Subject: Admissibility of Deputation (Duty) Allowance while on deputation – regarding.
The undersigned is directed to refer to this Department’s O.M. of even number dated 17th February 2016 vide which powers were delegated to Ministries / Departments / borrowing organisations to extend deputation tenures up to a period not exceeding 7 years at a stretch, in respect of cases covered by the O.M. dated 17th June 2010.
2. The matter regarding the admissibility of Deputation (Duty) Allowance in view of the change in maximum number of years of deputation tenure as provided above has been examined in this Department.
3. As per Para 8.3.2 of the OM No. 6/8/2009-Estt.(Pay-II) dated 17th June 2010, where the extension is granted up to the fifth year, the official concerned will continue to be allowed Deputation (Duty) Allowance, if he/she has opted to draw deputation (duty) allowance.
4. This Department’s O.M. No. 2/6/2016-Estt.(Pay-II) dated 17th February 2016 delegates powers to Ministries / Departments / borrowing organisations, to extend deputation tenures up to a period of 7 years in a stretch, in respect of cases covered by the O.M. dated 17th June 2010. However, there has been no modification of the Para 8.3.2. of the O.M. dated 17th June 2010 by the O.M. dated 17th February 2016. The new O.M. dated 17th February 2016 provides vide Para 4 that all other terms and conditions issued vide OM No. 6/8/2009-Estt.(Pay-II) dated 17th June 2010 will remain unchanged.
5. Thus, admissibility of Deputation (Duty) Allowance would be only as per Para 8.3.2 of the O.M. dated 17th June 2010, i.e. only up to the fifth year, if the deputationist has opted to draw Deputation (Duty) Allowance.

The Government is working actively on providing quality education to students, as it believes that only a proper and quality education has the potential of developing a good citizen with strong character. Stating this at the foundation laying ceremony of new building of Kendriya Vidyalaya Shahdara here today, Union Human Resource Development Minister Shri Prakash Javadekar emphasised the need for improving and providing quality education to students across the country on a priority basis. He said Kendriya Vidyalayas are a synonym of quality education, as parents have a long cherished dream of their wards getting good education. He said in addition to education sports activities are also an import aspect of education as the student learns and gains a feeling of collectiveness through sports after sweating and toiling hard. He said that it is sweating on the ground that makes a better student. The Minister said keeping in view the shortage of land in Metro cities and other places the Government has decided to relax the land requirement norms to build new Kendriya Vidyalayas in the country. The Minister said the land requirement in 06 Metro cities will now be 2.5 Acre instead of present 4 Acre and 5 Acre instead of 8 Acre in other places across the country.
Shri Javadekar said for providing better admission opportunity the form filling process has been made online from this session so that people do not have to run from pillar to post to get their wards admitted in Kendriya Vidyalayas. He said a link in this regard has been put up on the website of Kendriya Vidyalaya Sangathan.
Shri Javadekar said in view of shortage of teaching staff Kendriya Vidyalaya Sangathan has also begun process of recruiting more than 6000 personnel. He said this will be notified shortly.
The function was also addressed by Shri Manoj Tiwari, sitting North-East Delhi Lok Sabha MP who expressed his gratitude for Shri Prakash Javadekar for sanctioning the construction work of first KV of District Shahdara in Delhi. He said Shri Prakash Javadekar is the First Union HRD Minister who has visited this area.
OFFICIAL COMMITTEE – Constitution of an Official Committee to examine the revision of Pay scales / Pension to the State Government employees and pensioners following the decisions of the Central Government on the recommendations of the Seventh Central Pay Commission – Ordered
ORDER:-
The Government has decided to constitute an Official Committee to examine and make necessary recommendations for the implementation of the revision of scales of pay and allowances of State Government Employees and Teachers based on the decisions of the Central Government on the recommendations of the Seventh Central Pay Commission. The Committee shall comprise the following members:-
1. Additional Chief Secretary, Finance Department
2. Principal Secretary, Home Department
3. Principal Secretary, School Education Department
4. Secretary, Personnel and Administrative Reforms Department
5. Dr.P.Umanath, I.A.S., Member-Secretary
2. (i) The Committee shall be chaired by seniormost Member.
(ii) The Committee shall examine the orders issued / to be issued by the Central Government on the recommendations of the Seventh Central Pay Commission scales of pay and make necessary recommendations regarding revision of the pay scales to the State Government Employees and Teachers including employees of Local Bodies.
(iii) While making recommendations on scales of pay, the Committee shall take into account the local conditions and the present relativities in the functions, qualifications and hierarchy.
(iv) The Committee shall also examine the decision of the Government of India on the revision of pension, family pension, retirement benefits etc., and also make necessary recommendations to the State Government pensioners.
(v) The Committee shall also make necessary recommendations regarding Other Allowances based on the recommendations of the High Level Committee constituted for this purpose by Government of India.
3. The Committee shall submit its report to Government within four months i.e. on or before 30-06-2017.
4. Orders regarding supporting staff to the Official Committee will be issued separately.
5. All the Departments of Secretariat and Heads of Departments are requested to render all necessary information to the Committee as and when sought for.

Subject: Setting up of Anomaly Committee to settle the anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations.
The undersigned is directed to refer to DoPT’s OM of even number dated 16/8/2016 and to incorporate the following modification in the definition of anomaly:
“Where the Official Side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.”
2. With the incorporation of the above para in the O.M., the definition of anomaly will read as follows:
(1) Definition of Anomaly
Anomaly will include the following cases;
a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Sixth Central Pay Commission itself without the Commission assigning any reason;
b) Where the maximum of the Level in the Pay Matrix corresponding to theapplicable Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules;
c) Where the Official side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.
3. The rest of the content of the O.M. dated 16.08.2016 shall remain unchanged.

The Scheme for grant of Scholarship for the Children of Non-Statutory Departmental Canteens, out of the funds available in the Discretionary Fund of Director of Canteens was introduced vide this Department’s O.M.No.20/1/88-Dir.(C), dated 3.12.98 and revised vide O.M.No.20.1.2011-Dir.(C), dated 2.09.2011. In suppression of this office O.M.No.20.1.2011-Dir.(C), dated 2.09.2011, the amended scheme has been introduced in consonance of Section 57 of the Aadhaar (Targeted Delivery of Financial and other Subsidiaries, Benefits and Services) Act, 2016 to encourage higher studies for canteen employees Children whose past performance had been meritorious. The details of the scholarships being instituted and the considerations which will apply are given below:

3. Awards will be given on yearly basis and every aspirant will have to meet the prescribed norms in regards to the percentage of marks in the previous year of study for being considered for grant of fresh award during the course of his/her studies. The awards will be given strictly in accordance with the principle of the highest one or next highest one (if there are more than one scholarship) getting the Scholarship.
Conditions
(a) Candidates seeking award of Scholarship should have obtained a minimum of 60% marks in the aggregate in the previous year of examination:
(b) Children belonging to SC/ST categories and Handicapped Children would be given a relaxation of 10% marks in the minimum standard. 25% of the awards for school level and Under Graduate level studies (Serials (1) to (5) of Para (2) will be earmarked for such candidates. However, being an award Scheme there will be no strict applications of general orders relating to SC/ST/Physically Handicapped. In the event of the earmarked for such candidates. In the event of the earmarked awards remaining unutilised due to non-satisfaction of the minimum prescribed norms, the award will be transferred to the general category:
(c) One Scholarship will be reserved for girl child for class IX & X.Notwithstanding the prescribed minimum percentage the award will be given to those securing the highest marks. Only aggregate marks will be taken into account. However, every applicant should have obtained the minimum pass marks in all subjects:
(d) Children of only those Canteen Employees who are working in Central Govt. Offices/Establishments and who have been declared as Central Govt. Employees will be eligible to Apply;
(e) The Canteen employees from the Department of Telecommunications. Posts etc. Which are already having separate Scholarship Scheme are to certify that their Children are not already in receipt of Scholarship under the Schemes of their Department.
4. The Scholarship will be awarded considering the performance of the candidates in the previous years of examination. In case the studies were discontinued in the previous years(s) i.e prior to the academic year but an applicant otherwise becomes eligible for consideration, detailed justification for break in the studies during the preceding year(s) will have to be submitted. All applications will have to be submitted in the appended format only. Applications will have to be accompanied by the attested true copies of the Mark Sheets given by the recongnised Institution such as School. Central/State Boards of Education/Universities. Original certificates will be submitted, if called for, for verification.
5. The late date for receipt of applications in the office of Director (Canteens) has been extended upto 15.03.2017. It is expected that awards will be finalised by the month of March of the year. In no case any application received after the prescribed date will be entertained.
6. (i) Individual desirous of availing benefits under the scholarship to wards of employees of Departmental Canteens are required to furnish proof of possession of possession of Aadhaar or undergo Aadhaar authentication.
(ii) An individual desirous of availing benefits under the said scholarship scheme who is not yet enrolled for Aadhaar is hereby required to make application for Aadhaar enrolment by 28.02/2017, in case he is entitled to obtain Aadhaar as per the provisions of Section 3 of the said Act and such individuals may visit any Aadhaar enrolment centre (list available at www.uidai.gov.in) to get enroller for Aadhaar.
Provided that till the time Aadhaar is assigned to the individual, benefits under the said scheme shall be given to the individual, subject to the production of the following documents, namely:-
(a) (i) Aadhaar enrolment ID, if he has enrolled, or
(ii) A copy of request made for Aadhaar enrolment as specified in sub- paragraph (2) of Paragraph 2, and
(b) (i) Bank Passbook with Photo or (ii) Voter’s ID Card of (iii) PAN Card or (iv) Passport; or (v) Driving Licence or (vi) Ration Card; or (vii) Photo ID Card issued by the Government.
The above documents shall be checked by an officer specifically designated by the Office of Director (Canteen) in the Department of Personnel and Training.
7. Those canteen employees who have already applied scholarship for their ward under the previous scheme,are requested to apply a fresh in revised format incorporating the requirement of documents under para 6 above.
8. Applications will be forwarded to the office of the Director (Canteens) through concerned Head of Organisation.
9. The awards of Scholarships will be decided by a duly designated Committee, as may be appointed from time to time. The decision taken by the Committee will be final and no representation in the matterr will be entertained awards are finalised.
10. It is requested that wide publicity of this scheme may be given amongst all concerned.

S.O. 455(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity;
And whereas, the schemes specified in the Table below involve expenditure incurred from the consolidated fund of India;

Now, therefore, in pursuance of the provisions of section 7 of the Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government in the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training hereby notified the following, namely:––
1. (1) Individuals (eligible beneficiaries or service enablers) desirous of availing benefits under the schemes specified in the Table above are hereby required to furnish proof of possession of Aadhaar or undergo Aadhaar authentication.
(2) An individual desirous of availing benefits under the schemes specified in the above Table and is not yet enrolled for Aadhaar shall have to apply for Aadhaar enrolment by 28th February, 2017, in case he is entitled to obtain Aadhaar as per the provisions of section 3 of said Act and such individual may visit any Aadhaar enrolment center (list available at www.uidai.gov.in) to get enrolled for Aadhaar.
(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, Grih Kalyan Kendras and the Central Civil Services Cultural and Sports Board are required to offer enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in absence of such Aadhaar enrolment centers located in the vicinity, the Grih Kalyan Kendras and the Central Civil Services Cultural and Sports Board may provide enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or may provide Aadhaar enrolment facilities by becoming UIDAI Registrar:
Provided that till the time Aadhaar is assigned to the individual, benefits under the said schemes shall be given to the individual, subject to the production of the following documents, namely:––
(a) (i) Aadhaar enrolment ID slip if he or she has enrolled; or
(ii) a copy of request made for Aadhaar enrolment as specified in sub-paragraph (2) of paragraph 2; and
(b) (i) Bank Passbook along with Photo; or (ii) Voter’s ID card; or (iii) PAN card; or (iv) Passport; or (v) Driving License; or (vi) Ration card; or (vii) Photo ID card issued by the Government:
Provided further that the above said documents shall be checked by an officer, specifically designated by Grih Kalyan Kendras and the Central Civil Services Cultural and Sports Board, for their respective schemes.
2. (1) In order to provide convenient and hassle free delivery of benefits, Grih Kalyan Kendras and the Central Civil Services Cultural and Sports Board shall make all the arrangements including wide publicity through notices shall be given to service enablers or beneficiaries to make them aware of the requirements of Aadhaar to receive the benefits under the said schemes and in case they are not enrolled, they may be advised to get themselves enrolled at the nearest enrolment centers by 28th February, 2017.
(2) In case beneficiaries are not able to enroll due to non availability of enrolment centers in the vicinity, Grih Kalyan Kendras and Central Civil Services Cultural and Sports Board are required to create enrolment facilities at convenient locations by coordinating with UIDAI Registrars. The beneficiaries may be requested to register their request for enrolment by giving their details, such as, name, address, mobile number, etc., to Grih Kalyan Kendras and Central Civil Services Cultural and Sports Board .
3. This notification shall come into effect from the date of its publication in all the States except the States of Assam, Meghalaya and Jammu and Kashmir.

Subject: Grant of Advances – Seventh Central Pay Commission recommendations- Amendment to rules on Computer Advance to Railway servants.
Consequent upon the decision taken by the Government on the recommendations of Seventh Centrat Pay Commision, the Ministry of Finance vide their OM No. 12(1)/E.II(A)/2016 dated 07.10.2016 have amended the eligibility criteria in the existing provisions relating to the grant of Personal Computer Advance.
2. Amendment conditions of grant of Computer Advance are as follows:

3.Further, Ministry of Finance in their ibld OM have also decided that the other interest bearing advances relating to Motor Car Advance and Motorcycle/Scooter/Moped Advance will stand discontinued,
4.The above,mentioned OM of Ministry of Finance relating to grant of interest bearing advances will apply mutatis mutandis to Railway employees also.
4.1 So far as the interest free advances are concerned, Bicycle and warm clothing advances stands abolished for Railway employees also in terms of MoF’s decision.
4.2 Orders relating to other interest free advances will be issued separately by concerned Directorates.
5. Necessary ,Advance Correction slip to the chapter Xl of the Indian Railway Establishment Manual, Vol.l Revised Edition, 1989 will follow.
6. The revised orders are effective from 07.10.2016 i.e. the date of the issue of the aforesaid OM of the Ministry of Finance. Past cases where the advances have already been sanctioned under the provision of earlier rules on the subject need not be reopened.

G.S.R. 69(E).—In exercise of the powers conferred by the proviso to the article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely : –
1. (1) These rules may be called the Fundamental (Amendment) Rules, 2017
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Fundamental Rules, 1922, in rule 56, in clause (d), after the sixth proviso, the following proviso shall be inserted, namely:–
“Provided also that notwithstanding anything contained in the fifth proviso, the Central Government may, if considers necessary, in public interest, so to do, give an extension in service for a further period not exceeding one year beyond the said period of two years to the Foreign Secretary”.
