OFFICE MEMORANDUM

Subject: Reservation in promotion – Treatment of SC/ST candidates promoted on their own merit.

The undersigned is directed to refer to this Department’s O.M.No.36028/17/2001-Estt(Res.) dated 11th July, 2002 which clarified that SC/ST candidates appointed by promotion on their own merit and not owing to reservation or relaxation of qualifications will be adjusted against un-reserved points of the reservation roster and not against reserved points. It was subsequently clarified by this Department’s O.M. No.36028/17/2001- Estt. (Res.) dated 31.1.2005 that the above referred O.M. took effect from 11.7.2002 and that concept of own merit did not apply to the promotions made by non-selection method.

2. Central Administration Tribunal, Madras Bench in O.A. No.900/2005 [S. Kalugasalamoorthy v/s. Union of India & Others] has set aside the O.M.No.36028/17/2001-Estt. (Res.) dated 31.1.2005 and held that when a person is selected on the basis of his own seniority. the scope of considering and counting him against quota reserved for SCs does not arise. The High Court of judicature at Madras in the matter of UOI v/s.S. Kalugasalamoorthy [ WP No.15926/2007 ] has upheld the decision of the Central Administrative Tribunal.

3. The matter has been examined in the light of the above referred judgments and it has been decided to withdraw O.M. No. 36028/17/2001- Estt. (Res.) dated 31.1.2005 referred to above. It is clarified that SC/ST candidates appointed by promotion on their own merit and seniority and not owing to reservation or relaxation of qualifications will be adjusted against unreserved points of reservation roster. irrespective of the fact whether the promotion is made by selection method or non-selection method. These orders will take effect from 2.7.1997. the date on which post based reservation was introduced.

G.S.R(E).- In exercise of the powers conferred by the proviso to article 309 and clause(5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of lndia in relation to the persons sewing in the Indian Audit and Accounts Department, the President hereby makes the following rules regulating the educational and other quali tications required for direct recruits to the posts of Stenographer in Pay Band-l and Pay Band-2 in the Central Civil Services and Civil posts in connection with the affairs of the Union,
namely –

1. Short title and commencement- (1) These rules may be called the Central Civil Services and Civil posts, Stenographer grades in Pay Band-1 and Pay Band-2 (Educational and other Qualifications for Direct Recruitment) Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to all posts of Stenographer in the grade of Pay Band-1 and Pay Band-2 in the Central Civil Services and Civil posts under the Central Government and under the Indian Audit and Accounts Department for which direct recruitment is made through the Staff Selection Commission.

3. Educationaal and other qualifications required for persons to be eligible for direct recruitment to the post of Stenographers- Notwithstanding anything contained in any recruitment rules relating to the posts of Stenographers in Pay Band-1 or in Pay Band-2 borne on the Central Civil Services and Civil posts, the educatiopal and other qualifications rqquired for persons to be eligible to be appointed to such pst of Stenographers by the method of direct recruitment through the Staff Selection Commission shall be as under:-

(i) 12th class pass or equivalent qualification from a recognised Board or University;
(ii) Skill Test Norms:

(a) For Stenographers in Pay Band-1:
Dictation: 10 minutes @ 80 words per minute.
Transcription: 50 minutes (English), 65 minutes (Hindi) on computers”.

(b) For Stenographers in Pay Band-2:
Dictation: 10 minutes @ 100 words per minute.
Transcription: 40 minutes (English), 55 minutes (Hindi) on computers.

Attention is invited to this Ministry’s letter No. 23-1/2008-TS.II dated 16.09.2009 wherein inter-alia it was mentioned that the age of superannuation of the cadre of Physical Educational Personnel of Centrally Funded Technical Institutions (CFTIs) will be at par with UGC and hence be fixed at 62 years. subject to their possessing the qualifications and experience as precribed by UGC from time to time. Subsequently, IITs have represented that the posts of Director of Physical Education do not exist in IITs.

2. The matter was examined in the Ministry and it is clarified that the age of superannuation of only those pasts of Physical Educational Personnel in IITs, carrying the pay scale of Rs.37400-67000 with a Grade Pay of Rs.10.000/-, if any. will be 62 years, subject to their possessing qualification and experience as prescribed by UGC for the post of Director of Physical Education from time to time. For all other posts with Grade pay less than Rs.10,OO0/-, the age of superannuation will be 60 years.

Tamil Nadu Government Pensioners’ Health Fund Scheme, 1995 – Accreditation of Additional registered private hospitals – Orders – Issued.

ORDER:

In the Government order third read above, revised consolidated orders were issued showing list of diseases and a list of accredited private hospitals for availing assistance by the Government Pensioners under the Tamil Nadu Government Pensioners’ Health Fund Scheme. In the Government orders fourth, fifth and seventh read above, additional private hospitals were approved for availing assistance under the Scheme.

2. In the Government order eighth read above, few more hospitals were additionally accredited under the erstwhile Tamil Nadu Government Employees Health Fund Scheme.

3. In the reference twelth read above, the Director of Medical and Rural Health Services has recommended a private hospital viz. Shakthi Eye Hospital, Rajapalayam for according accreditation under the Tamil Nadu Government Pensioners’ Health Fund Scheme for the treatments approved under the scheme as per the guidelines issued in the Government order second read above.

4. The Government after careful consideration has decided to extend the orders issued in the Government Order eighth read above to the Tamil Nadu Government Pensioners’ Health Fund Scheme and also to accept the recommendation of the Director of Medical and Rural Health Services in the reference twelth read above.

5. Accordingly, Government direct that the hospitals shown in the Annexure to this order are approved for availing assistance for the specialities indicated against each under the Tamil Nadu Government Pensioners’ Health Fund Scheme.

6. There shall be no change in other existing rules and conditions.

7. The Director of Pension is empowered to sanction financial assistance under this scheme and requested to quote the correct name of the specialised advanced surgery/treatment as in the approved list and the correct name of the private hospital with its serial numbers in their proceedings for expeditious settlement of claims.

8. These orders shall take effect from the date of issue of this order.

Sub: Grant of financial upgradation under the Modified ACP Scheme – reckoning of Non-Functional Grade (NFG) to DR Assistants/DR Grade ‘C’ Stenographers – clarification reg.

In supersession of Board’s Order of even number dated 17.2.2010, it is clarified that DR Assistants/DR Grade ‘C’ Stenographers who have got Non-Functional Grade (NFG) in the Grade Pay of RS.5400 would only be entitled to 3rd financial upgradation in the immediate grade pay of RS.6600 on completion of 30 years of continuous service or on completion of 10 years of stagnation in 2 single Grade Pay, whichever is earlier. No further financial upgradation would be admissible to such officials.

2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways and has the sanction of the President.

Written Part Result of NDA & Naval Academy Exam (I) 2010 Announced

NDA & Naval Academy Exam 2010 ResultsThe Union Public Service Commission has announced the results of written part of the National Defence Academy and Naval Academy Examination (I) 2010 held in April 2009. The successful candidates have qualified for Interview by the Services Selection Board of the Ministry of Defence for admission to Army, Navy and Air Force Wings of the National Defence Academy for the 125rd Course and Naval Academy 10+2 (Executive Branch) for the 45th Course commencing from 30th December 2010.

The candidature of all the candidates is provisional. In accordance with the conditions of their admission to the examination, they are required to submit original certificates of Age and Educational Qualification direct to the “Additional Directorate General of Recruiting, Adjutant General’s Branch, Integrated Headquarters, Ministry of Defence (Army), New Delhi.” The candidates must not send the original certificates to the UPSC. The mark-sheets of the candidates, who have qualified, shall be available on the Commission’s website after thirty days from the date of publication of the result.

CGEGIS – Recovery of CGEGIS subscription in respect of Multi-Tasking Staff.

Sub:- Recovery of CGEGIS subscription in respect of Multi-Tasking Staff.

1. Consequent upon implementation of the provisions contained in DoP&T OM No. AB-14017/6/2009-Estt(RR) dated 30.4.2010, all Gp D posts in this department have been re-designated as Multi-Tasking Staff and classified as Group C with a common Grade Pay of Rs.1800/- vide this HQrs office letter No.AN/XI/11409/CR/2009 dated 19.5.2010.

2. In view of the above, it is intimated that the rate of subscription towards CGEGIS in respect of MTS will be Rs.30/- per month w.e.f. January, 2011 in terms of Para 5.3 of CGEGIS Rules 1980.

3. All controllers office are therefore requested to please take necessary action accordingly.

Monthly income scheme of Post Offices

The rate of interest payable in Monthly Income Scheme (MIS) accounts in post offices is 8 per cent per annum and Bonus at the rate of 5 per cent is also payable on the deposits made under this scheme on or after 8th December, 2007 upon maturity of the deposit. The interest rates on small savings schemes are regulated/reviewed as per recommendations of Committee on Administered Interest Rates and other related issues chaired by Dr. Y.V.Reddy, the then Deputy Governor, Reserve Bank of India(RBI) , according to which, being administered interest rates, they are benchmarked to average annual yield on Government Securities of comparable maturity in the secondary market, with a suitable spread subject to a maximum of 50 basis point over the benchmark yield, depending upon the maturity and liquidity of the instruments.

Bonus at the rate of 5 percent of the amount deposited in MIS accounts is payable in the accounts opened on or after 8th December, 2007 upon maturity of the deposit. The Central and State Governments take various measures from time to time to promote and popularize small saving schemes through print and electronic media as well as holding seminars, meetings and providing training to various agencies involved in mobilizing deposits under the schemes. As part of this ongoing exercise, Government has taken following steps to make the small savings schemes more attractive and investor friendly:-

The benefit of Section 80C of the Income Tax Act, 1961 has been extended to the investments made under 5-Year Post Office Time Deposits Account and Senior Citizens Savings Scheme, with effect from 01.04.2007.

With effect from 1.8.2007, the maximum deposit ceilings of Rs.3.00 lakh and Rs.6.00 lakh under the Post Office Monthly Income Account (POMIA) Scheme has been raised to Rs.4.50 lakh and Rs.9.00 lakh in respect of single and joint accounts respectively.

The penalty on pre-mature withdrawal of deposits under the Post Office Monthly Income Account (POMIA) scheme has been rationalized from 3.5% to 2% on withdrawal on or before expiry of three years and 1% on withdrawal after expiry of three years.

All categories of pensioners have been allowed to open and maintain ‘Pension Account’ under Post Office Savings Account Rules, with effect from 11th July, 2007.

The restriction on opening of more than one account during a calendar month under the Senior Citizens Savings Scheme has been removed with effect from 24th May, 2007.

Opening of “Zero deposit/Zero Balance” accounts for workers employed under NREG Act, under Post Office Savings Account Rules, with effect from 26th August 2008.

Opening of “Zero deposit/Zero Balance” accounts for Old Age Pensioner Account under Indira Gandhi Old Age Pension Scheme, Widows Pensioner Account under Indira Gandhi National Widow Pension Scheme and Disabled Pensioner Account under Indira Gandhi National Disabled Pension Scheme with effect from 13th October 2009.

National Savings Institute, a subordinate organization under the Department of Economic Affairs (Budget Division) also maintains its web site i.e nsiindia.gov.in in collaboration with National Informatics Centre to facilitate interface with the public through wider dissemination of information on small savings and on-line registration and settlement of investor’s grievances.

This information was given by the Minister of State for Communications & Information Technology, Shri Gurudas Kamat in written reply to a question in Lok Sabha today.

Subject : CCS (Conduct) Rules, 1964 – Permission to avail of mileage points earned by Government servants on tickets purchased for official tour/visits and acceptance of ‘Free Companion Ticket’ introduced from time to time by various Airlines, by Government servants.

The undersigned is directed to refer to Department of Personnel and Training O.M. No. 11013/7/2008-Estt. (A) dated 03.06.2008 on the subject mentioned above (copy enclosed) and to say that references are being received regarding the free companion/spouse ticket offers in the case of domestic travel extended by the airlines on payment of full fare.

2. In this context, Department of Expenditure have clarified as follows : –

(a) In their OM F.No. 7(1)/E.Coord/2008 dated 01.10.2008 instructions have been issued regarding :-

  • (i) Buying the cheapest fare in Economy/Business Class travel, preferably by getting information through the internet.
  • (ii) Using Corporate Coupons for EconomylBusiness Class travel through proper planning and coordination.

(b) Instructions for travel on Government account only by Air India were thereafter issued on 13.07.2009. Subsequently, vide OM dated 01.10.2009, all the Ministries/Departments were notified about the  ackages/concessions offered by Air lndia for Government of lndia Officials. All the above instructions were intended to effect economy in the matter of expenditure on air travel by Government of lndia officials, while on tours.

(c) In regard to whether the free companion ticket offered by Air India while on domestic official tour can be availed of, it may be noted that free companion tickets are provided by the Air lines for domestic travel against full fare tickets only. Purchase of full fare tickets defeats the purpose of instructions issued.

3. It is, therefore, clarified that Government of lndia officials are not expected to purchase full fare Air tickets but instead avail of –

(a) the coupon supersaver booklets being offered by Air lndia for Government of lndia officials as notified vide the Ministry of Finance (Department of Expenditure) OM dated 1st October, 2009;

(b) Supersaver scheme for Business class; or

(c) go in for the cheapest Air lndia fare. In the circumstances, free companion/spouse ticket offers in the case of domestic travel, which are made on payment of full fare, cannot be availed of.

4. Accordingly, all Ministries/Departments are advised to ensure compliance of the instructions by all Government servants in this regard.
