations for release of Grant-in-aid during 2018-2019 under Web-based ‘Pensioners’ Portal’ Scheme.

Sir,

This Department would be considering the proposal for release of Grant-in-Aid for the financial year 2018-19 to various identified Pensioners’ Associations under the Scheme of Pensioners’ Portal. For this, it is necessary that the Pensioners’ Associations submit a brief on the activities undertaken in the last financial year and also formulate a Work Plan for the current financial year. While formulating the Action Plan it also needs to be ensured that activities under SANKALP are also included in the Work Plan.

2. You are also aware that during 2017-2018 Grant-in-aid was released on the basis of your registration (Unique Identification number) with NITI AAYOG DARPAN PORTAL with Unique ID registration No. with PFMS (EAT) module which was a mandatory requirement to get the grant-in-aid. Further, you had to book the utilization of funds for approved components under the Scheme of GIA through EAT Module under PFMS which is also mandatory requirement. Any expenditure booked otherwise than through EAT module will not qualify for adjustment against the Grant-in-aid sanctioned and released and the Association will be liable to refund such amount to this Department alongwith interest. Moreover, your Association may also not become eligible of for further release of Grant-inaid for 2018-2019 onwards. In this connection please refer to this Department’s sanction letter for release of Grant-in-aid for the financial year 2017-2018 and also refer to number of e-mails sent to you in the matter.

3. Accordingly, all the Pensioners Associations will have to download/provide a copy of Utilization Certificate and Statement of Accounts through PFMS-EAT module and subsequently audited by CA so as to enable you to get Grant-in-aid for the financial year 2018-2019.

4. You are therefore requested to furnish the following information/documents :

i) Activities undertaken during 2017-2018 with reference to Annual Action Plan 2017-2018 submitted by you in the enclosed proforma (Annexure-I)

ii) Annual work plan for the year 2018-19. While undertaking this exercise, you may include activities which may contribute to overall welfare of the pensioners.

iii) The Work Plan/activities undertaken under “SANKALP’ in pursuance of this Department’s letter NoA/36/2013-P&PW(C) dated 17.09.2014 (copy enclosed)

iv) The number of Pensioners Grievances registered online on CEPENGRAMS by the Pensioners Association through their login-ID and present status of these Grievances.

v) Total existing memberships of the Association as on 01.04.2018 and no. of members added/deleted during 2017-18and the present status.

vi) Utilization certificate and statement of accounts for the Grant-in-aid released during 2017-18 downloaded/retrieved from the PFMS-EAT Module and audited the same by CA.

vii) Filled in proforma for furnishing Association Details (Annexure-II)

3. In addition to above, the Pensioners’ Association are also required to submit quarterly progress report in this regard to the department of Pension & Pensioners’ Welfare for perusal.

4. In view of the above, all the identified Pensioners’ Associations are requested to submit the above stated information alongwith requisite documents latest by so” h July, 2018 positively so as to enable for this Department to release the Grant-in-Aid for the financial year 2018-19 well in time.

With reference to the above subject the undersigned is to draw attention to the revised timelines and constitution of High Powered Committee in compliance of the directions of Hon’ble Supreme Court of India in their Judgement in the WP(Civil) No 694 of 2015 between Shiva Kant Jha Vs UOI delivered on 13th April 2018 and to state that it has been decided to issue guidelines to the Additional Directors of CGHS for implementing these decisions. The new guidelines are enclosed for perusal and compliance.

GUIDELINES TO PROCESS THE REQUESTS FOR SETTLEMENT OF THE MEDICAL CLAIMS

1. New Timelines for settlement of the Medical Claims

The new timelines prescribed for settlement of normal medical claims are 30 days from the date of submission to the payment by Pay & Accounts Office. Every effort must be made to avoid delay at any stage. Proper calculation sheet must be prepared in the file, so that the same could be shared with the beneficiaries, if there are requests for reasons for the deductions.

2. Full reimbursement case /Cases for relaxation of Rules

As per the new guidelines they fall into two categories
(a) Full reimbursement – Non-HPC (Non- High Power Committee) cases
(b) Full reimbursement – HPC (High Power Committee) cases

a) Full reimbursement – Non-HPC cases

The following cases fall under this category;

i) Treatment was obtained in a private unrecognized hospital under emergency and the patient was admitted by others when the beneficiary was unconscious or severely incapacitated and was hospitalized for a prolonged period.

ii) Treatment was obtained in a private unrecognized hospital under emergency and was admitted for prolonged period for treatment of Head Injury, Coma , Septicemia, Multi-organ failure , etc.

iii) Treatment was obtained in a private unrecognized hospital under emergency for treatment of advanced malignancy

iv) Treatment was taken under emergency in higher type of accommodation as rooms as per his/her entitlement are not available during that period.

v) Treatment was taken in higher type of accommodation under specific conditions for isolation of patients to avoid contacting infections

vi) Treatment was obtained in a private unrecognized hospital under emergency when there is a strike in Govt. hospitals.

vii) Treatment was obtained in a private unrecognized hospital under emergency while on official tour to non-CGHS covered area.

Although the new OM has not mentioned about STC recommendation, it is advisable to have expert Committee meetings under the Chairperson of Addl. DGHS (as in the case of earlier STC meetings) in respect of item Nos. i), ii),iii) and v) before arriving at a decision. The conditions mentioned at Nos. iv),vi) and vii) are administrative in nature and do not require meetings of expert committees and may be recommended by Addl. Director, if conditions are satisfied.

In Delhi the expert committee meetings shall be organized by respective CMO(R&H) and by AD(R&H) in case of claims of serving employees of Delhi. Such meetings in respect of other cities shall be organized by Sr. CMO in the office of Addl.DDG(HQ).

The requests for full reimbursement as examined by Additional Director (HQ)/ Addl. DDG(HQ), in consultation with expert committee meetings, wherever deemed necessary and recommended for full reimbursement shall be submitted to Director, CGHS and concurrence of IFD may be obtained after approval of AS&DG, CGHS before the seeking the approval of Secretary for reimbursement in excess of CGHS rates.

If the above criteria are not satisfied (including the regrets by expert committees) the requests may be regretted by Addl. Director of concerned City, with a covering letter explaining the reasons and referring to the concerned OM.

In case there is a representation to consider as a special case then only it may be placed before the High Power Committee.

Addl. Directors shall prepare a self-contained note giving details of case and submit the files with relevant documents to Director, CGHS though AD(HQ)/Addl. DDG(HQ)

If the proposal is approved by AS&DG,CGHS , concurrence of IFD and approval of Secretary , Health & Family Welfare are solicited for reimbursement in excess of approved rates.

b) Full reimbursement – HPC cases

The Composition of High Power Committee, shall be as under:

1. Special Director General —– Chairperson
2. Directorate General, CGHS or his Nominee —- Member
3. Additional Director, CGHS(HQ) / Addl. DDG(HQ),CGHS —- Member
4. Addl. Director, CGHS(R&H) —- Member Secretary
5. One Government Specialist (of concerned Speciality) —- Member

The High Powered Committee shall consider the representations of only those CGHS beneficiaries having a valid CGHS Card.

The High Powered Committee shall consider representations received from CGHS beneficiaries holding valid CGHS cards only at the time treatment, in respect of the following conditions:

1. Approval for air-fare with or without attendant on the advice of treating doctor for treatment in another city even though he is not eligible for air travel / treatment facilities are available in city of residence

2. Representations from CGHS beneficiaries seeking full reimbursements under special Circumstances.

3. Relaxation of Rules

High Powered Committee shall meet once in a month and action on the decisions taken shall be completed within seven days of meeting, with the concurrence of the IFD , wherever , it is deemed necessary.

Addl Directors shall submit the files with relevant documents to the AD(HQ) / Addl. DDG(HQ) for placing the representations before High Power Committee.

AD(R&H) shall be Member Secretary , who shall with the help of Sr. CMO of the Office of Adl.DDG(HQ) shall issue meeting notices including notices to concerned Govt. Specialists and organize meting for the Meetings of High Power Committee.

The requests received upto the 15th of the month shall be placed before the Committee.

If the High Power Committee does not recommend the regret letters shall be issued explaining the reasons.

If the High Power Committee recommends full reimbursement / relaxation of rules, Concurrence of IFD and approval of Secretary (H&FW) shall be obtained within 7 days.

3. In addition there are expert committees to consider several cases

Expert Committee meetings for other purposes shall continue to be held as in the past in the following cases:

Expert Committee meetings for Consideration of Liver Transplant cases, Bariatric Surgery,

Bone-marrow / Stem Cell Transplant, Justification of treatment / Implants in selected cases shall continue as before.

Standing Committee meetings for Cochlear Implant shall continue as before.

Expert Committee meetings for approval of Drugs , etc., shall continue

Attention is invited to this Ministry’s letter No.E(NG)II/84/RC-1/174 dated 25.06.1985, No. E(NG)ll/88/RC-1/1/Policy dated 02.11.1989 read with para 2(i) of letter No. E(NG)Il/88/RC- 111/Policy dated 16.05.1991, stipulating inter-alia, that suitability of a person to be considered for appointment on compassionate grounds should be assessed by an appropriate suitability test, keeping the compassion in view. Board’s letter dated 25.06.1985 has laid down that such appointment be considered as per the educational qualification possessed by the candidate.

2. As regards number of chances, this Ministry’s letter dated 28.04.1999 (RBE No. 84/1999), 21.09.2001(RBE No. 192/2001) and dated 02.03.2012 ( RBE No. 28/2012), specify the number of chances to be given to a candidate (wards as well as widow/wife), for appearing in the suitability test for appointment on compassionate grounds to Non-Gazetted posts on the Railways. Accordingly, at present, there are three (03) and four (04) chances available for wards and widow/wife respectively.

3. It has come to the notice that not only the procedure adopted for conducting suitability test and additional chances to be given to candidates for appointment on compassionate grounds by the Zonal Railways vary from the instructions issued at paras I and 2 above, but the directives/intent of stipulation made in the instruction ibid are also not being followed in true spirit.

4. Accordingly, the matter has been looked into. It has now been decided by the Board that in compliance of letters mentioned at para 2 above, maximum of three such chances to the wards and four chances may be given to widow/wife commensurate with their educational qualification to the post and suitability may be adjudged accordingly. Second chance should be given as a rule and uniformally followed.

5. It is also reiterated that 2nd chance to wards and widow should be given with the approval of competent authority (DRMs/HODs/CWMs as the case may be). However, 3rd chance to ward/widow/wife and 4th chance to widow/wife will require personal approval of the General Manager.

6. In case a request has been received from the candidate for appointment on other Railway, his/her case may be transferred alongwith all relevant papers to that Railway. Assessment of suitability may be done by the Railway where the candidate is to be appointed.

Consequent upon the decisions taken by the Government on the recommendations of the Seventh Central Pay Commission relating to revision of allowances, the President is pleased to decide that Medical Officers will be granted Post Graduate Allowance as detailed below:

3. The terms & conditions as contained in para 1426 of IREC Vol.11 (Sixth Edition — 1987, Second Reprint Edition 2005), will remain unchanged.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
