126. SHRI GANESH SINGH:

Will the Minister of HUMAN RESOURCE DEVELOPMENT be pleased to state:

(a) whether the Government is aware that the children of persons belonging to OBC non-creamy layer have not been provided the determined reservation in admission to Kendriya Vidyalayas and if so, the basis on which the guidelines issued by Kendriya Vidyalayas have sought for the latest certificate of OBC mentioning the OBC-non-creamy layer;

(b) the reasons for inclusion of OBC column in the diary provided by the Kendriya Vidyalaya Sangathan to school children if the children of persons belonging to Other Backward Castes are not being provided the determined reservation in admissions to Kendriya Vidyalaya and Navodaya Vidyalaya contains the OBC column; and

(c) whether the Government will consider giving the determined reservation to the children of persons belonging to Other Backward Castes admissions to Kendriya Vidyalaya and Navodaya Vidyalaya and if so, the time by which the same will be done and if not, the basis on which reservation is being provided to other categories?

(a) & (b) As far as Kendriya Vidyalaya Sangathan (KVS) is concerned, 10 seats (out of 40 seats) in class I per section are to be filled as per Right to Education Act Provisions (25% of seats) and these 10 seats will be filled by draw of lots from all applications of SC/ST/EWS/BPL/OBC (Non-Creamy Layer) who are the resident of Neighbourhood/Differently abled taken together. Kendriya Vidyalayas (KVs) asks for the latest certificate of OBC mentioning the OBC-non-creamy layer at the time of admission for the above mentioned purpose.

The basic details of all category students including OBC category are taken in the school diary for school records and providing information whenever required.

Navodaya Vidyalaya Samiti (NVS) has following reservation policy:-

  • At least 75% of the seats in a district are filled by candidates selected from rural areas and remaining seats are filled from urban areas of the district.
  • Reservation of seats in favour of children belonging to Scheduled Casts and Scheduled Tribes is provided in proportion to their proportion to their population in the district concerned provided that in none of the district, such reservation will be less than the national average (15% for SC and 7.5% for ST) but subject to
    maximum of 50% for both the categories (SC & ST) taken together. These reservations are interchangeable and over and above the candidates selected under open merit.
  • Minimum One third of the total seats are filled by girls.
  • There is a provision for reservation for Divyang children (i.e. Orthopedically Handicapped, Hearing Impaired and Visually Handicapped) as per Government of India norms.

The OBC column has been included in the JNV Selection Test proforma for maintaining records and to provide information to Central Board of Secondary Education (CBSE) on need basis.

(c) The matter is under active consideration of the Government.

Proposal for Corporatisation of Ordnance Factories Board

There is a proposal to convert Ordnance Factories under the OFB into a 100% Government owned public sector unit to provide functional and financial autonomy and managerial flexibility so as to enable the organisation to grow at a faster pace and play a greater role in defence preparedness of the country while also adequately safeguarding the interests of the workers.

A team of senior officials led by Additional Secretary, Deptt. of Defence Production along with Chairman Ordinance Factory Board met the office bearers of the All India Defence Employees Federation, Indian National Defence Workers Federation, Bhartiya Pratiksha Mazdoor Sangh and Confederation of Defence Recognized Association here today on the issue of strike notice given by them starting August 20, 2019.

The meeting lasted for nearly two hours in which both parties constructively engaged themselves in a candid and open discussion of each other’s’ viewpoint. It was decided to keep the process of dialogue open to arrive at a mutual understanding.

MoD clarifies there is no proposal to privatise OFB

In continuation of the meeting held on August 14, a Committee of senior officials of Ministry of Defenceled by Additional Secretary, Department of Defence Production alongwith Chairman, Ordnance Factory Board (OFB) once again met the office bearers of the All India Defence Employees Federation, Indian National Defence Workers Federation, BhartiyaPratikshaMazdoorSangh and Confederation of Defence Recognized Association here today on the issue of Strike notice given by them starting with effect from August 20, 2019. The meeting was also attended by officials from the Ministry of Labour& Employment, Government of India.

The Committee also pointed out that the employees’ call for 30 days’ strike was unprecedented, especially when Government has already agreed to their demand to hold discussions at the MoD level and is in process of continuously engaging with them.

The Committee explained to the employee organisations that there is no proposal to privatise OFB. The proposal under consideration of Government is to make it into Defence Public Sector Undertakings (DPSUs), which is 100 per cent Government owned. Rumours being spread that OFB is being privatised are misguiding and with the intent to mislead the workers. Corporatisation of OFB will bring OFB at par with other DPSUs of MoD. This is in the interest of OFB as it will provide operational freedom and flexibility to OFB which it presently lacks. Besides, the interests of the workers will be adequately safeguarded in any decision taken on the subject.

The Committee also pointed out that Government has been continuously trying to strengthen the functioning of OFB, including having taken several steps to modernise the factories, carry out capital upgradation, re-train and re-skill OFB employees at Government costs, enable development of products and components with indigenous technology.The Committee urged the employee organisations to recognise Government’s efforts to make OFB into a competitive, productive and efficient organisation with higher turnover and enhanced profitability, which would also be in the interest of the employees. Therefore, the Committee once again urged the employee organisations to withdraw their proposed strike.

Raksha Mantri Shri Rajnath Singh calls for increased private sector participation in Make in India inDefence; underlines the need to reduce dependence on imports

Raksha Mantri Shri Rajnath Singh today emphasised the need to progressively reduce dependence on foreign manufacturers and indigenously develop comprehensive capabilities in the defence sector. Delivering the inaugural address at the seminar on ‘Modernisation and Indigenisation plans of the Indian Air Force’ in New Delhi, Shri Rajnath Singh urged the private industry to take advantage of the policy initiatives of the Government and engage with defence services, Defence Public Sector Undertakings (DPSUs) and Ordnance Factory Board (OFB) for meeting their indigenisation demands. He reiterated the government’s commitment to resolving any outstanding issue in the way of growth and development of Indigenous Industries in defence sector. He asked the industry not to expect any short-term returns but invest for long term gains.

Raksha Mantri described Indian Air Force as a technologically advanced and extremely potent force saying that the recent offensive against terror outfits in our neighbourhood speaks volumes about the reach and lethality of the formidable arm of the Armed Forces. Indian Air Force, besides Army and Navy, needs to keep pace with the advancements in technology for enhancing operational capabilities, he added.

Recalling Prime Minister Shri Narendra Modi’s call to modernise our Armed Forces, Shri Rajnath Singh said efforts are being made to increase the participation of the private sector in ‘Make in India’ in defence sector.

Listing out the Government’s initiatives to promote ‘Make in India’, Raksha Mantri said foreign investment up to 49 per cent was allowed through automatic route and up to 100 per cent under Government route on case-to-case basis. He urged foreign Original Equipment Manufacturers (OEMs) to establish manufacturing facilities in India adding that a number of opportunities are available to foreign companies through FDI, Joint Ventures or the defence offset route. Shri Rajnath Singh also said the process of defence offset implementation has been streamlined and one of the major demands of the industry to reinstate the provision of services for discharge of offsets has now been provided.

Shri Rajnath Singh announced approval for use of test facilities of government entities for the private industry to meet the best quality standards required for defence manufacturing. He said the decision to this effect has been taken after incorporating the comments of the stakeholders particularly indigenous defence manufacturers. Shri Rajnath Singh expressed hope that the synergy between government’s efforts and industry participation will help fulfil the long-cherished dream of making India a frontrunner in defence production.

Raksha Mantri added that comprehensive outsourcing and vendor development guidelines for DPSUs and OFB to promote participation of private sector, particularly MSMEs in defence production. He said indigenisation requirements of Hindustan Aeronautics Limited (HAL), OFB, DPSUs, Army, Air Force and Navy have also been hosted on Ministry of Defence (MoD) website for the benefit of the private industry.

Raksha Mantri said the defence products list for issuing industrial licenses under Industry Development and Regulation (IDR) Act has been revised adding that it has reduced the entry barriers for the industry especially the small and medium segment. The initial validity of Industrial license has been increased from three years to fifteen years with a provision to further extend it by three years on a case-to-case basis, he added.

Shri Rajnath Singh also referred to the Technology Development Fund (TDF) Scheme which has been established under the aegis of Defence Research and Development Organisation (DRDO) to promote self-reliance in Defence Technology as part of ‘Make in India’ initiative. He said the scheme will encourage participation of public/private industries especially MSMEs so as to create an ecosystem for enhancing cutting edge technology capability for defence application.

In his keynote address, Chief of Air Staff Air Chief Marshal Birender Singh Dhanoa pitched for inhouse manufacturing of defence equipment and called for fine tuning the capabilities to meet the requirements. He said there is a need to replace obsolete war-fighting equipment with indigenous technology and bridge technological gaps in the defence sector. The Air Force is always alert on the border irrespective if there is any movement or not, he added.

Two books on indigenisation efforts of defence equipment were also released on the occasion.

Air Officer-in charge Maintenance Air Marshal S. Chaoudhary, Principal Adviser (Defence), Confederation of Indian Industry (CII) Lt. Gen. JP Nehra (Retd.), Member, Society of Indian Defence Manufacturers (SIDM) and Chairman CII (Northern Region) Satish Kumar Kaura, delegates of the industry and Armed Forces personnel were also present.

Appointment of Chief of Defence Staff

The Government has approved in principle the creation of a post of CDS. An Implementation Committee was also approved and constituted to further determine and finalize the exact responsibilities, an enabling framework for this new post and all other issues involved to ensure smooth operationalization.

A number of Committees viz. the Kargil Review Committee, Group of Ministers (GoM) Report, Task Force on National Security and Shekatkar Committee have studied and recommended creation of the post of CDS/Permanent Chairman Chiefs of Staff Committee.

Military reforms is a continuous process and requisite steps are taken by the Government from time to time, as deemed necessary.

The Unions and Associations of BSNL is constrained to conduct Relay Hunger Fast on 20th to 22nd November, 2019 at BSNL CO, Circle and SSA HQs in protest against the non-payment of salary, non-payment of wages to contract workers, electricity bills, rentals etc, no road map or action plan for maintaining the services in the post VRS scenario and demanding immediate clarifications on VRS-2019 and other demands. If BSNL is not able to pay the salary, Govt. should take the responsibility and pay the salary to all BSNL employees being the Principal Employer and owner of the company.

Charter of Demands

1. Immediate Payment of Salary by BSNL/DoT, remittance of recoveries, payment of wages to contract/casual workers, payment of electricity and rental charges.

2. Spell out the road map for maintaining BSNL services in post VRS scenario, proposed restructuring plan and immediate launching of 4G Services.

3. Immediate clarifications on the VRS-2019 regarding i) Pay Revision, ii) Pension Revision, iii) Commutation of Pension and iv) Gratuity sought by AUAB, well before the closing date of option for VRS.

4. Extend 100% of IDA (119.5%) neutralization till the implementation of 3rd PRC

5. Delinking of Pension Revision from the Pay Revision of working employees and 30% Superannuation benefits to BSNL directly recruited employees.

6. No Reduction of Retirement Age from 60 to 58 honouring the agreement at the time of formation of BSNL.

Norms of Aadhaar KYC are eased, not of the Change of Address in Aadhaar

Norms of Aadhaar KYC are eased for opening of bank account and not for the change of address in Aadhaar, said the Department of Revenue (DoR), Ministry of Finance today while clarifying on Aadhaar KYC use with reference to its notification dated 13.11.2019 on amendment to the Prevention of Money-laundering (Maintenance of Records) Rules, 2005. The DoR said in a categorical statement that its notification is with regard to easing of Aadhaar KYC use for opening of the bank account for the convenience of people who often migrate from place to place for jobs or any other reason and it is not regarding the change of address in Aadhaar card, as has been misreported in various media.

Revenue Secretary, Dr. Ajay Bhushan Pandey said, “The amended PMLR applies only to Aadhaar KYC purposes for opening of bank account and not for the change of Address in Aadhaar card. If a person has moved residence for purposes of work and needs to use Aadhaar KYC for opening a new bank account or change his bank branch, etc., he can give a self declaration of new address while retaining the original address on his Aadhaar card”.

Dr Pandey said that the PML Rules amendment makes opening bank account easier for individuals who are living in an address different from their address in Aadhaar. People who submitted Aadhaar card with a different address as KYC at banks can now submit local address by providing a self-declaration.

He said that with this amendment, giving a self-declaration about a local address or any address other than the one on Aadhaar card will be sufficient as address proof to open bank account with Aadhaar KYC. This amendment brings in convenience especially for the migrant people. For example, if a migrant worker comes from Jharkhand to Mumbai and his/her Aadhaar has Jharkhand’s address, then to open a bank account a self-declaration about his/her local address in Mumbai will be sufficient for Aadhaar KYC.”

DoR sources said that the change has been made through an amendment in the PML Rules and not by way of amending Aadhaar Act/Regulations. So, it does not apply to change of address in Aadhaar card. This amendment has been issued to allow people who have used Aadhaar KYC to open bank account and want to give an address different from the address in Aadhaar as current address on self declaration basis.

Sub : Transfer Policy for Postal Civil Wing Officers and Officials – Issue of guidelines.

Reference is invited to this office O.M. of even number dated 12th October, 2012 with amendment up to date vide which policy guidelines for transfer/postings of Civil Wing personnel of Department of Posts were issued. The matter relating to transfer guidelines for all the officers and officials of the Postal Civil Wing has been reviewed. The competent authority in partial modification and supersession of earlier policy guidelines mentioned above has approved the following transfer policy guidelines with immediate effect.

1. (a) The allotment of Junior Engineer (Civil/Electrical) and Architectural Assistants shall be made to the SE(Civil/Electrical)/ Senior Architect with the approval of the Chief Engineer (C), Works/HQ, New Delhi and thereafter transfers and postings shall be done by respective SE (Civil/Electrical)/ Senior Architect. Likewise allotment of AE(Civil/AE(Electrical/Assistant Architect shall be done to CE(C),Works/HQ with the approval of Additional DG (Coordination) and thereafter transfers and postings shall be done by respective CE (C), Works/HQ.

1.(b) The competent authorities to approve posting and transfer orders in respect of Junior Engineers (Civil), Junior Engineers (Elect.), Architectural Assistants, Assistant Engineers(Civil), Assistant Engineers (Electrical), Assistant Architects, Assistant Executive Engineers (Civil), Assistant Executive Engineers (Electrical), Deputy Architects, Executive Engineers (Civil), Executive Engineers (Electrical), Architects, Superintending Engineers (Civil), Superintending Engineer (Electrical), Senior Architects and Chief Engineers (Civil) shall be as indicated in Annexure ‘A’ (enclosed).

2. The post and station tenure for different cadres is uniformly fixed as 3 years and 6 years respectively. Moreover it will be ensured that tenure of officers/officials working on sensitive post does not under any circumstances exceed 3 years.

2.1 Notwithstanding the above a reduced tenure of two years is prescribed in respect of North East Region, Sikkim, Andaman & Nicobar, Lakshadweep, J&K and Ladakh.

2.2 Classification of Sensitive and Non-sensitive posts in the Civil Wing of the DoP shall be as under-

2.3 The officers due to be retired within a year will not generally be disturbed, subject to administrative exigencies.

3. On completion of the normal tenure, an officer may be considered for posting to anyone of the three stations of his choice as far as possible. However, in respect of officers posted to specified areas mentioned in Para 2.1, the officers on completion of their tenure will ordinarily get preference for posting to the place of their choice subject to administrative exigencies. In case no post is vacant and available, he may be transferred to any other place but will be adjusted at the place of his choice at the earliest opportunity whenever any post falls vacant at the place of his choice. It is clarified that such subsequent posting for adjustment of the officer will be treated as a request posting and no TA/DA shall be admissible.

3.1 No officer should normally be posted back to the same post or same station unless he completes a full tenure on a different post or at a different station as the case may be.

4. The Executive Engineers/Assistant Engineers should be rotated from field posts to Planning posts and vice versa after completion of normal tenures in post.

5. Crucial date for determining the completion of the tenure will be 30th September. The transfers, as far as possible (except in case of administrative exigency), should be issued to coincide with the start of academic session.

6. The request for transfer to a choice station will be considered only after the official has put in service of at least two years at the station where he/she has been posted. In case of transfers at own request the officers will not be entitled to any TA/DA and joining time etc. However, in cases where such officials have completed their normal tenure, the transfers will be issued in the interest of administration notwithstanding their requests, and in such cases the officers/officials will be entitled to TA/DA and joining time.

7. The vacancies available in a particular zone/station at the time of issue of posting orders will be filled up as per administrative requirements with due regard to overall shortage of staff which should be distributed on pro-rata basis.

However, consideration may be given to following categories ad seriatim as far as administratively feasible:-

(a) Eligible lady officers/officials, in order to accommodate them in the same station as their spouses.
(b) Eligible handicapped officials especially those requiring medical facilities not available at other stations.
(c) Eligible requests for transfer based on their continuous length of stay outside the station for which requested.

8. In respect of transfer on promotion, incase the officer/official does not join within one month of the issue of orders or earlier if specified it will be deemed that he/she has declined his/her promotion with all the attendant disqualifications. In case of declining of promotions on subsequent promotion, the benefit of pay will be allowed only from the date of assumption of charge of the post and officer will not be considered for promotion for a period of one year as per Rules.

9. For posting to specified areas with reduced tenure, a roster will be maintained at the level of Chief Engineer (Civil) in strict order of seniority and orders will be issued ad seriatim without exception except under medical advice issued by a duly constituted competent Medical Board. However, the Medical Certificate should be specific for the particular station e.g. Officers not found fit for posting to Ladakh for instance due to high altitude may be posted to other non-hilly areas with reduced tenure.

10. The respective SE(C)/SE(E)/Sr Architect may design guidelines for transfer and posting of staff in their jurisdiction within the broad framework of this policy, if felt necessary, keeping in view the peculiar geographical and other administrative considerations, only after prior approval of Chief Engineer ( Civil)/HQ Postal Directorate, Dak Bhawan, New Delhi.

11. Transfers in the interest of service may be ordered by the competent authority under administrative exigencies even though they do not fall within the purview of these guidelines but for all such orders the competent authority should record reasons in writing on the file.

12. Attention is invited to the provisions contained in the Rule 20 of CCS Conduct Rules 1964 which lays down that no Government servant shall attempt to bring or bring any political or other influence to bear upon any superior authority to further his interest in respect of matters pertaining to service under the Government. Often representations with full official data are being sent by the official’s spouse/parents of the Government servant bringing political or other influence to bear upon the Administration. This can only happen at the behest of the Government servant concerned and if a reference on his behalf is received from any dignitary, the full involvement of Govt. servant in bringing pressure upon Government in violation of Rule 20 of CCS conduct Rules will be assumed and will be viewed seriously which includes recording to this fact in the APAR of the concerned official and also suitable disciplinary action as prescribed in the Rules.

With a view to have broad uniformity over Railways, the avenue of promotion (AVC) of non-gazetted categories of all Departments are under review in Board’s office in consultation with the Zonal Railways and the concerned departments, taking into account the changes that have taken place over the years in the matter of pay scales, percentage distribution of posts etc..

2. As a result of the exercise mentioned above for Medical Department, the AVCs of various non-isolated non-gazetted categories of the Medical Department have been reviewed in consultation with the Health Directorate, and model AVC for various categories have been framed. These are enclosed herewith for information and guidance.

3. It may be noted that review of cadre structure of Medical Laboratory categories is presently under finalization separately. As and when this exercise is complete, the AVC for Medical Laboratory categories also will be revised.

Sub : Timely filling up of vacancies by General Departmental Competitive Examination (GDCE) and Limited Departmental Competitive Examination (LDCE).

The scheme of General Departmental Competitive Examination (GDCE) was introduced vide Boards’ letter No. ECNG)1/92/PM 2/16 dated 20.08.1993 to fill up 25% of Direct Recruitment quota vacancies in certain specified group ‘C’ categories to accelerate the process of redeployment of surplus staff. Later on General Managers were delegated powers to fill up upto 50% of the DR quota vacancies as per need, as well as redeployment of surplus staff.

2. All regular employees working in the lower grades or same grade (except from Safety posts to non-safety posts), irrespective of the cadre in which they are working, possessing the prescribed educational qualifications for direct recruitment are eligible to appear in this examination.

3. This channel as well as the channel of LDCE can be availed by the young, talented and qualified staff working in lower grades for fast track progression to higher grades.

4. Instructions have been issued by the Board from time to time for filling up the vacancies through GDCE and LDCE vide letters of even number dated 02.08.2018, 10.05.2019, 03.07.2019 etc.

5. It is reiterated that Railways should ensure making use of these schemes liberally to fill up the vacancies in time by chalking out-suitable action plan for the same.
