Subject:- Appointment of Security Personnel in Central Public Sector Enterprises (CPSEs) from Ex-servicemen Security Agencies sponsored by the Directorate General of Resettlement (DGR).

The undersigned is directed to refer to DPE OM of even no. dated 13-09-2018 on the above mentioned subject and to say that as per Para 2(iv) of the said OM, the service charges chargeable by security agency will be negotiable between the CPSE and the agency concerned subject to guidelines issued vide MoD OM No. 28(3)/2012-D (Res-1) dated 09.07.2012 and amendments made therein from time to time.

2. In this regard, it is clarified that in no case, service charges may be negotiated by CPSEs below the rate prescribed by DGR in its guidelines for empanelment of ESM Security Service Agencies from time to time (which is 14% at present).

3. All administrative Ministries / Departments are requested to kindly issue necessary instructions to the CPSEs accordingly.

Government assures BSNL management and representatives of the unions and associations of BSNL to support their reasonable demands

With reference to the call by All India Unions and Associations of Bharat Sanchar Nigam Limited (AUAB) for a 3-days strike starting tomorrow, the Government (Department of Telecommunications) and BSNL management have been engaged in discussions with representatives of AUAB on ways to address the various demands raised by the unions and associations. It has been continuously emphasized by the Department of Telecommunications (DOT) that Government recognizes the inherent strength and strategic position of BSNL in the Telecom sector in the country. All efforts are being made, and will continue to be made, to make BSNL robust and financially viable.

The main demands of AUAB include benefits to executives under the 3rd Pay Revision Committee(PRC) with 15% fitment and to non-executives as per the 8th wage negotiations w.e.f. 01.01.2017, allotment of 4G spectrum to BSNL, revision of pension for BSNL retirees w.e.f. 01.01.2017 and delinking of same with pay revision for PRC implementation, and deduction of payment of pension contribution by BSNL on actual basic pay instead of on the highest level of the pay scale.

DoT reiterates that positive steps are being taken by the Department in respect of each of these demands. In fact, for allotment of 4G spectrum, pursuant to decision taken in Digital Communications Commission (DCC) meeting held on 05.02.2019, the issue of spectrum allotment for providing 4G services to BSNL is being referred to TRAI to recommend on the issue of administrative allocation, quantum, price and appropriate frequency band. Further action will be taken on receipt of the said recommendation.

In parallel, a comprehensive proposal for revival of BSNL has been prepared, which will be taken up for consideration by competent authorities very soon.

An institutional mechanism in the form of a Coordination Committee comprising senior officers of the DoT, BSNL management, and representatives of AUAB is already functional. Representatives of AUAB have also held meetings with the Additional Secretary (Telecom), DOT in which they have been duly apprised of the progress being made in relation to their demands. BSNL management has issued appeals to its’ employees not to resort to any agitational program at this critical juncture – when the organization is engaged in sincere and serious efforts to protect and enhance its’ market-share, and when any disruption in services can only adversely impact the interests of BSNL and its’ customers, employees and other stakeholders.

Government wishes to re-emphasize that it will continue to engage with the BSNL management and representatives of the unions and associations of BSNL, to support their reasonable demands, and to guide the organization towards a revival. Government also hopes that BSNL employees and officers will not jeopardize the interests of their organization by going on strike at a time when it is in their own interest to protect their customer-base and revenue by providing uninterrupted, high-quality services.

Sub :- Extension of provisions of OM No.38/41/06-P&PW (A), dated-05.05.2009 for family pension to family to missing employees covered under NPS.

Attention is invited to Deptt. of Pensions & Pensioners Welfare OM No.1/24/2018-P&PW (E) dated 01.01.2019 (copy enclosed) wherein it is mentioned that the department is in the process of framing separate service rules for regulating the pensionary benefits. The question of extension of pensionary benefits to the families of missing NPS employees will be considered based on the NPS rules being finalized by DP&PW. This is for your kind information.

Sub: Long pending prominent issues of the Central Government Employees

You may kindly recall that, aggrieved by retrograde recommendations of the VII CPC in general and particularly related to Minimum Wage and Fitment Formula as also on the issue of Restoration of Defined Old Pension Scheme for the Central Government Employees, the Central Government Employees, including Railwaymen, had decided to go on “Indefinite Strike” w.e.f. 11th July, 2016 since 06:00 hrs., in the morning. With a view to resolve these important issues amicably, a meeting was convened by your goodself on 30th June, 2016, wherein Hon’ble Finance Minister, Hon’ble Minister for Railways and Hon’ble Minister of State for Railways, were also present.

After detailed deliberations, the representatives of the Central Government Employees(NC/JCM) were assured that, the Union Government would favourably consider their demand of improvement in Minimum Wage and Fitment Formula, recommended by the VII CPC. It was also assured to look into the demand of Scrapping Contributory NPS in respect of the Central Government Employees and restoration of Defined Old Pension Scheme.

The representatives of the Central Government Employees were made to understand in the said meeting that, the Government would take decision in regard to above demands within a timeframe of four months by constituting committees for the purpose. On the assurance of the Group of Ministers, the proposed “Indefinite Strike” was deferred by the NC/JCM.

You may kindly appreciate that, substantially long time has already elapsed and the Federations of the Railways and other Central Government Employees, who had participated in the said meeting, have still been awaiting the positive outcome of the discussions held and assurances given by the Group of Ministers therein.

There is, therefore, serious discontentment brewing among the Central Government Employees, including the Railwaymen, and it is quite difficult to further contain the same any longer. There is, therefore, tremendous pressure to revoke the decision of the “Indefinite Strike” of the Central Government Employees due to non-settlement of the said issues.

It would, therefore, be largely fair and conducive for harmonious relations of the Central Government Employees with the Central Government, that, at least the following two major issues be settled without any further delay:-

(i) Restoration of Defined Old Pension Scheme for all Central Government Employees, irrespective of their date of appointment, which was available for the Central Government Employees appointed before 01.01.2004.

(ii) Improvement in Minimum Wage and Fitment Formula.

I earnestly hope that, your goodself will take these issues with all seriousness for resolving the same before it is too late, in the larger interest of conducive atmosphere in the country.

Subject :- Filling up of the post of Chairman, Staff Selection Commission, New Delhi (Additional Secretary level) in the Level 15 of the pay matrix Rs.1,82,200 – 2,24,100/- on deputation basis.

The undersigned is directed to say that it is proposed to fill up the post of Chairman, Staff Selection Commission (SSC) in the Staff Selection Commission (Hqrs) at New Delhi in the Level 15 of the pay matrix Rs.1,82,200-2,24,100/- (Additional Secretary level). The eligibility criterion is given in Annexure-I.

2. Application of only such officers will be considered as are routed through proper channel and are accompanied with (i) bio-data in the proforma at Annexure II; (ii) clear photocopies of the up-to-date APAR dossier of the officer containing APARs of at least last five years, duly attested by a Group ‘A’ officer (if original APAR could not be sent); (iii) An attested Statement indicating the grading in the APAR during the last five years (iv) cadre clearance; (v) clearance from vigilance and disciplinary angle; and (vi) statement giving details of major or minor penalties, if any, imposed on the officer during the last ten years.

3. All Ministries/Departments and the State Governments/UTs are requested to forward the applications of willing and eligible officers in the prescribed proforma to:- Section Officer (Estt-B-I), Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Room No. 215-C, North Block, New Delhi-110001, so as to reach this Office, on or before 15/04/2019.

4. The applications of only those officers may be forwarded who, in the event of their selection, would immediately join the duties of the post, and whom the concerned authorities would be in a position to relieve immediately. The application once forwarded would not be allowed to be withdrawn. Applications received after the prescribed date or not accompanied with the required certificates/documents will not be entertained.

AUAB rejects the proposal of the Management for deferring the salary for the month of February 2019. – AUAB also rejects the appeal of the Management to withdraw the strike.

A meeting between the AUAB and the BSNL Management was held today at 17.30 hrs. Shri Anupam Srivastava, CMD, BSNL, Ms.Sujatha.T |Ray, Director (HR & Finance) and Shri A.M.Gupta GM (SR) were present. From AUAB, Com.P.Abhimanyu, Convener, Com.Chandeswar Singh, Chairman, Com.K.Sebastin, GS, SNEA., Com. Prahlad Rai, GS, AIBSBNLEA, Com.Pathak, AGS, AIGETOA., Com.Suresh Kumar, GS, BSNL MS, Com.H.P.Singh, Dy. GS,BSNLOA and Com.S. Sivakumar, President, AIBSNLEA participated.. The CMD, BSNL explained the serious financial crisis being faced by the BSNL and appealed for the cooperation of the AUAB, for deferring payment of the salary for the month of February 2019. The AUAB representatives firmly rejected the request of the CMD, BSNL. They told in one voice that payment that the payment of salary of employees should not be deferred. Thereafter, the CMD, BSNL said that the 3 days strike called on by the AUAB from 18-02-2019 will be self-defeating and appealed to call off the strike.. The representatives of the AUAB rejected the appeal of the CMD, BSNL and reaffirmed that the strike will take place at any cost. They told the Management that the repeated assurances given by the Hon’ble Minister of State for Communications are not implemented by DoT and that the strike will now take place successfully.. The AUAB told the HB Management in categorical term that there is no question of going back from the decision to go on strike.

The Government has issued guidelines vide Office Memorandum No. 399/33/2006-AVD-III dated 06.11.2006 regarding checking delay in grant of sanction for prosecution under Section 19 of the Prevention of Corruption Act, 1988, against delinquent officials working under different Ministries/Departments. A time line of three months has been prescribed therein for grant of prosecution. The proposals of sanction for prosecution are processed as per the said guidelines. Further, Government has also issued procedure for submission of proposals to the competent authority for sanction of prosecution under Single Window System vide Office Memorandum No. 142/04/2012-AVD.I dated 28.07.2014. A High-Level Committee under the Chairmanship of Secretary (Personnel) and comprising the Secretary of the Administrative Ministry/Department, Law Secretary and Director, CBI has also been constituted for scrutiny and reviewing all delayed cases of prosecution for Sanction. The meeting of the said Committee is being held periodically and the recommendation of the Committee is also placed before the Cabinet Secretary for orders of the Competent Authority.

Agitation against change in UPSC Exam

Several representations have been received from the Civil Services aspirants demanding additional attempts in Civil Services Examination (CSE) due to change in the pattern from CSE-2011.

The Government has already acted upon this matter by taking a policy decision for providing an additional attempt in CSE 2015 to those candidates who appeared in CSE 2011. Also, General Studies (Paper-II) of Preliminary Examination was made qualifying with effect from CSE-2015. Further the Government has already decided to allow two additional attempts to all category of candidates with effect from CSE 2014, with consequential relaxation of maximum age.

7th CPC : Facilities to Children of Martyrs

Prior to 7th pay commission children of martyrs were eligible to receive full tuition and hostel fee till they get their degree

The details of the tuition fee and hostel charges till they get their degree prior to 7th pay commission notified vide letter No. 6(1)2009/Edu. Concession/D(Res-II), dated 25th October, 2010 are as under:-

Tuition Fee:- Full reimbursement of tuition fee (capitation fee and caution money not included) levied by the educational institutions concerned (including charges levied for the school bus maintained by the school or actual fares paid for railway pass for students or bus fare certified by the Head of institutes).

Hostel charges:– Full reimbursement of Hostel Charges for those studying in boarding schools and colleges. After the 7th pay commission Government had restricted the said fee to Rs.10,000/- per month vide order No.6(1)/2009/Edu.Concession/D(Res-II), dated 13th September, 2017.

The decision was taken by the Government on the recommendations made by the Seventh Central Pay Commission (7th CPC) in Para 8.17.42 and 8.17.45 regarding Educational Concessions to the Children of Armed Forces Officers / Personnel Below Officer Ranks (PBORs) Missing / Disabled / Killed in action vide order No. 6 (1) / 2009 / Edu. Concession /D(Res-II), dated 13th September, 2017.

The case was taken up with MoD vide TRIPAS letter No.C/7026/VII CPC/73/Allce, dated 10th October, 2017.

In continuation of this Department’s letter vide order No.6(1)/2009/Edu.Concession/D(Res-II), dated 23rd March 2018, it has been decided with the approval of competent authority that the cap of Rs.10,000/- per month imposed on the combined amount of Tuition Fees and Hostel Charges vide para-5 of the order dated 13th September, 2017 stands deleted and all other provisions remain unchanged and the Educational Concession will continue to be admissible without the cap of Rs.10,000/- per month.

Sub :- Grant of Invalid Pension under Rule 38 of the Central Civil Services (Pension) Rules, 1972— Clarification regarding

The undersigned is directed to say that Rule 38 and Rule 49 of the Central Civil Services (Pension) Rules, 1972 have been amended vide Notification No. 21/1/2016-P&PW(F) dated 4th January, 2019 (copy enclosed). The proviso to the amended Rule 38 of the CCS(Pension) Rules provides that a Government servant who retires from service on account of any bodily or mental infirmity which permanently incapacitates him for the service before completing qualifying service of ten years, may also be granted invalid pension in accordance with sub-rule (2) of rule 49, subject to the conditions that the Government servant:

(a) was examined by the appropriate medical authority either before his appointment or after his appointment to the service or post and was declared fit by that authority for Government service, and

(b) fulfils all other conditions mentioned in this rule for grant of invalid pension.

2. In this connection, it is clarified that the condition of qualifying service of ten years for grant of pension under Rule 49(2) of the CCS (Pension) Rules, 1972 shall not be applicable in the case of a Government servant retiring on Invalid Pension on account of any bodily or mental infirmity, under Rule-A. Accordingly, Invalid Pension at the rate of 50% of emoluments or average emoluments, whichever is more beneficial, subject to a minimum of nine thousand rupees per mensem and maximum of one lakh twenty five thousand rupees per mensem, shall be payable to a Government servant who retires under Rule 38 of CCS (Pension) Rules, 1972 even before completing a qualifying service of ten years.

3. All Ministries/Departments are requested that the above clarification ma) be brought to the notice of Fiends of Department, Attached and Subordinate Offices, Controllers of Accounts. Pay & Accounts Offices. etc, under them.
