OFFICE MEMORANDUM

Subject: Clarification on increase in certain allowances by 25% after enhancement of Dearness Allowances w.e.f. 01.01.2024.

The undersigned is directed to refer to para 2(e) of this Department’s O.M. No.A-27012/02/2017-Estt (AL) dated 17.07.2018. This provides that the limits of Children Education Allowance and Hostel Subsidy would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. References are being received from various quarters with regard to the amount of Children Education Allowance (CEA) and Hostel Subsidy admissible consequent upon enhancement of Dearness Allowance payable to Central Government employees @ 50% w.e.f. 1st January, 2024 announced vide Ministry of Finance, Department of Expenditure O.M. No.1/1/2024-E-II (B) dated 12th March, 2024.

2. Subject to other conditions mentioned in this Department’s O.M. No.A-27012/02/2017-Estt.(AL) dated 17-07-2018, the following shall be the revised limits for CEA and Hostel Subsidy:

a) The amount for reimbursement of Children Education Allowance shall be โ‚น 2812.5/- per month (fixed)and Hostel Subsidy shall be โ‚น 8437.5/- per month (fixed) irrespective of actual expenses incurred by the Government employee;

b) The reimbursement of Children Education Allowance for Divyang children of Govt. employees shall be payable at double the normal rates i.e.โ‚น 5625/-per month(fixed),irrespective of actual expenses incurred by the Government employee;

3. The rates of Special Allowance for Child Care to women with disabilities stands revised to โ‚น 3750/-per month subject to other conditions mentioned in this Department’s O.M. No. A-27012/03/2017-Estt.(AL) dated 16.08.2017.

4. These revisions are applicable with effect from 1st January 2024.

Minutes of the 33rd Meeting of Standing Committee of Voluntary Agencies (SCOVA) held under the Chairmanship of Honโ€™ble MOS(PP) on 22.02.2024 at Vigyan Bhawan, New Delhi

At the outset, Secretary, DoPPW, welcomed Honโ€™ble MOS(PP), representatives of Pensioners Associations and the officers of various Ministries/Departments/Banks for participating in the meeting. List of participants is annexed.

2. Addressing the participants, Secretary (P&PW) highlighted recent reforms and initiatives undertaken by the Department for the welfare of Pensioners. He highlighted that Department has issued OM on 01.01.2024 stipulating that in case of divorce proceedings in respect of a female Government servant/female pensioner are pending in a Court of Law, the female Government servant/female pensioner can make a request for grant of family pension after her death to her eligible child/children, in precedence to her husband.

3. Thereafter, the Action Taken Report on the unresolved agenda items of 32nd SCOVA meeting, were taken up for discussion which are as follows:

(i) Shortage of Doctors, Specialists and Para-Medical Staff in CGHS posts due to increase in number of patients consequent on merger of Postal Dispensaries and need for creation/sanction of new posts to maintain patient and Doctor/Para-medical staff ratio.

Pensionersโ€™ Associations had mentioned that shortage of Doctors, Specialists and Para-medical staff in CGHS Wellness Centres is affecting smooth functioning of CGHS. Consequent on merger of P&T dispensaries in CGHS, the strength of Doctors/Staff needs to be augmented.

Discussion/Decision on agenda item

It was informed by Addl.Director(CGHS) that for Group-A posts under CGHS, the Central Health Services (CHS) Division and Ministry of Ayush are appointing authority and vacant post are being filled at their level through UPSC.

In 2021, CHS posted 184 doctors to CGHS out of which 29 doctors joined and for year 2022, 74 doctors were posted to CGHS, out of which 52 doctors joined. For the year 2023, offer of appointment will be issued by CHS in due course.

Engagement of retired doctors/staff on contractual basis is being undertaken by the respective Additional Directorates (CGHS) from time to time.

For Group B (Non-Gazetted) and Group C staff under CGHS, the vacant posts are being filled through SSC. As on date, out of 860 vacant posts, 647 candidates have been recommended. For vacant posts, Zonal Heads/ADs have been directed to take up the matter with SSC for expediting the recommendation of candidates for vacant posts

The Chairman, SCOVA directed DoPPW that a meeting may be convened with Chairman (SSC) and Ministry of Health &Family Welfare to expedite the process of selection of Pharmacists/staff against the identified vacancies.

In continuation of the OM No. Z-15025/23/2023/DIBJCGHS, dated 28.03.2024, it is hereby brought to the notice of CGHS beneficiaries, that:

A) Creation of ABHA ID (ABHA number) has been extended for a time period of 90 days, w.e.f. 30.06.2024 (3 months from 30.06.2024).

B) Linking of ABHA number with CGHS card has been extended for a time period of 120 days, w.e.f. 30.06.2024 (4 months from 30.06.2024).

C) In order to assist the CGHS beneficiaries, KIOSKS shall be made operational at all the wellness centres by 30.06.2024.

D) The beneficiaries may visit their nearest CGHS wellness centre on need basis for availing assistance in respect of:

1. updating their mobile number
2. correction of error(s) – in name, year of birth, or gender
3. linking of CGHS beneficiary ID to ABHA number, from 01.07.2024 onwards.

Kendriya Vidyalaya to open new school on IIT Tirupati, Yerpedu-Venkatagiri Road

The Kendriya Vidyalaya Sangathan (KVS) is opening a new school on the campus of the Indian Institute of Technology (IIT) Tirupati, Yerpedu-Venkatagiri Road, Yerpedu Post, District – Tirupati, Andhra Pradesh – 517619 (under IHL Sector). The school will initially offer classes from one to five, with plans to expand based on feasibility.

The Indian Institute of Technology Tirupati will be responsible for the construction of the school.

  • Permanent Vidyalaya building as per the specifications of the KVS
  • 100% staff quarters to all the staff of the Kendriya Vidyalaya.
  • All recurring & non-recurring expenditure including 15% Administrative Overhead Charges (AOC) and also future development expenditure

The admission to the Kendriya Vidyalaya will be as per the priorities/admission guidelines prescribed by the KVS from time to time for the KVs under IHL Sector.

The admission process for the academic year 2024-25 shall be completed within 30 days from the date of issue of this order.

Sub: Calendar of Departmental Examinations scheduled to be held in the year 2024-reg.

Sir/ Madam,

Please find enclosed Calendar of Departmental Examinations pertaining to Postal Accounts offices (Annexure-A) to be held in the year 2024.

2. The Circle PAOs will conduct the Departmental Examinations as mentioned in the Annexure-A. Necessary orders for setting of question papers for the said Examinations from the selected panel will be issued separately by the Head of the PAOs concerned. The Notification of holding the examination and calling for applications will have to be issued by the PAOs well in time as per the prescribed time limit of 40 days and the number of vacancies must be invariably indicated category-wise for the examinations as per the existing Recruitment Rules. In case where no vacancy exists or the Examination is not likely to be held for any other reason(s), the fact should be brought to the notice of PA Wing, DoP HQ.

3 The examinations shall be conducted as per the SOP issued vide this office OM No.3- 09/2021-PACE/ Exam/ DE/ 10228 to 10250 dated 06.01.2022. Further the officials on temporary attachment at DoP HQ or any other unit or on Deputation to any other department shall be allowed to appear in the exam in their respective unit.

4. It may also be ensured that the Time Schedule, as indicated in the columns of the Annexure- A are strictly adhered to and timely action is taken at all stages. Results should be declared within the period specified already. In case of delay in the announcement of the result, the reasons for delay and the measures that may be taken to avoid such delays in future may be brought to the notice of PA Wing DoP HQ.

5. Contents of this letter may be circulated to all for information.

Subject: Closing of Central Government Offices in connection with General Elections to Lak Sabha 2024 and General Election to the Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim and Bye- elections to fill the clear vacancies in Assembly Constituencies of various States- Grant of Phase-wise Paid Holiday – regarding

The undersigned is directed to say that in connection with the General Elections to the Lok Sabha 2024 and General Election to the Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim and Bye – elections to fill the clear vacancies in Assembly Constituencies of various States scheduled to be held during April-June, 2024, the following guidelines, already issued by DOPT vide OM No 12/14/99-JCA dated 10th October, 2001, have to be followed for closing of the Central Government Offices including Industrial Establishments in the States:-

(i) The relevant offices/organizations shall remain closed on the day of poll in the notified areas where general elections to the Lok Sabha and State Legislative Assembly are scheduled to be conducted.

(ii) In connection with bye-election to State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organization/Industrial Establishment located outside the constituency having a general/bye-election.

2. The above instructions may be brought to the notice of all concerned.

AICPIN for February 2024 Delayed, Impacting IDA Increase for Employees

The Consumer Price Index for Industrial Workers (CPI-IW) data for February 2024 has not been released by the Labour Bureau. This delay is causing uncertainty for workers who are expecting an increase in their IDA effective from April 1st, 2024.

The Bharatiya Sanchar Nigam Limited Executives Union (BSNLEU) has expressed their surprise at the delay in a statement.

BSNLEU Statement

It is already 2nd April today. Our comrades would have been waiting for the CHQ to give information regarding the expected IDA increase, to be paid w.e.f 01.04.2024. However, it is most surprising that the Labour Bureau has not released the Price Index numbers for the month of February 2024. As a result, IDA increase w.e.f. 01.04.2024 could not be calculated. CHQ will inform the expected IDA increase, as and when the data is released by the Labour Bureau.

It’s important to note that the Labour Bureau typically releases the CPI-IW data on the last working day of the succeeding month. However, the reasons for the delay in releasing the February 2024 data are unclear at this time.

The reasons for the delay in releasing the CPI-IW data for February 2024 are not yet known. It is recommended to keep an eye on the Labour Bureau’s website https://labourbureau.gov.in/ for updates on the data release.

Sub. Coverage under Railway Services (Pension) Rules, 1993 in place of National Pension System in case of those Railway employees who were recruited against the posts/vacancies advertised/notified on or before 22.12.2003-reg.

Ref: Board’s letters of even number dated 10.03.2023 and 14.02.2024.

Please refer to Board’s letter of even number dated 14.02.2024 vide which Zonal Railways/PUs were advised to furnish the details of cases, where options from the railway employees for inclusion under old pension scheme in terms of Board’s instructions dated 10.03.2023 have been received within the stipulated time i.e. 31.08.2023, however, the decision of the appointing authority could not be taken before 30.11.2023. Accordingly, the numbers of pending cases, as furnished by Zonal Railways and Production Units, without going into the merits of the cases, were forwarded to DoP&PW for seeking extension of time limit for taking decision by the appointing authority in the said cases.

2. The matter has been considered by DoP&PW and have conveyed extension of time limit upto 15.04.2024 only in these cases referred to Board by Zonal Railways provided the employees had given their option within the time limit specified in their O.M. dated 03.03.2023(adopted on Railways vide letter dated 10.03.2023).

3. In view of DoP&PW’s advice mentioned in para 2 above, Zonal Railways and PUs are advised to examine each and every case strictly complying with the conditions given in Board’s instructions dated 10.03.2023. The one-time option available under the instructions dated 10.03.2023 is applicable only in cases where the Railway employee has been appointed against a post/vacancy which was advertised/notified for recruitment/appointment, prior to the date of notification of National Pension System, i.e. 22.12.2003, and is covered under NPS on joining service on or after 01.01.2004. The instructions dated 10.03.2023 are not applicable in cases where conditions prescribed in these instructions are not fulfilled.

4. Accordingly, Zonal Railways, PUs, etc. may examine the cases duly complying with the instructions dated 10.03.2023 for seeking the approval of the appointing authority on or before 15.04.2024.

Subject: Waiver of recovery of excess payment made to Government employees – General instructions for Ministries/Departments – reg.

The undersigned is directed to say that Rule 15 of Delegation of Financial Power Rules (DFPRs), 2024 deals with waiver of recovery of overpayment made to Government Servants. As per this rule, a Department of Government of India, an Administrator and any other Subordinate Authority to the Department, to whom powers may be delegated by or under special order of the President, may waive the recovery of an amount found to have been overpaid mistakenly to Government servant, in excess of their entitlement, subject to certain conditions and financial limits as laid down under this rule.

2. The date of order for recovery of overpayment is a critical input for decision regarding waiver of such recovery. Therefore, such order for recovery of overpayment should be issued within one month from the date of detection of overpayment.

3. As per Rule 15 of DFPR 2024, a Department of Government of India may waive recovery of overpayment upto Rs. 2,00,000/- (Rupees two lakh only) in the case of each individual with the concurrence of Financial Adviser of the Department. The following guidelines may be adhered to while processing such cases:

(i) The Ministries/ Department should examine all proposal(s) in terms of the provisions laid down in Rule 15 of DFPRs.

(ii) Ministries/ Departments should verify that in cases of waiver, no serious negligence has taken place on the part of any Government servant, which may call for disciplinary action by a higher authority.

(iii) In case a Ministry/ Department is of the view that the loss is on account of a defect in existing rules or procedures, the same shall be brought to the notice of Department/ Ministry with authority to amend such rules or procedures.

(iv) The guidelines issued by DoP85T vide its O.M. dated 02.03.2016 shall be strictly adhered to by the administrative Ministry/ Department while considering waiver of excess payment made to Government servants. Each case of waiver should be recommended by the Financial Advisor and approved by the Administrative Secretary.

(v) In cases where the waiver of recovery arises from a Court direction, the Ministries/ Departments should satisfy themselves that there are appropriate justifications for not challenging such Court direction.

(vi) In case a recovery which is subsequently waived, is on account of incorrect interpretation of rules or procedures, Ministries/ Departments may review all similarly placed cases to check requirement of waiver of recovery in future cases. In case of incorrect interpretation of rules or procedures, Ministries/ Departments shall take appropriate measures to ensure that such lapses are corrected. If any inquiry has been made to fix the responsibility, the final report as well as action taken by the Ministry may be kept on record.

(vii) In case an incorrect interpretation of rules or procedures(e.g., incorrect pay fixation) has remained un-detected over a long period of time, Ministry/ Department may keep on record appropriate justification why such cases were not noticed during regular review, internal audit, etc.

4. Cases involving waiver of recovery of more than Rs. 2,00,000/- (Rupees two lakh only) should be referred to this Department. Such cases may be forwarded along with a detailed note covering information on para 3 along with the filled in checklist (attached as Annexure to this O.M.).

5. This issues with the approval of the Competent Authority.
