Subject: Grant of Scholarship to the Children of Postal & GDS Employees.

I am directed to inform you that with reference to letter No.13-1/93-WL&Sports dated 20.05.1993, 1-1/2017-WL & Sports dated 30/31.01.2018 and 19-31/2012-WL/Sport dated 02.12.2013, scholarship for the wards of postal as well as GDS Employees, the following decisions have been taken which are conveyed as under:

1 If a Postal/GDS employees who could not apply to the scholarship for his ward initially at the year of taking admission to the college i.e. in 1st year degree/diploma course after passing 12th exam, can he/she be considered eligible to the scholarship for subsequent years i.e. 2nd/3rd/4th year as the case may be, in which he/she applies He/she may apply in 2nd year and eligible for the Scholarship from current year i.e. 2nd yr to final yr
2 If a Postal/GDS who applies for the scholarship first time directly in the final (3rd or  4th as the case may be) year academic degree/diploma course and requested to grant Scholarship for previous academic years of his ward (1st year /2nd year/3rd year as the case may be) along with current year, can he be given scholarship for each previous year + current year altogether, if applied for He/she may apply in 3rd year and eligible for the scholarship from current year i.e. 3rd yr to final yr and in case of apply in final yr, eligible only for final yr.
3 If a postal/GDS who applies for the scholarship first time directly in the after completing academic degree/diploma course and requested to grant scholarship for previous academic years of his ward (1st year /2nd year/ 3rd year/final year as the case may be) can he be given scholarship for each previous year altogether, if applied for He/she may not apply after completing academic Year/diploma course.

2. This will be applicable for the ward of postal as well as GDS Employees

3. These change will be applicable for the wards studying in IIT/AIIMS/IIM Medical/Technical Education/PG in Degree/Diploma and non technical Education. This will be applicable from FY-2018-19.

New Delhi, the 20th September, 2018

G.S.R 899(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Posts (Postman and Mail Guard) Recruitment Rules, 2010 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Postman and Mail Guard in the Department of Posts, Ministry of
Communications, namely:-

1. Short title and commencement.—(1) These rules may be called the Department of Posts Postman and Mail Guard (Group ‘C’ post) Recruitment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and level in the pay matrix.—The number of posts, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating to the said posts, shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other ground for doing so, exempt any person from the operation of this rule.

5. Recruitment to serve in the Army Postal Service.—Any person appointed to the posts specified in the Schedule shall be liable to serve in the Army Postal Service in India or abroad, as required.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Savings.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-Servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Pursuant to NFIR’s reference vide letter dated 11/04/2018 relating to admissibility of payment of Breakdown Allowance to the staff working in GP 2000/Level-3 of 7th CPC who were left erroneously in Board’s order dated 30th August,2017 (RBE No.106/2017), Railway Board vide letter dated 14/09/2018 (RBE No.138/2018) have issued clarification for grant of Breakdown Allowance to the Technicians Grade-III though drawing pay in higher pay level under MACPS at the rates prescribed for the post held by the employee. Federation however noticed that the said instructions are not in conformity with the Federation’s demand to grant Breakdown Allowance to the Staff working in GP 2000/Level-3 at the pay received in the same Grade Pay/Pay Level.

In this connection, Federation desires to state that the Breakdown Allowance is treated as Compensatory Allowance and is attached to the extra-ordinary duties performed by such staff. The Board’s clarification dated 14-09-2018 limiting the payment of Breakdown Allowance to the post held by the staff i.e. substantive pay in GP 1900, is unjustified and needs to be corrected suitably to render justice to the staff of Technical Categories.

NFIR, therefore, urges the Railway Board to consider the above points and issue amendment to the clarification to letter dated 14-09-2018 soon duly endorsing copy to the Federation.

Subject : Fixation of pay under FR-22(1)(a)(i) to the officials, who were screening test passed & were officiating in the grade of JTO –  reg.

Sir,

Kind attention is invited to this office letter no.3-8/2010/Pers-IV dated 30.04.2013 and subsequent letter of even no. dated 01.01.2014 vide which the benefits of pay fixation under FR 22(1)(a)(i) was given to officiating JTO’s ( who are the members of AIBSNLEA & SNEA) as per Hon’ble PCAT orders dated 26.08.2010 in OA No.1282/2010 filed by AIBSNLEA and order dated 11.02.2017 in OA No.4116/2015 filed by SNEA from the date they become eligible for pay fixation, after obtaining an undertaking mentioned below;

“I …….. hereby undertake that in the event of success of SLP filed before the Hon’ble Apex court , the amount so paid will be recoverable with or without intervention of CAT or High court.”

In this regard, it is informed that, Apex court has given orders dated 20.07.2018 in SLP No.19274/18, 19271/18 &/19310/18 and order dated 30.07.2018 in SLPNo.19304/18, that ” we are not inclined to interfere with the impugned judgment and order. Consequently, the special leave petitions are dismissed”.

In view of the dismissal of SLP , the case has been re-examined and it has been decided to extend the benefits of pay fixation under FR 22(1) (a)(i) to all similarly placed officials, who are at par with officials ( for whom benefits of pay fixation under FR22(1) (a) (i) had already been granted) in accordance with instructions issued frOm this office letter no.3-8/2010/Pers-IV dated 01.01.2014 and Letter no. 3-32/2013/Estt-IV dated 22.12.2015 (both letters are available on BSNL Intranet).

Since SLP filed by BSNL has been dismissed , No undertaking is required from the officials while fixing their pay under FR 22(1)(a)(i). The undertaking already taken from such officials may be withdrawn.

You are therefore requested to take further action accordingly.

This is being issued with the approval of Competent Authority.

The issue of entitlement for house retention by Railway officers appointed as MDs/CMDs of Railway PSUs in project mode has been considered by Railway Board.

2. In exercise of the powers vested with the full Board to make reasonable relaxations in public interest for a class/group of employees in all or any of the provisions regarding house allotment / retention, Board has decided to make provisions in the Master Circular – 49 as under —

(i) Railway officers appointed as CMDs/ MDs of Railway PSUs, which are in project mode, will be allowed to retain Railway accommodation allotted to them while in Railway service for their tenure as CMD/MD at Market Rent applicable to the type of accommodation under their occupation while proceeding on absorption basis to the PSU. This dispensation will be available to them for a period of 05 (five) years from the date of issue of the order. No fresh allotment or change of house would be permitted to such personnel. These provisions are not applicable to the CMDs / MDs who had joined the PSUs earlier on absorption basis in any capacity.

(ii) DFCCIL and NHSRCL have been considered by the Board to be eligible for the above dispensation of PSUs in project mode that exclusively undertake Railway projects, as of now in case of deputation / absorption of Railway officers.

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

The Central Board of Secondary Education invites ‘Online applications’ from eligible students who have passed Class X Examination 2018 from the CBSE affiliated Schools for the following Scholarship Schemes: –

1. CBSE Merit Scholarship Scheme for Single Girl Child for + 2 studies – 2018.

2. Renewal of Online applications of CBSE Merit Scholarship Scheme for Single Girl Child X Pass awarded in 2017.

The details and eligibility conditions along with the application form are available on Board’s website i.e. www.cbse.nic.in at Scholarship Link. The last date for submission of online applications is 5th October 2018 and hard copy of application form (renewal only) has to be submitted on or before 31st October 2018. Hard copies received after the last date shall not be entertained.

Sub:- Observance of three phase countrywide agitational programme by GDS JCA

Sir,

As you are aware non-implementation of positive and basic recommendations of Kamlesh Chandra committee on G.D.S Employees viz., implementation with effect from 01st of January 2016, gratuity Revision, SDBS/pension, 30 days paid leave, Enhancement of composite allowance, financial up gradation on completion of 12, 24 and 36 years of service etc. has generated resentment and discontentment among the G.D.S employees. It is pertinent to mention here that although discussions were held at Directorate, I am sorry to state that no progress is observed so far on any of the issues. Under the circumstances we are compelled to observe three phase fast Programme of agitation.

The above three GDS Unions, JCA decided the following countrywide agitational programme to settle the charter of demands.

Agitational programmes:

  1. 25-09-2018 : One day country wide hunger fast infront of Divisional Offices
  2. 04-10-2018 : One day country wide hunger fast in front of Circle Offices.
  3. 10-10-2018 : One day massive hunger fast in New Delhi.

CHARTER OF DEMANDS

1) GDS committee report as a whole be implemented with effect from 01st of January 2016.

2) Change the formula already adopted for calculation of arrears.

3) Change of upper limit of gratuity from Rs 1,50,000/- to Rs 5,00,000/-

(a) GIS limit should be enhanced to Rs.5,00,000 with the subscription of Rs.500/-

4) 10% of the TRCA of the GDS should be recovered towards SDBS contribution and the Government to contribute equal share.

(a) And also EPF Scheme to be introduced to GDS as recommended by the GDS Committee. This was also recommended by the previous GDS Committees.

5) GDS should be granted 30days paid leave in a year and the leave should be allowed to be carry forward subjected to the maximum of 180 days and provide encashment of the leave.

6) Grant Children Education allowance Rs.6000/- per child per Annum.

7) Enhance composite allowance to the BPMs from Rs500/- to Rs 1600/- Also grant composite allowance to ABPMs & GDS working in classified cities and the GDS working in Departmental Offices etc., wherever applicable.

8) GDS employees should be granted financial up gradation on completion of 12, 24 and 36 years of service in the form of grant of additional increments.

(a) Point to point fixation to be ordered instead of bunching of TRCA scales.

9) Limited transfer facility to GDS on request should be relaxed. There shall not be any drop in wage scale on account of a request transfer. The transfer of GDS will be approved by Divisional head if the transfer is within the Division, by regional PMG if it is within the region by HOC if the transfer is within the Circle.

10) Voluntary discharge schemes for the GDSs: 3 types of voluntary discharge schemes as recommended by GDS committee for the GDSs’ who are willing to quit the post before the discharge at the age of 65 years should be implemented.

11) All discharge benefits (retirement benefits) should be implemented retrospectively, w.e.f 01 January 2016.

12) Put off duty may be averted by transferring the GDS to another place.

13) Incentive system should be abolished for India post payment bank (IPPB) work. Enhance the working hours of branch post office and GDS officials concerned after introducing the IPPB.

14) GDSs’ should be allowed to get discharge from the service on the last day of the month in which He/She attains the 65 years of the age.

15) All single handed branch post offices should be provided with one more hand to upgrade to double handed office.

16) Employees’ state Insurance ( ESI) facility to be extended to Grameen Dak Sevaks wherever E.S.I dispensaries and hospitals are available the country.

The programme will be a peaceful one.

Ref: 1. Ministry of Personnel, Public Grievances and Pensions (DoP&T)’s Notification No. GSR.767(E) dated 11.08.18 (Annexure A).

2. MoH&FW’s OM NO. A.12034/4/2018-CHS.V dated 13.8.18 (Annexure B).

In supersession of orders contained in Board’s Letters of even number dated 31.05.16 (RBE No. 57/2016) and 26.12.2017 (RBE No. 205/2017) and in accordance with the orders contained in the DoP&T’s Notification No. GSR.767(E) dated 11.08.18 amending Clause (bb) under FR 56 of the Fundamental Rules, 1922, the provisions in respect of age of superannuation of doctors of the Indian Railways Medical Service and Dental Doctors under the Ministry of Railways are modified as stated in the Notification.

2. The age of superannuation of Doctors belonging to IRMS and Dental Doctors under the Ministry of Railways shall be sixty-two (62) years unless they exercise the option of posting to a Clinical post depending upon their expertise and experience, as decided by the Competent Authority in the Ministry of Railways from time to time, in case they desire to continue in their service upto the age of sixty-five (65) years.

3. The serving doctors belonging to IRMS and Dental Doctors under the Ministry of Railways who have already attained the age of 62 years or will be attaining the age of 62 years within 6 months from the date of issue of these orders may exercise their option as per the enclosed format within a period of 30 days from the date of issue of these orders. All other doctors would, in future, be required to submit their option not less than 06 months before their attaining the age of 62 years. The Railway doctors should furnish their option through the Personnel Branches of their respective Railway administrations.

4. The serving doctors who fail to exercise the option within the period specified above shall stand superannuated from service on attaining the age of 62 years or on expiry of the period of 30 days from the the date of issue of these orders, whichever is later.

5. Posting orders involving inter-Railway transfers and for those working in Boards office will be issued by the Railway Board. Orders of CMSs and CMDs in Zonal Railways who cross 62 years of age and opt to serve in a Clinical post and who are posted on the same Railway itself would be issued by the Zonal Railway administration themselves.

6. Copies of options exercised by the Railway doctors should be forwarded to the Board’s office (Secretary’s Confdl. Cell) for record and necessary action.

7. A list of administrative posts identified by the Ministry of Railways and designations of IRMS officers after 62 years is annexed (Annexure C).

8. These instructions are available online at www.indianrailways.gov.in.

9. These instructions may be brought to the notice of all doctors belonging to IRMS and Dental Doctors under the Ministry of Railways.

10. This issues with the concurrence of Finance Directorate of the Ministry of Railways.
