OFFICE MEMORANDUM

Subject: Special benefits in cases of death and disability in service – payment of disability pension/family pension – relaxation of qualifying service :-

The undersigned is directed to say that the scales of disability pension admissible under CCS (EOP) Rules were laid down in para 3 of Department of Pension & Pensioners’ Welfare’s O.M. No.45/22/97-P&PW(C) dated 3.2.2000. The said O.M. dated 3.2.2000 was modified vide Department of Pension & Pensioners’ Welfare’s O.M. No.45/3/2008- P&PW (F) dated 18-11-2008.

2. The service element of the disability pension under Categories ‘B’ and ‘C’ of this Departments’ O.M. No.45/22/97-P&PW(C) dated 3.2.2000 is regulated by the CCS (Pension) Rules, 1972 and CCS (EOP) Rules, according to which only service gratuity is admissible to Government servants with less than 10 years qualifying service and pension is admissible for qualifying service of 10 years or more. The matter has been reviewed by the Government considering the hardships being faced by the disabled Govt. servants who have less than 10 years qualifying service at the time of discharge and it has been decided that the disability pension of Govt. servants who are discharged from Govt. service will be regulated as under:

Disability Pension – for cases covered under categories ‘B’ and ‘C’

(1) Disability pension comprising a service element equal to the retiring pension (@50% of the emoluments or average emoluments received during the last 10 months, whichever is more beneficial to the Government servant) and gratuity admissible under the CCS(Pension) Rules, 1972, plus disability element equal to 30% of basic pay, for 100% disability. There shall be no condition of minimum qualifying service for earning service element. No service gratuity would be admissible. The condition of minimum of qualifying service of 5 years for payment of gratuity would continue to be admissible/applicable in accordance with Rule 50 of CCS (Pension) Rules, 1972.

(2) For disability less than 100%, disability element of disability pension shall be reduced proportionately. In cases of disability pension where permanent disability is not less than 60%, the disability pension (i.e. total of service element plus disability element) shall not be less than 60% of the reckonable emoluments last drawn subject to a minimum of Rs. 7000/- per month.

Disability pension – For cases covered under Category ‘D’

(1) Disability pension comprising a service element equal to the retiring pension (@50% of the emoluments or average emoluments received during the last 10 months, whichever is more beneficial to the Govt. servant) and gratuity to which the employee would have been entitled to on the basis of his pay on the date of invalidation but counting service up to the date on which he would have retired in the normal course and disability element equal in amount to normal family pension subject to the condition that the aggregate of the service and disability element shall not be less than 80% of the pay last drawn, for 100% disability. There shall be no condition of minimum qualifying service for earning service element. No service gratuity would be admissible.

(2) For lower percentage of disability, the disability element shall be proportionately lower as at present subject to the broad banding of percentage of disability as in OM dated 3/2/2000.

Disability pension – For cases covered under Category ‘E’

(1) Disability pension comprising a service element equal to the retiring pension (@50% of the emoluments or average emoluments received during the last 10 months, whichever is more beneficial to the Govt. servant) and gratuity to which the employee would have been entitled to on the basis of his pay on the date of invalidation but counting service up to the date on which he would have retired in the normal course and disability element equal to pay last drawn. There shall be no condition of minimum qualifying service for earning service elements. No service gratuity would be admissible.

The condition that the aggregate of the service and disability elements shall not exceed the pay last drawn for 100% disability – stands withdrawn w.e.f. 1.7.2009.

(2) For lower percentage of disability, the disability element shall be proportionately lower as at present subject to the broad banding of percentage of disability as in OM dated 3.2.2000.

3. Other terms and conditions in the CCS (EOP) Rules and Liberalized Pensionary Awards Scheme which are not specifically modified by these orders shall continue to remain operative.

4. These orders will be effective from 01.01.2006.

5. This issues with the concurrence of the Ministry of Finance, Department of Expenditure vide their U.O. NO.515/EV/2010 dated 26.10.2010.

6. In so far as persons belonging to the Indian Audit & Accounts Department, these orders issue after consultation with the Comptroller & Auditor General of India.

All India Conference of Central Administrative Tribunal (CAT) Opened Today CAT Commended for Speedy Disposal of Cases

The All India Conference of the Central Administrative Tribunal (CAT) began here today. The Conference, which is being held in the Silver Jubilee year of the CAT, was inaugurated by Mr. Justice Altamas Kabir, a senior Judge of the Supreme Court and was presided over by Dr. M. Veerappa Moily, the Union Minister of Law & Justice. The Minister of State for Personnel, P.G. & Pensions, Shri V. Narayanasamy was also present on the occasion. The Inaugural Session was followed by in house discussion on the agenda items raised by the Members and the session was chaired by the Chairman, CAT, Justice V.K. Bali.

Speaking at the Inaugural Session, the Union Minister of Law & Justice Dr. Moily called upon for the change of attitude in our administrative governance to ensure that unnecessary and trivial service matters are not brought before the Tribunals and Courts. He said that we need to devise mechanism where the problems of the employees are sorted out in the administrative set up itself. To sort out these issues, he said, we need to do ‘out of the box thinking’. He said that the accountability, performance and output of the employees must be judged while handling their cases.

In his inaugural address, Mr. Justice Altamas Kabir applauded the Central Administrative Tribunal for disposing of the cases before it expeditiously and also commended it for the fact that most of its judgments have been upheld by the higher courts.

Speaking on the occasion, the Minister of State for Personnel, P.G. & Pensions, Shri V. Narayanasamy said that the pendency in the Tribunal is substantially low and the time period to dispose of cases is much less compared to higher courts. He said that the government is seriously thinking of ways and means to bring within the jurisdiction of the Central Administrative Tribunal many more Central Govt. organizations and institutions working.

He said that so far we have brought 191 organizations within the ambit of the CAT, so that more Government employees would be in a position to get speedy justice for their grievances. If we can fulfill the infrastructure needs of CAT, even the PSUs and Public Sector Banking Institutions could be covered. He asked the CAT officials to send a proposal to Planning Commission stipulating their infrastructural needs and assured that his Ministry would make efforts to ensure that CAT’s requirements in this regard are fully met.

Shri Narayanasamy said that the historic RTI Act, 2005, has brought great transparency in governance. He said that we are taking further steps to improve RTI law to strengthen it to increase public disclosure, so that most of the information except national security and personal privacy related information would be in public domain.

In his Key note address, Mr. Justice G.S. Singhvi, Judge, Supreme Court of India emphasized on reforms in the Public Services Commissions of the States and said that persons of impeccable integrity should be holding positions in such Boards. He said the Government must ensure that the matters like gratuity and pension etc are resolved in-house and such matters should not reach the Tribunals or the Courts. He called for evolving departmental mechanism which can address the employees’ grievances and thus help reducing burden of courts in service matters.

The Chairman of the CAT, Mr. Justice V.K. Bali said that the about 200 institutions/organizations have been notified resulting into manifold increase in the work of the various Benches of the CAT. But despite quantitative increase in the work, the Tribunals across the country have kept pace with disposal, he said.

Justice Bali informed that at the Principal Bench, the disposal rate is 100%. On an average, 91% cases of the Principal Bench have been upheld in the High Court and the position with regard to other Benches not much different, he said. Justice Bali said that the Tribunal has performed well quantitatively and qualitatively.

Earlier Shri L.K. Joshi, Vice-Chairman of the Central Administrative Tribunal delivered the Welcome Address and later Vote of Thanks was proposed by Shri K.V. Sachidanandan, also Vice-Chairperson.

The Administrative Tribunals in India were set up in 1985 and function from 17 Benches across the country. These Tribunals are unique in the sense that the Members of these Tribunals are both from the Administrative as well as Judicial side. Each Division Bench comprises of a judicial & administrative Member. The Administrative Tribunals in India are different from the Tribunals functioning in some other countries as the Central Administrative Tribunal (CAT) here was set up solely with the purpose of dealing with the cases relating to the recruitment and conditions of service of persons appointed to public services and posts under the control of the Government and thereby, reducing the burden of the High Courts to that extent.

The Conference being held is an Annual Conference which is generally held on 1st Nov every year as this was the day the CAT was established. It is attended by all the Members of the CAT where agenda items brought up by the various Members and other issues being faced by the Tribunal are discussed and recommendations of the Conference are sent to the Government for action. This year is being celebrated as the ‘Silver Jubilee” year of the setting up of the CAT.

MHA and IGNOU Join Hands to Launch Certificate Course in Anti-Human Trafficking

The Indira Gandhi National Open University (IGNOU), in partnership with the Ministry of Home Affairs, has launched a Certificate Course in Anti-Human Trafficking. The purpose of the Course is to accelerate the process of sensitization, awareness and training of law enforcement officials and other stake-holders like prosecutors, Government Departments and NGOs.

Launching the Course here today, the Union Home Minister, Shri P. Chidambaram suggested that those in the police forces should mandatorily enroll in the Course. He also suggested that police forces should include more women officers who can serve as anti-human trafficking officers some time in their career.

The Vice-Chancellor of IGNOU, Prof. Rajashekharan Pillai said that this is a unique programme which has been launched on the Human Rights Day.

Trafficking in persons for various purposes such as commercial sexual exploitation, forced labor, domestic servitude, begging, and public sport etc. is an organized crime that gravely violates basic human rights. Reports of such a criminal activity taking place are a matter of concern to the Government, particularly in reference to law enforcement response as the crime has not received due priority at the cutting edge level of police station. This is attributed to lack of awareness, sensitization, and knowledge of laws and investigation skills and also about lack of appreciation on some of the unique features of this type of crime.

A Certificate Programme on Anti-Human Trafficking by IGNOU will substantially help in furthering and complementing MHA’s efforts on training and competence building in the area of Anti-Human Trafficking. Ministry of Home affairs is implementing a scheme titled “Strengthening the law enforcement response in India against Trafficking in Persons through Training and Capacity Building”. The Scheme has two components: establishing Integrated Antihuman trafficking Units and Training of Trainers .

Sanskriti Schools

The details of grants-in-aid provided by Central Government to Sanskriti School during the last three years and the current year, year-wise are as under :-

Grants to Sanstriti School have been given for capital works only. Grants-in-aid under reference were given to Sanskriti School for construction of Annex block in the premises, which have been fully utilized by Sanskriti School for the said purpose. Utilization Certificates have been received from Sanskriti School and annual accounts of the school for 2007-08, 2008-09 have been audited by the Chartered Accountants. In their opinion, proper books of accounts have been maintained and the Balance Sheet and Income and Expenditure Account are in agreement with the books of accounts.

Grants-in-aid were given to Sanskriti School after obtaining the concurrence of the Ministry of Finance and with the approval of the Cabinet. The question of obtaining approval of the Ministry of Railways does not arise.

Sanskriti School has reserved 60% of its seats to cater to the wards of the officers of the Government including Railways. There are no other special benefits given to the employees of the Ministry of Railways.

Admissions for nursery classes in Sanskriti School are made as per the guidelines of the Government of NCT, Delhi. Further, 60 percent seats are reserved for the wards of Civil Services/Defence Cadre and Allied Services, 15 percent for the wards of the economically weaker sections and 5 percent for the wards of the staff.

For all other classes the admissions are restricted to the wards of Central Government Servants coming on transfer to Delhi. In their cases, the admissions are based on performance in the entrance test, and vacancies available in respective classes.

Government is finalizing a policy/guideline for setting up Sanskriti type schools in other parts of the country.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances & Pensions in written reply to a question in Lok Sabha.

Special Class Railway Apprentices Examination, 2010

The Union Public Service Commission will be conducting the Special Class Railway Apprentices’ Examination, 2010 at 41 centres on 19.12.2010 (Sunday). Admission certificates to the candidates have been dispatched. Rejection Letters citing the ground(s) for rejection have also been dispatched. If any applicant has not received either the admission certificate or the rejection letter, he/she may contact UPSC Facilitation Counter on Tel. NO. 011-23385271, 011-23381125 and 011-23098543 on all working days between 10.00 A.M. to 05.00 P.M. The candidates can also send fax messages on Fax No.011-23387310. Vacant Posts in Postal Department

The number of posts lying vacant in the Postal Department category-wise and scale-wise is as under:

The vacancies are either meant to be filled up by promotion or by direct recruitment according to the provisions in the Recruitment Rules. The Departmental Promotion Committees are meeting periodically to fill up the posts by promotion. Also the Departmental Examination is held regularly to fill up promotional posts wherever the Departmental examinations are prescribed. The vacancies meant to be filled up by direct recruitment are also being filled up in accordance with the policies of the Government.

The shortage of manpower due to promotions, retirement, death or leave is managed by adhoc arrangements, redistribution and combination of duties and by engagement of Short Duty Staff in the Post Offices and paid substitutes for delivery of postal articles. These steps ensure that postal services are not adversely affected.

2. In the Government Order cited, among others, orders have been issued to grant special allowance of Rs.500/- per month to the Secondary Grade Teachers and other teaching posts in the grade of Secondary Grade Teacher / Head Masters of High Schools with effect from 01—08–2010.

3. It has now been brought to the notice of Government that the Selection Grade / Special Grade Secondary Grade Teachers are denied the benefit of Special Allowance sanctioned in the Government Order cited stating that the Selection Grade / Special Grade holders are drawing higher scales of pay. In this connection, I am to state that in the revised pay structure implemented with effect from 01–01–2006, there is no separate Selection Grade / Special Grade scales of pay and only 3% benefit is awarded on awarding Selection Grade / Special Grade and therefore the special allowance is entitled to the category of Secondary Grade Teachers as a whole. Hence, I am directed to clarify that the Special Allowance sanctioned in the Government Order cited is also applicable to the Selection Grade / Special Grade holders in the post of Secondary Grade
Teacher / Head Master, High School.

I am to invite your attention to the references cited.

2. In the reference second cited, among others necessary guidelines on the admissibility of Selection Grade / Special Grade scales of pay notionally with effect from 1-1-2006 and with monetary benefit from 1-8-2010 consequent on the revision of scale of Ordinary Grade scale of pay of certain categories based on the recommendations of One Man Commission were issued. Accordingly a table showing the revised Selection Grade and Special Grade scales of pay has been indicated in Annexure–I therein.

3. In this connection, I am to state that the Ordinary Grade scale of pay of Superintendents and its promotional posts have been revised with effect from 12-12-2007 based on the recommendations of the Official Committee, 2009 and accordingly among others, orders have been issued in the Government Order cited. Subsequently, based on the recommendations of One Man Commission, the scales of pay of certain posts intertransferable with the post of Superintendents have been revised as Rs.9300-34800 + Grade Pay of Rs.4,800/- notionally with effect from 12-12-2007 with monetary benefit from 1-8-2010.

4. Consequent on the issue of clarification in the reference third cited indicating the admissible Selection Grade / Special Grade scales of pay, the Superintendents and the employees in its promotion posts who have been granted the revised scale of pay of Rs.9300-34800 + Grade Pay of Rs.4800 and Rs. 9300-34800 + Grade pay Rs.4900 respectively have requested to indicate the admissible Selection Grade /Special Grade scales of pay to these posts.

5. The request has been examined carefully in the light of the fact that the scale of pay of Superintendents and its promotion posts have been revised with monetary benefit from 12-12-2007 based on the recommendations of the Official Committee 2009 and that the intertransferable posts with Superintendents were granted the scale of pay of Rs.9300-34800 + Grade pay of Rs.4800 notionally with effect from 12-12-2007 with monetary benefit from 1-8-2010. Accordingly, I am directed to indicate the admissible Selection Grade / Special Grade scales of pay as below :-

However in the case of others (i.e. inter-transferable posts) for whom the scale of pay has been revised as Rs.9300–34800 + 4800 notionally with effect from 12-12-2007 with monetary benefit from 1-8-2010 based on the recommendations of the One Man Commission, the Selection Grade / Special Grade scales of pay indicated above shall take notional effect from 12-12-2007 with monetary benefit from 1-8-2010 subject to the fulfillment of the condition stipulated in para-4 (i) of the Government letter third cited

AICPIN for the Month of October, 2010

All India Consumer Price Index Numbers for Industrial Workerson Base 2001=100 for the Month of October, 2010


All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of October, 2010 increased by 2 points and stood at 181 (one hundred and eightyone).

During October, 2010, the index recorded an increase of 11 points in Kodarma centre, 7 points in Giridih centre, 6 points in Mercara centre, 5 points each in Bhilwara and Ghaziabad centres, 4 points each in 4 centres, 3 points in 4 centres, 2 points in 12 centres and 1 point in 32 centres. The index decreased by 2 points in Ludhiana centre, 1 point in 3 centres, while in the remaining 17 centres the index remained stationary.

The maximum increase of 11 points in Kodarma centre is mainly on account of increase in the prices of Rice, Wheat, Fish Fresh, Milk, Onion, Garlic, Vegetable & Fruit items, etc. The increase of 7 points in Giridih centre is due to increase in the prices of Rice, Wheat Atta, Milk, Onion, Vegetable items, etc. The increase of 6 points in Mercara centre is due to increase in the prices of Rice, Goat Meat, Onion, Garlic, Vegetable items, Firewood, etc. The increase of 5 points in Bhilwara centre is due to increase in the prices of Rice, Goat Meat, Milk, Onion, Tea (Readymade), Firewood, Auto Rickshaw Charges, etc. and in case of Ghaziabad centre it is due to increase in the prices of Rice, Wheat Atta, Vegetable items, Tailoring Charges, etc. However, the decrease of 2 points in Ludhiana centre is due to decrease in the prices of Wheat Atta, Arhar Dal, Masur Dal, Moong Dal, Vegetable & Fruit items etc.

The indices in respect of the six major centres are as follows:

The point to point rate of inflation for the month of October, 2010 is 9.70% as compared to 9.82% in September, 2010.

Railway Order – Placement of Pharmacists in the Entry Grade Pay of Rs.4200/-(NFG) on completion of 2 years service in the Grade Pay Rs.2800/-

Subject: Placement of Pharmacists in the Entry Grade Pay of Rs.4200/-(NFG) on completion of 2 years service in the Grade Pay Rs.2800/-

In terms of Board’s letter No.PC-VI/2009/1/RSRP/10 dated 30.03.2010, the Pharmacists (Entry Grade) in the pre-revised scale Rs.4500-7000 have been granted Grade Pay Rs.2800 in Pay Band-1 (Rs.5200-20200) w.e.f.01.01.2006. On completion of two years of regular service in the Grade Pay of Rs.2800, the Pharmacists (Entry Grade) in PB-1 (Rs.5200-20200) are eligible to be granted non-functional upgradation to the next higher Grade Pay of Rs.4200 in the Pay Band-2 (Rs.9300-34800).

2. A reference has been received from NFIR stating that some of the Zonal Railways are insisting on rendering of two years service by the Pharmacists in Grade Pay Rs.2800 for being placed in Pay Band-2, Grade Pay Rs.4200 in the revised pay structure ignoring the service rendered by them in the pre-revised pay scale Rs.4500-7000 and requested for issue of suitable clarification to the effect that the service put in by them in the pre-revised scale of Rs.4500-7000 which corresponds to Grade Pay Rs.2800/-should also be taken into account for counting two years service in Grade Pay Rs.2800 stipulated in Board’s letter No.PC-VI/2009/I/RSRP/10 dated 30.03.2010.

3. The matter has been considered in Board’s Office and it is clarified that the regular service rendered by the Pharmacists in the pre-revised scale Rs.4500-7000 should be counted as service in Grade Pay of Rs.2800 for being placed in Non-functional Grade of Pharmacists in Pay Band-2 (Rs.9300-34800), Grade Pay Rs.4200 in terms of Board’s letter No.PC-Vl/2009/I/RSRP/10 dated 30.03.2010

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
