Subject: Implementation of Hon’ble AFT Chandigarh order dated 04.03.2010 passed in OA No. 100/2010 filed by SPS Vains (Retd.) & 52 Others.
The undersigned is directed to refer to Govt. of India, MoD, Deptt. of Ex-Servicemen Welfare’s letter No.4(140)2010/D(Pen/Legal) Vol.III dated 10.08.2015 issued for implementation of Hon’ble Armed Forces Tribunal, Chandigarh’s order dated 04.03.2010 directing respondents to implement the decision of the Hon’ble Supreme Court dated 09.09.2008 rendered in SLP (Civil) No. 12357 of 2006 [Union of India Vs SPS Vains (Retd.) and 52 others] in the matter of fixation of pension of the pre-2006 retiree petitioners. As per ibid sanction the benefit of revision of pension to Maj Gen SPS Vains (Retd.) and 52 other petitioners was to be paid w.e.f. 01.01.2006 after notional fixation of pay in the revised 6th CPC Pay Scales in terms of SAI 2/S/2008 and corresponding instructions for equivalent ranks in Navy and Air Force.
2. It has now been decided to allow similar benefit of revision of pension/family pension to all Major Generals and equivalent ranks of Navy and Air Force who retired/died prior to 01.01.2006.
3. Para 4 of the ibid sanction letter No. 4(140)2010/D(Pen/Legal) Vol. III dated 10.08.2015 may be treated as deleted.
4. This issues with the concurrence of Ministry of Defence (Fin/Pen) vide their U.O. No. 17(04)/2015/Fin/Pen dated 03.04.2018 and Department of Expenditure, Ministry of Finance vide their ID No. C-44/E-V/2008-Vol. II dated 28.03.2018.

Subject: Grant of financial upgradations under Modified Assured Career Progression Scheme.
Reference is invited to DoP&T OM dated 19.05.2009 on the subject mentioned above. Para 6 of the OM ibid “the Screening Committee shall follow a time schedule and meet twice in a financial year — preferably in the first week of January and July of year for advance processing of the cases maturing in that half.”
Now the cases of those AAOs/PS have to be considered, who are eligible for grant of financial upgradation upto 31.03.2019.
In view of above, it is requested that all the Ministries/Departments may forward the cases of such AAOs/PS who are eligible for grant of financial upgradation upto 31.03.2019, in the enclosed proforma alongwith Service Book, complete CR Dossier upto 2016-17 and latest vigilance clearance certificate by 15.05.2018 positively.
This issues with the approval of Joint Controller General of Accounts.

Guidelines for Submission & Application Forms of Children Education Allowance
1. CEA rate from Apr 17 to Jun 17 is Rs 1500/- PM (required to submit School fees receipt and bills).
2. CEA rate from Jul 17 to Mar 18 is Rs 2250/- PM (Fixed amount no need to submit receipts / bills).
3. For Hostel Subsidy the rate is Rs 6750/- PM w.e.f. 01 Jul 17.
4. CEA for Specially Abled Children is Rs 4500/- PM w.e.f. 01 Jul 17.
5. For claiming CEA submit a certificate issued by Head of Institution / School.
6. For Hostel Subsidy similar certificate required with additional information about expenditure towards boarding and lodging in the residential complex.

Subject :- Amendment in the Payment of Gratuity Act, 1972 – enhancement of ceiling of the payment of Gratuity to the employees of CPSEs thereon – regarding.
In continuation of this Department’s OM No 2(25)/10-DPE(WC)-GL-X/2010 dated 02.06.2010 on the subject Cited above, the undersigned is directed to state that the Payment of Gratuity Act, 1972 has been amended vide the Payment of Gratuity (Amendment) Act, 2018 (No. 12 of 2018), Notification dated 29.03.2018 published in the Gazette of India. In pursuance of the Amendment, sub-section (3) of Section 4 of the Payment of Gratuity Act, 1972 has been amended to substitute the words “ten lakh rupees” with the words such amount as may be notified by the Central Government from time to time”.
2. Ministry of Labour & Employment (M/oL&E)’s Notification No S.O.1419(E) dated 29.03.2018 has indicated that Central Government hereby appoints the 29th day of March, 2018 as the date on which the said Act shall come into force. Further, Milo LISLE vide Notification No. S.O. 1420(E) dated 29.03.2018 has notified that Central Government hereby specifies that the amount of gratuity payable to an employee under the Act shall not exceed twenty lakh rupees.
3. The administrative Ministries/Departments are requested to bring the above to the notice of all the CPSEs under their administrative control for information and compliance
