Dear Sir,

Sub : Circulation of instructions/ circulars issued by various departments / Ministries to the Staff side members of National Council (JCM).

The Staff side complained in the meeting of the Standing Committee of National Council (JCM) held on 7-3-2019 that the copies of various instructions / circulars issued by various Ministries/ Departments are not endorsed to the members of the Staff Side of National Council (JCM) and necessary instructions may be issued in this regard. The Chairman was kind enough to give direction to all the Departments that all instructions / circulars pertaining to service matters should be endorsed to the Staff side and may be forwarded to them. We wish to inform you that other than Ministry of Railways no other department is forwarding their circulars / instructions to the Staff side members of the National Council (JCM).

It is therefore requested that DOP&T may kindly issue an instruction in this regard to all the Ministries / Departments by forwarding the list of staff side members of the National Council (JCM) alongwith their postal address. A copy of your instruction may please be endorsed to this Office.

Sub : Review of the Income criteria for the dependent parents of Government employees in the wake of the recent legislation of “Maintenance and Welfare of Parents and Senior citizens Act 2007”

The above demand was discussed as Item No.23 of the Standing Committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference

“Staff side requested to consider removing the enactment of the above act by the Parliament, to enable the dependent parents of Govt. employees to avail medical treatment, since the Act has made it mandatory for the Children to care for their parents at the old age. The CAT Ernakulam Bench has also given a judgement in this regard.

Chairman desired that the Min. of Health may review this issue’

The Ministry of Health not yet taken a favorable decision to implement the above provisions of the Maintenance and Welfare of Parents and Senior citizens Act 2007″. It is therefore requested that since the CAT Ernakulam Judgement was already implemented for the petitioner it is requested that a Central Government order may please be issued for extending the benefit of the above Act to all the Central Government employees.

Sub : Revision of the benefit of Deposit Linked Insurance coverage from GPF.

Dear sir,

You are aware that the above subject was discussed as Item No-3 in the standing committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference

Item No.3: Revision of the benefit of Deposit Linked Insurance coverage from GPF:

“Joint Secretary (Pension) informed that a proposal was sent to Department of Expenditure to consider enhancement of the limit set for deposit linked Insurance Scheme 1976 from Rs.60,000 to Rs.6,00,000/- Department of Expenditure requested for clarification and some precedent cases which are with EPFO, Since, Ministry of Labour and Employment has such similar benefits, wherein the limit of DLIS has been enhanced to 6,00,000/- for depositors in EPF, covered under the scheme, the precedent policy of M/o Labour & Employment along with the proposal has now been sent to Department of Expenditure, He further informed that the Department of Expenditure has been reminded to take action expeditiously.”

Inspite of the above decision it is regretted to inform you that till date the Government orders on the subject matters has not yet been issued. It is therefore requested that the pending issue may be settled by issuing necessary Government Orders. A copy of the Government orders may please be endorsed to this office.

Sub: Policy formulation for direct appointment of Trained Trade Apprentices of Central Government Industrial Establishments like Railways, Defence etc., as per the amended provisions of Section -22 of Apprentice Act,1961.

Chairman stated that in the first instance, the concerned Ministries/Department have to formulate a policy for direct appointment of Trained Trade Apprentices under the Apprentice Act, 1961 and the percentage of reservation of posts for Apprentices shall be decided

We regret to inform you that till date no steps have been taken by the various Central Government Industrial Establishments to implement the above mentioned decision of the National Council (JCM). We therefore request you to kindly arrange to issue necessary instructions for implementation of the above decision in consultation with the staff side of the respective Departments. It was decided in the meeting that the Department of Expenditure would reconsider the issue of restoring the Festival Advance to the Central Government Employees. However till date orders on the subject matter is not yet issued. Since various festivals are forthcoming the employees are pressing hard for an earlier decision on this issue. It is therefore demanded that as agreed in the meeting necessary orders may please be issued for restoring festival advance to the Central Government Employees. Awaiting for your earlier and favorable action please.

Sub: Correlation of the hourly rates of Industrial workers of Ordnance Factories based on 6th CPC Pay scale w.e.f. 1-1-2006

Respected Madam,

The above subject was discussed as Item No.8 of the Standing committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference.

“The Representative of MoD, Deptt. of Defence production stated that the matter has been considered in consultation with Department of Expenditure and decision was taken to the effect that it may not be agreed”.

Staff Side raised their objection on this and stated that there was a huge delay in examining the matter based on the recommendation of 6th CPC in 2008, and hourly rates of Industrial Workers were revised in 2014 and these rates are from prospective date. But, after so many years of delay, now it is informed that the matter has not been agreed to by the Department of Expenditure. They further informed that after the implementation of 7th CPC w.e.f 1-1-2016 till date, the hourly rate of the Industrial Workers of Ordnance Factories is not yet correlated and still pending with MoD. Such delay results in huge loss to the Industrial workers.

Chairman assured that Joint Secretary (Personnel), D/o. Expenditure has agreed to re-examine this issue again.

It is regretted to inform you that even after 5 months of the meeting necessary orders has not yet been issued. It is therefore requested that necessary instructions may be given to Moo to implement the correlation of hourly rates of Industrial Workers deployed on piece work system in the Ordnance Factories in 6th CPC Pay Scale w.e.f. 1-1-2006. Action taken in this regard may please be informed to this office.

Sub : Reduction of one day Productivity Linked Bonus (PLB) to the employees of OFB & DGQA under Department of Defence Production against the Cabinet decision and Government Orders.

The above demand was discussed as Item No.14 of the Standing Committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference.

‘Staff Side stated that inspite of the Govt, orders issued on the basis of Cabinet approval, the employees of Department of Defence Production, are eligible for 41 days Productivity Linked Bonus (PLB). However despite the recommendations by the Hon’ble Defence Minister the Department of Expenditure is reducing one day PLB for the past 11 years, and is approving only 40 days PLB. Similarly in case of EME also such reduction is taking place every year.

JS (Pers), Dept. of Expenditure stated that the issue is under consideration and in consultation with Dept. of Defence Production/MoD. The staff side requested for an early decision in the matter.

Inspite of a period of more than 5 months after the meeting of the Standing committee of National council (JCM) Department of Expenditure have not yet issued any instructions to Department of Defence Production. Since this is an outstanding demand it is requested that necessary instructions may be issued the DDP for payment of the one day PLB amount reduced from the actual PLB due to the Defence civilian employees of OFB, DGQA and DGAQA at the earliest. A copy of your instruction may please be endorsed to this office.

Sub : Grand of House Rent Allowance to the employees who have vacated Government Quarters.

The above demand was discussed as Item No.16 of the standing committee meeting of the National council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference.

Staff Side said that they are grateful for the Govt. order dated 5-3-2019 issued by the Dept. of Expenditure on the subject matter. However there is a difficulty in implementing this order, in the Min, of Railways & Defence, as these Ministries have their own residential colonies and it is also mentioned in the ibid order that ‘ wherever feasible’ . This provision may have to be deleted, so that the employees who have vacate the quarters due to less facilities etc., are able to avail HBA from various sources etc. and are entitled for HRA.

Joint Secretary (Pers) agreed to consider the proposal of the staff side

The Department of Expenditure have not yet issued the above mentioned amendment in the Department of Expenditure order dated 5-3-2019

As agreed in the meeting it is requested that an amendment of the above Government Orders may please be issued by deleting the provision “ Wherever feasible” . A copy of the amendment orders may please be endorsed to this office.

Dear Sir,

Sub : Grant of 3rd MACP in GP Rs.4600 to the Master Craftsmen (MCM) of Defence Ministry, who holding the post of MCM in the Pre-revised pay scale of Rs.4500-7000 as on 31.12.2005.

The above demand was discussed as Item No.19 of the Standing Committee meeting of the National Council (JCM) held on 07.03.2019. The extract from the minutes of the above meeting is given below for your kind reference.

‘Chairman desired that Addl,Secretary, DOP&T may hold a meeting with the officials of MoD to Settle the matter.’

It is understood that as per the decision of the Chairman a meeting was held in DoP&T with the Officials of MoD. However till date the issue is not resolved and the affected employees are retiring without getting their due MACP benefits. Considering the delay which is taking place in settling this genuine demand it is requested that necessary instructions for granting MACP to the above mentioned affected employees of MoD may please be issued at the earliest. A copy of your instruction may please be endorsed to this Office.

Sub : Remove the arbitrary ceiling on Compassionate Appointments.

The above demand was discussed as Item No.11 of the standing committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference

Staff side placed the following views:

(a) The 5% ceiling may be increased to at least 10%

(b) Dependents of employees who dies/medically incapacitated while performing his duty; Like accident on workplace etc., should be granted immediate appointment on compassionate grounds, as a special case without including the same in the 5% ceiling limit.

(c) In the MoD, compassionate appointment to the service personnel are granted within the 5% of Civilian vacancies which is not justified and their appointments may be adjusted from amongst the vacancies of the service personnel.

Chairman agreed to consider the above proposal of the staff side.’

Till date we have not received any instructions from the DOP&T in this regard. It is therefore requested that as agreed by the Chairman the above mentioned 3 proposals given by the Staff Side may be implemented by issuing necessary Government orders. Awaiting for your earlier and favorable decision please.
