Subject :- Preventive measures to contain the spread of COVID-19

The undersigned is directed to refer to O.M of even number dated 17th March, 2020 on the above-mentioned subject. The Ministry of Home Affairs (MHA) vide its Order dated 15.4.2020 has now extended the nationwide lockdown till 3rd May, 2020 to contain spread of Coronavirus in the country and has issued the consolidated revised guidelines for strict compliance. Para 18(ii) of these consolidated revised guidelines, inter-alia, provide that all officers of the level of Deputy Secretaries & above are to function with 100% attendance while 33% of the remaining officers/staff are to attend offices as per requirement.

2. The spirit of the guidelines is that crowding in the offices may be avoided and safe social distancing norms may be maintained. It is, however, seen that in some Ministries/ Departments, more than 1/3rd of officials /staff below Deputy Secretary level are being called to offices. This might lead to undesirable crowding in the office jeopardizing the preventive measures in place for containing the spread of COVID-19.

3. It is reiterated that guidelines for attendance for officers/staff at levels below Deputy Secretary, be strictly followed. Heads of Departments (HoDs) may also direct their officers/staff to attend office in staggered timings to further avoid crowding in offices/work spaces. As suggested vide O.M. of even number dated 19th March, 2020, the staggered timings may be as follows

(a) 9.00 a.m. to 5.30 p.m.
(b) 9.30 a.m. to 6.00 p.m.
(c) 10 a.m. to 6.30 p.m.

Suitable Roster may, accordingly, be drawn up by the Heads of Department. Needless to say that officials/staff working from home on a particular day should be available on telephone and electronic means of communications at all times. They should attend office, if called for any exigencies of work.

OFFICE MEMORANDUM

Subject : Freezing of Dearness Allowance to Central Government employees and Dearness Relief to Central Government pensioners at current rates till July 2021.

The undersigned is directed to say that in view of the crisis arising out of COVID-19, it has been decided that the additional installment of Dearness Allowance payable to Central Government employees and Dearness Relief to Central Government pensioners, due from 1st January 2020 shall not be paid. The additional installments of Dearness Allowance and Dearness Relief due from 1st July 2020 and 1st January 2021 shall also not be paid. However, Dearness Allowance and Dearness Relief at current rates will continue to be paid.

2. As and when the decision to release the future installment of Dearness Allowance and Dearness Relief due from 1st July 2021 is taken by the Government, the rates of Dearness Allowance and Dearness Relief as effective from 1st January 2020, 1st July 2020 and 1st January 2021 will be restored prospectively and will be subsumed in the cumulative revised rate effective from 1st July 2021. No arrears for the period from 1st January 2020 till 30th June 2021 shall be paid.

3 These orders shall be applicable to all Central Government employees and Central Government pensioners.

(ii) Delay in issuing orders for grant of additional Dearness Allowance w.e.f. 01.01.2020.

Sir,

With reference to the proposal for deduction of contribution from salary towards PM CARES FUND, we submit the following.

Needless to say that the Central Govt Employees organisations , especially Confederation of Central Govt. Employees and Workers , in the past , had stood with the Govt of India and people of our country , during the days of crisis , whether it is war with the neighbouring countries or natural calamities. We are fully aware that the crisis now created due to the Covid-19 pandemic is unprecedented and hence the central Government Employees have to play a major role in overcoming this alarming situation. In fact, some of our departments like Department of Posts, Department of Health and Family Welfare are declared as essential services by the Government and employees are working round the clock in offices and also in the field, inspite of the fact that many of them are not provided with preventive measures as instructed by Ministry of Health and Family Welfare.

We have already given a call to the employees to donate liberally, not less than one day’s salary, towards the PM CARES Fund. As we are representing the lower rung of employees, mainly non- gazetted employees; it may not be possible to donate more from their take home pay. Inspite of this constraint, if the Government is very particular to deduct more, it may be limited to maximum one more day’s salary, thus total two day’s salary. If any employee is willing to contribute more, the same may be deducted from their salary after obtaining consent letter.

Further it may be noted that the Government orders for granting additional DA of 4% to the Central Government Employees and Pensioners w.e.f.01.01.2020 is yet to be issued , even though Cabinet has approved it in March 2020.

It is reported by some print and electronic media that Govt is mooting a proposal to impound DA, which has created uneasiness in the minds of employees and pensioners. It is requested that action may be taken for issuing of DA orders early.

Concludingly , it is requested to issue strict instructions to all Departments that whenever employees are asked to attend duty , in office or in the field , it should be ensured that all preventive measures as instructed by Ministry of Health and Family Welfare is provided to each and every employee , without fail. The death of a Postal employee working in Foreign Post Kolkata due to Covid-19 infection has caused much anxiety among the employees.

This has reference to the even numbered letter dated 08.04.2020, on the same subject. Circles need to process any pending cases for payment of Leave Encashment and 31.3% exgratia, which were left out due some reason but are otherwise eligible according to the guidelines, in the month of April through Payroll Process.

2. The gratuity payment for the direct recruits is also to be ensured in the month of April 2020, for which instructions have already been issued in the even numbered letter dated 01.04.20.

As part of the economy measures adopted to tide over the financial constraints caused by the outbreak of COVID 19 pandemic, periodical surrender of Earned Leave by all categories of employees and teachers including those on temporary appointments will be deferred for a period of three months from the date of this order. This will apply to all bills pending with treasury as on the date of this order. Sanctions already issued, which are pending encashment, will be cancelled and Earned Leave re-credited to the leave account of the respective employees.

2. All Heads of Departments / Drawing and Disbursing Officers and Treasury Officers will ensure strict compliance of this order.

RESOLUTION

The Governor is pleased to decide that during the period from 01.04.2020 to 30.06.2020, accumulation at the credit of the subscribers to General Provident Fund and other similar funds under the administrative control of the Government of West Bengal shall carry interest at the rate of 7.1% (seven point one percent) per annum. The rate will be in force during this financial year for the period from 01.04.2020 to 30.06.2020. The funds concerned are:-

i. General Provident Fund (West Bengal Service).
ii. Contributory Provident Fund (West Bengal).
iii. Provident Funds maintained under the West Bengal Non-Government Educational Institutions and Local Authorities (CPFE) Act, 1983.
iv. Any other Provident Fund maintained under State Account with the approval of this Government.

2. Ordered that the resolution be forwarded to all Departments of the Government of West Bengal and published in Kolkata Gazette.

Disclosure of below benchmark grading in ACRs prior to the reporting period 2008-09 and objective consideration of representation

Subject : Disclosure of below benchmark grading in ACRs prior to the reporting period 2008-09 and objective consideration of representation by the competent authority against remarks in the ACR or for upgradation of the final grading.

The Department of Personnel & Training had vide OM No. 21011 /1/2005-Estt (A) (Pt-II) dated 14.05.2009, issued instructions regarding maintenance and preparation of Annual Performance Appraisal Reports. It was inter-alia stated therein that full APAR, including the overall grading and assessment of integrity, shall be communicated to the concerned officer. The new system of communicating entries in the APAR was made applicable prospectively with effect from the reporting period 2008-09.

2. Subsequently, this Department vide O.M. No.21011/1/2010-Estt.A dated 13.04.2010 issued instructions regarding disclosure of below benchmark gradings in ACRs of the period prior to 2008-09, providing that if an employee is to be considered for promotion in a future DPC and his ACRs prior to the period 2008-09, which would be reckonable for assessment of his fitness in such future DPCs, contain final grading which are below benchmark. for his next promotion, before such ACRs are placed before the DPC, the concerned employee will be given a copy of the relevant ACR for his representation, if any, within 15 days of such communication. It was clearly stated therein that only below benchmark ACR for the period relevant to promotion need be sent to the officer reported upon and there is no need to send below benchmark ACRs of other years.

3. References are being received in this Department from various Ministries/Departments seeking comments/views on disclosure of below benchmark ACRs of the period prior to 2008-09, which have already been considered by DPC prior to 13.04.2010, for promotion to a post/grade, for a representation and holding review DPC after due consideration of such representation.

4. The matter has been considered in this Department and it is felt that acceding to the request for disclosure of below benchmark gradings in ACRs for the period prior to 2008-09 will open flood gates and a large number of employees, both serving and retired, may come up with a request for disclosure of their ACRs of old periods, resulting into administrative difficulties and chaos. It is, therefore, reiterated that only such below benchmark ACRs prior to the reporting period 2008-09 need to be disclosed to the officer reported upon for his representation, as are reckonable for assessment of fitness in future DPCs. In other words, below benchmark grading in the ACRs for the period prior to 2008-09 need not be disclosed to the officer reported upon, if the same are not reckonable for future DPCs.

5. This Department may be consulted in case of any deviation from the aforesaid instructions.

Subject : Choice of CRA Selection by NPS subscribers

It has been decided that the subscribers under All Citizen Model, who were so far allowed to exercise the choice/change of CRAs only once in a financial year, will hitherto be allowed to exercise such choice twice in a financial year. Further, for the subscribers who are under employer-employee relationship, the choice of two CRAs can exceed, if their employer chose to change CRA.

2. Similarly, the Subscribers of All Citizens Model who have already exercised the choice of CRA twice in a financial year, can exercise their choice of CRA even beyond two times, in case they become a member of NPS through their employer viz under Government or Corporate Model.

3. The statement of transactions of NPS Subscribers generated post change of CRA, would reflect the transaction details performed through the earlier CRA also.

4. This circular is issued under Section 14 of PFRDA Act 2013 and is placed under circulars in the CRA section of Intermediaries and also under circulars in the Regulatory framework at PFRDA website.

Functioning of the Benches of the CAT will remain suspended till 03.05.2020

It must be recalled that in the press note issued on 14.04.2020, it was mentioned that the possibility of functioning of the Benches of the Central Administrative Tribunal would be examined after 20.04.2020, depending upon the decision which the government may take as regards the lockdown.

The government announced the relaxation of conditions of lockdown in respect of certain activities. They are aimed at ensuring the transport and supply of essential commodities and in particular food grains; apart from the measures to provide livelihood to the poorer sections. The offices are permitted to function in a highly restricted manner without permitting entry of, or any physical contact with, the public in general.

The information received so far has also revealed that the High Courts are not functioning and exceptional cases are dealt with through video conferencing. In almost all places, the Benches are located at hotspots. The representatives of Bar have also expressed their difficulty in filing or pursuing the cases in this situation.

It is therefore decided that the functioning of, and hearing in, the Benches of the Central Administrative Tribunal shall remain suspended till 03.05.2020. The feasibility of working on certain days already declared as holidays or vacation shall also be considered once the functioning begins.


उल्‍लेखनीय है कि दिनांक 14.04.2020 को जारी प्रेस नोट में कहा गया था कि केंद्रीय प्रशासनिक न्यायाधिकरण की शाखाओं में कामकाज की संभावना पर 20.04.2020 के बाद सरकार द्वारा लॉकडाउन के बारे में लिए गए निर्णय के आधार पर गौर किया जाएगा।

सरकार ने कुछ खास गतिविधियों के संबंध में लॉकडाउन की शर्तों में छूट की घोषणा की है। उन गतिविधियों का लक्ष्‍य निर्धनतम वर्गों को आजीविका उपलब्‍ध कराने के उपायों के अलावा आवश्‍यक वस्‍तुओं विशेष तौर पर अनाज की ढुलाई और आपूर्ति सुनिश्चित करना है। कार्यालयों को अत्‍यंत सीमित रूप से कार्य करने की अनुमतिदी गई है, आम जनता के प्रवेश अथवा उसके साथ किसी तरह के फिजिकल सम्‍पर्क की अनुमतिनहीं दी गई है।

अब तक प्राप्‍त सूचना से भी पता चला है कि उच्‍च न्‍यायालयों में कामकाज नहीं हो रहा है और विशिष्‍ट मामलों की सुनवाई वीडियो कॉन्‍फ्रेंस के माध्‍यम से हो रही है। लगभग सभी स्‍थानों पर खंडपीठ हॉटस्‍पॉट्स में स्थित हैं। उनकी बार के प्रतिनिधियों ने भी इस स्थितिमें मुकदमे दर्ज करने या अनुसरण करने में कठिनाई जाहिर की है।

इसलिए यह निर्णय लिया गया है कि केंद्रीय प्रशासनिक न्यायाधिकरण की शाखाओं में कामकाज और सुनवाई 03.05.2020 तक स्‍थगित रहेगी। इस बात की घो‍षणा पहले ही की जा चुकी है कि एक बार कामकाज शुरु होते ही छुट्टी अथवा अवकाश के रूप में घोषित कुछ खास दिनों में कामकाज की संभावना पर भी विचार किया जाएगा।
