Subject:- Clarification on the admissibility of House Rent Allowance to the Central Government Employees posted at Greater Noida – regarding.

It has been observed that payment of HRA @ 30% of Basic Pay is being made by certain Ministries / Departments to the Central GOvernment employees posted at Greater Noida, in violation of the instructions issued by the Ministry in this rgard from time to time.

2. It is, therefore clarified that Greater Noida was an ‘Unclassified’ town/place for the purpose of grant of HRA prior to 01.09.2008 and consequent upon the implementation of the recommendations of the 6th Central Pay Commission, it has been classfied as ‘Z’ class town/place w.e.f. 01.09.2008 vide this Ministry’s O.M. No. 2(13)/2008-EII(B) dated 29.08.2008 on grant of House Rent Allowance to the Central Government employees and classficiation of cities/towns for the purpose

3. Financial Advisers of All Ministries/Departments are, therefore requestd to ensue the implementation of the oforesaid O.M. in letter & spirit.

FREQUENTLY ASKED QUESTIONS ON NON-FUNCTIONAL UPGRADATION (NFU)

1 What are the recommendations of 6th CPC for grant of Non-Functional Upgradation to for Officers of Organized Group A’ Services? The Government should, consider batch-wise parity while empanelling and /or posting at Centre between respective batches of IAS and other organized Group A services with the gap being restricted to two years. Whenever any IAS officer of a particular batch is posted in the Centre to a particular grade carrying a specific grade pay in pay bands PB-3 or PB-4. grant of higher pay scale on non-functional basis to the officers belonging to batches of organized Group A services that are senior by two years or more should be given by the Government.
2 Whether the recommendations of 6th CPC have been accepted by the Government? Yes. This will also be applicable to the Indian Police Service and the Indian Forest Service in their respective State Cadres for which the relevant cadre controlling authorities will issue the orders, (Ministry of Finance, Department of Expenditure Notification dated 29th August, 2008 refers)
3 When were the guidelines on NFU issued by DOPT? DOPT have issued instructions on grant of officers of Organized Services in OM No. 14017/64/2008-Estt.(RR) dated 24th April, 2009.
4 To whom the instructions are applicable? NFU is applicable to the officers of Organized Group A services in PB-3, PB-4 and in HAG scale also where there is such a Grade in the Service
5 From which date the grant of NFU to officers of Organized group A services is to be made? The benefit is based on the recommendations of 6th CPC and will be available w.e.f the date of posting of IAS officers in various grades on/after 01.01. 2006.
6 What are the eligibility conditions to be met for grant of NFU? The terms and conditions for grant of NFU are prescribed in the Annexure to the OM dated 24.4.2009. As per the same all the eligibility criteria and promotional norms including ‘benchmark’ for upgradation to a particular grade pay would have to be met at the time of screening for grant of higher pay scale under these orders.
7 What is the definition of the term ‘Batch’? For the purpose of grant of NFU the ‘Batch’ for direct recruit officers in the induction grade shall be the year following the year in which competitive exam was held. In subsequent grades the ‘Batch’ would remain the same provided the officer is not superseded due to any reason. In case an officer is superseded the officer would be considered along with the ‘Batch’ with which his seniority is fixed.
8 Where the entry of officers in Organized Group A Service by DR is at STS, JAG level, how the ‘Batch’ shall be reckoned? In respect of officers entering Organized Group A service by DR at STS, JAG level, they shall be assigned the benefit of ‘Batch’ corresponding to the ‘Batch’ of the officers with whom the seniority is clubbed.
9 Whether the benefit is available to Group B officers inducted into the Organized Group A service? Yes. Such officers shall b assigned the benefit of ‘Batch’ corresponding to the batch of the ‘direct recruit’ officers with whom their seniority is clubbed.
10 Whether the officers can exercise option regarding date of fixation in the higher scale as provided in CCS(RP) Rules? Provisions of CCS(RP) Rules, 2008 will apply.
11 Whether retired employees are eligible for the benefit of NFU? Retired officers who are other wise eligible as on due date shall be considered for the benefit of pay upgradation.
12 Whether the scheme is applicable to Scientists, Doctors, etc. who are covered by their own in-situ promotion schemes? Non-Functional Upgradation and other in situ promotion schemes are separate schemes and it would not be desirable to mix one with the other. The benefit of NFU to Organized Group A Services shall not be applicable to the officers in those Organized Services where FCS and DACP Schemes are already operating and where officers are already separately covered by their own in-situ Career Progression Schemes.
13 Whether DOPT OM dated 13.4.2010 on communication of ACR prior to 2008-09 is applicable while considering cases for NFU? The instructions issued in this Department’s OM dated 13.4.2010 on communication of ACRs prior to 2008- 09 shall be applicable for considering cases of NFU also.
14 What is the due date of upgradation if found unfit on the date assigned to a batch? If an officer is not found eligible during a vacancy year and is found fit in the next vacancy year, NFU may be granted from the 1st April. i.e. the 1st day of the next vacancy year.
15 How to consider cases where the officers do not meet the qualifying service in the vacancy year in which the batch is covered for non functional up gradation? If an officer does not meet the eligibility requirement as on the 1st January of the corresponding vacancy year then such officer is to be considered for grant of NFU in subsequent vacancy year on completion of qualifying service w.e,f. 1st April, i.e. 1st day of the next vacancy year .
16 How the NFU shall be given in respect of officers given penalty? The NFU becoming due after the expiry of the penalty period may be granted w.e.f. the due date as per DOPT instructions. In respect of officers for whom NFU becomes due before the expiry of the penalty period, the same may be granted from the day next to the date on which penalty gets over.
17 Whether the instructions regarding counting of past Group A service at the time of lalteral entry on DR basis to higher grades as per DOPT OM dated 1.9.98 shall be applicable for grant of NFU also? In view of the provisions on meeting the prescribed eligibility criteria and promotional norms in DOPT OM dated 24.4.09. these instructions shall be applicable for the purpose of grant of NFU also.

Subject:- Payment of Transport Allowance to Central Government Employees in Faridabad, Gurgaon, Ghaizaibad and Noida.

It has been brought to the notice of this Ministry that some Central Government Offices located in Faridabad and Gurgaon are paying Transport Allowance to its employees at the rates other than that applicable to such areas and such payment is irregular. It is clarified that the Central Government Employees posted at Faridabad Gurgaon, Ghaziabad and Noida are entitled to Transport Allowance at the rates applicable to ‘other places’ i.e.other than 13 classified cities as per the conditions laid down in this Ministry’s O.M. No, 21(2)/2008-E-II(B) dated 29.08.2008.

Subject- Extension of orders for grant of Child Care Leave to all Civilian Female Industrial Employees of the Central Government.

The undersigned is directed to state that the matter regarding extension of benefit of Child Care Leave to all Civilian Female Industrial Employees of the Central Government at par with the civilian femaleindustrial employees of Defence Establishment covered by the CCS (Leave)Rules, 1972 has been under consideration of this Department. It has been decided in consultation with the Ministry of Finance (Department of Expenditure) to extend the benefit of Child Care leave to all Civilian Female Industrial Employees of the Central Government at par with the civilian female industrial employees of Defence Establishment covered by the CCS (Leave) Rules. 1972 subject to condition provided in rule 43-C of the CCS (Leave) Rules. 1972, as amended from time to time

2 These order shall take effect from the date of 01.9 2008, Earned Leave, if any availed by these employees between 01.0 9.2008 to till date specifically for the purpose of taking care of needs of their eldest two minor children may be converted into Child Care Leave.

All-India Consumer Price Index Numbers for Industrial Workers on Base 2001=100 for the Month of June 2012

All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of June, 2012 increased by 2 points and stood at 208 (two hundred eight).

During June, 2012, the index recorded maximum increase of 8 points each in Mercara and Godavarikhani centres, 7 points in Puducherry centre, 5 points in Madurai, Howrah, Chennai, Lucknow and Warrangal centres, 4 points in 7 centres, 3 points in 13 centres, 2 points in 11 centres, 1 point in 18 centres. The index decreased by 2 points each in Ludhiana and Mysore centres and 1 point in 5 centres, while in the remaining 14 centres the index remained stationary.

The maximum increase of 8 points in Mercara centre is mainly due to increase in the prices of Rice, Poultry (Chicken), Tea (Readymade), Coffee (Readymade), Bidi, Refined Liquor, Firewood, Cinema Charges, Bus Fare, etc. In Godawarikhani centre this increase of 8 points is mainly due to increase in the prices of Rice, Arhar Dal, Moong Dal, Groundnut Oil, Vegetable & Fruit items, Firewood, Petrol, Toilet Soap, etc. The increase of 7 points in Puducherry centre is due to increase in the prices of Rice, Arhar Dal, Poultry (Chicken), Fish Fresh, Fish Dry, Eggs (Hen), Vegetable & Fruit items, Cigarette, Cinema Charges, Petrol, Tailoring Charges, etc. The increase of 5 points in Madurai, Howrah, Chennai, Lucknow and Warrangal centres is due to increase in the prices of Rice, Arhar Dal, Poultry (Chicken), Fish Fresh, Eggs (Hen), Vegetable & Fruit items, Petrol, Tailoring Charges, etc. The decrease of 2 points in Ludhiana centres is mainly due to decrease in the prices of Onion, Vegetable & Fruit items, Firewood, etc. and the decrease of 2 points in Mysore is due to decrease in the prices of Rice, Vegetable & Fruit items, etc.

The indices in respect of the six major centres are as follows :

1. Ahmedabad – 205
2. Bengluru – 211
3. Chennai – 197
4. Delhi – 188
5. Kolkata – 200
6. Mumbai – 212

The point to point rate of inflation based on CPI-IW(General) for the month of June, 2012 is 10.05% as compared to 10.16% in May, 2012. Inflation based on Food Index declined to 10.45% in June, 2012 from 10.61% in May, 2012.

The CPI-IW for July, 2012 will be released on the last working day of the next month, i.e. 31st August, 2012.

Due Date of E-Filing of Income Tax Returns for Assessment Year 2012-13 Extended up to 31st August, 2012

On consideration of the reports of disturbance of general life caused due to failure of power and further in consideration of the fact that the e-filing of returns for a specified category of individuals and HUF has been made mandatory, the Central Board of Direct Taxes (CBDT), in exercise of powers conferred under section 119 of the Income Tax Act, 1961, has extended the ‘due date’ of filing of returns of income for the Assessment Year 2012-13 to 31st August 2012. This has been done in respect of assesses who are liable to file such returns by 31st July 2012 as per provisions of section 139 of Income Tax Act, 1961

Empanelment of Annuity Service Providers (ASPs) for National Pension System (NPS) for providing annuity services to the subscribers of National Pension System

Subscribers to the National Pension System (NPS) will now have a choice of Annuity Service Providers, from whom they can choose their annuity schemes on their exit from NPS on attainment of 60 years of age. Pension Fund Regulatory and Development Authority (PFRDA) has empaneled the following six IRDA approved life insurance companies for providing annuity services to the subscribers of National Pension System (NPS).

1. Life Insurance Corporation of India
2. SBI Life Insurance Co. Ltd.
3. ICICI Prudential Life Insurance Co. Ltd.
4. Bajaj Allianz Life Insurance Co. Ltd.
5. Star Union Dai-ichi Life Insurance Co. Ltd.
6. Reliance Life Insurance Co. Ltd.

2. It may be mentioned that under the provisions of NPS, a maximum of 60% of
corpus accumulated at the time of exit, normally on the attainment of 60 years
of age, can be withdrawn but a minimum of 40% corpus has to be utilized for
purchasing an annuity from one of the empanelled annuity service providers.
Subscriber can choose from any of the six above mentioned annuity service
providers and can also make their choice of the annuity scheme from amongst
the schemes being offered by these providers.

3. With the above empanelment, PFRDA has taken an important step towards
providing an exit route to the subscribers.

Free Rail Travel Facility to Arjuna Awardee Sportspersons Extended to Rajdhani/Shatabdi Trains also

The Ministry of Railways has decided that the Complimentary Card Passes issued to sportspersons who are Arjuna Awardees shall now be valid for travel in 1st Class/2nd AC in Rajdhani trains and Chair Car (CC) in Shatabdi trains besides being valid for travel in 1st Class/2nd AC in other mail/express trains (except Duronto trains) over All Indian Railways (except Metro Railway/Kolkata) as per the existing provision. A circular dated 20th July 2012 of Railway Board has been sent to all the Zonal Railways for implementation.

The said Card Pass entitles them lifelong free travel for self only. In addition, the Arjuna Awardee sportsperson is entitled to facility of a companion in the same class along with the sportsperson on this complimentary card pass on attaining the age of 65 years. In case of Arjuna Awardee Sportsperson, the companion allowed at the age of 65 years shall also be entitled to travel in the same class along with the Arjuna Awardees in Rajdhani/Shatabdi trains.

As per extant policy, Ministry of Railways provides 1st Class/2nd AC Complimentary Card Passes to meritorious sportspersons who are Arjuna Awardees, Olympic Medalists, Gold Medalists in Asian or Commonwealth Games or Dronacharya Awardees. The said Card pass entitles them life long free rail travel for self only in 1st Class/2nd AC over all-Indian Railways (except Metro Railway/Kolkata) by any train other than Rajdhani/Shatabdi trains. The policy further prescribes that sports-person is entitled to facility of a companion in the same class on the aforesaid card pass on attaining the age of 65 years. From now on in case of Arjuna Awardees and their companions only the facility has been extended for travel in Rajdhani/Shatabdi trains.

Complimentary Railway Card Pass Facility Extended to ‘Civilian’ Recipients of ‘Chakra’ Awardees

The Ministry of Railways has decided that the civilian recipients of gallantry awards of Chakra series (namely Param Vir Chakra, Maha Vir Chakra, Vir Chakra, Ashok Chakra, Kirti Chakra and Shaurya Chakra) will also be provided 1st /2nd Class AC Complimentary Card passes on the lines as admissible to Defence awardees. The procedure and other conditions for issue of such Card Passes to civilian Chakra awardees will remain the same as applicable to Defence awardees.

As per extant policy, Ministry of Railways provides 1st Class/2nd AC Complimentary Card passes to Defence personnel recipients of gallantry awards of Chakra series and to widows of posthumous gallantry awardees of Chakra series viz. Param Vir Chakra, Maha Vir Chakra, Vir Chakra, Ashok Chakra, Kirti Chakra and Shaurya Chakra. The Card Pass entitles them life-long free rail travel in 1st Class/2nd AC Class along with one companion in same class over all India Railways except Metro Railway/Kolkata. From now on, this facility will now be available to both civilian and Defence personnel recipients of Chakra Awards.
