Sub :- Settlement of Dues of Officers/staff on retirement.

Ref :- Railway Board’s letter No. 89/AC-II/21/4 dated 9.3.1989 and 16.4.1990.

Kindly refer to the above mentioned letters issued by Railway Board on the captioned subject. In supersession of these instruction, Board (FC and MS) has approved that following procedure may be enforced with immediate effect:-

1. Officers/Staff should be settled by the Railways/Unit from where the Officers/Staff are retiring. In case Officer/Staff are retiring from Railway Board they can opt for settlement of retirement dues, either from Railway Board or from their lien Railways.

2. In the case of Officers/Staff retiring from Railway Organisations who are not authorized to do final settlement, their settlement should be done by the Railway/Unit where the Officers last worked prior to their transfer to such organization.

3. Nothwithstanding the provision (1) above, in the cases of Officers retiring on deputation, they may have an option to get their settlements either from Railway/Unit where service records, leave account and PF account are maintained. However, this option shall be exercised at least six months in advance.

4. Officers/Staff retiring while on deputation to a Central Government Department are to be settled by the borrowing Departments only..

Consumer Price Index for Industrial Workers (CPI-IW) – August,2019

The All-India CPI-IW for August, 2019 increased by 1 point and pegged at 320 (three hundred and twenty). On 1-month percentage change, it increased by (+) 0.31 per cent between July, 2019 and August, 2019 which was static between the same two months a year back.

The maximum upward pressure to the change in current index came from Fuel & Light group contributing (+) 0.31 percentage points to the total change. At item level, Rice, Wheat, Goat Meat, Dairy Milk, Garlic, Onion, Cauliflower, Palak, Peas, Pumpkin, Coconut, Banana, Mango, Sugar, Cooking Gas, Medicine (Allopathic), Bus Fare, Flowers/Flower Garlands, etc. are responsible for the increase in index. However, this increase was checked by Jowar, Eggs (Hen), Fish Fresh, Poultry Chicken, Carrot, Green Coriander Leaves, Methi, Tomato, Apple, etc., putting downward pressure on the index.

The year-on-year inflation based on CPI-IW stood at 6.31 per cent for August, 2019 as compared to 5.98 per cent for the previous month and 5.61 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 5.10 per cent against 4.78 per cent of the previous month and (-) 0.32 per cent during the corresponding month of the previous year.

At centre level Amritsar observed the maximum increase of 7 points followed by Sholapur & Doom Dooma Tinsukia (6 points each) and Mariani Jorhat & Ahmedabad (5 points each). Among others, 4 points increase was observed in 4 centres, 3 points in 5 centres, 2 points in 10 centres and 1 point in 17 centres. On the contrary, Quilon recorded a maximum decrease of 10 points followed by Goa (8 points) and Godavarikhani & Vijaywada (5 points each). Among others, 4 points decrease was observed in 1 centre, 3 points in 1 centre, 2 points in 5 centres and 1 point in 13 centres. Rest of the 13 centres’ indices remained stationary.

The indices of 32 centres are above All-India Index and 44 centres’ indices are below national average. The indices of Mundakkayam and Puducherry centres remained at par with All-India Index.

The next issue of CPI-IW for the month of September, 2019 will be released on Thursday 31st October, 2019. The same will also be available on the office website www.labourbureaunew.gov.in.

Subject : Non / Irregular receipt of rent/allied charges statements.

Reference : PCDA(AF) New Delhi DO letter no. IA/123/Misc/Vol/IV addressed to the Addl. CGDA dated 05/09/2019 (copy enclosed).

Please refer to the DO letter u/r (enclosed) wherein the issue of non / irregular receipt of rent/allied charges statements from AAOs BSOs & AOs/AAOs GEs across all commands has been raised by the PCDA (AF) New Delhi.

The non/irregular floating & late receipt of Rent & Allied Charges by the offices-in-charge has resulted in non-recovery of Govt. dues and incorrect assessment of the demand in r/o officers under posting / superannuation.

In this regard, please refer to CGDA letter no. PRO/AT/MES/203 dated 14/12/1984, wherein it has been explicitly mentioned that AAOs BSOs/ AOs/ GEs should forward the quarterly statement of water and electricity charges by 17th January, 17th April, 17th July and 17th October covering the period for preceding quarter ending 31st Dec, 31St March, 30th June and 30th Sept respectively.

The undue delay in the floating and receipt of Rent & Allied charges is causing recurring loss to the state, and hence it is obligatory on the part of the AAOs BSOs and A0s/ AAOs GEs to adhere to the time frame outlined in the above mentioned CGDA letter in the realization of Rent & Allied Charges.

Dear Sir,

Sub : Removal of ambiguity in fixation of pay of re-employed ex-servicemen and grant of the same benefit extended to commissioned officers who are below officers rank.

The above demand was discussed as Item No.26 of the Standing Committee meeting of the National Council (JCM) held on 7-3-2019. During the course of discussion the Staff side was informed that the issue is in final stage in consultation with the Ministry of Defence and necessary instructions are expected to be issued very shortly. However to our knowledge no Government order has been issued to implement the demand of Ex-servicemen. Therefore it is once again requested that the discrimination meted to the PBOR’s may be removed and necessary Government Orders may please be issued to remove the anomaly / ambiguity in the fixation of pay of re employed ex-servicemen.

Sub : Circulation of instructions/ circulars issued by various departments / Ministries to the Staff side members of National Council (JCM).

The Staff side complained in the meeting of the Standing Committee of National Council (JCM) held on 7-3-2019 that the copies of various instructions / circulars issued by various Ministries/ Departments are not endorsed to the members of the Staff Side of National Council (JCM) and necessary instructions may be issued in this regard. The Chairman was kind enough to give direction to all the Departments that all instructions / circulars pertaining to service matters should be endorsed to the Staff side and may be forwarded to them. We wish to inform you that other than Ministry of Railways no other department is forwarding their circulars / instructions to the Staff side members of the National Council (JCM).

It is therefore requested that DOP&T may kindly issue an instruction in this regard to all the Ministries / Departments by forwarding the list of staff side members of the National Council (JCM) alongwith their postal address. A copy of your instruction may please be endorsed to this Office.

Sub : Review of the Income criteria for the dependent parents of Government employees in the wake of the recent legislation of “Maintenance and Welfare of Parents and Senior citizens Act 2007”

The above demand was discussed as Item No.23 of the Standing Committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference

“Staff side requested to consider removing the enactment of the above act by the Parliament, to enable the dependent parents of Govt. employees to avail medical treatment, since the Act has made it mandatory for the Children to care for their parents at the old age. The CAT Ernakulam Bench has also given a judgement in this regard.

Chairman desired that the Min. of Health may review this issue’

The Ministry of Health not yet taken a favorable decision to implement the above provisions of the Maintenance and Welfare of Parents and Senior citizens Act 2007″. It is therefore requested that since the CAT Ernakulam Judgement was already implemented for the petitioner it is requested that a Central Government order may please be issued for extending the benefit of the above Act to all the Central Government employees.

You are aware that the above subject was discussed as Item No-3 in the standing committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference

Item No.3: Revision of the benefit of Deposit Linked Insurance coverage from GPF:

“Joint Secretary (Pension) informed that a proposal was sent to Department of Expenditure to consider enhancement of the limit set for deposit linked Insurance Scheme 1976 from Rs.60,000 to Rs.6,00,000/- Department of Expenditure requested for clarification and some precedent cases which are with EPFO, Since, Ministry of Labour and Employment has such similar benefits, wherein the limit of DLIS has been enhanced to 6,00,000/- for depositors in EPF, covered under the scheme, the precedent policy of M/o Labour & Employment along with the proposal has now been sent to Department of Expenditure, He further informed that the Department of Expenditure has been reminded to take action expeditiously.”

Inspite of the above decision it is regretted to inform you that till date the Government orders on the subject matters has not yet been issued. It is therefore requested that the pending issue may be settled by issuing necessary Government Orders. A copy of the Government orders may please be endorsed to this office.

It was decided in the meeting that the Department of Expenditure would reconsider the issue of restoring the Festival Advance to the Central Government Employees. However till date orders on the subject matter is not yet issued. Since various festivals are forthcoming the employees are pressing hard for an earlier decision on this issue. It is therefore demanded that as agreed in the meeting necessary orders may please be issued for restoring festival advance to the Central Government Employees.
