Subject:-Restoration of 1/3rd commuted portion of pension in respect of Government servants who had drawn lumpsum payment on absorption in Central Public Sector Undertakings / Central Autonomous Bodies -Stepping up of notional full pension w.e.f. 01,01.2006 for the purpose of Dearness relief and additional pension for old pensioners.
Orders for revision of 1/3rd restored pension of absorbees, who had drawn lumpsum payment on absorption, were issued vide this Department O.M. of even number dated 15.9.2008 as amended/ modified vide OM No. 4/30/2010-P&PW(D) dated 11 07.2013. As per these memorandums, the full pension of the absorbees was notionally revised w.e.f. 01.01.2006 in accordance with the instructions contained in this Department O.M. No.38/37/08-P&PW{A} dated 01.09.2008. The payment of DR and additional pension to old pensioners is regulated an the basis of the notional full pension.
2. Instructions were issued vide this Department’s OM No.38/37/08-P&PW(A) dated 28.01.2013 for stepping up of the pension.af pre-2006 pensioners w.e.f. 24.09.2012. Accordingly, the notional full pension of the absorbee pensioners was also stepped up w.e.f 24.09.2012 in accordance with the instructions contained in the aforesaid OM dated 28.01.2013 vide this Department’s OM of even number dated 03.04.2013
3. Instructions have now bean issued vide this Department’s OM No 38/37/08-P&PIN(A) dated 30.07.2015 for revision of pension/ family pension of all pre-2006 pensioners/ family pensioners in accordance with this Department’s OM dated 28.01,2013 with effect from 01.01.2006 instead of 24.09.2012, Accordingly, the notional full pension of absorbee pensioners would also be revised in accordance with the instructions contained in aforesaid OM dated 30.07,2015 w.e.f. 01.01.2006 instead of 24.09.2012 and dearness relief and additional pension for old pensioners would be admissible on such revised notional full pension.
4. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their I.D. No, 1(5)IEV/2012 dated 18.01.2016.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Fulfillment of procedural requirements.
This Department is in receipt of a number of references regarding the procedural difficulties faced by the Government employees in application and settlement of the LTC claims. Sometimes, the Government servants claim that failure to follow the correct procedure was on account of a lack of knowledge of the rules/instructions. It is alleged that in some cases, processing of LTC claims takes unduly long time, particularly when the employee and the sanctioning authorities are located at different stations.
2. To remove these bottlenecks, it has been decided to simplify the procedure of application and make the procedure of processing of LTC claims time bound. The following time-limits shall be followed while processing the LTC applications/claims of the Government servants.

*(a) Additional 3 days transit-time may be allowed in cases where the place of posting of the Government employees is away from their Headquarters, The Government employee may proceed on LTC after action on S.No.1 .
(b) Efforts should be made to reduce the duration of processing of LTC applications/claims at the earliest. The maximum time limit should be strictly adhered to and non —compliance of time limit should be adequately explained.
3. Under CCS (LTC) Rules, the Government servants are required to inform their controlling Officer before the journey(s) on LTC to be undertaken. It has now been decided that the Leave sanctioning Authority shall obtain a Self-Certification from the employee regarding the proposed LTC journey. The Proforma for self-Certification has been annexed with this O.M.
4. In addition to the above, it has been decided that whenever a Government servant applies for LTC, he/she should be provided with a copy of the guidelines (Enclosed) which needs to be followed while availing LTC.
5. Employees may be encouraged to share interesting insights and pictures, if any, of the destination he/she visited while availing LTC in an appropriate forum

Guidelines
1. Please ensure that you have applied for leave and submitted the self-certification form to your Administration before the LTC journey is undertaken.
2. Please check your eligibility before applying for LTC. LTC to Home Town can be availed once in a block of two years and LTC to Any Place in India may be availed once in a four year block. If not availed during these blocks, the LTC may also be availed in the first year of the following block.
3. Please note that the current two year block is 2016-17 and the current four year block is 2014-17.
4. In case of fresh recruits, LTC to Home Town is allowed on three occasions in a block of four years and to any place in India on the fourth occasion. This facility is available to the fresh recruits only for the first two blocks of four years applicable after joining the Government service for the first time. 5. A Fresh recruit may at his option choose to avail LTC under the normal LTC rules as applicable to other Government employees. In this case he/she will not be allowed to avail other LTCs as admissible to the fresh recruits in that block of four years.
6. The retiring Government employees are eligible to avail LTC as per their entitlement provided that the return journey is performed before their date of retirement. LTC is not allowed after retirement.
7. The Journeys on LTC are to be undertaken in the entitled class of the Government servant in public/Government mode of transport.
8. Travel by private modes of transport is not allowed on LTC, however, wherever a public transport is not available, assistance shall be allowed for the private transport subject to the certification from an Appropriate Authority that no other public/Government mode of transport is available for that particular stretch of journey and these modes operate on a regular basis from point to point with the specific approval of the State Governments/Transport authorities concerned and are authorised to ply as public carriers.
9. If a Government servant travels on LTC upto the nearest airport/ railway station by authorized mode of transport and chooses to complete rest of the journey to the declared place of visit by ‘own arrangement’ (such as personal vehicle or private taxi etc.), while the public transport system is already available in that part, then he may be allowed the fare reimbursement till the last point where he has travelled by the authorised mode of transport. This will be subject to the undertaking from the Government employee that he has actually travelled to the declared place of visit and is not claiming the fare reimbursement for the part of journey performed by the private owned/operated vehicle.
10. Government Servant may apply for advance for himself and/or his family members before the proposed date of the outward journey and he/she is required tickets within ten days of the drawal of advance, irrespective of the date of commencement of the journey.
11.Reimburseme under LTC scheme does not cover incidental expenses and expenditure incurred on local journeys. Reimbursement for expenses of journey is allowed only on the basis of a point to point journey on a through ticket over the shortest direct route.
12.The time limit or submission of LTC claim is :
• Within dire months of completion of return journey, if no advance is drawn;
• Within one onth of completion of return journey, if advance is drawn.
13. Government employees entitled to travel by air are required to travel by Air India only Class at LTC-80 fare or less unless permitted to do so by any is provision.
14.Government employees not entitled to travel by air may travel by any airline,However,reimbursement in such cases shall be restricted to the fare of their entitled Class of train/transport or actual expense, whichever is less.
15.In all cases whenever a Govt. servant claims LTC by air, he/she is required to book the air tickets ither directly through the airlines or through the approved travel agencies viz: M/s Balmer Lawrie & Co. Ltd/ M/s Ashok Tours & Travels Ltd/IRCTC. Bookin of tickets through any other agency is not permissible.
16.Travel on tour packages is not allowed, except in the case of tours conducted by Indian Touris Development Corporation (ITDC), State Tourism Development Corporation (STDC) and Indian Railway Catering and Tourism Corporation (IRCTC). In such cases, only the fare component shall be reimbursable provided ITDC/STDC/IRCTC separately indicate the fare component and certify that the journey was act I ally performed by the Government servant and his family members for which he/sh claiming the Leave Travel Concession.
17.Please ensure that your LTC claim is as per the instructions to avoid rejection of your claim.

1.Settle the issues raised by the NJCA on the recommendations of the 7 CPC sent to Cabinet Secretary vide letter dated 10th December 2015.
2.Remove the injustice done in the assignment of pay scales to technical/safety categories etc. in Railways& Defence, different categories in other Central Govt establishments by the 7 CPC.
3.Scrap the PFRDA Act and NPS and grant Pension/family Pension to all CG employees under CCS (Pension) Rules, 1972 & Railways Pension Rules, 1993.
4.i) No privatization/outsourcing/contractorisation of governmental functions.
ii) Treat GDS as Civil Servants and extend proportional benefit on pension and allowances to the GDS.
5. No FDI in Railways & Defence; No corporatization of Defence Production Units and Postal Department.
6. Fill up all vacant posts in the government departments, lift the ban on creation of posts; regularize the casual/contract workers.
7. Remove ceiling on compassionate ground appointments.

Federation invites attention of the Railway Board to the minutes of the meeting held by Railway Board (CRB, MS & FC) with NFIR on 23/08/2013 wherein NFIRs 34 Point Charter of Demands was discussed. The Railway Board while conveying comments on the 34 Point Charter of Demands vide letter cited under pference had advised following position in respect of demand No. 30 on the subject:-
“Definition of SPAD is not laid down as such. Any passing of ‘stop’ signal (except permissible signals and those permitted under certain rules such as Automatic signals) at danger by a loco without authority is treated as SPAD irrespective of distance travelled by Loco after ‘ passing a signal at danger. Safety Directorate is of the view that the same should continue.
However, Railways were asked to give their suggestions with regard to review of punishment norms issue by Railway Board including those for SPAD.
Replies received from Railways are being compiled and changes proposed, if any, will be put up for perusal and approval of Board”.
Thereafter, a period of more than two years has passed, the position relating to changes proposed and the decision of Railway Board thereon is yet to be communicated to the Federation.
NFIR, therefore, requests the Railway Board to apprise the Federation the proposed changes and the decision taken by the Board at an early date. The Federation also requests to make available the suggestions received from railway early.

1. The Finance ministry has constituted an implementation cell which will function as the Sectt. of the empowered Committee headed by Cabinet Secretary in which Secretary , Department of Post is also a member.
2.As per the minutes of implementation cell held on 2nd February, Nodal Officers from our Department has not attended, it is reliably learnt.
3. The implementation cell has fixed two weeks time for submission of any Departmental specific Modification on 7th CPC recommendations but it is learnt that Nodal Officer appointed by the Department is out of Delhi and will be returning after 12th February , by that time, there will be 4 days time left for cutoff date fixed by implementation cell..
4.Further minutes says that any modification recommended by the Secretary Posts should be approved by the Minister (C) also before submission to implementation cell. We feel that if action is not taken on war footing it will be impossible for the Postal Department to submit modification proposal to the implementation cell after completing all the above formalities before the cutoff date
5.Regarding Cadre Restructuring also if orders are not issued before implementation of Pay Commissions report, there is every chance of returning the proposal by DOP&T for resubmission after signing fresh agreement taking in to consideration the 7th CPC orders issued by the Government.
In view of the above we request you to kindly act immediately to safe guard the interests of Postal Employees without giving room for any delay or omission or commission on the part of Postal Department.
We have decided certain agitational programmes on which we will be giving a separate memorandum on 11th March 2016.

The NJCA met on 08.02.2016 as scheduled. The meeting after taking into account various factors decided that the proposed indefinite strike will commence from 11.04.2016 if no settlement is brought about on the charter of demands by that time. The meeting also took the following decisions.
1. Strike notice will be served by the NJCA and all its constituents on 11.03.2016 by holding massive demonstration.
2. There will be a massive Rally on 11.03.2016 at Delhi and leaders of NJCA will make it possible to attend the said rally and the strike notice will be served on Cabinet Secretary, Government of India.
3. All the National JCA leaders will attend Rally at the State Capitals/big industrial centres during the month March and April, 2016. Dates will be finalised in consultation with the concerned State JCA.
4. To strengthen the campaign, the NJCA will place on the website a pamphlet explaining the demands.
5. Posters will be centrally designed and kept in the website for State JCAs and constituents to adopt.
6. All Constituents will undertake independent campaign programmes in the month of March 2016 to popularize the demands.
7. 29th March will be observed as solidarity day throughout the country unitedly by all the Constituents of NJCA.
8. The indefinite strike will commence at 6 am on 11.04.2016.
9. The updated Charter of Demands on which the indefinite strike is to be organized is enclosed.
10. The Constituent organizations may add sectional demands as Part B of the Charter of Demands of the NJCA
The National JCA appeals all constituents to make intensive campaigns to make the strike an unprecedented success.

We have written under the cover of the NJCA’s letter in No JJCA/2015/7th CPC dated 11th December 2015 our comprehensive suggestions for effecting changes in the recommendations of the 7th CPC. This was also subjected to discussion with the JS (A) of DOPT on 11.12.2015 in response to the letter in No 3/1/2015-JCA dated 10-12-2015.
We request that the same may be treated as the consensus view of the Staff Side, JCM/National Council.
AIRF to conduct secret ballot for indefinite strike on 11-12th, February 2016
All affiliated unions of AIRF had conducted Strike Ballot on 37 Point Charter of Demands in the month of December, 2013. After Strike Ballot, 7th CPC was appointed by a Notification by the Govt. on 28th February, 2014 and some of the issues were partially resolved. In the meantime General Election of Country was convened, we had to postponed the strike as per decision of the General Council of AIRF held at Kota 9W. C. Railway) in February, 2014. The new Govt. led by Shri Narendra Modi took oath on 26th May, 2014. The next General Council of AIRF held in July, 2014 postponed the strike decision further to provide time to the new Govt. to settle. But the same Govt. instead of reciprocrating the good gesture issued notification on 22nd August, 2014 permitting 100% Foreign Direct Investment (FDI) in Construction, Operation and Maintenance and after one month i.e. on 22nd September, 2014 appointed a Committee headed by Shri BibekDebroy for re-structuring of Indian Railways…….
STRIKE BALLOT
All affiliated unions of AIRF had conducted Strike Ballot on 37 Point Charter of Demands in the month of December, 2013. After Strike Ballot, 7th CPC was appointed by a Notification by the Govt. on 28th February, 2014 and some of the issues were partially resolved. In the meantime General Election of Country was convened, we had to postponed the strike as per decision of the General Council of AIRF held at Kota 9W. C. Railway) in February, 2014. The new Govt. led by Shri Narendra Modi took oath on 26th May, 2014. The next General Council of AIRF held in July, 2014 postponed the strike decision further to provide time to the new Govt. to settle. The Committee had since submitted its report drawing a road – map for privatisation of Indian Railways through contractorisation. Inspite all out protest by all affiliated union of AIRF and other Central Govt. Employee’s organisation Govt. did not stop in taking all antilabour steps, rather escalating the same. The 7th CPC was appointed to submit its report within 18 months i.e. by August, 2015. During deliberations of NC/JCM with the Pay Commission, Justice A. K. Mathur, the Chairman of the 7th CPC assured that he would submit the report to the Govt. on 28th August, 2015. But the Govt. extended the date for submission of the report by 4 months. The Pay Commission has submitted its report on 19th November, 2015, which is over loaded with all antilabour recommendations. The National Joint Council of Action has submitted a rejoinder to the report to the Govt. on 10th December, 2015 and AIRF has submitted two rejoinders on the report of 7th CPC to the Ministry of Railways on 14th& 15th December, 2015, fixing a time frame of 1st week of February, 2016 for a negotiated settlement failing which all the Central Govt. Employees including Railways would be compelled to launch an indefinite strike from any date from 1st week of March, 2016. There was only a preliminary discussion with the Govt. on 12th December, 2015. The Govt. has formed a Committee of Empowered Secretaries of the Govt. of India headed by the Cabinet Secretary. Finding no further response Com. Shiva Gopal Mishra, the Convenor of National JCA has sent a communication to the Union Finance Minister on 21st January, 2016 highlighting the protest Dharna launched by all Central Govt. Employees Organisations across the country from 19th to 21st January, 2016. The empowered Committee of Secretaries of the Govt. of India headed by the Cabinet Secretary has also been appointed by the Govt. on 27.01.2016 to process the implementation of the report of 7th CPC. The 2nd Strike Ballot perforced by FDI, Deb Roy Committee’s report, anti labour report of 7th CPC etc. would be conducted on 11th& 12th February, 2016 on the following Charter of Demands.
CHARTER OF DEMANDS
1. To improve Minimum Wage of Rs.18,000/- and multiplying factor. Reject all the retrograde recommendations of the VII CPC.
2. Scrap National Pension Scheme(NPS) and restore Old Pension Scheme for all those who appointed on or after 01.01.2004.
3. Settle 36-point Charter of Demands, include reduction in duty hours, removal of anomalies of 6th CPC, removal of ceiling of Rs.3500 for PLB, grievances of different categories of railwaymen, improvement in the medical facilities, railway quarters etc. etc., already submitted to Ministry of Railways by the AIRF in December, 2013(on which strike ballot was conducted on 20th and 21st December, 2013).
4. Scrap Report of Bibek Deb Roy Committee and implement positive recommendations of D.P. Tripathi Committee.
5. Re-call the Notification issued by the Government of India on 22nd August, 2014 in the matter of 100% FDI in Construction, Operation and Maintenance of Indian Railways and to scrap all the agreements entered with the Foreign/National Companies in detriment to the interest of the Indian Railways and the country as a whole.
6. Stop all anti-workers amendments in the labour-laws.
7. Injustice done with the Technicians, Technical Supervisors(Engineers), Loco & Traffic Running Staff, Operating and Medical Categories Staff, etc. etc. in respect of allotment of Pay Matrix and promotions also should be done away with and justice be administered.
8. Parity in pay structure and promotional scope for Common Categories with those working in the Central Secretariat/Ministries should be ensured.
9. Retain all the existing allowances and advances.
10-A. Constitute Joint Committee at each Ministry/Department level to resolve VII CPC anomalies, aberrations and injustice within a time frame manner, and powers for the same should be delegated to the Ministries to resolve their issues at the Ministry level. 10-B. Set-up National Joint Committee to discuss and resolve all VII CPC anomalies, aberrations and injustice within a time frame. 11. Ensure payment of arrear for PLB as per amendment in the Bonus Act, as was done in the year 2008. The All India Railwaymen’s Federation gives a clarion call to all railwaymen irrespective of their affiliation to any organization to participate in the Strike Ballot and exercise opinion in this regard.

Subject:- Discontinuation of interview for direct recruitment to various Group B & C posts in non-statutory departmental canteen located in Central Government Offices.
The undersigned is directed to refer to this Departments DO No.39020/01/2013-Estt(B) dated 4.9.2015 (copy enclosed) drawing attention to Hon’ble Prime Minister’s address to the nation on occasion of Independence Day wherein it was announced that Government should discontinue holding interviews for recruitment of junior level post in order to improve objectivity, transparency and enable level playing opportunity to candidates from all Sections of Society.
2. The issue relating to discontinuation of interviews for various junior level posts in the Government of India was considered by the Committee of Secretaries in its meeting held on 14.9.2015. The recommendation of conunittee of Secretaries have since been accepted by the competent authority vide OM No.39020/01/2013-Estt(B) dated 12.11.2015 (copy enclosed). The clarification on issue of discontinuation of interviews have also been issued vide OM No.39020/01/2013-Estt(B) part dated 29.12.2015 (copy enclosed).
3. Accordingly, it has been decided that holding of interviews shall be discontinued in all direct recruitment to non-gazetted, non-ministerial Group B & C posts in non-statutory departmental canteens located in Central Governments Offices. The recruitment to these posts shall be made purely on the basis of written test/skill test by respective Ministries taking into consideration job requirement for specific post. Duties and Responsibilities of canteen employees have been circulated vide this Department OM No.03/02/2009-Dir(C) dated 5.6.2014 (copy enclosed).
3. All Ministries/Departments are required to follow above instructions and related Government Orders as quoted above meticulously in respect of recruitment in Departmental Canteens under their administrative control.
