PREAMBLE :

The Hon’ble Chief Minister in the Budget Speech 2015-16 had announced the Government’s decision to provide the facility of VAT reimbursement on purchases made from Police Canteens upto. Rs.3000/- per month for each Police Constable, Accordingly the following orders are issued.

Government are pleased to grant VAT Allowance to Police Constables at the rate of Rs.250/- per quarter subject to a maximum of Rs.1000/- per annum in lieu of VAT paid by Police Constables for purchases made from Police Canteens with effect from 1st April 2017 and until further orders.

PREAMBLE :

According to the order issued in G.O dated 8.05.97 read at (1) above, a Government servant who has reached the maximum of time scale of pay or Selection Time Scale of pay under the Karnataka Civil Services (Time Bound Advancement) Rules; 1983 or Senior Scale of pay under the Karnataka Civil Services (Automatic Grant of Special Promotion to Senior Scale of pay) Rules, l991 and who is granted Selection Time scale/Senior Scale of pay or is promoted to higher post oh or after l-4-96 before accrual of stagnation increment, if he so desires shall give an option in writing to continue in the scale of pay of the lower post or in the Selection Time Scale or Senior scale of pay:as the case may be until he gets the benefit of stagnation increment, to the authorities specified there in ‘within three months from the date of grant of Selection Time scale.of pay or Senior Scale of pay or promotion as the case may be or from the date of issue of the said orders, whichever is later.

In the Government orders read at (2) & (3) above, the time limit specified for exercise of option for Stagnation Increment was extended upto 31-12-99 & 31-07-2012 respectively.

Several cases have been brought to the notice of the Government wherein requests have been made by Government servants to further extend the time limit for exercise of option for stagnation increment as there is anomaly in the pay the Senior Government Servants who have failed to exercise timely option for stagnation increment in term of Government orders dated 08-05-1997 30-08-1999 and 07-05-2012 read at (1), (2) and (3) above.

Government are pleased to extend the time limit for giving option by the Government Servants who have reached the maximum of the time scale of pay / Selection Grade Pay Scale or Selection Time Scale of Pay under the KCS (TBA) Rules, 1983 or Senior Scale of Pay under the KCS (Automatic Grant of Special Promotion to Senior scale of pay) Rules 1991 and who are granted Selection Time Scale of pay, Senior Scale of pay or are promoted to higher post on or after 1-4-1996 before accrual of stagnation increment to continue in the scale of pay of the lower post or Selection Time Scale or Senior Scale or Selection Grade Pay Scale, as the case may be, until they get stagnation increment for a further period upto 04-10-2017 or until further orders whichever is earlier.

The Heads of the Departments should bring the contents of this order to the notice of all concerned immediately for necessary action.

Subject: Revision of pension / family pension of pre-01.01.2016 and post-01.01.2016 retired faculty and non-faculty of Centrally Funded Technical Institutions- regarding.

Sir,

I am directed to convey the approval of the Government of India to revise pension/family pension of pre-01.01.2016 and post-01.01.2016 faculty and non-faculty pensioners / family pensioners of CFTIs, as per Department of Pension and Pensioners’ Welfare OM No. 38/37/2016-P&PW(A)(i)/(ii), dated 04.08.2016 and OM No. 38/37/2016-P&PW(A) dated 12.05.2017 & 06.07.2017, as amended from time to time.

2. The DoP&PW (as per aforesaid OMs) has provided for following manner of revision of pension/family pension:

As per 2nd formulation (recommended by 7th CPC), vide para -4.1 of OM dated 04.08.2016. as follows:

For existing pensioners, who have retired before 01.01.2016 the revised pension / family pension with effect from 01.01.2016 shall be determined by multiplying the existing pension/family pension, as had been fixed at the time of implementation of 6th CPC recommendations, by 2.57. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

OR

As per 1st formulation (recommended by 7th CPC), vide para-4 of OM dated 12.05.2017. as follows:

The pension/family pension w.e.f. 01.01.2016 may be revised by notionally fixing the pay of pensioners in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which pensioners retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. While fixing pay on notional basis, the pay fixation formulae approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. Then:

  • 50% of the notional pay as on 01.01.2016 shall be the revised pension and 30% of this notional pay shall be the revised family pension w.e.f. 01.01.2016; and
  • for family pensioners who were entitled to family pension at enhanced rate, the revised family pension shall be 50% of the notional pay as on 01.01.2016. This shall be payable till the period up to which family pension at enhanced rate is admissible as per rules. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

All CFTIs may, accordingly, workout pension on the lines of concordance tables prepared by the DoP&PW vide OM dated 06.07.2017 as amended from time to time.

3. The DoP&PW’s OM dated 12.05.2017 vide para-5, further maintains that higher of the two formulations i.e. the pension/family pension already revised in accordance with the OM dated 04.08.2016 or the revised pension/family pension as worked out in accordance with para 4 of OM dated 12.05.2017, shall be granted to pre-01.01.2016 pensioners as revised pension/family pension w.e.f. 01.01.2016.

4. Accordingly, all the CFTIs are requested to workout the pension/family pension of pre-01.01.2016 faculty and non-faculty pensioners/family pensioners of CFTIs, as per the formulations discussed above read with other principles enunciated in DoP&PW’s OMs of dated 12.05.2017 & 06.07.2017 and subsequent OMs dated 18.07.2017 & 13.09.2017.

5. In case of those employees who retired/died before 01.01.1986, the pension may be worked out on the lines of concordance tables given in Department of Pension and Pensioner’s Welfare OM No. 38/37/2016-P&PW(A), dated 06.07.2017 based on their notional pay as on 01.01.1986, which was fixed in accordance with DoP&PW’s OM No. 45/86/97-P&PW(D)(iii), dated 10.02.1998.

6. The revision of pension and pensionary benefits such as gratuity, etc. to those pensioners who retired on or after 01.01.2016 shall be done as per Department of Pension and Pensioners’ Welfare OM No. 38/37/2016-P&PW(A)(i), dated 04.08.2016. The revision of pension and pensionary benefits such as gratuity etc. are to be made applicable to only those who are covered with the schemes which are in accordance with the similar schemes for Central Government employees.

7. This order is applicable in only those cases where such pension schemes have already been adopted with prior approval of Government of India/Ministry of Human Resource Development (MHRD), as amended from time to time.

8. In case any institute has revised pension in a manner different from the above formulations, the same may have to be reworked by the concerned institute and necessary adjustments are to be made.

9. Any excess payment made on account of incorrect fixation of pension or any other excess payment made shall be adjusted/recovered against the future payments due or otherwise to the beneficiary.

10. This issues with the approval of IFD at note 18 dated 12.06.2018.

Subject: Implementation of interim Orders / directions in Special Leave to Appeal (C) No. 30621/2011 arising out of final judgment and order dated 15.07.2011 in CWP No. 13218/2009 passed by the Hon’ble High Court of Punjab & Haryana and Special Leave to Appeal (C) No. 31288/2017 arising out of Hon’ble Delhi High Court judgment dated 23.08.2017 and other related court cases — regarding

The Hon’ble Supreme Court vide its order dated 15.11.2017 in SLP(C) No. 28306/2017 has decided to refer to a Constitution Bench to examine whether its earlier decision in M. Nagraj and others vs. Union of India and others requires reconsideration or not, inter alia, on the issue as to whether test of backwardness would, at all, apply in case of SC and ST.

2. The Hon’ble Supreme Court in SLP (C) No. 30621/2011 has passed the following Order on 17.05.2018:

“It is directed that the pendency of this Special Leave Petition shall not stand in the way of Union of India taking steps for the purpose of promotion from `reserved to reserved’ and ‘unreserved to unreserved’ and also in the matter of promotion on merits

3. Further, in the matter related to SLP(C) No. 31288/2017, connected to Special Leave to Appeal (C) No. 28306/2017, the Hon’ble Supreme Court held as under on 05.06.2018 :

“Heard learned counsel for the parties. Learned ASG has referred to order dated 17.05.2018 in SLP (C) No.30621/2011. It is made clear that the Union of India is not debarred from making promotions in accordance with law, subject to further orders, pending further consideration of the matter. Tag to SLP(C) No.30621 of 2011.”

4. The cadre controlling authorities of Central Government Ministries, Departments and Union Territories are to carry out promotions in accordance with the directions of the Hon’ble Supreme Court mentioned in paragraphs 2 and 3 above based on existing seniority/select lists.

5. Every promotion order must clearly mention the stipulation that the promotion shall be subject to further orders which may be passed by the Hon’ble Supreme Court.

6. All Ministries/ Departments are requested to bring this to the notice of all concerned for information/ compliance.

7. State Governments are also advised to take necessary action in accordance with the above mentioned orders passed by the Hon’ble Supreme Court.

Sir/Madam,

I have been directed to invite reference to Finance Department circular letter No. 4/1/2009-5FR/34644 dated 22nd November, 2017 on the subject noted above and to say that the Governor of Haryana is pleased to enhance the rate of Dearness Allowance admissible to employees of Haryana Government who continue to draw their pay in the pre-revised pay scale as per 5th Pay Commission from the existing rate of 268% to 274% of the pay w.e.f. 1st January, 2018.

2. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Haryana Government employees with the salary for the month of June, 2017 to be paid in July, 2018.

3. The payment of arrears of enhanced Dearness Allowance for the month from January, 2018 to May, 2018 shall be made in the month of July, 2018.

4. The provisions contained in Para 3,4,5 & 6 in FD’s instructions dated 12-01-2009 shall continue to be applicable while regulating Dearness Allowance under these instructions
