Subject:- Sixth Central Pay Commissions recommendations – amendment of Service Rules – regarding

This Department in OM No.AB14017/61/2008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules/Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations. Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMs dated 15.12.09 (Non-Technical) and 18.01.2011 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6th cpc recommendations have been issued in OM dated 24.4.09

2. As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the Ministries/Departments/Cadre Controlling Authorities of Organized Group ‘A’ Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPT/UPSC & Ministry of Law.

Subject:- Non-Functional upgradation for Officers of Organized Group ‘A’ Services in PB-3 and PB-4

A reference is invited to this Department 0M No.AB.14017/64/2008-Estt.(RR) dated 24.04.09 on the above subject. The details of batch of the officers belonging to the Indian Administrative Service who have been posted at the Centre in the various grades of PB-3. PB-4 and HAG was last circulated in this Department OM of even No.dated 04.01.2011.

2. The details of the lAS officers who have been subsequently posted in the Centre in the various grades as well as the date of posting of the first officer belonging to the batch is annexed. Necessary action may be taken for grant of higher scale for the Officers belonging to batches of Organized Group A Services that are senior by two year or more and have not so far been promoted to that particular grade in accordance with the provisions of this Department’s 0M No.AB.14017/64/2008-Estt.(RR) dated 24.4.2009

Gratuity Amount Calculation

Employees, as defined here, are the ones hired on company payrolls. Trainees are not eligible and gratuity is paid on the basis of the employee’s basic plus dearness allowance if any.

How much can you get?

You become entitled to a gratuity on resignation or on retirement after five years or more of service. As per the Act, the gratuity amount is 15 days’ wages multiplied by the number of years put in by you. Here wage means your basic plus dearness allowance. Take the monthly salary drawn by you last (basic plus dearness allowance) on resignation or retirement and divide it by 26, assuming there are four Sundays in a month. This is your daily salary. Multiply this amount by 15 days and further with the number of years you have put into service.

For instance, if your average monthly salary is Rs 50,000, the gratuity payable to you after 10 years of service would be Rs 290,000. However your employer factors in another term: ‘uninterrupted service’. The term covers the service period of the employee including leaves or breaks, except periods notified as breaks in service by the employer.

For employees who do not fall under the Gratuity Act, the amount due for them is half of the average ten months’ salary multiplied by the number of years of service.

How to calculate Gratuity ?

Gratuity = (Last drawn salary + Dearness Allowance / 26) x 15 x Number of years of service

Exemption from filing I-T return for persons with income up to Rs 5 lakh

The Central Board of Direct Taxes has notified the scheme exempting salaried taxpayers with total income up to Rs.5 lakh from filing income tax return for assessment year 2011-12, which will be due on July 31, 2011.

Individuals having total income up to Rs.5,00,000 for FY 2010-11, after allowable deductions, consisting of salary from a single employer and interest income from deposits in a saving bank account up to Rs.10,000 are not required to file their income tax return. Such individuals must report their Permanent Account Number (PAN) and the entire income from bank interest to their employer, pay the entire tax by way of deduction of tax at source, and obtain a certificate of tax deduction in Form No.16.

Persons receiving salary from more than one employer, having income from sources other than salary and interest income from a savings bank account, or having refund claims shall not be covered under the scheme.

The scheme shall also not be applicable in cases wherein notices are issued for filing the income tax return under section 142(1) or section 148 or section 153A or section 153C of the Income Tax Act 1961.

Central Government Holidays – 2012

The government has released the list of 17 holidays, however four of these holidays fall on weekends (Three on Sunday and one on Saturday). Only 13 holidays are effective holidays for central government employees.

Central Government Holiday List – 2012

 

The holidays that fall on weekends are

February 5 – Id-e-Milad-un-Nabi,
May 6 – Buddha Purnima
October 27 – Id-ul-Zuha/Bakr Id
November 25 – Muharram

Two holidays fall on April 5 and April 6 (Thursday and Friday), hence central government employees can take four days holiday including Saturday and Sunday
for that week.

In case of the central offices outside Delhi, 14 holidays are compulsory, while three others will be decided in consultation with the employees’ coordination committees in the state capitals from a list of 12.

The compulsory holidays outside Delhi are:

Republic Day (January 26)
Id-e-Milad (February 5)
Mahavir Jayanti (April 5)
Good Friday (April 6)
Buddha Purnima (May 6)
Independence Day (August 15)
Id-ul-Fitr (August 20)
Mahatma Gandhi’s birth anniversary (October 2)
Dussehra (October 24)
Id-ul-Zuha (October 27)
Diwali (November 13)
Muharram (November 25)
Guru Nanak birth anniversary (November 28)
Christmas (December 25).

Twelve other holidays, from which 3 will be selected in consultation with the coordination committee, are: an additional day for Dussehra, Holi, Janmashtami, Ram Navmi, Maha Shivratri, Ganesh Chaturthi, Makar Sankaranti, Puri Rath Yatra, Onam, Pongal, Basant Panchami and Vaisakhi (also celebrated as Cheti Chand, Gudi Padwa , Karva Chauth, Chhath Pooja, Ugadi and first day of Navratra).

Subject: Holidays to be observed In Central Government Offices during the year 2012.

It has been decided that the holidays as specified in the Annexure —I to this O.M. will be observed in all the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2012. In addition, each employee will also be allowed to avail himself/herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure — II.

2. Central Government Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3.1 below:

3.1. In addition to the above 14 Compulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Central Government Employees Welfare Coordination Committee in the State Capitals, if necessary, in consultation with Coordination Committees at other places in the State. The finai list applicable uniformly to all Central Government offices within the concerned State shall be notified after seeking prior approval of this Ministry and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicated.

3.2 No substitute holiday should be allowed if any of the festival holidays initially declared subsequently happens to fall on a weekly off or any other non working day or in the event of more than one festivals falling on the same day.

4. The list of Restricted Holidays appended to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.

5.1 For offices in Delhi / New Delhi, any change in the date of holidays in respect of Idu’l Fitr, Edu’l Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.

5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of ldu’l Fitr, Idu’l Zuha, Muharram and ld-e-Milad.

5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.

6. During 2012, Diwali (Deepavali) falls on Tuesday, November 13, 2012 (Kartika 22). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on ‘Narakachaturdasi Day”. In view of this, there is no objection if holiday on account of Deepavali is observed on “Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.

7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi’s birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2012, subject to para 3.2 above.

8. Union Territory Administrations shall decide the list of holidays in terms of Ministry of Home Affairs letter No.14046/27/83- GP-I dated 15.2.1984 by which they would observe a total of 16 holidays including the three National Holidays Viz. Republic Day, Independence Day & Mahatma Gandhi’s birthday.

9. in respect of Indian Missions abroad, the number of holidays may be notified in accordance with the instructions contained in this Department’s O.M. No.12/5/2002-JCA dated 17th December, 2002. In other words; they will have the option to select 10(Ten) holidays of their own only after including in the list, three National Holidays and Milad-un-Nabi or Id-E-Milad, Buddha Purnima, Idu’l Zuha (Bakrid) and Muharram included in the list of compulsory holidays and falling on days of weekly off.

10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.

The undersigned is directed to draw attention to this Ministry’s Office Memoranda of even number dated 8th December 2010, 19th January, 2011 and 31st May, 2011, and to state that the last date for submission of applications for empanelment of private hospitals, diagnostic laboratories and Imaging Centres by CGHS under Continuous Empanelment Scheme is being extended up to 31st July 2011.

Subject: Sunderban Allowance to Central Government employees working in West Bengal.

The undersigned is directed to refer to this Ministry’s OM No.20(1)/97-E.II(B) dated 17th July,2001 on the subject cited above and to convey the sanction of the President for the continued grant of Sunderban Allowance at the existing rates (Based on the notional pay in pre-revised scales) to the Central Government employees posted in the Sunderban areas of West Bengal for a further period from 01-01-2003 to 31-08-2008 and at the revised rates (indicated in the Table below) from 01-09-2008 onwards and upto the period for which the Government of West Bengal continues to pay this allowance to its employees, subject to the fulfillment of the existing terms and conditions in this regard.

2.In case of those employees who have opted to retain the pre-revised scale of pay after the Sixth Pay Commission, their entitlement to the Sunderban Allowance would be determined with reference to pre-revised pay range indicated in column (1) of the table above and the rate prescribed in Column (2) will apply from 1.1.2003 to 31.8.2008 and that in column (4) of the table will apply w.e.f. 1.9.2008

3. In their application to employees serving in Indian Audit and Accounts Department, these orders issue in consultation with Comptroller and Auditor General of India.

AICPIN for the month of May, 2011

ALL INDIA CONSUMER PRICE INDEX NUMBERS FOR INDUSTRIAL WORKERSON BASE 2001=100 FOR THE MONTH OF MAY, 2011

All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of May, 2011 increased by 1 point and stood at 187 (one hundred & eighty seven) .

During May, 2011, the index recorded increase of 8 points in Ludhiana centre, 6 points in Nasik centre, 5 points each in Giridih, Mundakkayam and Sholapur centres, 4 points in 3 centres, 3 points in 4 centres, 2 points in 14 centres and 1 point in 18 centres. The index decreased by 4 points in Rangapara Tezpur centre, 3 points in Ghaziabad centre, 2 points in Guwahati centre, 1 point in 10 centres, while in the remaining 21 centres the index remained stationary.

The maximum increase of 8 points in Ludhiana centre is mainly on account of increase in the prices of Arhar Dal, Masur Dal, Mustard Oil, Vanaspati Ghee, Milk, Chillies Dry, Electricity Charges, Toilet Soap, Washing Soap, etc. The increase of 6 points in Nasik centre is due to increase in the prices of Wheat, Bajra, Chillies Dry, Vegetable & Fruit items, Petrol, etc. The increase of 5 points in Giridih, Mundakkayam and Sholapur centres is due to increase in the prices of Rice, Jowar, Vegetable & Fruit items, Tea (Readymade), Firewood, Soft Coke, Hair Oil, Washing Soap, etc. The decrease of 4 points in Rangapara Tezpur centre is the outcome of decrease in the prices of Wheat Atta, Fish Fresh, Turmeric Powder, Garlic, Vegetable & Fruit items, Pan Leaf, etc. The decrease of 3 points in Ghaziabad centre is due to decrease in the prices of Wheat Atta, Onion, Vegetable & Fruit items, etc. The decrease of 2 points in Guwahati centre is due to decrease in the prices of Wheat Atta, Vegetable & Fruit items, Pan Leaf, etc.

The indices in respect of the six major centres are as follows :

1. Ahmedabad – 180
2. Bangalore – 192
3. Chennai – 166
4. Delhi – 172
5. Kolkata – 181
6. Mumbai – 186

The All-India (General) point to point rate of inflation for the month of May, 2011 is 8.72% as compared to 9.41% in April, 2011. Inflation based on Food Index is 7.61% in May, 2011 as compared to 8.24% in April, 2011.

The CPI-IW for June, 2011 will be released on the last working day of the next month, i.e. 29th July, 2011.
