Sub : Allotment of House to staff improving availability and simplification of process.
In order to improve availability of Houses for Railway Employees and to simplify the process of allotment, Board (ME, MS, FC & CRB) have approved the following:
1. The quarters of a pool laying vacant for more than 3 months or so should be brought into a Common Pool. The process may be started from way side station colony and progressively moved to minor and major colony.
2. There may be a single allotment agency considered at the station of the unit that would maintain the record and allot the quarters in accordance with the rules set out by the Railway/Division/Unit.
3. Vacant Quarter shall be allotted as per the rules set out, preferably within 7/15 days of the vacancy.
4. Railway/Division/Unit may formulate necessary guidelines for implementation keeping in view the Local conditions and shall make the process transparent and preferably allot the quarters online.
5. Other rules & guidelines including policy of allotment of quarters to essential staff as issued from Board shall remain unchanged and as modified from time to time.
This issues with the concurrence of Associate Finance of Transformation Cell of Railway Board.

Income tax exemption for gratuity enhanced Up to Rs. 20 lakhs
Ministry of Finance has enhanced the income tax exemption for gratuity under section 10 (10) (iii) of the Income Tax Act, 1961 to Rs. 20 lakhs. Shri Santosh Kumar Gangwar, Minister of State for Labour and Employment has expressed hope that this would benefit those employees of PSUs and other employees not covered by Payment of Gratuity Act, 1972 and has thanked the Finance Minister for enhancing the exemption limit.
The ceiling of Gratuity amount under the Payment of Gratuity Act, 1972 has been raised from time to time keeping in view over-all economic condition and employers capacity to pay and the salaries of the employees, which have been increased in private sector and in PSUs. The latest such enhancement of ceiling of gratuity was made vide Government of India Notification dated 29.03.2018 under which the gratuity amount ceiling has been increased from Rs.10 lakhs to 20 lakhs w.e.f. 29.3.2018.
The Union Cabinet, chaired by the Prime Minister Narendra Modi has approved Memorandum of Understanding (MoU) between Union Public Service Commission (UPSC) and Civil Service Council of Mongolia (CSCM).
The MoU will strengthen the existing relationship between CSCM and UPSC. It will facilitate sharing of experience and expertise of both the parties in the area of recruitment.
Cabinet approves reservation in Teachers’ Cadre Ordinance, 2019
The Union Cabinet, chaired by the Prime Minister Narendra Modi has approved the proposal for promulgation of “The Central Educational Institutions (Reservation in Teachers’ Cadre) Ordinance, 2019” considering the University/ College as a unit instead of ‘Department/ Subject’.
Impact:
This decision is expected to improve the teaching standards in the higher educational institutions to attract all eligible talented candidates.
Benefits:
This decision will allow filling up of more than 5000 vacancies by direct recruitment in Teachers’ Cadre duly ensuring that the Constitutional Provisions of Articles 14, 16 and 21 shall be complied with and stipulated reservation criteria for the Scheduled Castes/ Scheduled Tribes and Socially and Educationally Backward Classes are met with.
Cabinet approves setting up of 50 new Kendriya Vidyalayas under Civil/Defence Sector all over the country
The Union Cabinet, chaired by the Prime Minister Narendra Modi has approved the setting up of 50 new KendriyaVidyalayas under Civil/Defence Sector all over the country.
The Vidyalayas are proposed to be opened in the Civil/Defense Sector and once they are fully functional they will provide quality education to approximately 50,000 students once they become fully operational.

Subject : Reservation for Handicapped (Persons with Disability) in engagement of Gramin Dak Sevaks.
I am directed to invite your kind attention to this office memo no.17-08/2017-GDS dated 21.06.2017 regarding Reservation for persons with disability in engagement of Gramin Dak Sevaks.
2. As per existing instructions, the Head of Circles and Regional PMGs are required to give preference ceteris paribus, (other things being equal), to persons with disabilities for appointment in GDS categories. The capacity of the candidate to perform the job should however is to be considered in consultation with prescribed medical authorities. It further provides that no specific posts will be reserved for these categories. In other words, no roster etc. is required to be maintained. As far as possible the representation of physically handicapped persons should be approximate to the levels applicable to Group C and D posts.
3. Now, the Parliament has passed a new Act viz. “THE RIGHTS OF PERSONS WITH DISABILITIES ACT 2016 ” which has come into force with effect from 19th April 2017. The provisions of this Act are mandatory and binding on all establishments. According to this Act, no Government establishment shall discriminate against any person with disability in any matter relating to employment. Every Government shall appoint in every Government establishment, not less than four percent of the total number of vacancies in the cadre strength in each group of posts meant of be filled with persons with benchmark disabilities under clause (a), (b) and (c), and one percent for persons with benchmark disabilities under clause (d) and (e) namely :-
(a) Blindness and low vision
(b) Deaf and Hard of Hearing
(c) Locomotors disabilities including cerebral palsy, leprosy cured, dwarfism, acid attack victims and muscular dystrophy
(d) Autism, intellectual disability, specific learning disability and mental illness
(e) Multiple disabilities from amongst persons under (a) to (d) including deaf-blindness in the post identified for each disability.
4. As per recommendations of the Committee constituted for identification of posts in Gramin Dak Sevaks as suitable for Persons with Benchmark Disabilities in pursuance of Rights of Persons with Disabilities Act, 2016, following orders are issued.
(a) All Recruiting Authorities shall maintain 4% reservation for persons with disabilities to all categories of GDS posts except for persons with benchmark of disability -Blind’ (for all categories of GDS). Percentage of reservation may be maintained as in the case of SC, ST and OBC categories in GDS posts. As per the recommendation of Committee constituted for identification of GDS as suitable for PwD, it has been decided that, ‘Low Vision’ category may be considered instead of ‘Blind’.
(b) Production of disability certificate as applicable in regular appointment of all categories of GDS would be compulsory.
(c) These provisions do not require maintenance of reservation rosters but all Recruiting Authorities shall maintain a register for reservation of persons with disabilities so that required percentage of reservation to persons with disabilities could be ensured. The register shall contain the details like Name, Address, kind of disabilities and date of engagement.
(d) For maintaining required percentage of reservation for persons with disabilities, all Recruiting Authorities shall reserve more GDS posts to these categories in future engagement subject to existing instructions on overall sealing of reservation in a year.
(e) Following categories of disability are suitable for the posts in GDS.

5. This is for strict compliance. Non observance of the provision of the reservation for persons with disabilities shall be considered as an act of disobedience and the concerned nodal officer concerned in the Circle/ Region responsible for the proper strict implementation of reservation for persons with disabilities, be departmentally proceeded against for the default.
6. The above scheme of reservation will be effective in respect of all categories of GDS for direct recruitment vacancies to be notified on or after 01.02.2019.

Attention is invited to Board’s letter No. 2008/AC-II/21/19 dated 29.05.2009 on the above subject vide which instructions were issued providing for additional relief on death/disability of Government servants covered by New Defined Contribution Pension System (NPS).
2. In the wake of the above instructions, some of the Zonal Railways have raised the issue of admissibility of provisional family pension to the family members of the deceased railway servant who were governed by National Pension System (NPS) but died prior to allotment of FRAN Card and starting of the deductions towards NPS.
3. The above issue has been examined in consultation with Pension Fund Regulatory and Development Authority (PFRDA) and the Department of Pension 8: Pensioners’ Welfare (DOP&PW). It is clarified that all the railway servants appointed on or after 01.01.2004 are to be covered by the National Pension System (NPS). Therefore. the provisional benefits granted vide Board’s letter dated 29.05.2009 to all NPS employees in case of death in service/disability, will be admissible to the family of the deceased subscribers/subscribers on fulfillment of the conditions specified therein irrespective of the fact that FRAN Card was not allotted at the time of death/disability or the deductions towards NPS had not started. However, while giving the provisional benefits, instructions issued vide Board’s letter No. 2012/F(E)III/1(1)/4 dated 08.09.2014 may also be kept in view.

Misinformation Being Spread About Level-1 Results of Railway Recruitment Board
For Level 1 results, no new method of result preparation was introduced As per Centralised Employment Notification, marks secured by candidates are subjected to normalization On normalisation, marks secured by a candidate can become more than the total marks of the exam paper This method of normalisation is being followed for nearly 19 years now, since 2000
RRBs had invited online applications against Centralized Employment Notification (CEN) No. 02/2018, published by RRBs on 10.02.2018, for a total 62,907 vacancies. Record number of 1,89,78,913 online applications were received. World’s largest Computer Based Test was successfully conducted on 51days from 17.09.2018 to 17.12.2018 in 152 shifts.The result of the above Computer Based Test was announced on 04.03.2019.
Para-7 under the Head “Important Instructions” of the Centralized Employment Notification(CEN) 02/2018, it has been stated that marks secured by the candidates would be subjected to normalization.
Now large number of candidates have represented on the result declared by RRBs and the method adopted for the same. For the above Computer Based Test no new method of preparation of result has been introduced. The short listing of candidates has been done purely on candidate’s merit and by the following time tested method of normalization:-

All RRB examinations/Computer Based Test held since 2000 have followed this normalization method.
It is not uncommon that on normalization, marks secured by a candidate would go more than the total marks of the exam paper. In the previous examinations of RRBs, there have been instances where normalized marks of candidates were more than the total marks. In CEN-02/2018 results there is nothing unusual because raw marks secured by the candidates are crucial indetermining their normalized marks.
The maximum normalized marks of any candidate in Level-1 (CEN-02/2018) Computer Based Test(CBT) is 126.13. Any other marks higher than this, is pure concoction.
Before publication of results, all candidates were made privy to the Question Papers, Master Answer Key and their own evaluated answer sheet. The ‘Objection tracker’ was accessible to candidates from 14th January 2019 to 20th January 2019. During this 1.58 lakh candidates submitted their objections which were considered and reviewed.
It may be noted that in addition to 1.5 lakh jobs, Railways will also be recruiting 2.3 lakh more people over next two years. Taken together with the ongoing process, the total number will be a 4 lakh jobs by Indian Railways.

Subject: Proposed Nationwide Dharna/Demonstration by National Joint Council of India (NJCA) on 13th March, 2019 against National Pension Scheme (NPS) -Instructions under CCS (Conduct Rules), 1964 – Regarding.
It has been brought to the notice of the Government that a forum by the nomenclature of National Joint Council of Action (NJCA) has decided to organize Dharna/Demonstrations in front of Jantar Mantar, New Delhi and all across the country on 13th March, 2019 in order to protest against New Pension Scheme (NPS).
2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1/(s)/2008- Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).
3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the willing employees are allowed hindrance free entry into the office premises.
4. In case employees go on Dharna/demonstration, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty on the day of Dharna/demonstration, i.e., 13.03.2019.
