OFFICE MEMORANDUM
Sub: Issue of Pensioners’ Identity Card to Pensioners- Revised Format.
The undersigned is directed to refer to this Department’s OM of even no. dated 12.08.2015 and to say that the instructions related to the issue of Pensioners’ Identity Card to Pensioners were issued by this Department. In para 2 of the OM dated 12.08.2015, it is mentioned that Pensioners’ ID Card shall include the Aadhaar No. of the pensioners, if available. Accordingly, a format for the pensioners’ Identity Card was also issued.
2. The matter has been reconsidered. It has been decided that henceforth, the Pensioners’ Identity Card may be issued to the pensioners in the revised format (copy enclosed).

Subject:- Clarification on Multi Tasking Staff, Recruitment Rules, 2018.
Madam / Sir,
I am directed to refer to Department of Posts (Multi Tasking Staff) Recruitment Rules (RRs), 2018 notified on 16.08.2018 which superseded the Recruitment Rules notified in 2015. In this regard, a few Circles have sought clarification on certain points, which are clarified as under:-

When there is more than one mode of recruitment or more than one source of feeder cadre, percentage of vacancy to be filled by each mode / source is specified. Since, no percentage has been fixed in the 2018 RRs of MTS of Administrative Offices, entire vacancy will have to be filled up in the manner provided under Column-10 of the relevant Schedule, i.e. First by appointment of Casual Laborers the order specified therein, failing which from GDS through Competitive Examination, failing which direct recruitment from open market

Karnataka :- Whether GDS should satisfy all the educational and other qualifications (schedule 7-RR, 2018) prescribed for Direct Recruitment .

Punjab:- Few units like MMS does not have GDS cadre in their establishment and the first component for filling up of 50% posts on the. basis of seniority-cum-fitness basis from the GDS of recruiting unit will not be possible in these units.
Whether the posts of MTS can be filled up through LDCE component in respect of units/divisions where GDS candidates are not available or less in number as compared to MTS and whether GDS of other units may be considered against these vacancies.
As per column 10 of Part II-(Posts of Subordinate Office) of Multi Tasking Staff, Recruitment Rules, 2018, 50% of the vacancy ls to be filled up by direct recruitment on the basis of seniority-cum-fitness from GDS. If sufficient eligible candidates are not available (including non-availability of candidate as mentioned by Punjab Circle), unfilled vacancies shall be added to the number of vacancies to be filled in by second method i.e. the number of vacancy calculated as per the provision at (ii), viz. 25% by direct recruitment of GDS on the basis of competitive examination m the manner provided therein.

Karnataka:- Circulate revised pattern and syllabus.
The issue is under consideration by a Committee. Further communication will be sent to Circles in due course.

Telangana:- The GDS candidates selected for APS through Limited Departmental Competitive Examination but temporarily deployed in civil post offices whether their deployment should be cancelled and reverted back to GDS cadre or What further course of action to be taken in respect of these candidates?
In this context, clarification issued vide letter No. No. 14-07/2017-SPN-I dated 31.01.2019 may be perused.

Telangana:- Whether leftover vacancies of the year 2016-17 can be offered to GDS surplus qualified candidates as per the provisions of new recruitment rules?
O.M No. AB.14017/13/2013 Estt.(RR)(1349) of Department of Personnel & Training (DOPT) states as under:-
“The legal position is that the posts are to be fi lled up as per the eligibility conditions prescribed in the Recruitment Rules in force at the time of occurrence of vacancies unless the Recruitment Rules are amended retrospectively. The practice has however been to give eff ect to the Recruitment Rules prospectively”
Further, clarification has already been issued vide letter number 37-10/2002-SPB-I dt. 14.11.2002 which states as follows-
“According to cannons of law, the recruitment rules in force at the time of occurrence of vacancies, whatsoever be the date of notification, should be followed.” Subsequently, after notification of RRs of MTS m Subordinate Offices on 28.06.2012, it was clarified vide letter number 45-2/2011-SPB-I dated 18.10.2012 that vacancies pertaining to the years 2009, 2010 and 2011 were to be filled up as per the pre-amended RRs.
Accordingly , vacancies upto the vacancy year 2017 (April 2017-March 2018) are required to be filled up as per the MTS, Recruitment Rules, 2015, and vacancies occurring in 2018 vacancy year (April-December 2018) and thereafter are required to be filled up as per Recruitment Rules of 2018 notified on 16.08.2018.

Andhra Pradesh, Karnataka, Haryana:- Whether a common of examination may be conducted for filling the MTS vacancies of both Administrative and Subordinate offices by calling options from the candidates.
If a common examination is to be conducted to fill up the posts of Subordinate offices and Administrative offices:
(i) Who will issue the roll number to the candidates as the candidates will apply for vacancies in both the units
(ii) while preparing the result, whether a common merit list will be prepared or two separate lists will be prepared for selection;
(iii) if a separate merit list has to be prepared, detailed procedure may be intimated;
(iv) if a common merit list is prepared, who will be given the first preference for selection as MTS m Administrative offices;
(v) whether we have to obtain preferences from the candidates at the time of applying for the post
(vi) whether the post of administrative offices would be filled up from surplus qualified candidates.
A common examination may be held across the Circle for filling up of vacancies both Administrative and Subordinate offices.
Issue of Roll Number
a. Circle shall issue two digit numerical code for each recruiting division (10 for Administrative Office. For other Divisions, from 11 onwards alphabetical order)
b.Circle shall issue single digit numerical code starting from 1for each category of vertical vacancy. Similarly single digit numerical code for each category of horizontal vacancy shall be issued.
c. Candidates shall submit their application to appear in Examination in their respective Unit where they are working. Roll Number to candidates shall be issued by the Recruiting Division in the following manner:
Recruiting Division Code; followed by
Category code for vertical vacancy; followed by
Category code for horizontal vacancy; followed by
Three digit roll number starting from 001.
Seeking Option of Candidatea.
a.At the time of inviting application for appearing in examination, candidates may be asked to exercise order of preference of Recruiting Units (All Divisions / Administrative Office).
b. There shall be two sets of preference to be exercised by a candidate.
c. In the 1st set of preference , the candidate shall indicate the order of preference for ‘Parent Division’, i.e. the recruiting unit to which a candidate belongs, and Administrative Office in the manner the Candidate decides. If a candidate does not want to be considered for either of these two recruiting units or both these recruiting units, he/she shall write ‘not to be considered’.
d. In the 2nd set of preference, rest of the Recruiting Divisions (other than Parent Division and Administrative Office) shall be arranged in the order of preference the candidate decides.
e. It should be clarified that candidates should exercise preference for all Recruiting Units for consideration. In case preference is exercised for a limited number of units and could not be allocated to one of those limited units as per merit vis a vis vacancy in the category he/she belongs to, he/she will not be considered for other recruiting units not preferred even though a candidate lower in rank to him/her is considered who has opted for that unit.
f. Order of Preference once exercised shall not be changed
Preparation of Merit List and allocation of Divisions
a. There shall be single Merit List for the entire Circle.
b. Qualified candidates shall be allocated to their respctive parent recruiting unit or Administrative offices in the order of merit vis a vis preference exercised in first set of preferences and category in which selected vis a vis availability of vacancy in the respective category (for the purpose of vertical I horizontal reservation).
c. A reserve category candidate selected against an unreserved vacancy on own merit shall have choice to migrate to reserve category if by doing so he/she can be allocated to a Unit, which is higher m the order of preference exercised by him/her. Therefore, an undertaking to this effect shall be included m the application for appearing in examination.
d. After allocation of candidates as per preference for Administrative Office and Parent Unit (s), remaining candidates in the order of merit shall b allocated to other recruiting division(s) where there are unfilled vacancies in respective category. Provisions of (c) above shall also apply in this case.Publication of ResultsResults shall be published in three Parts -(i) Part-I showing the list of candidates in order of merit who have been allocated to Administrative Office, (ii) Part-II showing the list of candidates, Recruiting Division wise, in order of merit who have been allocated to Parent Division, and (iii) Part-III showing the list of surplus qualified candidates who were not allocated to Parent Division or Administrative Office and allocated to other Recruiting Units/Divisions based on merit.
2. The above clarifications may be brought to the notice of all concerned and action taken to conduct DPC/Examination for promotion/appointment to the cadre of MTS at the earliest.

The said set of settlement forms has been modified to include the option for Cashless Treatment Scheme in Emergency (CTSE) as well.
2. Accordingly, in partial supersession of the letter dated 12.11.2018, a modified set of settlement forms is enclosed herewith for compliance and guidance. Other instructions contained in the letter dated 12.11.2018 will remain the same.

Sub: Regulation of LTC claims when portion of journey are performed by private transport- Regd.
This Directorate has sought clarification from the Nodal Ministry regarding reimbursement of LTC claims where a part of the journey (be it in the beginning, middle or end) has been performed by the Government servant by unauthorized mode of transport (private bus/private taxi etc.) and rest of the journey to the declared place of visit by authorized mode of transport.
2. The Nodal Ministry has issued following clarification:
(I) DOP&T’s OM no. 31011/3/2015-Estt. (A.IV) dated 09.02.2017 provides that cases where a Government servant travels on LTC upto the nearest airport/railway station/bus terminal by authorized mode of transport and undertakes rest of the journey to the declared place of visit by private transport/ own arrangement (such as personal vehicle or private taxi etc.), may be dealt with as follows:-
(a) In all such cases the Government servant may be required to submit a declaration that he and the members of the family in respect of whom the claim is submitted have indeed travelled upto the declared place of visit.
(b) If a public transport is available in a particular area, the Government servant will be reimbursed the fare admissible for journey by otherwise entitled mode of public transport from the nearest airport/railway station/bus terminal to the declared place of visit by shortest direct route.
(c) In case, there is no public transport available in a particular stretch of journey, the Government servant may be reimbursed as per his entitlement for journey on transfer for a maximum limit of 100 kms covered by the private/personal transport based on a self-certification from the Government servant. Beyond this, the expenditure shall be borne by the Government servant.
(II) In view of the above provisions, a Government employee shall get fare reimbursement in cases where the initial or end part of the LTC journey from the source/destination to the nearest railhead/airport or vice-versa, as the case may be, has been performed by a private/personal mode of transport while the major part of the journey from the nearest railhead/airport has been performed by the authorized mode of transport.
3. Taking into account the advice ofthe Nodal Ministry in this regard, action may kindly be taken in similar cases only on the basis of the above advice and in any case of deviation from the above, the advice ofthe Directorate may be sought for.

The 3 day strike called on by the AUAB started at 00:00 hrs. today. The entire Executives and Non-Executives of BSNL have given a tremendous response to the strike call. In almost all the circles, strike is total.
This is a fitting reply given by the BSNL employees, in response to the arrogant and high-handed DoT. BSNLEU salutes all the leaders and comrades who have made the strike a grand success. Through this historic strike, the entire Executives and Non-Executives of BSNL have told no uncertain terms that, they would not allow the government to ruin BSNL, for the benefit of Reliance Jio. BSNLEU requests that the same vigour and spirit should continue for the next 2 days also.

The employees and officers of BSNL have long been demanding allocation of 4G spectrums to BSNL for strengthening its operational capabilities and commercial viability. The Central Government, out and out pro-corporates as it is, has stubbornly been denying this legitimate demands while liberally allowing the private telecom operators the same facility, thereby putting BSNL, a strategic Public Sector Undertaking, in extremely disadvantageous position vis-à-vis its private-sector competitors. Such discriminatory policy of the Central Government towards BSNL is detrimental to national interests. The struggle of the employees and officers of BSNL is thus a struggle to defend the BSNL and the national interests.
The discriminatory and anti-PSU policies of the Central Government, as aforesaid, are a deliberate gambit to systematically weaken the operational efficiency and commercial viability of BSNL; this has pushed the BSNL into severe financial stringency and in a disadvantageous situation. Now, on the plea of losses being incurred by BSNL owing to such discriminatory policy, the Government has been denying wage revision, due since 01st January 2017, to the employees and officers. While the employees and officers of BSNL can in no way be held responsible for the losses incurred by BSNL because of deliberate Government policies, they have restrained themselves from going on strike in view of repeated assurances, from the Government, of positive consideration regarding their demands, both in relation to allocation of 4G spectrum as also to wage revision. But the Government at the centre now, true to its character, has repeatedly neglected and failed to honour its own repeated assurances given to the employees and officers.
The employees and officers of BSNL are, therefore, left with no alternative than going for intensified struggle on their legitimate demands in order to save both the national interests as also their own livelihoods.
In the circumstances, the United Platform of BSNL Employees’ and Officers’ Unions have decided to go in for a Three Days Continuous Strikes on 18th, 19th and 20th February 2019.
While extending our full support and solidarity to the three days strike in BSNL on 18-20 February 2019, we demand of the Central Government to concede the very legitimate and justified demands of the Employees and Officers of BSNL without further delay.
The Ministry of Finance, Govt. of India agreed in principle to allow the public sector banks (PSB) for offering stock options to their employees. As per media reports, the decision was taken in March last year. Some banks have, since then, as per decision of their respective boards, offered shares to the employees. The scheme is named “Employee Share Purchase Scheme” (ESPS).
Though all the bank managements, in their respective circulars, mentioned that purchase of share through ESPS is purely optional, but we are informed that employees are being pressurized, intimidated and coerced for purchasing the shares and the reluctant ones are either being transferred or being threatened of transfer.
A campaign have been launched on behalf of the bank management that a minimum percentage of share is being off loaded through ESPS by which there will be no change in character of the respective banks. We are opposed to dilution of Govt. stake, irrespective of percentage, through selling of shares in the PSBs.
Moreover, a campaign has been launched that, through ESPS, the employees will be the owner of the bank. From the past experience, we can easily apprehend that the shares will not remain with the employees in the long run. We also feel that adequate capital should be provided by the Govt. of India to meet the regulatory level of the respective banks. We should not support dilution of Govt. equity for augmentation of capital. We also emphasize that ESPS, would, at the very best, change the ownership structure of the respective Banks through transfer of a certain percentage of shares from the Central Government to the employees; it will not change, even a bit, the very capital base of the banks in any way.
In the prevailing situation, we call upon our Units to unleash extensive campaign amongst all sections of workforce in respective banks so that they refrain themselves from joining the scheme. We should stand firm for safeguarding the
public sector character of the banks.

DECISIONS OF THE NATIONAL SECRETARIAT MEETING OF CONFEDERATION
National Secretariat Meeting of Confederation held at New Delhi on 15.02.2019, after detailed deliberations, took the following important decisions. Com. K. K. N. Kutty, National President, presided.
Confederation National Secretariat Strongly Condemned the barbaric attack on Indian security forces by Pakistan sponsored terrorists, killing 40 Jawans. Confederation conveys its deepest Condolences to the bereaved family members of the Jawans who sacrificed their life for the nation.
CONFEDERATION DECLARES THREE PHASE CAMPAIGN AND STRUGGLE.
FOR WORKING CLASS, ELECTIONS ARE ALSO PART OF STRUGGLE.
CHANGE IS INEVITABLE.
The BJP-led NDA Government is going to complete its five years tenure. General Elections to the Parliament is going to be declared shortly. Based on our five years experience, Central Govt. Employees and Pensioners and their families have to take a position and use our right to vote to protect our interest and the interest of the Nation at large. We should remember that “Ballots are more powerful than bullets” in a democratic country.
As far as 32 lakhs Central Government employees and 33 lakhs Central Govt. Civilian Pensioners are concerned this five year period is the worst in the post-independence period. None of our demands are favourably considered by the NDA Government, rather we have been betrayed and our hopes ended is despair. The same is the case with three lakhs Gramin Dak Sevaks of the Postal department and thousands of casual, contingent and contract workers.
Even though the Group of Cabinet Ministers headed by Shri Rajnath Singh, Home Minister and Shri Arun Jaitley, Finance Minister had given categorical assurance on 30.06.2016 that Minimum Pay and Fitment formula will be increased, in 2018 December, Govt. made it clear in the Parliament that “no such proposal is under consideration of the Government, at present”. Much publicity was given for the Constitution of “NPS Committee”, but the demand to “Scrap NPS &; Restore OPS” is rejected and even the demand for ensuring guaranteed Minimum Pension (i.e., 50% of the last pay drawn or Rs.9000/- whichever is higher) was also turned down. Again, Govt. replied in Parliament that the demand to scrap NPS & Restore OPS cannot be considered favourably due to various reasons. NPS employees are retiring every month with a megre amount of Rs.1000/- to 3000/- as annuity pension. Retirement of each NPS employee is just like a death due to uncertainty about the future life of NPS Pensioner and the family dependent on him/her.
HRA arrears from 01.01.2016 to 30.06.2017 was denied and each employee lost an average Rs. One Lakh. MACP Bench mark, date of effect from 01.01.2006, promotional hierarchy, everything fell on deaf ear. None of the anomalies of 7th CPC are settled. Option-I parity recommended by 7th CPC to Pensioners is mercilessly rejected. Revison of wages and pension of many Autonomous bodies are still pending. Compassionate appointment has become a cruel joke, as majority of the cases are rejected. Trade Union rights are under attack and pro-BJP Unions are given undue favours. All negotiating forums including National Council JCM are either defunct or ineffective.
More than six lakhs posts are lying vacant due to undeclared ban on recruitment. Three lakhs low-paid Gramin Dak Sevaks are cheated by denying arrears of pay for 30 months to be calculated proportionately on the basis of pay scales recommended by the Kamalesh Chandra Committee. Many positive recommendations are either rejected or diluted. Thousands of Casual, part-time, contingent, daily rated mazdoors and contract workers are denied equal wage for equal work. Regularisation of GDS and Casual/Contract workers has become a mirage. None of the 10 points demands of Confederation is settled including sectional demands of various cadres. None of the demands raised by JCM National Council Staff Side and National Joint Council of Action (NJCA) are also settled.
More and more attacks on existence of Central Govt. departments and employees are made. Privatisation of various functions of Railway department, outsourcing of more than 200 items in Defence sector, fast move to corporatize Postal, Closure of 12 out of 17 Govt. of India Printing Presses etc. are threatening the very existence of thousands of employees.
In short, under the BJP led NDA Government our wages and allowances are under attack, our job security and existence is under attack, our social security and pension is under attack, and our trade Union rights and facilities are under attack. Shall we vote for continuation of aggressive implementation of this destructive policies. No, not at all. It is in the above background Confederation National Secretariat has decided to implement the following campaigns and agitational programmes.
I. CAMPAIGN FORTNIGHT FROM 2019 MARCH 15TH TO 30TH CULMINATING IN MASS RALLIES AT ALL STATE HEADQUARTERS AND DISTRICT HEAD QUARTERS.
Intensive campaign among the employees, pensioners and their families and also among the public should be conducted during the fortnight. General body meetings, conventions, group meetings, office to office campaign, seat to seat campaign etc. are to be organized by each COC and each affiliated organization. As a culmination of the campaign programmme mass rallies of employees and pensioners are to be organized in an impressive manner at all state Head Quarters and District/Divisional Head Quarters. Notices, leaflets, posters, boards etc. are to be printed and widely circulated. Maximum publicity through print and electronic media and also through websites and other social media is to be given. 10 point charter of Confederation, of which the 1st and the most important demand is “Scrap NPS & RESTORE OPS”, shall be the basis of the campaign and mass rallies. Wherever Confederation units (COC) are not there, NFPE Divisional Secretaries shall jointly take the responsibility to organize the above programme and also below mentioned other programmes.
II. TWO PROGRAMMES EXCLUSIVELY ON NPS
(1) Day Long Mass Dharna on 11th April 2019 (Thursday) at all Centres – state and District Head Quarters.
(2) “Candle light protest” on 23rd April 2019 (Tuesday) at all Centres at state and District head Quarters.
In the Central Government employees sector Confederation is the only organisation which has been continuously organizing struggle programmes against NPS, including strikes. It is decided to organize the above two programmes, exclusively on one demand i.e., “Scrap NPS & Restore OPS”. These programme are to express our protest and anger against the totally negative attitude of the NDA Government and also to build pressure on other political parties to compel them give top most priority to the above demand. In both the programmes, maximum participation of employees and pensioners is to be ensured. Candle light programme is to be arranged in such a manner, so that maximum public attention and media attention will be received. In both the above programmes, like-minded political Leaders, trade Union leaders, important personalities etc. may also be invited to participate and address. Candle light procession is not required. Maximum mobilization at a selected place is enough on the evening of 23rd April 2019 (Tuesday).
III. NJCA PROGRAMMES
National Joint Council of Action (NJCA) met after a long gap. Eventhough Confederation Leadership reiterated our earlier stand i.e; revival of the deferred indefinite strike, the Railway Leadership (AIRF & NFIR) are reluctant to give a call for strike, for their own reasons. Finally it is decided to organize the following two programmes.
1. 13th March 2019 – NPS Dharna and Demonstration at Jantar Mantar, New Delhi
A massive demonstration – cum – dharna will be organized under the auspices of National JCA to highlight and focus the demand for the withdrawal of New Pension Scheme and restoration of old Pension Scheme for Central Govt. Employees. The National JCA will simultaneously write to all Political parties to make their stand clear on the issue of New Pension Scheme in their respective manifestos. The National JCA will spearhead a campaign amongst the employees for acceptance of the demand by the Political Parties. The dharna will be at Jantar Mantar, New Delhi, and the same will be participated by the employees of Railways, Defence and Confederation working in and around Delhi besides NJCA Leaders. On the same day similar dharnas and demonstration will be held in front of the all Central Govt. offices throughout the country. The employees will also be requested to wear black badges projecting the demand for withdrawal of NPS.
Confederation National Secretariat calls upon all COCs and affiliated organisations to mobilise maximum number of Central Govt. employees from Delhi, Uttar Pradesh, Haryana, Punjab, Rajasthan, Himachal Pradesh, Uttarakhand and Bihar on 13.03.2019. Dharnas and demonstrations may be organized in all major centres of other states, if possible jointly with Railways and Defence or Confederation alone.
2. 28TH MARCH 2019 – FOR REVIVAL OF JCM FORUMS
A protest day long dharna will be organised at Jantar Mantar, New Delhi, on 28.03.2019, in which all National Council Members will take part, to highlight the need to revive the JCM forums, thus ensuring constant and continuous interaction between the Government and the employees. It will also focus the intolerable attitude of the official side even in issuing orders, where Supreme Court has given the verdict in favour of the employees. The Cabinet Secretary will be informed of this decision well in advance. A huge demonstration will also be organized on the same day in front of dharna venue in which employees working in and around Delhi will participate.
National Secretariat of Confederation calls upon the Delhi C-O-C and affiliated organisations to ensure maximum participation of employees from Delhi in the above programme on 28.03.2019.
IV.NCCPA PROGRAMME – PENSIONERS DEMANDS – 15TH MARCH 2019 – NEW DELHI
National Coordination Committee of Pensioners Associations (NCCPA) will be organizing a mass dharna at New Delhi on 15.03.2019 demanding early settlement of Charter of demands submitted by NCCPA to Govt. National Secretariat Members of Confederation, COC Delhi and all affiliated organisations are requested to mobilise maximum employees from Delhi to participate in the NCCPA dharna on 15.03.2019.
V. A resolution on important demands of Central Govt. employees and Pensioners
is adopted in the National Secretariat meeting which is to be circulated widely among the Central Govt. employees and Pensioners during the campaign fortnight. Copy of the resolution will be exhibited in the Confederation website shortly.
VI.INTERNATIONAL WOMENS DAY ON 8TH MARCH 2019
National Secretariat decided to celebrate International Womens Day on 8th March 2019 in a befitting manner alongwith likeminded organisations wherever possible or separately by Confederation. Confederation Womens Sub Committee office bearers Com. Usha Bonepalli (Chairperson) Com. R. Seethalakshmi (Convenor) Com. Gita Bhattacharjee (Joint Convenor) had attended the National Secretariat meeting. An article written by Com. Usha Bonepalli on the theme of the 2019 Women’s Day and also about the importance of International Womens Day will be published shortly in the Confederation website.
VII. NEXT NATIONAL CONFERENCE OF CONFEDERATION
National Secretariat decided to conduct the next National Conference of Confederation at Nagpur (Maharashtra). COC Nagpur will convene their meeting immediately and fix the dates and venue of the Conference. A preparatory committee will also be formed at Nagpur shortly to commence the preliminary work in connection with the National Conference.
VIII. ALL INDIA TRADE UNION CAMP
All India Trade Union Camp, as already decided in the last National Secretariat meeting will be organized after General Elections.
IX. FINANCIAL REVIEW
National Secretariat decided to request all affiliated organisations and COCs to remit their quota arrears before 15.03.2019. Details of quota and arrears is already sent to all by Financial Secretary Com. Vrigu Bhattacharjee. As the Financial position of Confederation CHQ is precarious, all affiliates and COCs are once again requested to remit the quota and arrears before 15.03.2019.

Memorandum
All India Central Excise and Service Tax Ministerial Officers’ Association have given notice wherein it is stated that the members of this association will wear black badges from 21.01.2019 onwards and have lunch hour demonstration on every Friday and if their problem are not heard and suitable solution is not seen within a month, they will go ahead with their Dharna/Stike program w.e.f. 21st February, 2019.
2. Attention of the All the Members of All India Central Excise and Service Tax Ministerial Officers’ Association in the CBIC is invited to the instructions issued by the DoPT,. which prohibit Government servants from participating in any form of strike including mass casual leave, go-slow etc., or any action that abet any form of strike in violation of Rule 7 of the Fundamental Rules, pay and allowances are not admissible to an employee for his absence from duty without any authority. The right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequence which, besides deduction of wages, may also include appropriate disciplinary action. A copy of 0.M No.33012/1(s)/2008-Estt(B) dated 12th September, 2008 containing instructions issued by the Deptt. of Personnel & Training regarding treatment of period of strike by Government servants, is also enclosed.
3. It is again reiterated that if any employee or an association/group of employees, under any nomenclature, indulge in any form of strike/boycott of work in pursuance of any alleged demand, strict action as per Para 2 above shall be taken.
