SUbject: – Implementation of orders of Hon’ble Courts/AFTs in pre-2006 retiree Havildars granted Hony Rank of Nb Sub cases.
The Hon’ble Supreme Court in the following cases has decided:-
(a) Ex Hav (Hony Nb Sub)Virender Singh & 4 Ors. who retired prior to 01.01.2006, filed OA No. 42/2010 before Hon’ble AFT (RB) Chandigarh seeking the benefits of fitment in the pay grade of Nb Sub in accordance with Government of India, Ministry of Defence letter No 1(8)/2008-D(Pen/Policy) dated 12 June 2009. The Hon’ble AFT, vide its order dated 08 February, 2010 ordered to grant the benefit to the petitioners with instructions to release the entitlement of pension and arrears w.e.f. 01.01.2006. Civil Appeal filed by the U01 to assail AFT order dated 08 February, 2010 was dismissed by the Hon’ble Supreme Court vide order dated 13 December, 2010.
(b) In a similar case, Civil Appeal No 4677/2014 was filed by the UO1 in the Hon’ble Supreme Court in Ex Hay (Hony Nb Sub) Subhash Chander (OA 3305/2013) case. Hon’ble Supreme Court vide its order dated 20 May 2015 has dismissed the appeal and held that “we are not inclined to entertain this appeal, which is dismissed accordingly.”
2. In view of the above judgment of Hon’ble Supreme Court, matter for implementation of orders of Hon’ble Courts/AFTs in respect of Armed Forces Personnel in Hony Nb Sub cases was taken up with Department of Expenditure, Ministry of Finance for consideration. Deptt. of Expenditure has agreed to implement those orders of Hon’ble Courts/AFTs.
3. Accordingly, I am directed to convey the approval of Competent Authority in Ministry of Defence for implementation of orders of Hon’ble Courts/AFTs in pre-2006 retiree Havildars granted Hony rank of Nb Sub cases, by Service Hqrs. as under
a) Service Hqrs may implement the orders of Hon’ble Courts/AFTs in Hony Nb Sub cases by issuing absolute sanction keeping in view of the orders of Hon’ble Apex Court, quoted at Para 1 above.
b) In those Hony Nb Sub cases in which conditional sanctions have been issued by the Service Hqrs. with the approval of competent authority in MoD, Service Hqrs. may convert conditional sanction into absolute sanction ,Ett their level with the approval of competent authority at Service HQ. No interest shall be payable as per Hon’ble Supreme Court order dated 20.05.2015 in the case of UOI Vs Subhash Chander Soni.
4. The benefit regarding grant of pension of Naib Subedar to pre-2006 retired Havildars who were granted Honorary rank of Naib Subedar after their retirement, as ordered by the Courts/AFTs, would be applicable only in case of revision of pension as indicated in MoD order No 1(8)/2008-D(Pen/Policy) dated 12.06.2009 and not for retirement gratuity, encashment of leave, composite transfer grant etc.
5.The amount involved on account of implementation of Court/AFT orders will be booked under charged expenditure.
6. This issues with concurrence of Department of Expenditure, Ministry of Finance vide I.D. Note No. 140/E-V/2017 dated 05.09.2017 and MoD (Fin/Pen) U.O. No. 10(6)/2012/Fin/Pen/2012 dated 08.09.2017.

I am to invite your attention to the references cited.
2.Based on the recommendations of the Official Committee, 2017, orders have been issued in the Government Orders first to fourth cited granting revision of pay, special pay and allowances to the State Government employees and teachers including employees of local bodies. The pay revision has been given notional effect from 1st January 2016 with monetary benefit from 1st October 2017.
3.As per Rule 6(2) of the Tamil Nadu Revised Pay Rules, 2017 every employee shall have to exercise option to come over to the revised pay structure within 3 months from the date of coming into force of the above rules on a date advantageous to the employees concerned as classified under sub-rule (1) of the above Rules. Considering the time limit available for exercising option by the employees to switch over to the revised pay structure, the pay bills have been presented by the Drawing and Disbursing Officers in the old pay itself to avoid difficulty in drawing salary by the employees.
4.Based on the option exercised by the individual employees,
(i) In the case of non-self drawing employees, the Heads of Offices concerned shall fix the pay of such employees in the revised pay structure and send the orders to the Drawing and Disbursing Officers concerned for drawing salary in the new pay immediately;
(ii) Likewise in the case of self-drawing officers, the Pay and Accounts Officer in case of the city offices including Pay and Accounts Officer, Madurai and in respect of other officers in Districts, the Accountant General shall fix the pay of the Officers in the revised pay structure and issue necessary pay slips so as to enable the Officers concerned to present the bills and draw the salary in the new pay structure immediately.
5.The Drawing and Disbursing Officers concerned on getting the orders from the Heads of Offices / pay fixing authorities concerned shall draw and disburse monthly salaries in the new pay structure from the month of November 2017 along with arrears for the month of October 2017. They shall present salary bills accordingly for the month of November 2017 after claiming arrears for October 2017 before 20-11-2017.
6.The National Informatics Centre (NIC) is requested to update the software application for salary bills in accordance with the orders issued in the Government Orders cited to enable drawing of salary in revised pay structure from November 2017, after claiming the arrears for the month of October 2017 before 20-11-2017.
7.The Commissioner of Treasuries and Accounts is also requested to co-ordinate with the National Informatics Centre (NIC) to finalise the revised software application for presenting salary bills in the revised pay structure immediately.
8.All Head of Departments are therefore requested to issue necessary instructions to all their subordinate officers to adhere to the above instructions scrupulously.

The undersigned is directed to refer to this Department’s Office Memorandum of even number dated 11.08.2017 on the subject cited above whereby the Ministries/ Departments were requested to nominate their Liaison Officers for the above training programmes organised by Institute of Secretariat Training & Management (ISTM) to facilitate them in the performance of their duties.
2. It is stated that the ISTM issues course circulars for all the calendared courses at least 90 days before the commencement of the courses. Online nomination by the interested applicant/ nominees is mandatory in all courses. This is, inter-alia, required for shortlisting of the candidates, issuing automated communications through mail/ SMS of acceptance/ non- acceptance to their personal e-mail address/ mobile, plan logistics, etc.. The undersigned is directed to state that the Delhi Police have intimated about the visit of the Hon’ble Prime Minister at Patel Chowk on 31.10.2017 to pay floral tributes at the Statue of Sardar Patel on the occasion of his birth anniversary. It has also been informed that the Run for Unity will be held on 31.10.2017 at MDC National Stadium and the Hon’ble Prime Minister is likely to flag off the run.
2. To make elaborate law & order/ security arrangements, the buildings surrounding Patel Chowk and MDC National Stadium are required to be sealed after conducting anti-sabotage checks. These office buildings (as per lists attached) are required to be vacated at 1500 hours on 30.10.2017 so that room are sealed after conducting regular anti-sabotage checks. The arrangements by Delhi Police will continue till 0930 hours on 31.10.2017 for the buildings/ offices indicated in List-I and till 1700 hours on 31.10.2017 for the buildings/ offices indicated in List-II.
3. All Ministries/ Departments are requested to bring this to the notice of all concerned for information/ necessary action.

In continuation of this office letter of even number dated 15.09.2017 (RBE No. 130/2017), the procedure for Mutual Transfer is further simplified. Hereafter, for Divisionally controlled posts, applications for Mutual Transfer duly signed by both applicants in the proper format, from a Division of one Railway to Division on another Railway need not be routed through the HQ offices. It shall be dealt directly only by the Divisions concerned.
For HQ controlled posts the prevailing procedure shall continue

Personnel Department will forward the application with all necessary documents to Zonal HQ (CPO office).
(iii)
Forwarding by Headquarters Personnel Deptt (For HQ controlled posts):-On receipt of the application duly forwarded from Division/Workshop, the HQ Personnel Department office will forward it to the Zonal Rly/PU concerned.

Note : Mutual Exchange is between two employees of the some grade and cadre. This must be verified by the Personnel Department at every stage of processing of applications.

Relieving/Sparing:Â – Once the transfer order is issued; employees should be relieved immediately with the senior employee being relieved first. This will be the responsibility of Branch Officer/Head of Department concerned under whom the staff is working (Board’s letters No. ERP/Portal – Transfer/2013 dated 30.04.2014 and No. E(NG)I-2007/TR/26 dated 04.12.2007 refers).

Dispatch of LPC and Service Records :- Personnel Department concerned should ensure that the LPC and Service Record of the employee(s) are sent expeditiously to the new Division/Zone etc. in terms of Board’s letter number E(NG)I-2001/TR/16 dated 21.11.2001. Attested Xerox copy of the Service Record should be given to the employee concerned.

Note :Â (i) At the stage of forwarding of applications, files need not be routed through concerned Branch Officer/HOD. The consultation with Branch Officers/MODS concerned in Division/HQ shall be done at the stage of relieving only.
(ii) Necessary modifications to Schedule of Powers (SOP) should be made accordingly.
3. As the mutual transfers are ordered with the consent of both the employees. it should be made clear right at the time of forwarding applications that no request for backtracking from the mutual exchange arrangement will be entertained under any circumstances (Board’s letter No.5(NGll-2006/TR/6 dated 21.04.2006 refers).
4. It may specifically be noted that forwarding of application cannot be done by any level lower than the Divisional Personnel Officer (DPO) or Sr DPO in the Divisions and WPO in the Workshops. Dy CMM, WMs, AENs and other such Officers/Unites should invariably route the request applications through their corresponding Personnel Officer ang should not forward any application to other Division/Unit directly.
5. All other terms and conditions regulating mutual transfer of Railway employees will continue to remain in force.

12/2009: Recognition of hospitals and tie-ups for Neuro surgery patients on Central Railway.
As per the extant practice being followed by the Railways, private hospitals are empanelled as per CGHS rates. In the instant case, Jaslok Hospital, Mumbai is not willing to provide Neurosurgery treatment as per CGHS rates whereas there are other private hospitals available which are willing to provide Neurosurgery treatment as per CGHS rates and Railway has empanelled four such private hospitals i.e. (i) Surana Hospital, Chembur (2) Suraj Hospital, Sanapada (3) Balalji Hospital, Byculla and (4) Seven Hills Hospital, Mumbai. Four private hospitals empanelled for Neurosurgery treatment seems enough to cater the Neurosurgery cases needs of Central Railway.
On the insistence of the Staff side, it was agreed to review empanelment of Jaslok Hospital.

Instructions have been reiterated jointly by Commercial and Accounts Directorates to all Zonal Railways vide letter No.2006/AC-II/45/10 dated 27.06.2016. Staff side raised that when the Alpha code is not printed by system mistake, debits should not be raised without enquiry. Official side explained that the main issue stands settled with the issue of the above
instructions.
22/2010: Provision of adequate facilities for Ticket Checking Staff in the Rest Houses on the Zonal Railways.
Staff side requested for status report from all the zonal Railways which was agreed to. Staff Side also requested that policy instructions in the matter be reiterated which was also agreed to.

12/2005: Payment of Washing Allowance. & 8/2011: Demands of the AC staff of the Indian Railways.
Instructions have been issued vide RBE No.141/2017 to the effect that consequent to the decision taken by the Government on the recommendations of the 7th CPC, these four allowances namely Washing allowance, kit maintenance allowance, uniform allowance and Shoe allowance have been subsumed into a single Dress Allowance. On other issues under Item No.8/2011, position will be furnished.

1/2011: Disciplinary proceedings arising out of Vigilance cases against Group ‘C’ and ‘D’ staff.
The matter was discussed. In some railways the adequacy of punishment is also being decided in consultation with Vigilance. Clarification will be issued on this aspect.

Out of total 1647 identified stations, 396 stations have been provided Rest Rooms. Number of stations where work is in progress is 63 and number of stations where work has been proposed is 266. Latest status report shall be provided to the Staff Side.

26/2010: Special Duty Allowance – Exemption sought for from the purview of Income Tax.
The matter has been referred to the Ministry of Finance vide Board’s OM No.F(X)I-2009/ 23/6 dated 24.09.2012. Reply from Ministry of Finance is still awaited despite reminders, the latest of which was sent on 04.09.2017. Staff side requested for copies of references made which was provided in the meeting itself.
13/2012: Refund of Income Tax deducted from the salary of Running Staff.
Mechanism for refund of excess income tax has been prescribed in Sec.237 & 238 of the Income Tax Act 1961. It was however agreed to issue instructions to the Zonal Railways etc. in the matter.

Ministry of Finance (CBDT) vide Notification No.39/2015/F.NO.142/02/2015-TPL dated 13.04.2015 have revised the exemption limits regarding Transport Allowance w.e.f. 01.04.2015.

Ministry of Finance’s OM No.F-2-1/2015-E.III(A) dated 16.10.2015 has been adopted by Ministry of Railways on mutatis-mutandis basis vide Railway Board vide letter No.PCVI/2015/IC/I dated 08.04.2016. Clarification on some of the issues raised by Staff Side, Zonal Railways/ PUs has also been issued vide letter dated 19.09.2017.

Will lead to fast track decision making, execution and the overall working of Railways. A step towards steady and systematic transformation of Railways.
Minister of Railways and Coal Shri Piyush Goyal addressed a Press Conference here today. He gave details of various decisions and initiatives taken by Indian Railways in the recent past. The brief description of these are listed below:-
Employees Charter:- An employees’ charter is being notified today for ensuring time bound redressal of railways employees’ issues related to dues, entitlements and grievances. In phase 2, a charter of Rail users will be finalized and notified in the next one month.
Fast Tracking Station Redevelopment Program:– A high powered committee headed by the Secretary Railway Board has been constituted to restructure Rail Land Development Authority (RLDA) as well as related processes with a view to fast track redevelopment of stations and monetization of vacant railway land parcels. The committee’s report is expected by next week and shall be implemented quickly thereafter.
Safety at Railway Worksites
With a view to ensure better safety to staff and workers working on railway worksites mainly tracks, Ministry of Railways has notified a Five Member Committee of senior officials of Railway Board to suggest measures for making substantial improvement in worksites safety over all Indian Railways network. The Committee among other things will come out with clear recommendations to prevent/reduce such incidents. The recommendations will be in two phases i.e. short term implementable within three months and long term implementable within one year. The Committee would submit its report by the 2nd week of December, 2017.
Mumbai suburban audit reports
Following the unfortunate tragedy at Elphinstone Road on 29.09.2017, as per the directions of Minister of Railways, a detailed survey of each suburban station by Multidisciplinary Audit Teams to access the adequacy of present infrastructure in context of passenger flow and dispersal and accordingly to lay out a road map for improvements of the same has been carried out on CR as well as WR.
The gist of the recommendations/actionable points include Provision of new FOBs and Widening/replacement of existing FOBs, Provision of Escalators in a large number, Provision of additional entry/exit at the stations, Provision of subways at required locations, Removals of hawkers from FOB or entry/exit points of landings, Requirement of deployment of TC/RFP staff for crowd control measures, Augmentation of CCTV cameras.
Based on above recommendation, detailed action plan is under preparation by Zonal Railways.
Increasing the posts of Additional Divisional Railway Managers
With a view to improve supervision, Ministry of Railways has decided to increase number of posts of Additional Divisional Railway Managers (ADRMs) in all the railway division offices. In most of the cases, the post will increase from existing 01 post to 02 posts. In important divisions like Delhi, the number of posts of ADRMs will increase to 03 posts in place of existing 02. In case of two divisions in Mumbai, in Western & Central Railways, the number of ADRM posts will increase to 04 from the existing 02 post- one post of ADRM in each of the two Mumbai Divisions will be exclusively for handling suburban services.
Empowerment of GMs, DRMs and field officials of Indian Railways –(A step towards steady and systematic transformation of Railways)
? Empowerment of frontline officials through enhanced delegation of powers:-
In order to improve the functioning of Railways, substantial financial and administrative powers covering a wide spectrum of working have been delegated by the Indian Railways to General Managers (GM),Divisional Railway Managers (DRM) and field officials. Hon’ble Minister of Railways, Shri Piyush Goyal, while reviewing the unfortunate incident at Elphinstone Station Mumbai Suburban Railway on 29.09.2017 had directed Railway Board to empower the GMs, DRMs and field units, so as to fast track decision making, execution and the overall working of Railways. This mammoth exercise has been completed in a record time in consultation with stakeholders including GMs, DRMs and other railway officials and staff.
? Comprehensive delegation based on 10 Principles for Steady and Systematic Transformation:-
Hon’ble Minister had outlined 10 principles on the basis of which, transformation in governance can be achieved. These are being applied to working of Government and have been the guiding force for the delegation of powers as well. These include Decisive Leadership, Outcome Oriented Action, Root Cause Analysis, Prioritization of Issues, Time Bound Execution, Innovative Financing, Technology Focus,Accountability and Close Monitoring, Partnership with Stakeholders, and Rule of Law and transparency. The delegation is comprehensive,and covers commercial, engineering works, track maintenance, mechanical, financial, establishment, procurement and medical matters,and will improve safety, speed and service of Railways.
IMPACT OF ENHANCED DELEGATION AND EMPOWERMENT
i.) Improved Safety
GMs have been given full powers to sanction out of turn safety related works without any ceiling, within the financial limit set out by Ministry of Finance. DRMs /Chief Workshop Managers (CWMs) have been given powers to re-engage retired railway employees up to 62 years of age against vacancies. This will take care of safety and maintenance related works wherever there are vacancies. Enhanced powers for repairs of Track Machines have also been given to the field officers for faster track safety work. Further, procedures have been substantially simplified for procurement of material like spare parts for locomotives, coaches etc.
ii.) Faster access to work/breakdown sites
Junior field officers and supervisor in charges have been provided multi-utility vehicles, and may hire vehicles up to Rs 5,000/- per case for rushing to breakdown sites without loss of time; this will lead to faster restoration of train services and improve punctuality/safety of trains.
iii.) Improve stations and passenger interfaces
Power of DRMs to sanction amenities and works (like waiting halls, platform shelter, lifts/escalators, digital chart displays, illumination, train/coach indication board) has been increased from Rs 1 cr to Rs 2.5 cr per case.
Powers have been given to DRMs for repair of computers, printers and other equipment for Unreserved Ticketing System (UTS)/Passenger Reservation System (PRS), up to Rs 50 lakhs per case, to reduce passenger inconvenience in case of a break down. Further, they have been fully empowered for hiring of space for opening of UTS/PRS at non-rail head terminals. This will hugely benefit passengers in remote areas for booking tickets.
Station Directors in large Stations have been now given the powers of the Branch Officers in the divisions to enable them to take decisions for smooth operations. Instructions have also been issued to post young and dynamic officers as Station Directors at 75 important stations.
iv.) Ease of procurement by user departments
Departments have been empowered for procurement through Government E-Marketplace (GeM) directly up to Rs 25,000/- per case with a ceiling of Rs 10 lakh per department in the zone.
v.) Innovative financing & efficient execution of projects
DRMs have been given full powers to undertake projects on Build Own Operate Transfer (BOOT) basis like setting up of laundry for linen cleaning, which will reduce set up time of essential amenities.
vi.) Improved upkeep of equipment
Divisional officers have now been empowered to enter into Annual Maintenance Contract (AMC) of critical equipment with OEMs to ensure uninterrupted service.
vii.) Swachh Bharat: Improve cleanliness and hygiene at stations and in trains
DRMs have been empowered to enter into service contracts like cleaning of stations and trains upto Rs 100 cr from earlier Rs 20 cr. They will be able to enter into long term contracts, which would attract participation of quality vendors.To ensure important services are not discontinued in case of contract failures, they can engage a new approved vendor following a quotation process.
Full powers have been given to DRMs to sanction environment related works like solar panels, rainwater harvesting, rainy wells, water recycling.
viii.) Enhanced revenue earning
DRMs have been given full powers to enter into earning contracts like leasing of parcel space, brake van, parking, publicity etc. which, will improve earnings for Railways. They will also have land licensing powers to help in early commissioning of private sidings.
ix.) Improved Security
GMs can now sanction 2 wheelers for all RPF chowki in-charges to improve their mobility and response for better safety and security.
x.) Move towards Digital India
GMs have been given powers for software development up to Rs 2.5 cr per case and DRMs up to Rs 10 lakh per case.This will improve technology adoption at the operational level while enhancing efficiency.
xi.) Enhanced training & capacity building of staff
Substantial powers have been given to DRMs for training of staff in new technologies which, will improve efficiency and productivity of staff. Power has been quadrupled to Rs 40,000 per trainee per course from Rs 10,000 earlier.
xii.) Way Forward – Model Schedule of Powers for Zonal Railways
A model Schedule of Power (SOP) covering the best practices of all zonal railways is also under preparation and would be released shortly. The model SOP would serve as a guiding document and minimum benchmark for delegations of powers by GMs to DRMs and field units. However, this would not restrict GMs from further delegating powers and in fact, would encourage them to adapt as per local requirements.

2. In terms of Para-1 of GOI, MOD letter dated 8th June 2017, the rate of Special Pension to Blinded Ex-Servicemen under AO 606/75 has been enhanced from Rs. 500/- pm to Rs. 4000/- pm with effect from June, 2017.
3. In view of the sanction of the GOI, MOD, the enhanced rate of Rs.4000/- pm as admissible to Blinded Ex-Servicemen w.e.f. June 2017 may be revised and paid on the authority of this circular.
